ROLL CALL The City Council met in session on this date at 2:00 P.M. - in the Council Chambers of City Hall, Yakima, Washington. Mayor Henry Beauchamp, presiding, Council members Clarence Barnett, Lynn Buchanan, Lynn Carmichael, Jerry Foy and Bernard Sims present on roll call. City Manager Zais, City Attorney Vanek, City Clerk Roberts and Deputy City Clerk Toney also present. Council member Pat Berndt absent and excused. 2. INVOCATION • The Pledge of Allegiance was led by Council member Lynn Carmichael. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER It was MOVED by Sim, seconded by that Phil Posada be reappointed to the Civil Service Commission.'_ Unanimously carried by voice vote. Berndt absent. (Mr. Posada is to serve a six year term which will expire June 1, 1993.). . 4. CONSENT AGENDA Mayor Beauchamp referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. It was the general consensus of the Council to add Item No. 10, and remove Item No. 16 from the Consent Agenda. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED by Carmichael, seconded by Sims, that the Consent Agenda, as read, be passed. Unanimously carried by roll call vote. Berndt absent. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF MINUTES OF COUNCIL MEETING OF OCTOBER 13, 1987 The Council minutes of October 13, 1987 were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION Gary McClenaghan, Bills Place Tavern, 206 South 3rd Avenue, distributed a packet of information containing responses to a number of inquiries presented to the Trade Stimulant Operators at previous meeting. He asked Council to review this information and stated he would be happy to discuss this at a later date if they so desire. 7. PUBLIC HEARING ON FINAL ASSESSMENT ROLL FOR L.I.D. NO. 1039, CONOVER PARK SEWER DISTRICT (SEE ORDINANCE CONFIRMING ASSESSMENT ROLL) This being the time set for the public hearing on the final assessment roll for the Conover Park Sewer Local Improvement District No. 1039, Office Engineer Rita Germunson reviewed the information contained in the staff report. She stated the project consisted of approximately 4,720 lineal feet of 8 inch sewer pipe to serve an L.I.D. boundary of 45 parcels outside • the City limits. The City's participation in this particular project is $21,277.53, with the individual property owners being assessed $3,272.17. (This is $564.83 less than the preliminary assessment of $3,837.) Following the overview of the staff report, Mayor Beauchamp opened the public hearing for citizen testimony. There was no one present to speak against the final assessment roll, however, one unidentified male seated in the audience stated he is in favor of the project. Ordinance No. 3059 having been read by title only, it was MOVED by Foy, seconded by Sims, to approve the ordinance affirming the assessment roll. Unanimously carried by roll call vote. Berndt absent. PUBLICMEETING ON REZONE OF PROPERTY AT SOUTH 16TH AVENUE AND GRANT STREET, FROM R -2 TO R -3, AS REQUESTED BY MANUAL BABAYAN . Supervising Associate Planner Don Skone stated the -applicant, Manuel Babayan, has requested this matter be continued as he !did not receive -notice of today's public meeting until yesterday, and would like to be present to address the issue before the City Council. Mr. Skone recommended continuing the public meeting on November 10, 1987. Council member Foy questioned if it would be appropriate to 'hear testimony from citizens present today and then continue the public meeting to November II 10th. Mr. Skone responded affirmatively. It was MOVED by Foy, seconded by Buchanan, to open the public meeting portion for those that came today to speak to the issue and then continue the public meeting to November 10th. Unanimously carried by voice vote. Berndt absent. City Attorney • Vanek asked Council - members to declare there has been prior contact from anyone regarding this issue, and Council members declared there had been none. Mayor Beauchamp then opened•the public portion of the meeting and asked if anyone would like to speak in favor of the rezone, and • no one responded. The opponents were asked to give'testimony and comments ' • regarding the request for rezone. Constant Hinkle, 1317 South 18th Avenue, Adelle Boswell, 1301 South 18th Avenue, and'Lester Schrader, 1802 Greenway, addressed Council voicing concerns about the current traffic congestion, the potential increase of school children -to the area, if the rezone should be approved,•and the fact that•Mr.•Babayan had stated he'would not be able . to hire - an apartment or .property manager maintain the buildings, nor would he be present to do so. - The testimony having concluded, the public . meeting portion was closed. It was MOVED by Foy, seconded by 'Barnett to continue this hearing to November 10th at 2:00 p.m. Carried by 5 -1 voice vote. Carmichael voting nay. "Berndt absent. .. 9. REPORT FROM VISITOR AND CONVENTION BUREAU REGARDING PROPOSED ADJUSTMENT IN YAKIMA CENTER RENTAL RATES • It was MOVED by Foy, seconded by Barnett, to defer this report to'November 10th when Council will be reviewing the Convention Center's budget. • Council member Barnett stated he would like to 'know the anticipated increase in revenue' under the new 'rate structure, and what the demonstrated need is for the rate increase. He stated he would also like an evaluation, or opinion, from Dianne Gilliland, Assistant Executive Director of the Yakima Center,'whether she feels the Center will remain competitive with the proposed increase. Council member Foy asked 'Ms. Gilliland to consider a two year step increase' in the percentage rather than a flat rate increase.' He expressed concern that implementing the full increase immediately may remove the Center - from the tcompetitive market. Ms. . . ' Gilliland stated she shares those same concerns. question was called for a. vote on the motion. Carried unanimously by 'voice vote. Berndt absent. - - *10: REPORT FROM DEPARTMENT OF ENGINEERING AND UTILITIES REGARDING STORM WATER MANAGEMENT . CONSIDERATION OF RESOLUTION AUTHORIZING' EXECUTION OF FUNDING AGREEMENT . WITH- WASHINGTON STATE DEPARTMENT 'OF TRANSPORTATION FOR IMPROVEMENT OF NORTH 1ST STREET AND "I" STREET INTERSECTION - ' . - . '' RESOLUTION NO. -D -5402, A RESOLUTION 'authorizing and directing the City Manager and City Clerk of the City of Yakima. to - execute an with the State of Washington, Department of Transportation for partial reimbursement of costs for improvements to the intersection of North First Street and "I" Street. *12. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF SURVEY CONSULTANT AGREEMENT FOR VIEWMONT PARK SEWER L.I.D.. M /MD /2 154 OCTOBER 27,' 1987 RESOLUTION NO. D -5403, A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute an agreement with Preston L. Shepherd & Associates, Inc. for professional engineering services. *13. APPROVAL OF RIGHT-OF-WAY USE PERMIT REQUESTED BY THE LUND BUILDING FOR AWNINGS AT 5 NORTH FRONT STREET The Right -of -Way Use requested by the Lund Building Partnership to erect non- illuminated awnings overhanging the sidewalk 4'6" on both the west. side and south side of the building at 5 North Front Street, was approved. . *14. The Out -of -State travel for Rosemarie Ulmer,•Tom Dillon and Dale ,Rodgers, • Police Department, for on -site 'computer aided dispatch training by'Business ' Information Systems, in Ventura, November 14 -19, 1987, at a cost of $368.00 each (motel expenses paid by BIS), was approved. RICK PETTIJOHN AND CHUCK GREENOUGH, FINANCE DEPARTMENT, TO PHILADELPHIA, PENNSYLVANIA AND CHARLESTON, SOUTH CAROLINA (AMENDS PRIOR AUTHORIZATION APPROVED SEPTEMBER 8, 1987) • • The Out -of -State travel for Rick Pettyjohn and Chuck Greenough, Finance Department, for on -site visits to evaluate operational Financial Management Systems from Keystone Information Systems and Price Waterhouse, Inc., in Burlington County, Pennsylvania and Charleston, South Carolina, November 2- 5, 1987, at a cost of $1,944 each, was approved. • *15. CONSIDERATION OF AN ORDINANCE AMENDING THE 1987 BUDGET AND APPROPRIATING • FUNDS FOR THE DIAL -A -RIDE PROGRAM (FIRST READING) An ordinance appropriating funds for the Dial -A -Ride program having been read by title only at this meeting was laid on the table for two weeks or until November 10, 1987. • 16. CONSIDERATION OF AN ORDINANCE AMENDING THE BUSINESS LICENSE FEE SCHEDULE TO FINANCE CITY PARTICIPATION IN THE AGPLEX FACILITY - Council member Buchanan state& he received several calls from citizens who operate small businesses and are opposed to the 50% increase in business license fees. He stated the small businesses are paying considerably more per person than the larger businesses. It was MOVED by Buchanan, seconded by Foy, to defer this item for one week to allow staff time to re- compute and re -write this making it more equitable. Council member Foy stated it is important that the ordinance contain the three 'recitals requested by the Chamber Commerce after they polled their membership concerning this issue. Barbara Harris, 1911 West Yakima Avenue, questioned if the business operators have been notified of the increase. It was noted that this issue has been in the newspaper several times and a telephone survey conducted by the Chamber of Commerce indicated their membership is supportive of this measure, with certain provisions. Mrs. Harris pointed out that not all small business owners are members of the Chamber of Commerce, therefore, may not be aware of the proposed increases in their . business license fees. Council member Foy stated the staff report also indicates if Council approves this ordinance, a letter notifying them of the increase will be mailed to all business license holders prior to mailing the business license renewal notices. The question was called for a vote on the motion. Unanimously carried by voice vote. Berndt absent. For point of clarification, Council member Carmichael explained that even though. the next Council meeting is a study session, this issue well be dealt with at that time. • 17. OTHER BUSINESS • • Acting City Manager Stouder announced there will be an executive session after a'few brief comments Director of Finance and Budget John Hanson. Mr. Hanson circulated the Distinguished Budget Presentation Award received by the City Finance Department from the Government Finance Officers M /MD /3 155 OCTOBER 27, 1987 Association. This award is for. distinguished budget presentation by the City of Yakima for the 1987 fiscal year. He also called attention to the schedule for budget hearings, noting the 'budget review sessions have been scheduled on Tuesdays to minimize the amount of time Council members would have be to away from their places of employment. The Budget Wrap -Up is scheduled for December 12th. Council member Barnett. stated' he will not be able to attend the November 24th Budget Review session as. he will be out of town. .. - .EXECUTIVE SESSION . It 'was - MOVED , by Buchanan, seconded by Sims, to 'move =into Executive Session .for approximately. 30' minutes to discuss. pending litigation, collective bargaining and prospective litigation. Unanimously carried by voice vote. Berndt absent.
