BUSINESS MEETING
1. ROLL CALL •
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Henry
Beauchamp, presiding, Council members Clarence Barnett, Pat Berndt,
Lynn Buchanan, and Lynn Carmichael present on roll call: City
Manager Zais, City Attorney Vanek, City Clerk Roberts and Deputy
City Clerk Toney also present. Council members Jerry Foy and
Bernard Sims absent and excused.
2. INVOCATION
The Invocation was given by Mayor Beauchamp:_ _
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Yakima Police Department Community Relations.Officer Brenda Fenich
reported on the success of the August llth, 1987 "National Night
Out" effort. Ms. Fenich introduced Michelle Shaw, a: 'member' of the
. Police Department's new Explorer Program, along with Amy Geary,
Betty Hudson and Ed Cater, winners of the "Suspicious Vehicle"
contest. All three contestants were presented a stuffed animal' '
depicting Mr. McGruff, the crime dog.
Mayor Beauchamp read a proclamation declaring the week of October
18 -24, 1987 as "Venture Week" in the City of Yakima. The
.proclamation- was accepted by- Wendy Teagarden, representative of
- - Venture Club. `

Mayor Beauchamp read a proclamation declaring October 24, 1987 as
the "5th - Annual Operation Harvest" in the City of Yakima. The
proclamation was, accepted by Dr. Jeff Bartlett who commented that
the food, banks are quite low and encouraged everyone, td. participate.

4. CONSENT AGENDA '
Mayor Beauchamp referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Council members or citizens present. It was the general
consensus of the Council to add Items Nos. 7 and 8 to the Consent
Agenda. The City Clerk then read the Consent Agenda items,
including resolutions and ordinances by title. It was MOVED by.
Carmichael, seconded by Buchanan, that the Consent Agenda, as
read, be passed. Unanimously carried by roll call vote. Foy and
Sims absent. (Subsequent paragraphs preceded by an asterisk ( *)
indicate items on the Consent Agenda handled under one motion
without further discussion.)
*5. APPROVAL OF MINUTES OF THE COUNCIL MEETING OF OCTOBER 6, 1987
The Council minutes of October 6, 1987 were approved, having been
duly certified accurate by two Council members and no one present
wishing to have said minutes read publicly.
6. AUDIENCE PARTICIPATION
The following citizens expressed displeasure and disapproval of
the "Chippendale" show scheduled to appear at the Yakima Center
October 27th: Dennis Hawkins, 40.7 W. 3rd Street, Wapato, Barbara
Sires, 411 Suntides, Yakima, Mary Ann Kerr, 10102 Estes Road,
Yakima, Reverend Dennis Brown, 2607 South 34th Avenue, Yakima, Jean
Hutchinson, 1119 Jerome Avenue, Yakima, Ron Wood, 10501 Summitview
Extension, Yakima, and Kay Brown, 2607 South 34th Avenue, Yakima.
Mayor Beauchamp commented he spoke with City Attorney Vanek about
this type of entertainment and learned that basically there is
nothing the City can do unless the City Municipal Code is violated
by nude performances, the producers are protected by the First

Constitutional Amendment. City Attorney Vanek stated this is an
• ' issue that is not new to the City Council. Mr. Vanek stated a few
years ago when "Oh, Calcutta" came to the Capitol Theatre, there
was an.unsuccessful attempt to ban that performance on the basis
that it contained nudity. He stated the City Attorney learned at
that particular time, that a number of other cities had also
attempted to ban. the,. show through, legal measures, and were
unsuccessful. The court ruled on the - matter. deeming the nudity
involved in the performance "artistic," and declaring the ban
- unconstitutional. Council member Carmichael stated even though the
City Council does not personally condone this type of
entertainment, the City does not have any legal basis for
-litigation in this matter. She stated perhaps the best way. for
concerned citizens to take a stand against the issue is to impose
an economic sanction.
Lloyd Mullanix, 623 North ..6th Avenue, reported on a survey he
conducted in his neighborhood regarding a- property maintenance
program. He stated he had obtained twenty -six signatures from one
area, and he would like the record to indicate there is public
support for such a program. Council member Berndt thanked - Mr.
Mullanix for his efforts, adding this is _a difficult issue to
address, but at least he has made people aware that the,problem
exists. Mr. Mullanix indicated there are two abandoned houses the
Code Enforcement Department should investigate. One is located at
411 Swan Avenue_ and the other at 115 Cherry. Avenue. .
Dan Snyder, 116 North 6th Street, Elberth Trotter,.-.209 South 4th
Street, and Vern Shaw, 202 S. 4th Street, again addressed the City
Council regarding the drug trafficking in their neighborhood. They
stated there has been a noticeable change in that the drug dealers
are not as bold about conducting their business .publicly,. They
commended the efforts of Police Chief Green for' '" the additional
emphasis in that particular area of town. They stated the drug
., problem still exists, however, it is .not. quite as visible as
before.
Pam Aylmer, '805' %South .46th' Avenue; a r 'local realtor, expressed
concern about the rapid erosion of property "values`on'the eastside
of town due to drug trafficking. Mrs. Aylmer, related, she has been
- having ,difficulty showing or selling property with an eastside •
location. She stated property values in area 1, which includes
property from the river to 1st Street, have- decreased from $30,000
to $22,000 since 1985. She stated she is aware of several citizens
who share her concerns and would be willing to serve on a task
force or committee in an attempt to resolve, some of the problems
• plaguing that area. She asked Council to consider formation and
sanction of such a task force. In response to Mrs. Aylmer's
comments about the deterioration of the housing .on -the eastside,
Council member Carmichael, commented that the City has expended
approximately ten million dollars of Community Development Block
Grant Funds over the past several years to rehabilitate housing in
the target area. Mayor Beauchamp stated a number of years-ago the
City attempted to pass a code enforcement .program containing
certain standards for rental units within the City, however, that
issue was soundly rejected. Council member Carmichael stated an
effort such as the one suggested by Mrs. Aylmer should not be
limited to_the City limits of Yakima,., but should also include
areas such as Union Gap, Selah, Moxee City, Yakima county, etc.
Mrs. Aylmer was in agreement with this suggestion. -
Barbara Harris, 1911 .West Yakima Avenue, .Realtor with L.B.
Andrews,. commented that the drug problem is. -not the only-cause of
the erosion of property values. She stated the development of
large apartment complexes have also .impacted property values, as
well as the rezoning of property for office buildings, town houses
and parking lots. She indicated in past years this type of
rezoning was restricted under the auspices of,the •City Planning
Commission, however, this commission was dissolved when the Urban
Area Zoning Ordinance was adopted and the.Hearing Examiner position
established. She stated it is her opinion that the - concerns.

* 7. REPORT FROM TRANSIT DIVISION REGARDING ALTERNATIVE FUNDING
PROPOSALS FOR DIAL -A -RIDE SERVICE
The staff report and recommendation from the Transit Division
directing staff to develop the necessary documentation /prepare
appropriation ordinance allocating additional funds'_to the Dial -A-
Ride Program from Transit Unencumbered Furid balance in the amount
of $30,000 was accepted.
*8. REPORT FROM DEPARTMENT OF ENGINEERING AND UTILITIES REGARDING
STATUS OF STREET BOND ISSUE PROJECTS FUNDING AND CASH FLOW
PROJECTIONS
The report from the Engineering Department, dated October- 10, •
1987, regarding the status of Street Bond Issue .Projects, was
accepted.
*9. CONSIDERATION OF RESOLUTIONS AUTHORIZING EXECUTION OF AGREEMENTS
FOR LEGAL SERVICES WITH:
A. YAKIMA COUNTY FOR PROSECUTION SERVICES
RESOLUTION NO. D- 5400, A RESOLUTION authorizing the City Attorney
to execute an agreement with the Yakima County Prosecutor for
prosecution services'.
B. GLEN P. WARREN FOR PUBLIC DEFENDER SERVICES
RESOLUTION NO. D- 5401, A RESOLUTION appointing Glen P. Warren as
City of Yakima public defender for the calendar year 1988.
*10. APPROVAL OF FINAL "CONTRACT PAYMENTS (STANDARD MOTION V -B -- ACCEPT
PROJECTS AND APPROVE FINAL PAYMENTS):
A. PRIDEVIEW SEWER LOCAL IMPROVEMENT DISTRICT
The report from the City Engineer dated October 20, 1987, with
respect to the canpletion of the work on the Prideview Sewer
L.I.D. project,• performed by DeBlasio Construction, was approved,
the work accepted and payment of the final estimates ", as therein
set forth, was authorized.
'B. WEST NOB HILL BLVD. IMPROVEMENT - TREE REMOVAL, TRAFFIC ' CONTROL
AND MISC. EXCAVATION

The report from the City Engineer dated October 20, 1987, with
respect to the completion of the work on the West Nob Hill
Boulevard Improvement -Tree Removal, Traffic Control and
Miscellaneous Excavation project, performed by .Tri -Ply
_Construction, was approved, the work accepted and payment of the
final estimates, as therein set forth, was authorized.
11. OTHER BUSINESS
Mayor Beauchamp stated Council needs to make an appointment to the
Regional Planning Commission and questioned the manner in which
they would like to do this. Council member Buchanan suggested a
Council Committee be established to review the applications that
• have been received'by the City Clerk. It was MOVED by Buchanan,
seconded "by Barnett, to appoint Council members Berndt, Carmichael
and Foy to act as the Council Committee to review the applications
and submit- their recommendation for appointment. Unanimously
carried by voice vote. Berndt,=Foy and Sims absent.

12. ADJOURNMENT •
There being no further business to come before-the Council, it was
MOVED by Barnett, seconded by Carmichael, that this meeting be
II adjourned at the hour of 3:35 P.M. Unanimously carried by voice
vote. Berndt, Foy and Sims- absent.
