BUSINESS MEETING
1. ROLL CALL .' - .
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Henry
Beauchamp, presiding, Council members Clarence Barnett, Pat Berndt,
Lynn Buchanan, Lynn Carmichael, Jerry Foy and Bernard Sims present
on roll call. City, Manager Zais, City Attorney. Vanek, and City
Clerk Roberts also present. ,
2. INVOCATION r
The Pledge of Allegiance was led.by Council member Berndt.
3.' OPEN DISCUSSION FOR THE GOOD OF THE ORDER '
Council member Berndt read a, proclamation declaring
. September 25th and 26th as Sunfair Days. Kirk Gilday, Sunduster,
was present to receive the proclamation and acknowleged the
presenceof Barney Smith, President of ,the Lions Club, Dan Fortier,
Lions Club, Barb Thompson, Executive,., Director of Sunfair Festival
Association, and Chuck Hinckley, Vice President' of Sunfair
Festival Association, who had worked diligently on the Sunfair Park
project. Council member Berndt stated she had ,requested. a list
naming the, individuals who,had worked on this.project. and expressed
appreciation for their hard work. Council.. member •.Foy.,.suggested
that each of those individuals be pr with a. copy of this
proclamation. Barney Smith, President of the Lions Club, extended
an invitation to Council members to attend the Sunfair. Festival.
Council member Foy proposed a formal_Motion be adopted in support .
of efforts to continue program funding : from the;State_of Washington
,Department of Social and Health Services . and requesting the. current
contract with the. Yakima Street Kids Projectbe continued. Council
member Foy having read the Motion, it was MOVED,by.Foy, seconded by
Carmichael, that this Motion be approved by the City. Council and we
all affix our signature, along with the Mayor's, to this Motion.
Mr. Foy stated he has drafted a letter in support of this cause for
' the Mayor to sign. He stated Senator Alex Deccio will carry this
letter to _the Director of the Department Of Social_,and Health
Services. The question was called for a.vote ,on .the motion.
Unanimously carried by ,voice vote. Jennifer Fitterer, Yakima
Street Kids Project, thanked the Council for their support. ,
Council member Carmichael reported on the status of the proposed
grant,for the,Agplex, stating she and Fred Stouder, Assistant City
Manager, met with the Economic Development Administration, Regional
Office, and presented the City's proposal and discussed the
preliminary criteria for the EDA grant. She •stated that after .
reviewing the preliminary information, EDA was very encouraging.
. She stated the preliminary application should be. ready to submit by
the end of next week.
4. CONSENT AGENDA , .
Mayor Beauchamp referred to the items placed.on the. Consent Agenda,
questioning •whether there were any additionse,.or..deletions from
either Council members or citizens It. was the general
consensus of the Council that Items Nos. 10..and 14.:be removed from
the Consent Agenda as requested by Council member Barnett,.. and Item
No. 13 be-.removed,from the Consent Agenda,_•as requested by Council
member. Carmichael.The City Clerk then .read , the. Consent Agenda
items, , .including resolutions and ordinances by title. It was MOVED
. by Carmichael, seconded by Sims, that the Consent Agenda, as read,
be passed. Unanimously carried by roll call vote. (Subsequent

*5. APPROVAL OF MINUTES OF THE COUNCIL MEETING OF SEPTEMBER 15, 1987
The Council minutes of September 15, 1987 were approved, having
been duly certified accurate by two Council members and no one
present wishing to have said minutes read publicly.
6. AUDIENCE PARTICIPATION
Guy Hanson, representing his Mother, stated he received a bill from
the'City for $600 (penalty and labor) for weed abatement at his
Mother's residence at 710 N. 7th Street. He stated he ; normally
cares for the lawn and questioned why she was billed over $200 for
ten hours work when it takes him about an hour to mow the lawn. He
stated he would like to talk to somebody about this situation. It
was the consensus of the Council to refer this matter to Bob
Shampine, Code Administration Manager, to review and report back
to Council.
7. PUBLIC HEARING ON AMENDMENT TO THE NATIONAL FLOOD INSURANCE
PROGRAM /FLOOD DAMAGE PREVENTION ORDINANCE (SEE ORDINANCE)
This being the time set for a hearing on an amendment to the
National Flood Insurance Program/Flood Damage Prevention Ordinance,
John Haddix, Associate Planner, reviewed the information in the
staff report regarding the proposed changes to this program. He
stated staff supports retaining community eligibility in the
National Flood Insurance Program by amending the 1981 Flood Damage
Prevention Ordinance. Council member Carmichael commented that
when the 1981 Ordinance was adopted there were some maps reflecting
the areas designated as flood prone areas. Since there were some
errors in that map, she _questioned if the map. has been
corrected. Mr. Haddix stated revisions to that map are still being
made. Council member• Carmichael stated she would be interested in
seeing the map when it becomes available. There being no , citizen
present wishing to address this issue, the public portion of the
hearing was closed by Mayor Beauchamp. Ordinance No. 3052 having
been read by title, it was MOVED by Foy, seconded by Berndt, that
this Ordinance, as read, be passed. Unanimously carried by roll
call vote.
ORDINANCE NO..3052,. AN ORDINANCE relating to building regulations;
defining terms, _adopting' standards and - requiring a development
permit and providing for the administration of the standards and
' requirements for constructing in areas of special flood hazard and
floodways; amending 11.58.030, 11.58.100, 11.58.120, 11.58.130,
11.58.140, 11.58.150; amending subsection 11.'58.050A and enacting a
new section, 11.58.170, all of the City of Yakima Municipal Code.
8. PRESENTATION FROM NEW VISION (YCDA) REGARDING INDUSTRIAL PARK SITE
SELECTION STUDY
Tim McGree, Executive Director of .Yakima Valley Development
Association, stated that about a year ago they hired a consultant
to perform an industrial park site selection study to identify
sites which could be developed as industrial parks in Yakima
County. He stated six sites were chosen from up and down the
valley. The consultant then conceptionally designed each of those
sites and estimated the cost to develop those sites. He
commented there is about $25,000 of New Vision money involved in
this project. He stated this study recommends a series of steps be
established' to place these sites in a marketable position: 1) An
agency should be identified' as the land control agency; 2) That
site (16th Avenue and SR12) be placed under the control of
' the land control agency to ensure the property will get developed
and discourage unfounded price speculation; 3) That site should be
incorporated within the Yakima city limits; 4) Improvements should
be made Phase I of the plan for that site, including access and
utilities; and 5) Restrictive covenants should be adopted to ensure
a minimum. quality of development. Mr. McGree responded to
Council's questions regarding ownership of the property,
' alternative of forming a port district, and accessibility by

railroad. It was MOVED by Foy, seconded by Sims,...to accept the
,staff recommendation to accept the report. Unanimously carried by
voice vote.. Preston Shepherd, Chairman of the Sites and
Development, `Committee, praised*. McGree's efforts to promote and
develop the. Yakima area. .
*9. REPORT, FROM DEPARTMENT OF COMMUNITY & ECONOMIC DEVELOPMENT
REGARDING 1988 HOUSING ASSISTANCE PLAN
The report from the Department of Community & Development
and staff recommendation to accept the 1988 Assistance Plan
Goals and authorizing the submission to the HUD area office, was
• accepted. .
10. CONSIDERATION OF A RESOLUTION AUTHORIZING SALE OF .SURPLUS PROPERTY
Council member ,Barnett requested A.nformation on how the new
containers are faring and,, what is their estimated life span. He
questioned, if these containers should be retained for emergency
use.. Del' Kary, Street and Divisions Superintendent, stated
,. the warranty for the new containers is five years for full
replacement and then it is pro -rated for the next five years. He
stated the metal bins are not canpitable with the type of trucks in
service and we no longer _have the old trucks. Resolution
No D -5394 having been read by title, it was MOVED by Buchanan,
seconded by Sims, that the Resolution, as read, be _adopted.

RESOLUTION NO D - 5394, A RESOLUTION declaring 350 City -owned 1 -1/2
yard Capital Industries and DeWald,.Northwest bins..surplus
and authorizing their sale. , . ..
* 11. CONSIDERATION OF A RESOLUTION INITIATING REZONE OF PROPERTY AT 501
WEST WASHINGTON AVENUE-FROM R -2 TO M -1 ZONING . ,
RESOLUTION NO D- 5395,.A RESOLUTION initiating an - amendment to the
. • ` City zoning map by rezoning property in the vicinity of 501 West
Washington,Avenue in the City of Yakima, Washington.
12. CONSIDERATION OF AN ORDINANCE REZONING PROPERTY IN THE VICINITY OF
2308 -2318 S. 1ST STREET, REQUESTED BY TRILLIUM CORP. & OTHERS
Council member Berndt excused herself from voting on this issue
because the property is adjacent, to. her _business., Ordinance
No. 3053, having been read by title, it MOVED by - Carmichael,
seconded. by Foy,_ that the Ordinance, as.. read, be passed.
Unanimously carried by roll call vote`.

ORDINANCE NO. 3053, AN ORDINANCE affirming the .Hearing Examiner's
recommendation to rezone, property in the ,, vicinity ;of .2308 -2318
South 1st Street, and amending the zoning map of the City of
Yakima.
13. ' CONSIDERATION OF AN ORDINANCE AMENDING THE TRAFFIC CODE TO
PARKING ON CERTAIN STREETS (SUMMITVIEW AND TIETON DRIVE)
Shelley Harlington, Traffic Technician stated this ..,ordinance was
revised due to the construction which took place.this summer and to
make a correction on Summitview to reflect what is posted in that
.. area., Council member Carmichael, asked. Ms. Harlington if she had
talked to Jerry,. Copeland, Director of Public Works, regarding this
part of Summitview. Ms. Harlington stated Mr-. Copeland. indicated
there was some problem with the upper end towards 40th Avenue,
however, she assumed that was due to the part they changed due to
the construction. Mrs. Carmichael stated there were some other
. changes contemplated which aren't reflected in this ordinance. She
stated she was 'concerned we might be missing part of the
contemplated changes. City Attorney ; ,Vanek, stated it. was the
feeling of the Council during the discussion on April 28th that
staff bring all revisions to the parking ordinance at one time due ,
to the cost to publish the ordinance. Mrs. Carmichael stated she

understood there were plans to remove some parking. Ms. Harlington
responded that they were looking at restricting parking on the east
end of Summitview, however, this did not have the businesses'
support. Ed Delahoussaye, 1215 S. 3rd Avenue, stated he
understands they want to take the parking area on South 3rd Avenue,
from Nob Hill Boulevard to Mead, and make a pedestrian walk. He
stated South 3rd Avenue has a sidewalk on the west side and no
parking, so now they will take the other side and there won't be •
• any place to park. He stated he is concerned about that.
Ms. Harlington advised Mr. Delahoussaye that change is not
• addressed in this ordinance. She commented that this change is
something Hoover School is working on and this issue will probably
cane to Council in the next year. Mayor 'Beauchamp told
Mr. Delahoussaye that he would be notified when this item comes
before the Council. Council member Carmichael stated she is still
not comfortable with this ordinance and suggested that a map
indicating the changes might have helped. It was MOVED by Barnett,
seconded by Buchanan, to table this until we find some answers to
' these questions. Unanimously carried.by voice vote.
14. CONSIDERATION OF AN ORDINANCE FIXING AND LEVYING THE AMOUNT OF AD
-. VALOREM TAXES FOR 1988
Council member Barnett asked if we are going to receive the amount
of ad valorem taxes that was estimated in the 1987 budget. John
Hanson, Director of Finance and Budget, commented the operating
levy is $4,836,465, including Police pension funding. He stated
due to the second limitation in property tax, we expect we will get
3% more.in 1988 from 1987. Ordinance No. 3054 having been read by
title, it was MOVED by Buchanan, seconded by Sims, that the
ordinance, as read, be passed. Unanimously carried by roll call
vote.
. ORDINANCE NO. 3054, AN ORDINANCE fixing and levying the amount of
ad valorem taxes necessary to balance estimated revenue with
estimated expenditures for the 1988 budget for'the City of Yakima.
*15. CONSIDERATION OF ORDINANCES,. AMENDING THE 1987 BUDGET (SECOND
READINGS):
A. ORDINANCE APPROPRIATING FUNDS FOR THE LID SEWER CAPITAL FUND
AND COMPREHENSIVE SEWER PLAN
An Ordinance appropriating funds for the LID Sewer.Capital Fund and
Comprehensive Sewer Plan having been read by title only at the '
previous meeting, was brought before the Council for a second
reading.
ORDINANCE NO. 3055, AN ORDINANCE amending the 1987 budget for the
City, of Yakima; and making appropriations' in the 473 -Sewer
Operating and 476 -Sewer Construction Funds for expenditure during
1987. '
B. ORDINANCE APPROPRIATING FUNDS FOR THE DOMESTIC WATER CAPITAL
FUND
An Ordinance appropriating funds for the Domestic Water Capital
Fund having been read by title only at the, previous meeting, was,
brought before the Council for a second reading.
ORDINANCE NO. 3056, AN ORDINANCE amending the 1987 budget for the
City of Yakima; and making an appropriation in the 477 -Water
Construction Fund for expenditure during 1987.
C. ORDINANCE APPROPRIATING FUNDS FOR THE AFSCME AND FIRE PERS
LABOR NEGOTIATION SETTLEMENTS '
An Ordinance appropriating funds for the AFSCME and FIRE PERS labor
negotiation settlements having been, read by title only at the
previous meeting, was brought before the Council for a second
reading. ,

ORDINANCE NO. 3057, AN ORDINANCE, amending the 1987, Budget for the
City of Yakima; - making appropriations from upappropriated fund
balances within various funds for expenditure during 1987.

16. HER BUSINESS -- V - "
Council member Barnett asked if there are any plans to carry the
Dial -A-Ride program through the end of this year. City Manager
Zais stated: this problem surfaced a couple of months ago on
Transit's monthly." report. He stated this is a policy issue- for
1988 . and - it's ' an issue that 'will have "to "come -- back ; to. Council for
this year. He stated. this is an agenda item for the Council
Transit Committee and,` we have been trying to get a meeting
together. Council member Barnett stated he would like to see this
issue come before the Council right away,'before it gets too late.
Council member Foy stated there was an issue relating to the
advertising media trade -out which was tabled by the Council last
April until the entire Council would be present. He suggested this
issue be put on the November 3rd agenda.
Council member- Foy brought up for discussion, the draft letter
to the Trade Stimulant Operators, submitted by City Manager Zais
for Council's comments, stating Council should indicate their
opinion regarding this letter. Council member Barnett stated he ,
wrote Council a memo regarding his opinion of the revised draft
letter, indicating he feels some of these questions go beyond the
scope of the original motion. He stated most of these inquiries
would be more appropriate after the Trade Stimulant Operators bring
in their issues and concerns. He .suggested another approach would
be to ask if sane of this information can be readily assembled and
if it is and they are amenable to supplying that information, then
proceed with these questions. Council member Berndt expressed her
agreement with Council member Barnett's concerns. Stating he
reviewed the previous minutes of this discussion, Council member
Foy expressed his opinion that this second draft letter should
not be sent, but that we invite them to us their position."
Gary McClenaghan, representing the Trade Stimulant Operators,
stated they are willing to to do anything to initiate discussion.
He stated they want to answer all Council's questions and if this
is the beginning point, he would welcome it to be strong, just to
get dialogue started. Council member Foy then gave Mr. McClenaghan
a. copy of the draft letter.
