OPEN DISCUSSION FOR THE GOOD OF THE ORDER Council member Carmichael reported on the status of the Agplex - •t, Project,. and the Committee's , specific task. .of - exploring •sources of _- • financing • ,and , funding •of this faci to- State funds . appropriated.in•the {last legislative. session in.the- amount of $9.5 -million. She stated Yakima County intends-fto issue43 million in -'General Obligation Bonds'as a part.lof the plan for financing the local match to' -the- :.State appropriation. Further, i the :payment of • debt service and principle for the first $2. million would come from future County (Room 'Tax' Revenues ' collected•t inside i the - City of . ' Yakima'-r''after'' January ' 1.; 1988, as those funds will no - longer be . required by the City for servicing bonds on thecconvention center facility. There will be sufficient debt service reserve capacity, . , r , 'together-,: 'with a year - end;- -contribution of „ $140; 000 'from • Yakima County, to provide adequate coverage for the bond debt payments over the next nine years remaining from the Yakima Center construction .project. The County has .requested :an ^. annual • contribution from the City in the 'amount of $70,000 towards the debt service principle and interest payment'for a million Agplex bond. Yakima and Union Gap have also been asked to contribute $20,000 towards the debt , se - vice'�and principle on this bond issue. Together, $90,000; is required annually to meet the debt. service obligations fors the next - 25.iyears`of the{'pr-oposed bond - :' , :retirement schedule-.-The _ City has also been asked , to - contribute •- towardsr;-the annualrmaintenance and,, operationrcosts oftsthe ~facility . - ', exceed • normal operating revenues. That amount is - undetermined at this Council - member Carmichaeli pointed out -, there-' :is; also a need to provide . street' taccess, and• - improvements, : lighting,,.; signing: and .sidewalks-between - the Fairgrounds , and the. ;Central - i , District: ' ' She. stated this - - could. 'have a significiant impact on the City and the County, .because these expenditures are not included in the current $9.5 million cost estimate of the facility. She stated the Committee has --explored •• , various•options for financing and tentatively, propose that+ :the City - increase ! its. - license -• fees - • 50% to" generate income to support the City's proposed $70-,000 per annum share in .debt service cost, provide-additional revenue .to towards maintenance and operations;-- -andifor'- future:street• improvements. Mrs. Carmichael. reported the Chamber of Commerce- is a • ,-: , -:,-poll -r of their membership to- the •business~ community's r t_-, ~receptiveness to the . X50%% increase _in - business = -license - fees. She • stated _she. spoke with-Congressman Sid Morrison' and has determined • •- it-may be_ possible to secure federal funding up to- $1 million for . the Agplex Project. She asked for a consensus - of, :the• - Council to direct staff to submit an application for such funds. Therefore, • it 'was MOVED by Carmichael; seconded 4by Foy,; to direct.;staff to proceed with the . tinitial - funding application and preliminary work _,necessary to - apply: - to :EDA and . any . other i like agencies, for a • . -• grant in the amount $1 million; and. that initial application would be filed the end of this-week of ..necessity: ~ : member Barnett questioned if the motion is addressing funding for the Agplex building itself, or for the streets and other improvements. Council member Carmichael clarified the motion, explaining grant monies cannot be used for the Agplex building because it does not 114i' SEPTEMBER 15, 1987 belong to the City. She stated it may be prudent for the City to ask the County to join in the grant application process at a later time. Council member Berndt expressed appreciation to Council member Carmichael for taking the initiative in researching this issue. Mayor Beauchamp stated Goodwill Industries is having a Constitutional 'Celebration at 8:30 a.m. tomorrow' and'-has invited Council to attend. . • Assistant Mayor Barnett stated the Constitution Bicentennial Committee has a program scheduled at 12:00` noon at the downtown Yakima Mall - in the vicinity of Mervyns Store'. Mayor Beauchamp stated on Thursday and Friday nights there will be a musical presentation at the Capitol Theatre in celebration of the 200th Anniversary of the United States Constitution. Proceeds from this event will go to the Greenway Foundation. 4. CONSENT AGENDA • Mayor Beauchamp referred to the items placed on 'the Consent questioning whether there were any additions or deletions from either Council members or- citizens present. There - being no - changes, the City Clerk then read the 'Consent Agenda items, including resolutions and ordinances by title. It was MOVED by Carmichael, seconded by Sims, that the Consent Agenda, as•read, be passed.. Unanimously carried by roll call vote. (Subsequent 'paragraphs preceded by an asterisk ( *) indicate items on the Consent ' Agenda handled under one motion without further discussion.) • *5..• APPROVAL OF MINUTES OF THE MEETINGS OF SEPTEMBER 1 & 9, 1987 • The Council minutes of September 1 & 9, 1987 were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. • 6: AUDIENCE'PARTICIPATION • • Clare Brower, President of Chapter 225 of the Viet Nam Veterans of America,'P.O. Box 10543, Yakima, presented a Prisoner of War Flag to Mayor Beauchamp, on loan for a period of one week. Mr. Brower 'stated the purpose of loaning the flag is in recognition of September'l8th, National POW /MIA Recognition Day as proclaimed by the President of the United States, and also to acknowledge the fact that there is still no solution to the'prbblem of POW's and • MIA's" from the Viet Nam conflict and all previous wars in this century. Wanda Schatz, President of the Chamber of Commerce, 601`North 1st Street, Yakima, 98901, addressed Council and reported. on the poll of the Chamber's membership regarding the proposed 50o increase in the business license fees for the purpose of generating the funds needed to cover the City's share of the bond for the Agplex. She stated 15% of the members had responded to the poll, and of that 15 %, 88% of them were in favor of this measure, providing the ordinance stipulate these funds will only be used for the purpose - of • debt retirement in the City's share of bonds, and that the increase will be repealed at the time adequate reserves for debt •retirement have been . met to retire the bonds, or other related • sources of revenue are found for this debt retirement. Mrs. Schatz stated the Chamber of•Commerce will continue to assist the City, County and Fair Board to seek legislative changes to maintain the long term viability of the operations for the Yakima Center and the Agplex. Council member Foy complimented Mrs. Schatz* for her efforts in the difficult task of polling the membership of the Chamber of Commerce. • • 13J SEPTEMBER .I5, 1987 . • 7: PUBLIC' MEETING "ON"THE%REZONE'.OF PROPERTY IN THE VICINITY "OF 2300 -.t SOUTH'.rFIRST STREET, AS REQUESTED BY "TRI'LLIUM 'CORPORATION AND 'OTHERS • r : , , r 9 j • This being the time set for the public' meeti.'ng on the: rezone of property - in the vicinity of 2300 South First Street,' Associate - Planner . Larry Lehman stated staff and 'the Examiner have - recommended - approval of this request for rezone. The change in the . -n zoning: F -from M -1.; Light Industrial, to - :•.CBDS, Central‘ Business District Support, would allow for construction of a'supermarket and other retail development in the future. Council member Barnett , i. r referred 'to page '2 of the Heating Examiner's report which indicates Cascade Auto 1Wrecking would be allowed ontinue''business in a nonconforming classification. He asked if Cascade Auto Wrecking fully understands that some uses may be made nonconforming under 7 rezone. Mr:'i Lehman 'stated they -fully'•'understand`'that their specific use, the use' "for-' Cascade - Auto ='Wrecking would be , _ as monconforming.' Mr. Koreski stated they had not understood this, and given that information, he does not believe the rezone would be in their best interest. .George Sears, 122 Rosa Vista',' Yakima, 98901, stated he owns the property formerly known as Sears Lumber, which is included - in-this rezone :..iHe - stated he is " in agreement with Mrs. Gorton s , .that this property'should be to Centrah'Business;District Support. Following rz.'further comments' ., byF Mr: Robert : Mead in oppostion to'the rezone, Council members' were asked'to declare for the.. record whether} - they' had shad + any 'communication from anyone opposing or supporting the rezone.. Council members - indicated none had been contacted by either opponents or proponents of the rezone. Council member Berndt indicated her family -owned business is • located within 300 feet of the area to be rezoned, and stated she • 13 SEPTEMBER' 15, 1987 ' believes she should abstain from voting on this issue. The public meeting portion of • the meeting was declared closed by Mayor Beauchamp and it was MOVED by Foy, seconded by Sims, to accept the Urban Area Hearing Examiner's recommendation of approval. Under discussion, Council.member Foy encouraged Council to support the • motion, commenting he believes the area's economy'will improve with the potential expansion of the Firing Center and the construction of the Agplex. The question was called for a vote on the: motion. Unanimously, carried by •voice vote.- Berndt abstaining due to possible conflict of interest. 8. CONSIDERATION OF 'REQUEST FROM NEIL BUREN FOR COUNCIL INITIATION OF . A REZONE OF PROPERTY AT 501 WEST WASHINGTON AVENUE FROM R -2 TO M -1 - ZONING • Supervising Associate Planner Don Skone, stated Neil Buren approached the City recently regarding the zoning of his property • at 501 West Washington. Mr. Skone distributed a map .illustrating the area in question and. explained that the property was. M -1, Light Industrial prior to the adoption of the new Urban Area Zoning Ordinance. He stated Mr. Buren believes this was an erroneous • oversight and is seeking Council action to'initiate a rezone of ' this property -to restore the previous M- 1 Neil Buren, 402 North 4th Street, Suite 202, Yakima, addressed the issue stating the business on this, property has been there since 1946 and had been.used for welding and grinding purposes, however, it is currently vacant. He stated it appears the division line was drawn down the middle- of his property during the Urban Area Zoning process resulting in two different zoning classifications for his property. :Following further discussion, it was MOVED by Foy, seconded by Buchanan, that the City initiate the request for rezone. Council member explained this matter will have to be reconsidered before the_Hearing Examiner, who will then send a • recomuendation backto the City Council. The question was called for a vote on the motion. Unanimously carried by voice vote. • *9. CONSIDERATION OF :A RESOLUTION AUTHORIZING EXECUTION OF r SUPPLEMENTAL AGREEMENT NO. 3 FOR REALLOCATION OF FUNDING FOR THE NOB HILL BOULEVARD OVERPASS RESOLUTION NO: D -5390, A RESOLUTION authorizing and directing the City Manager. of the City of Yakima to execute. a supplemental agreement, Supplement No. 3, with the State of Washington, • Department of. Transportation, for partial reimbursement- of costs for the rehabilitation of Nob Hill Boulevard Overpass. - *10. •CONSIDERATION OF A RESOLUTION AUTHORIZING THE CLOSURE OF CERTAIN STREETS FOR THE APPLE CLASSIC RUN • RESOLUTION NO. D -5391, A RESOLUTION authorizing the closure of certain streets within the City of Yakima to accommodate the Apple Classic Street Run. *11. APPROVAL OF THE AUGUST 1987 BUDGET REPORT (ACCEPT' REPORT FOR FILING PURPOSES) The Budget Report for August 1987 was accepted for filing. *12. OTHER BUSINESS • City Manager Zais stated he received a request this afternoon from County Commissioner Chuck Klarich that the City release the County from their agreement regarding retirement of bonds for the Yakima Center, which would enable them to pledge their portion of roan tax • revenues collected after January 1, 1988 toward theAgplex Project. Mr: Zais stated such'an agreement has been drafted and reviewed by City Attorney Vanek and himself, however, still must be reviewed by the Committee members, the County's legal' counsel, and Forrest Walls," of Preston Thorgrimson's office.. Mr. Zais explained that County Commissioner Chuck Klarich will be traveling to New York to present the County's request for issuance of the bonds and attempt 'to obtain a better bond rating, and has asked Council to authorize a letter of intent stating it is the City's intention to release the County of their obligation, as presently contemplated in the -context of the agreement that has been drafted. It was MOVED by Barnett, seconded by Berndt, that-Council authorize a letter of intent as described by the City,Manager.- Unanimously carried by voice vote.
