Executive Session regarding pending litigation pursuant to RCW 42.30.110 (1)(i) Present: Mayor Janice Deccio, presiding,Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Patricia Byers, Holly Cousens, Danny Herrera (present at 5:23) and Eliana Macias (attending remotely via Zoom) MOTION: Byers moved and Brown seconded to adjourn to an executive session for up to 30 minutes regarding pending litigation pursuant to RCW 42.30.110 (1)(i). The motion carried by unanimous vote, Herrera absent. Executive session was held and adjourned at 5:25 p.m. 1. Roll Call Present: Mayor Janice Deccio, presiding,Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Patricia Byers, Holly Cousens, Danny Herrera and Eliana Macias (attending remotely via Zoom) Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Sonya Claar Tee 2. Pledge of Allegiance Mayor Deccio led the Pledge of Allegiance. 3. Interpreter Services Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Open Discussion for the Good of the Order A. Appointments to Boards, Commissions and Council Committees Appointments to the Planning and Tourist Promotion Area Commissions Councilmember Cousens, Chair of the Nominating Committee, reported on the recent Council Nominating Committee meeting. Page 1 of 4 478 MOTION: Cousens moved and Brown seconded to appoint Colleda Monick to the Planning Commission. The motion carried by unanimous vote. MOTION: Cousens moved and Byers seconded to appoint Lonna Wise to the Tourist Promotion Area Commission. The motion carried by unanimous vote. 5. Council Reports None. 6. Consent Agenda Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. She noted an issue with item 6G and it was removed from the agenda. There were no other changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Lund moved and Cousens seconded to approve the consent agenda. The motion carried by unanimous vote. A. Approval of minutes from the April 5, 2022 City Council regular meeting and April 12, 2022 study session B. Approve payment of disbursements for the period March 1-31, 2022 C. 2022 1st Quarter Treasury Report D. Project Completion and Acceptance for Farmers Electric II, LLC. Project 2527 WW Pump Station Improvements E. Project Completion and Contract Acceptance for Spring Creek Phase 3 Wetland Mitigation Project 2577 F. Resolution authorizing a recurring annual Agreement with Yakima Valley Umpires Association to obtain officiating services for the City's organized softball program RESOLUTION NO. R-2022-047,A RESOLUTION authorizing an Agreement with the Yakima Valley Umpires Association for officiating services for the City of Yakima's organized softball program. G. This item was removed from the consent agenda H. Resolution ratifying the declaration of an emergency and authorizing the City Manager to execute all applicable contracts for the realignment of a stormwater pipe near Prasch and 16th Avenues RESOLUTION NO. R-2022-049,A RESOLUTION authorizing the One Washington Memorandum of Understanding among Washington Municipalities. J. Resolution authorizing a service agreement with Penser Northwest, Inc. to serve as third party administrator of the City's workers' compensation program RESOLUTION NO. R-2022-050,A RESOLUTION authorizing a service agreement with Penser North America, Inc., to serve as third party administrator of the City's workers' compensation program. K. Ordinance amending the 2022 Budget for the City of Yakima and making appropriations from Unappropriated Fund Balances within various Funds for expenditure during 2022 for various purposes (Second Reading) ORDINANCE NO. 2022-008,AN ORDINANCE amending the 2022 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various funds for expenditure during 2022 for various purposes including 2021 encumbrances as described in the attached Schedule. Items Removed from the Consent Agenda A. Resolution authorizing an Agreement with Central Washington Mountain Rescue (CWMR)to use Franklin Park for its annual two-day Rope Training Program This item was removed from the agenda. 7. Public Comment Tony Courcy, City resident, spoke about storm drains. DEPARTMENT ITEMS 8. Ordinance amending the City of Yakima Municipal Code, Chapter 1.04: City Council Election Districts, and adopting the updated districting map entitled: Yakima City Council Election Districts 2022 City Attorney Sara Watkins briefed Council on the ordinance. Ms. Watkins recommended the map entitled Yakima City Council Election District 2022, as the district map of the City of Yakima, be adopted before passing the ordinance. The City Clerk read the ordinance by title only. MOTION: Macias moved and Cousens seconded to adopt the map for the redistricting. The motion carried by unanimous vote. MOTION: Macias moved and Byers seconded to pass the ordinance. The motion carried by unanimous vote. ORDINANCE NO. 2022-009,AN ORDINANCE amending the City of Yakima Municipal Code, Chapter 1.04: City Council Election Districts, and adopting the updated districting map entitled: Yakima City Council Election Districts 2022. 9. Report on Police Technology and Crime Analysts Police Chief Murray reported on the utilization of new technology called Flock Safety Page 3 of 4 480 cameras to leverage personnel resources to further reduce crime. He also reported on the recent hire of two crime analysists, for a total of three, and their scope of work. 10. Other Business MOTION: Byers moved and Brown seconded to add to the next agenda a discussion on amending the Council Rules of Procedure relating to limiting public comment to County residents only. The motion carried by unanimous vote. MOTION: Cousens moved and Byers seconded to suspend the rules of procedure to discuss and vote on who will attend the upcoming Association of Washington Cities (AWC) conferences. The motion carried by unanimous vote. Discussion ensued on who will be attending the conferences with possibly four members attending the June conference. City Manager Harrison stated if more than three members attend, they cannot discuss City business. MOTION: Cousens moved and Lund seconded to add to a future agenda a discussion on the resolution regarding naming park facilities. The motion carried by unanimous vote. MOTION: Brown moved and Byers seconded to add to the next agenda a discussion about having the City apply for County ARPA funds for internet in our parks. The motion carried by unanimous vote. 11. Adjournment MOTION: Lund moved and Byers seconded to adjourn to a City Council study session on April 26, 2022, at 5 p.m. in the Council Chambers. The motion carried by unanimous vote.
