RESOLUTION NO. R-2015-077
initiating municipal purpose annexation pursuant to RCW 35.13.180
for annexation of two parcels in the vicinity of Sorenson Road and
South 38th Avenue for soccer park purposes, and authorizing the
City manager to prepare and submit any and all documents to
accomplish such annexation ("Municipal Purpose Soccer Park
Annexation")
WHEREAS, the City of Yakima (City) has received a petition from Cleat City, LLC
and Darlene Bohannon, owners of the properties described herein and below, for
annexation of such properties to the City; and
WHEREAS, the parcels subject to the petition for annexation consist of two
parcels comprising a total of approximately 119.37 acres situated in the vicinity of
Sorenson Road and South 38th Avenue as further shown and described in the "Petition for
Municipal Purpose Annexation" and attached map, which petition and map are attached
hereto as Exhibit "A" and incorporated herein by this reference (hereafter "Subject
Property"). The Subject Property is legally described as follows.
The South half of the Southwest quarter of the Southeast quarter of
Section 34, Township 13 North, Range 18 East, W.M., EXCEPT the East
20 feet thereof for County Road.
Situate in Yakima County, State of Washington.
Yakima County Assessor's Parcel Nos. 181334-34001 and 181334-33001;
and
WHEREAS, the purpose of such annexation is to facilitate development of a
recreational public/private soccer park serving the needs of the community; and
WHEREAS, the City Council finds and determines that such use constitutes a
municipal purpose, and
WHEREAS, pursuant to RCW 35 13 180 and RCW 35.22.195, the City has
jurisdiction and authority to initiate annexation proceedings for municipal purposes; and
WHEREAS, the City Council finds and determines that the petition filed by the
petitioners, which petitioners are the owners of record of the Subject Property, constitutes
written consent to such annexation as required by RCW 35.13 180; and
WHEREAS, the City Council finds and determines that such Petition for Municipal
Purpose Annexation should be accepted and that annexation proceedings as prayed for
therein should be commenced by the City, and that such proceedings are in the best
interests of residents of the City of Yakima and will promote the general health, safety and
welfare, now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. The Petition for Municipal Purpose Annexation attached hereto as Exhibit
"A" is hereby received and approved.
Section 2. The date of this action, June 2, 2015, constitutes and satisfies any
condition or procedural requirement that the City and proponents for annexation conduct
an annexation initiation meeting between the proponents for the annexation and the City.
Section 3. Commencement of municipal purpose annexation proceedings by the City
of Yakima is hereby authorized, approved and directed, and the Subject Property, upon
completion of such annexation, shall be subject to and be required to assume its share of
City indebtedness.
Section 4. The City Manager is hereby authorized to prepare and file a Notice of
Intent to Commence Annexation Proceedings with the Yakima County Boundary Review
Board and any other agencies with jurisdiction; now, therefore
ADOPTED BY THE CITY COUNCIL this 2nd day of June, 2015.

ITEM TITLE: Resolution initiating a Municipal Purpose .Annexation for a
public/private soccer park

SUMMARY EXPLANATION:
The City of Yakima and property owners Darlene Bohannon (Seller) and Cleat City, L.L.C. (Purchaser) of
the subject property located in the vicinity of Sorenson Rd. and S. 38th Ave. (See Attached Map) within
the "Municipal Purpose Soccer Park" Annexation Area hereby request that the Yakima City Council
initiate a Municipal Purpose Annexation for the purpose of establishing a public/private soccer park upon
the above described property. The assessed value of this property equals 100'1, of the area'_ total assessed
value of $ 574,200 (10'% is required for initiation). This proposed annexation consists of two tax parcels
(see map), and is approximately 119.37 acres in size with no one currently residing within the annexation
area.

At this time, City Council is being asked to act upon a request to initiate a Municipal Purpose Soccer Park
Annexation requested by Darlene Bohannon and Cleat City, L.L.C. by passing the accompanying
resolution.

described property situate in Yakima County, Washington, to -wit:

be annexed to the City of Yakima by means of Municipal Purpose Annexation for the expressed purpose
of developing a public/private soccer park, and in support of said Petition, we, the undersigned person(s),
firm(s) or corporation(s) being the owners/purchasers of 100 percent in value according to the assessed
valuation of said property for which annexation is petitioned state; that said property is not now within the
limits of any incorporated city or town; that said property is contiguous to the City of Yakima; that a plat or
drawing of the boundaries of said property which is sought to be annexed is attached hereto; that the City
Council of the City of Yakima is responsible for determining if it will accept the proposed Municipal
Purpose Annexation, which annexation will require the pro rata assumption of existing City indebtedness
by the area proposed by this petition to be annexed.
WHEREFORE, petitioners pray that the City Council make and enter an Order fixing the time and place of
hearing for this petition pursuant to R.C.W. 35.13.180; that due notice be given of such hearing and that
upon a hearing the said property be annexed to the City of Yakima.
The petitioners subscribing hereto agree that all property within the territory hereby sought to be annexed
shall be assessed and taxed at the same rate and on the same basis as other property within the City of
Yakima, including assessments or taxes in payment of any bonds issued or debts contracted prior to or
existing at the date of annexation.
