BUSINESS MEETING
1. ROLL CALL
•
The City Council met in session on this date at 2:00 P.M. in the Council
Chambers of City Hall, Yakima, Washington. Mayor Henry Beauchamp, presiding,
Council members Clarence Barnett, Pat Berndt,'Lynn Bucharian,'Lynd'Carmichael,
Jerry Foy and Bernard Sims present on roll call. Assistant City Manager .
Stouder, City Attorney Vanek, and City Clerk Roberts also present.
2. INVOCATION
•
The'Invocation was given by Council member Sims:
3.• ' OPEN DISCUSSION FOR THE GOOD OF THE ORDER .
•
Mayor Beauchamp read and presented to Dwayne Henning, a proclamation
declaring the month of June as Manufactured Housing Month. Mr. Henning
accepted the proclamation and extended an invitation to attend their open
house at the Yakima Center on June 19th.
4. CONSENT AGENDA •
Mayor Beauchamp referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from either Council
members or citizens present. It was the general consensus of the Council
that Item No. 8 be added to the Consent Agenda, as requested by Council
member Buchanan. The City Clerk then read the Consent Agenda items,
including resolutions and ordinances by title. It was MOVED by Carmichael,
seconded by Berndt, that the Consent Agenda, as read, be passed. Unanimously
carried by roll call vote. (Subsequent paragraphs preceded by an asterisk

6: CONSIDERATION OF RESOLUTION. REGARDING HAZARDOUS VEGETATION AND DEBRIS
ABATEMENT PROGRAM
Robert Shampine, Code Administration Manager, was present to respond to any
questions. He indicated that none of the citizens who received weed
abatement letters is present at the meeting. Resolution No. D -5354 having
been read by title only, it was MOVED by Carmichael, seconded by Buchanan,
that the resolution, as read, be adopted. Unanimously carried by roll call
vote.
RESOLUTION NO. D- 5354, A RESOLUTION authorizing the Code Administration
Manager to clear certain weedy lots.
7. REPORT FROM LEGAL DEPARTMENT REGARDING VICIOUS DOG LEGISLATION AND POTENTIAL
REGULATION OF DART BLOWGUNS
Mr. Vanek reviewed his memo dated May 18, 1987 regarding the proposed
regulation of pit bull dogs. He reported, today, he attempted to contact the
legal counsel from Everett, which has a pit bull dog ordinance. He stated
his last communication from Everett was that they were looking into whether
SB 5301 pre -empts their local legislation, which declares pit bull dogs as a
vicious dog. He said the State legislation may rescind the local
jurisdictions' ability to define a specific breed of dog as a vicious dog.
Until some research is done, he advised against passing an ordinance at this
time because State legislation pre -empts local legislation. Larry Mathews,
805 S. 17th Avenue,. read and presented to the Council his memo, dated May 26,
1987, in which he requested protection for citizens against pit bull dogs.
He indicated he does not believe SB 5301 prevents local jurisdictions from
passing its own legislation defining pit bull dogs as a vicious dog and
regulating that specific breed of dog. Council members discussed the current
leash law for controlling dogs from running at large, SB 5301, and the memo
from the City Attorney suggesting additional research be conducted before

legislation is enacted. Dorothy Cole, Yakima Valley Kennel Club., requested
Council to involve the ' Kennel Club in the preparation of any dog regulating
legislation. Carol Hudlow, President of the Kennel Club, commented the Club
became aware • of-I.this issue and had a discussed the subject l'at its annual
meeting. She stated they are not opposed to a vicious dog ordinance. She
further stated the Club has contact with the national American Kennel - Club in
New Hampshire, who has worked with legislation regarding vicious dogs. She
' stated the Club would be willing to work, with City staff on this issue.
Council member Barnett commented that staff could coordinate its 'efforts
with the Kennel Club and work with them. Council member Buchanan stated he
•would'like.- -to see-the present ordinance enforced more strictly. Referring to
the issue of the -dart blowguns his May 18th memo, Mr. Vanek stated Council
can pass an ordinance . prohibiting the shooting of )al-dart blowgun, unless
otherwise permitted by ? law. Council, member. Carmichael- asked .if this
legislation would cover "throwing stars ". Mr. Vanek stated that device is
regulated by State law. It was MOVED by Carmichael, seconded by Foy, to
adopt the report and staff recommendation which has been submitted to us.
Council member Barnett stated • he would like for the .dog -issue• to be handled
as expeditiously as possible. Jim Stillwell, - :.citizen, stated the existing
leash law needs to be.better enforced.. Michelle Griffin,. S. 16th Avenue,
stated she owns a pit bull dog and whether a pit bull dog is mean, depends on
the training;fram•its. owner. Mark-Shirley, 1902-Greenway, reported he has
trouble in his neighborhood with eight pit bull dogs-•left-_unattended at a
house which has .been condemned. _He-stated - these dogs run :loose.; He reported
he called the Humane Society and the.police, however, the dogs are still
running loose. He stated-.:that laws we have,' are not :working. Council
member Carmichael.' asked 44r. Shirley- to contact.John Hanson Department
Director for: Animal Control,-after-this meeting and speak to .him about this
'problem. Mark Johnson, '921 S. 21st'- Avenue, commented it is the dog owner
•.who' trains the dog to attack people. He commented fthe American Kennel Club
Dog Book describes the Staffordshire as a-good: breed of dog for a
' • family. He .encouraged Council not specify one breed of dog in a vicious
dog ordinance. Darlene . -. Michelle :Griffin's Mother, commented her
daughter's dog doesn't bite: She, too, urged Council to make -an- ordinance
for all vicious dogs. The question was called for on the motion.
Unanimously carried by voice vote. .
* 8. REPORT PUBLIC W3RKSIDEPARTMENT:'REGARDING HAZARDOUS WASTE DISPOSAL
The report from the Public Works Department, regarding',' hazardous waste
disposal., and .staff recommendation - :.to :declare that a3.' state of . emergency
exists ands authorize staff to negotiate with State licensed waste diposal
. companies .for the disposal of existing waste, without the need to 1procure
sealed bids, and provide funding as identified in the staff report, was
accepted and approved. '

The report and staff recommendation from the Department of Community and
Economic Development regarding the status of the city hall energy management
system, was accepted.

. TRANSPORTATION IMPROVEMENT PROGRAM FOR JUNE„23, 1987
RESOLUTION NO. D- 5355, A RESOLUTION fixing the'time and place for hearing on
,a Six Year Transportation Improvement Program for the period of 1988 through
1993;..... -`
*11. SET DATE OF MEETING FOR BURLINGTON NORTHERN RAILROAD REZONE FOR JUNE 9, 1987
June 9, 1987 was set as the date of public meeting on a rezone by
Burlington Northern Railroad.
*12. CONFIRMATION OF APPOINTMENT BY THE CITY MANAGER TO THE UTILITY RATE ADVISORY
BOARD
The appointment of Deborah - A. Krautwurm to the Utility Rate Advisory Board,
by the City Manager, to fill the vacant term left by Jay Vincent, to July 28,
1989, was confirmed. .

* 13. CONSIDERATION OF AN ORDINANCE AMENDING THE 1987 BUDGET AND APPROPRIATING
FUNDS FOR RESTAINING OF THE YAKIMA CENTER - (FIRST READING)
An ordinance appropriating funds for restaining of the Yakima Center having
been read by title only at this meeting was laid on table for two weeks
or until June.9, 1987. •
*14. CONSIDERATION' OF AN ORDINANCE AMENDING THE CLASSIFICATION AND COMPENSATION
PLAN DUE TO CLASSIFICATION STUDIES (POLICE RECORDS SUPERVISOR)
ORDINANCE NO. 3021, AN ORDINANCE relating to City personnel; adopting a
classification.and compensation plan for City employees to be effective June
29, 1987; 'amending Sections 2.20.100 A., 2.20.100 C., 2.20.110 A., and
• 2.20.110 F., all of the City of Yakima Municipal Code.
15. OTHER BUSINESS
•
After. discussion, it was the general consensus of the Council to rotate the
seating location , around the Council horseshoe ,. with the exception of the
Mayor's chair. '
Mayor Beauchamp stated that if the next Council meeting is to be held at the •
Wastewater 'Treatment Plant, Council needs to designate that site as the
location for the next meeting. Several Council members indicated they did
• not think•it necessary to conduct the Council meeting at that site. Three
Council members indicated they could not attend the June 2nd meeting and one
Council member expressed doubt about being available to attend the next
meeting. Assistant City, Manager Stouder stated that under these
circumstances, and the importance of the item to be 'discussed, perhaps the
next Council meeting should be cancelled. He stated he would contact the
Council members next week and if there is a meeting held, it would be held in
the Council Chambers. Council member Buchanan suggested that those Council
members who have not toured the Wastewater Treatment Plant, do so. •

Information Items. •
Items of information supplied to Council were: Letter from Community
Development Advisory Committee to the Parks and Recreation Commission
regarding use of CDBG funds for reconstruction of Washington and Franklin
Pools. 4/13/87; Letter from U. S. Department of : Housing. and Urban
Development regarding 1986 Grantee Performance Report.'5 /20/87; Memorandum
from City Attorney regarding Damage Referred to Insurance
Company. 5/14/87; and Transit Operations Report for month of April 1987.
16. EXECUTIVE SESSION REGARDING PROPERTY ACQUISITION
It was MOVED by Berndt, seconded by Buchanan, to move into Executive Session
for approximately 15 minutes to discuss property acquisition, and adjourn the
meeting immediately thereafter. Unanimously carried by voice vote.

17. ADJOURNMENT
Following the conclusion of the Executive Session, the meeting was adjourned
'at 3 :15 p.m.
