The Utility Services Division, under the Direction of Finance and Budget Director, is responsible for the management of all utility and miscellaneous receivable accounts. This memo will provide foundational information on billing and collection practices currently used by the Utility Services Division and will outline some potential municipal code and ordinance changes that will be presented for future council consideration. Utility accounts are billed on 60 day/2-month cycle and are broken down into reading/billing routes to effectively bill the approximately 30,000 accounts the division manages. Utility Bills are considered late 15 days after being billed. The City of Yakima municipal code chapter 7.50 currently allows utility accounts, with the exception of raw water (untreated water) irrigation services and multi-unit facilities such as a duplex, tri-plex or apartment complex, served by one water meter to be held in the tenant's name. The tenant is required to pay a deposit within 14 days of opening an account unless the applicant is able to provide a letter of credit from another utility showing at least one year of good payment history. The current deposit amount for a property with all three services i.e. water, waste water and solid waste is $215.28 ($51 .51 for refuse, $116.04 for waste water and $47.73 for water). There is no deposit required for an irrigation service. The deposit amount is determined by the service rendered at the property and based on a formula that calculated the deposit to be equivalent to an amount equal to three months of service based on an average of the preceding months and is not dependent on a national credit rating. The current deposit amounts have not been increased since start of the COVID 19 pandemic. Under most cases, the property owner is not required to pay a deposit for services, however, a deposit can be required if the property owner has prior poor payment history with the Utility Services division. The practice of allowing an account to be held in the tenant's name can be problematic as the property owner, who is ultimately responsible for the utility charges, is often unaware of an outstanding utility balance left owing by a tenant 3 until the time of sale of the property when a request is made from a title company for any outstanding balances or liens against the property. It is also not uncommon for a new or existing tenant to establish an additional account at an address that is currently in delinquent status. The City's municipal code Chapter 7.50.010 specifically states "The customer named on the account will be responsible for utility charges that occur if the utility services division is not notified of changes in billing status". When a tenant is named on the account and the tenant does not pay, the City does not have recourse to obtain payment from a property owner. The State of Washington currently provides that all utility bills follow the property and are the responsibility of the property owner. State statutes provide several mechanisms for municipalities to attempt to recover delinquent utility amounts including disconnection of service, referring to a collection agency, or collecting at the time of sale of the property pursuant to RCW 60.80.010-.020. Many cities in Washington State such as Walla Walla, Spokane, and Seattle have adopted ordinances and or polices that either require utility bills to be held in the property owners' names exclusively, and or have a copy of each billing invoice be sent to the owner. In addition, some municipalities have identified the property owner, not the tenant, as the responsible party for utility charges in their municipal code. The ordinances from the above-mentioned municipalities are included as exhibits to this memo. The Utility Services Division, in consultation with the Legal Department, will conduct a comprehensive review of the current municipal code relating to how utility accounts are billed, collected and managed and Staff will draft an ordinance that will address the issues of landlord vs. tenant held accounts to be presented to council for consideration. Exhibit I 4 ORDNANCE NO. 2022-11 AN ORDINANCE AMENDING THE WALLA WALLA MUNICIPAL CODE TO REQUIRE UTILITY ACCOUNTS BE MAINTAINED IN A PROPERTY OWNER'S NAME, SECTIONS 13.03.600, 13.04.900 AND 13.06.090 OF THE WALLA WALLA MUNICIPAL CODE REGARDING THE CITY'S LIEN FOR DELINQUENT UTILITY CHARGES, AND ADDING SECTION 2.01.040 TO THE WALLA WALLA MUNICIPAL CODE REGARDING APPLICATION OF PAYMENTS TO UTILITY ACCOUNTS WHEREAS, the City of Walla Walla passed Municipal Ordinance A-2405 on May 13, 1970 which classified the City of Walla Walla as a nonchartered code city under Title 35A of the Revised Code Washington (RCW); and WHEREAS, RCW 35A.01.010 provides that optional code cities organized under RCW Title 35A have the broadest powers of local self-government consistent with the Constitution of this state; and WHEREAS, RCW 35A.21.160 provides in pertinent part that "[a] code city organized ... under this title shall have all of the powers which any city of any class may have and shall be governed in matters of state concern by statutes applicable to such cities in connection with such powers to the extent to which such laws are appropriate and are not in conflict with the provisions specifically applicable to code cities;" and WHEREAS, RCW 35A.11.020 provides in pertinent part that "[t]he legislative body of each code city shall have all powers possible for a city or town to have under the Constitution of this state, and not specifically denied to code cities by law;" and WHEREAS, RCW 35A.11.020, RCW 35A.21.150, 35A.80.010, Ch. 35.67 RCW and Ch. 35.92 RCW authorize the City of Walla Walla to operate utility services and establish rates and charges for such services; and WHEREAS, the Walla Walla City Council has considered adoption of this ordinance during a regularly and duly called public meeting of said Council, has given careful review and consideration to said ordinance, and finds said ordinance to be in the best interests of the City of Walla Walla, NOW THEREFORE, the City Council of the City of Walla Walla ordains as follows: Section 1: Section 13.03.600 of the Walla Walla Municipal Code is amended to read as follows (added terms are bolded and italicized; and removed terms are stricken): 13.03.600 Sewer service charges —Receipts—Collection and disposition. There are established rates to be charged all users of any element of the city sewer system to be known as sewer service rate. This rate and all other charges for sewer service, penalties, connection charges, and interest thereon, shall attach to and be a lien upon all property to which such service has been furnished or is available. A. The city shall have a lien for all delinquent and unpaid rates and charges for sewer service and all other charges for sewer service, penalties, connection charges, and interest 1 5 thereon, which lien shall have the superiority established by RCW 35.67.200 and shall be foreclosed in the manner provided in Chapter 35.67 RCW. This lien shall be effective for a total not to exceed one year's delinquent service charges without necessity of any writing or recording of the lien with the county auditor. B. Delinquent charges shall bear interest at a percentage.rate of eight percent per annum eet forth in the city's rate ordinancc(s), computed on a monthly basis, and should the city foreclose the lien as authorized by this chapter,the city shall be entitled to its reasonable attorney's fees. C. As an additional and concurrent method of enforcing its lien, the utility is authorized, in accordance with law and in the manner provided by Sections 13.04.300 and 13.04.420 and RCW 35.67.290, to shut off water service to such premises for so long as any delinquent fees or charges remain unpaid. D. The remedies and charges imposed by this section are additional and concurrent to other remedies and charges imposed by this chapter. E. All accounts for sewer service shall be kept in the name of the owner of the property and not in the name of the tenant, and the owner only shall be held responsible for payment of all accounts. Property owners may complete a payment transfer form with tenants transferring payment responsibilities to tenants. However, the agreements do not relieve property owners of the responsibility for payment of accounts. Section 2: Section 13.04.300 of the Walla Walla Municipal Code is amended to read as follows (added terms are bolded and italicized; and removed terms are stricken): 13.04.300 Service —Accounting of charges. All accounts for water shall be kept in the name of the owner of the property and not in the name of the tenant. The account bills will be sent to the owner and the owner shall be held responsible for payment of all accounts. Property owners may complete a payment transfer form relieve property owners of the responsibility for paymcnt of accounts as stated herein. All delinquent and unpaid charges for water, sewer, sanitation or other city charges shall result in discontinuance of service and a lien against the premises to which the same are furnished. Section 3: Section 13.04.900 of the Walla Walla Municipal Code is amended to read as follows (added terms are bolded and italicized; and removed terms are stricken): 13.04.900 Collection of charges. A. All service charges and all other fees or charges hereafter established by the city council by this chapter shall be deemed to be levied upon the premises themselves. B. The city shall have a lien for all delinquent and unpaid charges and fees, including interest thereon, assessed against premises to which water services were furnished which lien maybe enforced in the manner provided in RCW 35.621.290and 35.21.300. 2 6 C. Delinquent charges shall bear interest at eight percent per annum computed on a monthly basis, and should the city foreclose the lien as authorized by this chapter, the city shall be entitled to its reasonable attorney's fees. D. The remedies and charges imposed by this section are additional and concurrent to other remedies and charges imposed by this chapter. Section 4: Section 13.06.090 of the Walla Walla Municipal Code is amended to read as follows (added terms are bolded and italicized; and removed terms are stricken): 13.06.090 Collection of charges. A. All rates, charges, penalties and interest thereon, shall be deemed to be levied upon the respective premises within the boundaries of the utility. B. The city shall have a lien for all delinquent and unpaid rates, charges, penalties and interest thereon, which lien shall have the superiority established by RCW 35.67.200 and shall be foreclosed in the manner provided in Ch. 35.67 RCW. This lien shall be effective for a total not to exceed one year's delinquent service charges without necessity of any writing or recording of the lien with the county auditor. C. Delinquent charges shall bear interest at eight percent per annum computed on a monthly basis, and should the city foreclose the lien as authorized by this chapter, the city shall be entitled to its reasonable attorney's fees. Section 5: Section 2.01.040 of the Walla Walla Municipal Code is added as follows: 2.01.040 Order of Application of Payments on City Utility Accounts Whenever a payment is made upon a City of Walla Walla utility account, the payment shall be applied in the following order to the amounts owed: first to penalties, second to accrued interest, third to recycling fees and charges, fourth to sanitation (garbage collection) fees and charges, fifth to water service fees and charges, sixth to stormwater fees and charges, and seventh to wastewater(sewer service)fees and charges. Section 6: The City Clerk and the codifiers of this ordinance are authorized to make necessary clerical corrections to this ordinance including, but not limited to, the correction of 3 7 scrivener's/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. The City Clerk and the codifiers of this ordinance are also authorized and directed to make changes to chapter indexes necessitated by repeal of sections, code additions, and changes to section titles and captions made herein. Section 7: If any portion or part hereof shall be determined to be invalid or unenforceable, it shall be deemed severable from the remainder hereof. Section 8: The Walla Walla City Clerk is authorized to publish a summary of this ordinance in such form approved by the City Attorney. The ordinance also amends sections 13.03.600 and 13.06.090 of the Walla Walla Municipal Code to provide that the City shall have a lien for a total not to exceed one year's delinquent wastewater and stormwater charges without necessity of any writing or recording of the lien with the county auditor. The ordinance also amends section 13.04.900 to correct a cross-reference. The ordinance also adds section 2.01.040 to the Walla Walla Municipal Code establishing that partial payment of utility accounts will be applied in the following order: first to penalties, second to accrued interest, third to recycling fees and charges, fourth to sanitation (garbage collection) fees and charges, fifth to water service fees and charges, sixth to stormwater fees and charges, and seventh to wastewater (sewer service)fees and charges. C3 3764 An ordinance relating to utilities and utility bills, amending SMC sections 04.02.160 and 13.01.0312. The City of Spokane does ordain: Section 1. That SMC section 04.02.160 is amended to read as follows: 4.02.160 Obligations of Landlords and Sellers A. Property owners derive substantial benefit and value to their property from service from the three municipal utilities being furnished or available to their premises at the lowest cost, even where an owner is not the direct customer. As a condition of continued enjoyment of such benefits, property owners must accept joint and several responsibility for full payment of municipal utility charges to their premises during their time of ownership as well as any additional periods allowed by municipal utility lien rights or as otherwise provided by contract or at law. B. A person selling or letting any premises subject to delinquency for municipal utility services shall provide the purchaser or renter, at or before the sale or rental, with a copy of the most recent City utilities bill. A person failing to make such disclosure commits a class 3 civil infraction. C. Property owners and landlords are required to make provision for the payment of charges regularly listed upon the City utilities bill before transferring ownership or occupancy. Failure to make provisions for payment for utility services at a premises tends to create unhealthful and unsanitary conditions and is a public nuisance. A property owner or landlord failing to make provision for payment of a utility bills prior to transferring ownership or occupancy commits a class 1 civil infraction. A thirty-day warning notice, including notice of a right to a hearing on any disputed amounts, shall be given prior to further enforcement action where a prior utility bill has not been regularly furnished to a property owner or landlord. D. The City utility billings office may seek recovery of all combined utility bill charges in any court of competent jurisdiction against a customer or other responsible party for unpaid charges, including any special charges imposed under SMC 4.02.120, plus any other recoverable costs or fees. As used herein, "other responsible person" includes the landlord or property owner. Said term additionally may include any tenant or occupant, where such person received the benefit of municipal utility services or otherwise regularly paid or made arrangements to pay municipal utility bills during the period of tenancy or occupancy. The director does not terminate ((may forego termination of)) water service ((at of the latoct bill as required by subsection B of this section)) to a new tenant not otherwise responsible for the bill, so long as the account ((new customer)) remains current for ((in-the)) payment of services thereafter ((received by him or her)). Section 2. That SMC section 13.02.0312 is amended to read as follows: 13.01.0312 Security Deposit; Partial Payment; Landlord Notice; Bankruptcies. A. Security Deposit. Prior to furnishing utility equipment or services, a deposit of up to two months estimated combined utility service billings may be required by the utility billing supervisor to guarantee payment for regular service, where deemed needed to protect utility interests. Additional deposits or advance payment may also be required as a condition of special service or equipment needs. B. Partial payments_on past due accounts shall be applied first to solid waste, then to sewer, then to water utility charges unless requested by the payor at the time of payment, to avoid termination of specific utility services. C. As provided in RCW 35.21.217, upon request and payment of a duplicate billing charge of fifty cents (50 ), the property owner of premises served or the owner's designee may request a duplicate billing of utility service bills sent to a tenant or other address. If an owner or the owner's designee notifies the Utility Billings Office in writing that a property served is a rental property, and asks to be notified of a tenant's delinquency, and has provided, in writing, a complete and accurate mailing address, the Utility Billings Office shall notify the owner or the owner's designee of a tenant's delinquency at the same time and in the same manner the city or town notifies the tenant of the tenant's delinquency or by mail. No charge is assessed for this service. D. When the Utility Billings Office provides a real property owner or the owner's designee with duplicates of tenant utility service bills or notice that a tenant's utility account is delinquent, the Office shall notify the tenant that it is providing the duplicate bills or delinquency notice to the owner or the owner's designee. If the Utility Billings Office fails to notify the owner of a tenant's delinquency after receiving a written request to do so and after receiving the other information required by this subsection, the City shall have no lien against the premises for the tenant's delinQuent and unpaid charges. E. As authorized by 11 USC Section 366, unless otherwise directed by the director of the affected department, the minimum deposit for adequate assurance of payment in the event of bankruptcy shall be two months estimated utility charges for Chapter 7 and 11 filings and one month estimated utility charges for Chapter 13 filings. Whenever the owner of any premises connected with the City's water supply system desires to discontinue 4 the use of water, he shall make written application to have 5 the meter removed from the service. The actual cost of 6 removing meter shall be charged to the property, except that 7 the Superintendent may establish standard charges based on 8 a review of prevailing actual costs of removal of meters. 9 The sere rate shall apply for reinstatement. 10 When it is desired to have a meter reinstalled the owner 11 of the premises to be supplied by such meter shall file an 12 application at the office of the Superintendent on forms 13 provided for the purpose, and shall pay the cost in full for such reinstallation. 14 The Superintendent shall cause the reinstallation of 15 meters within twenty-four (24) hours after the receipt of 16 application for same. In the event of emergency the 17 Superintendent may, at his discretion, permit the temporary 18 use of unmetered water, such temporary use to be limited 19 to the time of the placing of the meter on the service 20 connection. 21 In all cases of the City furnishing temporary service 22 within the meaning of this section a charge to be determined by the Superintendent of Water based on the actual cost 23 of furnishing said temporary service shall be added to and 24 made a part of the regular meter charges. 25 Section 3. That Section 18 of Ordinance 65877 is amended 26 to read as follows: 27 Section 18. All accounts for water shall be kept 28 only in the name of the owner of the premises for which -2- 17 1 service was installed, provided, however, that persons holding 2 under recorded lease may be supplied on their own account, 3 and in such cases the Superintendent may require such deposit 4 of money with the Treasurer of the City of Seattle as in his 5 judgment shall be necessary to protect the City against any 6 and ail delinquent and unpaid charges for water or other charges on account of such service. The property owner shall 7 have the right to have water bills mailed to a tenant, or 8 agent, but this shall not relieve the property from liability 9 for water charges incurred. 10 The Superintendent of Water may establish and collect 11 charges based on actual costs, for special meter readings 12 ordered in connection with property ownership or occupancy 13 changes. 14 Section 4. That Section 33 of Ordinance 65877, as last amended by Ordinance 99109, is further amended to read 15 as follows: 16 Section 33. The proceeds from this demand charge shall be 23 deposited in a separate fund far use in financing projects 24 which serve the wholesale areas. 25 By July 1, 1975, an implementing ordinance containing 26 a proposed demand charge rate schedule and the methodology 27 of its application shall be submitted to the City Council by 28 the Superintendent of Water. 22 1 Section 6. That Section 36 of Ordinance 65877 as last t 2 amended by Ordinance 86455'is further amended to read as follows; 3 Section 36. For the collection of metered water rates the City shall be divided into districts corresponding to daily routes for meter reading. 5 The Superintendent in his discretion may cause bills 6 for water used for domestic purposes to be issued and mailed 7 every three ( ) months (quarterly) or less. 8 AU bills for metered water shall become past due and 9 delinquent fifteen (15) days after date of mailing, and date 10 of delinquency shall be plainly noted on bill. 11 Upon non-payment of bills as prescribed in this section, 12 water supply will be subject to shut off. A charge of $2.00 13 will be assessed upon actual delivery of notice of intent to shut off, in order to compensate in part for the cost in 14 delivery and associated collection efforts. The Superintendent 15 may give a further five (5) day grace period before actual 16 ' shuttingoff, Upon actual shut off, said charge shall be 17 payable before the water shall again be turned on 18 Section 7. That Section 38 of Ordinance 65877 is amended 19 to read as follows 20 Section 38. Where the accuracy of record of a water 21 meter is questioned, it shall be removed at the consumer p s 22 ! request and shall be tested in the shops of the Water Department by means of the apparatus there provided, and a report thereon. 23 duly made. It shall be the privilege of the consumer to be 24 present at the Water Department shops and witness such test. 25 If the test discloses an error against the consumer of more 26 than three (3) per cent on the meterts registry, the excess 27 of the consumption on the three (3) previous readings shall 28 23 (To be used for all Ordinances except Emergency.) be credited to the consumer's meter account No meter shall be removed, or in any way disturbed, nor the seal broken, except in the presence or under the direction of the Superintendent. Section 8. That imposition of the rates and charges hereinabove set forth as of January 1, 1975 and any other act pursuant to the authority and prior to the effective date of this ordinance are hereby ratified and confirmed.
