HomeMy WebLinkAbout04/30/1987 Adjourned Meeting • 51 APRIL 30, 1987 " ' '• ADJOURNED MEETING TO CONSIDER PROPOSED'CHANGES` '- TD THE YAKIMA AREA ZONING ORDINANCE • The City•Council met in session'on this date at 7:00 , p.m..in the Council Chambers bf City Hall, Yakima, Washington, in1a"joint public hearing with- the County Commissioners to review the proposed amendments to the Urban Area Zoning Ordinance March 4, 1986. County Commissioner Klarich called' "the meeting to " for' the County'-Commissioners indicating Commissioners Chuck - Klarich, Graham Tollefson,. and Jim Whiteside present; along with Assistant Director-of the County Planning Department, Mark Hinthorne, and Terry Austin from the Prosecuting Attorney's office. Mayor Henry Beauchamp called the meeting to order for the-City Council noting that Council members Clarence ' Barnett,- Lynn Buchanan and Jerry Foy were in'attendance.`City Manager Dick Zais, City' Attorney John Vanek,' Community-'& Economic Development Director Glenn Rice, Supervising Associate Planner Don'Skone and Deputy City Barbara Toney were also present. Commissioner " Klarich stated the "purpose of this.,meeting is, to consider adoption of proposed text amendments. \ to,the; Yakima =Urban Zoning"•Ordinance. Commissioner Klarich stated lit is•his. understanding that a "couple of amendments in the ordinance need further' study, therefore, Council member Barnett was recognized to •remove these items from the , agenda. Council member Barnett asked staff to,conf,irm that the • subjects relating''to "Bed and "`Breakfasts," 'and "Schools" are currently before the Regional Planning Commission for review. This was confirmed by Don Skone, therefore','it was MOVED'by Barnett, seconded'by Foy,'that Item #2, that - is on"the•first white'page of the handout,` which is'labeled Item • . 2. ,Page 6: a) "Bed and Breakfast" •and -Item " #8 Off the next page which refers to Page 18: a) on" "Schools" and Item #12 which is on the fourth white page, - a) - and b) 'on "Permitted Land' "Uses as it "relates to Schools and Vocational Schools, be removed - from the discussion. The question was called for a "vote on the motion by the City Council. Unanimously - carried by voice vote'. "Berndt;' Carmichael and Sims absent.) It= was MOVED - by Whiteside; seconded by Tollefson;'that these 'items ommitted from the • discussion this "evening, with Klarich concurring. ' ,,, ' Commissioner Klarich` requested that staff `.proceed with a brief presentation with the canission'of the items just removed from the agenda. Due to the • fact ' that there' are only two citizens in the audience' who were "familiar with the proposed amendments, Mr. Hinthorne asked if the Commissioners' and Council members would like staff to proceed'or forego that staff '`'report. It was the ' general' "consensus ' •to cask for public testimony rather than'listen' to 'a presentation -'of the staff report. Therefore, Commissioner 'Klarich asked that anyone present wishing to speak to any 'of the —proposed. amendments ' or- ' any ''other item,' .• step to the _ microphone* at= this time. Barbara Harris, 1911 W.'•Yakima Avenue, questioned what is•go`ing to happen with-R -2 duplexes in the R -1 zone. Council member Barnett stated the Regional Planning Commission' (RPC) 'will be discu"ss'ing that matter and forwarding a recommendation to the "Council mem ' and Coiianissioners. Don Skone added that -the Regional{ Planning Commission - met in study session this month and currently is in the process of reviewing all of the decisions that have been' Made by `the .Examiner, 'related to duplexes in an R -1 zone, both inside the City and in the County. He stated as `soon as'the RPC reaches a consensus and a'public hearing' is scheduled,` Mrs': • will be notified: - -- Council 'member Barnett directed attention to'page 6-'.under Single Wide manufactured homes' 1,`` `stating ' the word "or " has been deleted and now • semicolan and the word "and" appears. He questioned if all three; of the criteria must apply. He then referred page 7 under Multi -wide manufactured -homesr'under'A''Class use the - text appears with semi colons. He asked- how' this is'to be interpreted. Mr. Hinthorne suggested amending the text so that b) ' on page ,6 reads' then same' as c) on page .7 'with semicolons. He "stated the'intent was in any of those three situations a single wide manufactured' home would be a''Class 1 use.' It was MOVED by Barnett; seconded Foy, to remove the word - "and" • frcan the text on page six APRIL 30, 1987 52 • ADJOURNED MEETING TO CONSIDER PROPOSED CHANGES TO THE YAKIMA AREA ZONING ORDINANCE under 15. #1., after the word "parks" and after the word "subdivisions." Unanimously carried by voice vote. Berndt, Carmichael and Sims absent. Under discussion, Commissioner Tollefson asked staff to explain the rationale for this. Council member Barnett explained that on page 6, it is his interpretation that all three of the criteria must be met, whereas on page seven, only one of the three criteria must be met. He stated he feels the intent is to be consistent, therefore, he had . requested clarification from staff. Council member Barnett referred to page 8, . Subsection. c) Siding Materials and then to page 3, of ,a letter written to Mayor -Johnm Hodkinson ` on January 21, 1987, in which the last, sentence of the paragraph reads, "this, amendment would provide the opportunity to locate manufactured homes with -a flat roof -and. aluminum siding in the SR District." He questioned why aluminum.siding cannot be within the normal definition of siding - materials. Mr. Hinthorne stated the actual text change that paragraph in Mr. Hodkinson's-letter refers to is on page 7, 15. •a) as reference as a lead -in statement to that subsequent paragraph. Responding to Council member Barnett's question, criteria was developed and included regarding the type -of siding to be used for siding manufactured homes. He explained. that this criteria addresses the most common complaints regarding placement of manufactured homes into a neighborhood with -that being the fact that they do not look like stick built homes The three most common complaints are: a) slope of the roof, .b) the composition of the roof :and. c) the: aluminum siding. He stated a homer:may. have aluminum siding, but typically in terms of width, design and character it looks much like wood siding, whereas manufactured homes, especially the, older ones, are more -of a corrugated aluminum that may have vertical ,rows and columns rather than horizontalas you see on a normal house. Council member Barnett referred to page. 11 and commented on the: definition of "gross-4-floor area" stating, he personally feels elevator shafts and stairways should be excluded from gross floor area, and secondly, the last portion of the definition that has been deleted - should be included in the definition., The deleted portion reads as follows: "and .basements if the ceiling is less than six feet above the basement floor." He asked staff to comment on. why elevator shafts and stairways should be included in the definition gross floor•,area as it relates -.to this subject. Don Skone stated the general intent and purpose is to try to determine, by floor area, what the parking demand of the facility is. going to be. He stated the portion of the sentence that has been istricken is more specifically addressed at the top of page 12. This criteria is intended to prevent the use of storage spaces with less than 6 feet ceilings to be used as dwelling space. It was MOVED by Barnett, seconded by Foy, that. stairways and elevator shafts be removed from the inclusion of gross floor area and be under the area of exclusion. Unanimously carried by voice vote. Berndt, Carmichael and Sims absent. Council member-Foy referred to page 12 wherein staff has added parking standards for community centers, meeting halls and fraternal ,organizations in Table 6 -1: "One space for each five (5).f•ixed seats or 54 inches of bench seating -.plus ,open space for every 40 square -feet of assembly or moveable seat area" and questioned if any of the organizations to be affected by this requirement have been contacted. Mr. Skone stated they have not. He explained that he discussed this matter, with the Code Manager and was informed that the parking requirements currently used for .churches are also used for fraternal organizations,, - community centers, meeting halls, etc. Council members Barnett and Foy expressed concern that staff did not seek public input on this matter prior to proposing this amendment. Mr. Hinthorne stated the ordinance does allow for parking standards to be adjusted by the administrative official with a Class (2) review. . Council member Foy referred to page 17 which outlines additional requirements for developments and asked local developer Lou. Alderman if the addition of Numbers 11 -15 will cause any additional problems for local developers. Mr. Alderman stated in some cases it could present same problems in the future. He went on to relate an .instance where a developer would have been required to develop streets on three sides of a 2 1/2- - acre parcel for a multi - family -unit, - however, the property was finally sold and is to be used for a single family residence. As a point of clarification, .Mr. Hinthorne stated this section is a correlary to the amendment to the bottom of page 15 where staff- is proposing to delete the private road standards from the zoning ordinance and place them under the subdivision ordinance where they are more appropriately found. It-is the intent that the administrative official • APRIL 30, 1987 53 ADJOURNED MEETING TO CONSIDER PROPOSED CHANGES TO THE YAKIMA AREA ZONING ORDINANCE may have the authority to require some of the additional criteria. • Following discussion, it was MOVED by Foy, seconded by Whiteside, to remove Items Numbers 11 through 15 of Item; 36 and have staff remand it to the Regional ,Planning Commission for review. Unanimously carried by voice vote. Berndt, Carmichael and Sims absent. There being no further business to come before this body, it was'MOVED -by Buchanan, seconded by Barnett, to continue this meeting to May 19, 1987 at 2:00 p.m.. in the Council Chambers of City Hall.
