Mayor Henry - Beauchamp, 'presiding,:Council members Clarence Barnett, Pat Berndt, Lyrin Buchanan, Lynn Carmichael'and Bernard Sims present on'roll call. ' City Manager Zais, City Attorney Vanek, and Acting ' City 'Clerk Toney present.'' 'Council member Foy absent and excused : - '' - 2. INVOCATION ' The'Invocation'waS by Council member Pat Berndt. 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER •' Council` member' commented he noticed the Regional Planning Commission (RPC) is scheduled" to meet on April' , 23, 1987.. to discuss • three subjects listed' as' additional 1987 text'amendmerits - the Urban Area Zoning Ordinance. 'He if "duplication or are' these additional amendments that might'.confl•ict with the public hearing 'scheduled` for April 19th. Director ' of ' Community & ( Economic Development' Glenn' Rice' ` 'stated this 'meeting will ''consist of discussion of' the' 'build'ing . height in R -I ' zoning. 'Mr. Rice stated if ' Council wishes `tb make other changes,' those- additional items can be continued and'discussed at a later time. Mayor Beauchamp read ' and' presented a 'proclariiation to Kay Pfaff . - 'proclaiming April 19th -25th "National Consumer Week."' ' Mayor Beauchamp read'and presented a proclamation to Diane' Lewis proclaiming April 19th -25th "Better Business Week:" Mayor Beauchamp'read and presented a proclamation to Ray Stenberg, of . Washington Time Fiddlers Union, proclaiming 'April 26th -May 2nd "Old Time Fiddlers Week." 4. CONSENT 'AGENDA' Mayor Beauchamp refer, toy the items placed on the Consent - Agenda, questioning whether,there were any additions or deletions from`either) Council members -'or citizens present. There being none, the' Acting/ City Clerk then read the Consent Agenda items, including resolutiond\, and ordinances by title. It` was MOVED' by 'Buchanan, seconded by - Carmichael, that the Consent Agenda, as 'read, be passed: Unanimously carried by', roll ca vote: absent. (Subsequent paragraphs preceded by an asterisk ( *) ' • indicate items 'on -the ' Consent Agenda handled under one motion without further discussion.) ' 5. SPECIAL VIDEO PRESENTATION BY SMALL BUSINESS REGIONAL CONFERENCE Bud Synoground gave a brief report to City Council regarding the ' inception of the Small Busi Conference, after'which a • promotional video' was viewed. Mr. Synoground stated in'August of 1986, thirty -three small business loperatorS froth the state of Washington traveled to 'Washington D.C.. to attend the 'White House Conference ''on Small' Business where they me-t with 1,833 'other representatives of Small Business in an' effort to -reduce an agenda of 485 items' to ' 60 items to ` be - presented . `to legislators and' the President o the United'States. Out'of that session, the decision was made to create' a Small - Business Conference -for small ' businesses - in the state '' of Washington. Upon returning - to Washington ' State, a group'of small :business•'representatives'met in September and October and Small Business Corporation was- formed in - December of 1986. Twelve Regional Conferences have been�established with '.the first conference scheduled.for April 29,' 1987 to b in Richland. He ,encouraged Council members to attend the`conference'scheduied for May • 42 APRIL 21, 1987 29th in Yakima. Mr. Synoground stated Governor Booth Gardner signed a bill which mandates the Small Business Corporation furnish him with their findings in December. At that time a list of 60 recommendations will again be presented for consideration. Testimony will be given before the House and the Senate in January and February of 1988 presenting these ideas as to the needs of Small Business in the State of Washington. Mr. Synoground distributed a list. of the dates and places of the twelve conferences and the Statewide Conference in October,, as .well . as .the - agenda, . for, . the.. Regional Conference. A ,video presentation followed which explained the history of the,.Conference; how .it functions, and what' it.hopes to accomplish for the State of, Washington. Mr..Synoground responded to inquiries from.,City Council members, following the, video presentation. He stated he recently. learned that 100% of the new, jobs _created in Washington in the last two years were created by Small Business, and 85% of those came from employers who have less than 20 employees. Mayor Beauchamp thanked Mr. Synoground for his presentation before Council today. ,No formal action was•required regarding this.Item. 6. AUDIENCE PARTICIPATION Larry Mathews, 805 South 17th Avenue, addressed., the City Council suggesting a change in the Municipal Code regarding Pit Bull Terriers. He read an, article from the Seattle. P I giving an account of a .small boy who had been attacked and severely injured by. a Pit Bull - Terrier.. in Forks, Washington. .Mr. Mathews suggested the following language be added to the Municipal Code. under- Section 6.20.030: "By definition of the City Council, a Pit Bull Terrier is deemed:a-vicious dog,,and.shall not be kept,. harbored or maintained within the,City.limits of Yakima for -.the protection and.safety of the public." Mr. Mathews also requested the following.. information be included in the "Be a Good Dog Neighbor" brochure distributed by City Animal ; Control Officers: "Any -such dog or-.animal .is declared to be a nuisance and may be seized and impounded,as provided in this chapter. For the purposes of this section, no action may be taken for a violation hereof except upon the written,complaint of at least three persons residing . in separate. residences within the immediate neighborhood." Mr. Mathews stated this inclusion would educate ,citizens as to the appropriate action required to file_a- complaint regarding a frequent or habitual,_ howling, yelping or. barking.dog. Regarding another matter, Mr. Mathews displayed a robin that had been shot with a dart blow gun by neighborhood youths. He urged Council to ban the sale of such lethal weapons ii\ the, City of Yakima. It was the consensus .of -the City Council to request - that staff analyze " -the issues presented by .Mr.;. Mathews and .submit, a report. back to Council. . At this time, Cecil Collins, Executive Director of the. Southeast Community Center, presented the Acting City .Clerk with a copy of -the .December 1986 and 1985 Financial Statements for the Southeast Yakima- Corrmunity.At Work, Inc., and requested the report be made a part of the public record. 7. CONSIDERATION OF REQUEST FROM YAKIMA SUNFAIR FESTIVAL ASSOCIATION FOR USE OF ROOM TAX FOR FLOAT FOR SUNFAIR PARADE • Director of Community &,.Economic,Development Glenn Rice, introduced this item,.;stating- the Sunfair Festival Association is requesting . $12,865 to be used for.the construction of the, Sunfair Float. He also-pointed out,- that Yakima Sunfair .Festival..Association is a • • _ separate entity from .,the Yakima Convention Center.. ..Mr.. Rice • explained if .the funds are approved by Council today, the money will be. taken from the. Yakima Convention Center's. Hotel /Motel Room Tax. Mr. Rice ,and Accounting Manager Bob Wheeler responded to Council member Barnett's inquiries regarding the.1987 Budget for the Yakima Convention ,Center. Barbara Thompson, Executive Director, of the Yakima Sunfair Association, was present .to ,speak. to Council regarding this request for funds. .She introduced the following members of the Sundusters: Verna Messer, Dan Fortier, Fred Iraola, Kirk Gilday, Mary Lou,-Wainright, ,Fred Smith, Herb Stark and Pat Berndt. Ms. Thanpson pointed out that this is.a new organization • • 43 APRIL 21, 1987 operating under the umbrella of the Yakima'Convention Center and this request for funds is a one time request.'She distributed' pictures of the new three piece float unit for which the funds are being requested :' - MS.. Thompson indicated the members, of the :Yakima Center Advisory Commission -are aware'of this request and have expressed their support. Fred Iraola and Kirk Gilday, members' of:the Yakima Sunfair Festival Association, also addressed Council on behalf of this request and encouraged Council to approve the $12,865 to be used as outlined in the report. Mr. Gilday stated since September of 1986 the Sundusters have raised over $17,000 to be•used for the: Sunfair Float and related expenses. Council member Barnett voiced concern about the approval of such funds for the; Sunfair Float stating, the City owns the Yakima 'Convention Center which' currently has a shortfall of $82',000 in-the'depreciation =•reservefund. Mr. Barnett stated!_he has not seen any plan'from the•Yakima. Convention Center • : regarding funding*.the depreciation shortfall, -•nor• has , he •'seen a long '"range Capital Improvement Program which might haveto use some'of the - funnds being requested. Council member' Carmichael. reminded -_Council that-' it. -was the" Hotel %Motel tax which is used; to generate the reserves and was also the financial vehicle used • to generate funding torbui'ld the' Yakima' Convention Center. She stated the use these funds for community relations and 'Promotional -• programs is • legitimate. She stated if the City does not enhance the Sunfair Festival through this type •of participation, the City' will;not.be able t� attract tourists to this community and therefore, will not be able" • to ' bring those tax dollars back :into the City. Mayor. Beauchamp supported request and- .encouraged •;fellow Council members to 'approve the •:request for funding. He •stated , he views - this as an appropriate investment -and h a means of generating , - trade in ; the community. Following further discussion on the manner in which the funds were solicited, it was MOVED by Berndt, seconded by Carmichael, to grant the request from the Sunfair Festival Association: , Motion - carried .by 4- 2 - _voice _vote. Barnett and Sims voting nay. Foy absent. Council member Barnett'requested the record show that he is' not against the Sunfair Parade or the Sunfair Festival Association'f.but without.a Capital Improvement Program from .tne Yakima ,ConVentiph _Center' ors .any plan for funding the depreciation shortfall, he could not vote in favor of the motion. 8. CONSIDERATION OF RESOLUTIONS AUTHORIZING EXECUTION OF AGREEMENTS WITH .CITY. OF _ UNION; GAP FOR UTILITIES 'SERVICES Director of CUnu &` ` Economic Development Glenn Rice stated _:, detailed_ . document , represents more than two .years ` o f , work ,with,'the City of Union'Gap and the' Yakima City Council.. A brief discussion ensued wherein Glenn Rice, Associate Planner Larry Lehman and Mayor John Hodkinson of Union Gap, responded to Council's inquiries. Resolution No. D -5346 having' been read by title, as requested by • Council member Barnett, it was MOVED, by Barnett, seconded by Buchanan, that the resolution, as read, be adopted. Unanimously carried by roll call vote. Foy absent. RESOLUTION D -5346, A RESOLUTION authorizing the City Manager and the City Clerk to. execute a Water Service Agreement with the City of Union Gap. - The resolution relating to the Sewer Service Agreement having been read by title, it was MOVED by Berndt, seconded by Sims, that the resolution, as read, be adopted. Unanimously carried by roll call vote. Foy absent. RESOLUTION D -5347, A RESOLUTION authorizing the City Manager and City Clerk to execute an agreement for the sale of the South Broadway Sewer Interceptor to the City of Union Gap. *9. APPROVAL OF MARCH TREASURY REPORT (STANDARD MOTION V -A — ACCEPT AND APPROVE REPORT) The report from the Director of Finance and Budget dated April 21, • 1987 regarding the investments of the City of Yakima, was accepted and approved. . 44 APRIL 21, 1987 *10. APPROVAL OF OUT -OF -STATE TRAVEL FOR MIKE MEYER,- FIRE DEPARTMENT, TO MISSOULA, MONTANA The Out -of State Travel for Mike Meyer, Fire Department, to attend the 1987• Western States Crime Seminar, in-Missoula, Montana; May 3 -6, 1987, at a cost of $285 was approved.. - 11. OTHER-BUSINESS • Information Items Items of information supplied to Council were Agenda for April 20, 1987 Special Parks and Recreation Commission meeting and memo from Director of Public Works - regarding 1988 -1993 Parks. and Recreation Capital Improvement Program; Agenda for April 12, 1987 Yakima Hearing Examiner meeting and, memorandum from - Director of Community =& Economic Development regarding Quarterly Report for Hearing.Examiner Services, 4/15/87; Agenda for. April 13, 1987 Parks and Recreation Commission meeting and minutes of 'its 16, 1987 meeting; 1987= Community Development Block Grant Monthly Report, for March 1987 and Minutes of the March 31, March 11, and February 24, 1987 Yakima Constitution Bicentennial Committee Meetings. 12. EXECUTIVE SESSION REGARDING COLLECTIVE BARGAINING It was•MOVED,by Berndt, seconded by Buchanan, to move into Executive Session for the purpose of discussing collective bargaining for approximately 30 minutes, and. then immediately adjourn thereafter. Unanimously carried by voice vote. Foy absent. 13.
