ROLL CALL . • .The City Council .met in session on this date at 2:00 P.M. in the • Council Chambers of City Hall,_ Yakima, Washington. Mayor Henry Beauchamp, presiding, Council members Clarence Barnett, Pat Berndt, Lynn Buchanan, Lynn Carmichael, Jerry Foy and Bernard Sims 'present on roll :call. City..Manager .Zais, Acting City Attorney Vanek, City Clerk Roberts and Deputy City Clerk-Toney also present: 2. ;INVOCATION The .Invocation was given by. Reverend •Joe T. Denman. . 3,, OPEN DISCUSSION FOR THE GOOD OF THE ORDER . • Council member Carmichael stated she has some recommendations for the vacancies on the-Downtown Area Redevelopment Committee (DARC) • .which meets. quarterly. She explained that one of the requirements .for . serving .on this Committee is that the person must represent a specific quadrant of the downtown area.., She stated she would like to make the following recommendations in the form of a motion, and • • will indicate which quadrant each .applicant represents. She stated in. Quadrant 1, Herb -_ Hill would like to "be reappointed as his term expired -last month.JA new applicant, Steve Smith of S.O. Hawkes, wishes. to be appointed from Quadrant L and there are two vacancies . there. In _Quadrant 2,, new applicants Roberta McDonnell of the Flower Shop and Pat Gilmore of Dunbar Jewelers, would like to be appointed. -In' Quadrant 1, incumbent .Joe Morrier wishes to be reappointed. In Quadrant 4, incumbent.Maxine Moore wishes to be reappointed, and a new applicant for the second position is John Weile;.Manager of the Chinook Tower and the Larson Building. The banking institution has , a representative,on this.. Committee and we • have +a•..new applicant, Don Sinsel from Seafirst. Representing private utility is incumbent. Bill Parrett, District Manager for Pacific Power- & • Light, and: the At -Large Position, Lee Semon was filling the vacancy in Quadrant 1, but wishes to change and assume the At -Large position.) It .was the-. general consensus of the Council to add Item•No. 11 to the Consent Agenda, • as requested: The City Clerk then read the. APPROVAL OF MINUTES OF THE COUNCIL MEETINGS OF FEBRUARY•10 1 7, AND 24, AND MARCH 3, 1987 - • The Council minutes of February 10, 17, and 24, and March 3, 1987 • were approved, - having certified accurate by two .Council members and no one present wishing' to :have said minutes read publicly. - - - • B -1 /1 24 MARCH 24, 1987 6. AUDIENCE PARTICIPATION None 7. HEARING ON THE 1987 IRRIGATION MAINTENANCE ASSESSMENT ROLL (SEE ORDINANCE CONFIRMING ASSESSMENT ROLL) This being the time set for the hearing on the 1987 Irrigation Maintenance Assessment Roll, Mayor Beauchamp opened the hearing and asked staff to make their presentation. Ty .Wick, Water Division Superintendent, stated staff received a memorandum from Council member Barnett, Monday, expressing concerns regarding certain assessments.' Having •discussed these concerns with Mr. Barnett, Mr. Wick stated it is staff's decision to uphold their original recommendations. Regarding District #857, Mr. Wick explained this district is experiencing some problems and, as a result, there may be some additional unknown costs. He stated Mr. Barnett has agreed staff will likely not be making recommendations at this time. Council member Barnett stated he feels'the problem that has arisen with District #857 should be indicated for the record. Mr. Wick explained there is a question concerning the Adams pipeline which serves water to that system. He stated the Adams pipeline has been providing the service of carrying the water from the Naches - Cowiche Canal Company to the City's box where the water is then distributed to the City's users. The City has been paying approximately $50 a year for this service, while area residents contribute to the maintenance. There is apparently no ownership other than the group of people who take water from that system. He stated staff is attempting to ascertain the necessary action by the City to ensure a supply of water, and at this time it is unclear whether the City will have to assume the maintenance ' and operation of that system, or perhaps utilize another source. Mayor Beauchamp asked that citizens wishing to speak to this issue address Council at this time. John Klingele, 1312 West Walnut, commented he is pleased tb see the report contains information unavailable in previous years, that rates of increase are and the monetary position' within each district is improving. Mr. Klingele stated'he would` like to know the amount• of money paid to Pacific Power & Light and the canal canpanies for pumping services, adding it might be more cost effective for the City to take over some of the canal companies as we have a large interest in them. Don Mitchum, 608 South 3rd Street, stated he acquired his property in the early 1970's when the irrigation maintenance was $9.00 per year and now it is four times that amount and his income has not kept pace with this type of increase. Mr. Mitchum stated it is his understanding he would be required to pay this assessment even if he were to gravel his ' property. He stated he feels there is a need for a little fine tuning in this area. Council member Barnett commented it would be helpful if Mr. Mitchum would meet with Ty Wick and Rita Germunson to identify his district so they could advise him as -to the needed repairs for 1987. Carol Joan Watkins, 809 North Naches, District #308, questioned why she.is being billed for irrigation maintenance assessment when she has not had irrigation water for the past two years. Mrs. Watkins indicated she had replaced the old irrigation pipe last year, and has also had the lines flushed, but still has no water pressure. Council member Foy stated there was no increase scheduled for District 308 this year, and suggested Mrs. Watkins meet with Ty Wick as it appears she may have a service problem. ' Pauline Prescott, 224 North 38th Avenue, Winterhaven Co-op Court, District #822, stated last year's rate was $73.39 and questioned the reason for this year's rate of $108.25. Council member Barnett responded in 1985 and 1986 her rate was .0040 and this year it is .0059. He explained District #822 did not have any main repairs, however, they did have a number of service calls. He stated the .0059 per square foot is the rate staff feels will offset the B -1/2 • 25 MARCH • 2,4, ' 1987 • anticipated expenditures' which are directly related to ;an increase in the canal company rates. ,Caroline= _Bryan, 609 South 26th Avenue, District #556; stated her - assessment - •is $25:88 for 5750 square feet. She then readia letter of protest' whichwas later presented :to City - Clerk) Roberts. Mrs. Bryan stated An 1981 they spent $3,000 to pave:a portion their ' :property for parking purposes, leaving only a 3 1 /2"foot strip .requiring water. She • commented' if the irrigation water was • billed. according to _usage there would be a lot less problems. She indicated she •:waters by •hand and never allows water to run unattended. Mrs,' Bryan stated 'the City needs to replace all; of the old pipes. Council member Foy explained to•'Mrs. Bryan that she is apart of-:a subdistrict under District #534, and that entire district,_'including District #538, #556 #579 is proposed for a 2.17 decrease. He further pointed out that the increase is • attributed to a rate increase imposed by the•irrigation canpany for :delivery of the water rather than an increase imposed by the City -of•Yakima. Mrs. 'Bryan stated she had misunderstood the'.`notice as she thought their irrigation assessment being-increased the -City of Y a k i m a - :, Steve Emhoff, 1703 West Yakima Avenue,•District #758, stated he is one of 10 households on his particular system, and assessment -has increased 62% this .year. He indicated there havei been some • - problems with the pump on this system, in that he' has had water 12 outof 14 days. Mr. Emhoffvstated he does not 'object to paying - the assessment, however, would'like to'see the problem resolved on a more permanent basis so the users will the service for which they are being-assessed, f• • 'There being no other citizens to address 'Council 'regarding the 1987 Irrigation Maintenance Assessment' Roll, Mayor Beauchamp closed the public hearing. Council member Barnett' stated before voting on the ordinance he would like to make a recommendation to reduce_ three of the districts. He stated prior to .today's meeting he sent out a memorandum recommending-•reductions • in , districts; However, view of the additional ":information supplied by Ty Wick, he offered the following It' - was MOVED 'by 'Barnett, seconded: by `Foy, that , District' #529 be reduced from • :0067• to .0049,'District #601 be reduced from .0082 to .'0055 and •District #622 be.-reduced from .0106 to .0073, for reasons stated in -my memorandum: 'Council member • Carmichael stated she' has no •.objection to the motion, .but_asked.•.for procedural clarification. Council-member Barnett 'questioned: if the-assessment should be • amended - prior to the passage-of Acting City - Attorney ' Vanek responded affirmatively. Unanimously - carried by •roll ^call .vote.•iCounctl member Barnett- last year Council discussed: the current; philosophy • of a four month basic minimum - cash reserve - and was in general :agreement that the cash reserve gradually increased. Therefore, it was MOVED by Barnett, seconded - by Buchanan,'that the philosophy on the cash reserve be •increased to •six months. Unanimously carried by voice vote. - .. ORDINANCE NO. NOTICE OF '-'INTENT TO COMMENCE ANNEXATION OF PROPERTY" KNOWN AS • EASTSIDE ANNEXATION AREA (STANDARD:MOTIONS'FI -A & B) AssociaterPlanner Don Skone responded' to Council member Barnett's inquiries regarding - the annexation procedure: for this' issue. Following a brief discussion, it was MOVED by: Barnett, :seconded by Foy, .that March-24, be set as then time -for a meeting'with the • . , initiating , parties- - who . signed the Notice - of -- •Intention to 'Commence • B -1/3 • • 26 MARCH 24, 1987 Annexation- Preceedings dated March 11th and 12th, 1987, those initiating parties being Robert ._Hall, Robert Lynch and Michael Murphy. Director of Community & Economic Development Glenn Rice stated the parties initiating the annexation are present at today's Council meeting ,to , request that the City proceed with the annexation process. He stated staff is in the process of gathering the information requested by Council on February 17, 1987, regarding the impact this annexation will. have on the City's water /sewer plan and six -year street plan.. Mr. Rice related to Council a recommendation made by the County Commissioners earlier in the day to •exclude the area west of South 18th Street (Fairview) and north of Nob Hill Boulevard, thus leaving inside the unincorporated area the portion that is the county shops and the other private residences at the northeast quadrant of the intersection of 18th Street and Nob -Hill Boulevard. Council • member Carmichael questioned if this action would leave that area • without fire protection. Mr. Rice stated this is an issue that can be discussed later, and suggested Council accept the annexation petition as presented. The question was called for a vote 'on the motion. Unanimously carried by voice vote. Council member Barnett requested to hear from the initiating parties at this time. Rob Lynch, Vice President of Lynch Motor Company, and Jack Thomas, representing Bob Hall of 'Sunfair Chevrolet, addressed Council requesting. the City proceed with the annexation. It was MOVED by Carmichael, seconded by Buchanan, that the annexation proposed by Robert Hall, Robert Lynch and Michael Murphy, be accepted by the City of Yakima and that the area to be annexed be required to assume its share of the City's existing indebtedness, and that a Notice of Intention to Annex be filed with the Yakima County Boundary Review Board. Unanimously carried by voice vote. 9. CONSIDERATION OF RECOMMENDATION FROM THE - PARKS AND RECREATION COMMISSION REGARDING PROPOSED CLOSURE OF WASHINGTON AND FRANKLIN POOLS . • • Mayor Beauchamp acknowledged the receipt of many letters and phone ..calls regarding this issue. He stated this is the first time Council has had an opportunity to consider the Parks &• Recreation Commission's recommendation to close .Washington and Franklin Pools, and hopefully a determination will be made-today on the course of action to be taken. It was MOVED by Foy, seconded by :Barnett, that Washington and Franklin Pools to be operated, as funded in the 1987 budget with a supplement for repairs at Washington during, the calendar year or swim year 1987. Council member Carmichael asked Mr. Foy to clarify the motion with regard to the source'of funding for the repairs to Washington Pool. Mr. Foy explained that the 1987 budget allocates funding for the operation. of Washington and Franklin Pools, however, it does not include any additional funds for the identification and resolution of, the repairs at Washington Pool. He stated Council would have to authorize' supplemental funds for the repair of the broken line at Washington .Pool. Council member•Carmichael stated she would like to see an amendment to the motion specifying the source of funding, however, identification of the funds does not have to occur today. She suggested Community Development Block Grant Funds as a possible source of funding as Washington Pool is in the target area. Council member Foy Stated it is the responsibility of staff to return to Council with funding sources for Council's consideration and approval. Mr. Foy stated following discussion of the motion, he intends to offer a second motion regarding the issue. Council member Barnett commented the cost of repairing the leak is unknown, therefore,. staff may have to provide a number of alternatives depending upon the total cost. The question was. called for a vote on the motion. Unanimously carried by voice vote. Council member Buchanan commented given the amount of community interest generated on this issue, staff should begin immediately to identify funding sources for Washington and Franklin Pools. Council member Berndt •commented this is a much broader issue than just swimming pools and should be approached from the aspect of making the parks an attractive and functional part of the City. Council member Buchanan was in agreement, adding the,City must. develop a financing program for the entire park system. Council member Carmichael B -1/4 27 MARCH 24, 1987 spoke of. the community's ,responsibility to encourage .youth to utilize the,pools and city parks on a m o r e regular basis. Council member Barnett echoed Mrs, Carmichael's sentiments,I noting the attendance at Lions Pool has increased while the attendance at the outdoor pools- has decreased. It was MOVED by Foy, "seconded by Sims, that a long range park renovation program be developed by the Parks and Recreation Board for appropriate legislation. of the bond issue to be placed on the November elections.. Mr. Foy encouraged the Parks & Recreation Commission to work with interested citizens t - ...to develop. a. long, range plan which would include the bond issue. Council member ,_Carmichael asked if Mr. Foy and Mr. Sims would consider splitting the question as the_ motion speaks of two separate issues; the- bond issue and the long :range plan. Mrs. .Carmichael, explained that the .Parks & Recreation Commission has been working on a long range plan for: some time now,. but has not _, had the opportunity to complete. it. She stated the commitment to place. a bond issue on the ballot this fall seems irresponsible , without-having the criteria for that bond issue. Council member Foy clarified his motion, stating he is asking that the issue be referred back to the Parks & - Recreation.Comnission, so they can .,bring ,in.:.a responsible long range .plan and a bond issue to finance • it, .to be. presented to the voters in the-fall. .Council member • Carmichael requested to have the motion re - read to, clarify it's intent. The replayed from the tape recorder as follows: "I'd like to move that a long range. park renovation : program be developed by, the.. Parks and Recreation. Board for appropriate . • .legislation of .the bond issue to be placed on the November • elections :" Discussion continued on,-the. intent of ,the -motion. Council member. Sims suggested instead of coming back with a bond issue, • the -- :motion be modified recommending. that _the .Parks & Recreation Commission submit a financial plan which.would -be used . , . as a basis. for ,a recommendation for., a bond _issue, Mr. Sims stated he would_ withdraw his second: to the- motion- if Mr. .Foy: would like • to ,- restate.: it -. • Mr. Foy stated he will accept the change in wording. Council, member Buchanan spoke of the•difference between . bond issues and - financing or- funding. for.the year, stating, "we are talking about apples and . oranges. "; • He said it would- not be difficult, pass..a bond issue, however, before constructing new .pools, soccer fields,< or.- baseball fields, a good sound financial program: must_.be developed for - maintenance and operation. Council member Sims stated •he believes Mr. Foy recommendation was for the :,Parks ; .and - .Recreation Commission to submit a Jinancial plan that,will- .reduce the .ongoing maintenance costs and replace that with., a, .capital project, for-example an underground. sprinkler system that would ,allow, a reduction. of..cost -.in the .maintenance area. • . , Mayor Beauchamp ..stated, he is hopeful that - .the. Parks-.& .Recreation Commission will, submit a plan with; a ,funding recommendation that could include, a. bond issue•and other funding options., Council member.Barnett stated whatever financial plan comes back,.he hopes due- consideration. -is given- -.to the senior citizens and .those who have lesser incomes, and their .ability to-pay-on any financial plan. Bill James,, 21.4 South, 25th Avenue, -asked Mayor Beauchamp to :clarify the . ,decision : made;. - .by.. Council today. :Mayor ; Beauchamp.- responded the :Washington and Franklin pools will be operating as usual this • - summer, and .a plan ,-will be- .developed to improve-the :City's parks and swimming pools on a.. long range basis.,, : Nancy Faller, 2207 . Barge,: .representing Washington .Fair, Share, presented a petition,with signatures and letters the pool issue • to the City Clerk, and thanked - ,Council for the action just taken. Mrs.,. Faller--stated Yakima. Fair Share would like to see a citizens task force formed to research the financial constraints and the community- needs. She indicated there -are several • organizations ,that have offered.; to spearhead a.task force-and several individuals . have indicated .a willingness to serve. on such a committee. Denman, "814' Central Avenue, stated `he is to report 'the action taken by Council today to the Association'of Minister's and the •'Evangelicals and asked for clarification' of 'this: Mayor 'Beauchamp stated Washington and Franklin' pools will open this summer as usual,.and a long'range plan is •to be developed for 'the City's parks address current future needs'and concerns. Frances K. 'Corday, 405 South 47th Avenue, encouraged Council keep the pools open' to allow young' people 'the `opportunity to'learn'to -swim in a, safe place rather than' in gravel pits situated around the valley. '"He `comMehted if the pools are closed the young people `will be on the streets getting into mischief and this will result in additional'expend'itures for the police department. Council member • Barnett 'commented that all five pools were open last year and there was a' reduction` of - 19 o in the 'Learn- to-Swim' Program. Mr." Corday stated the economy could have been a contributing factor`last year arid' perhaps the fees were too'high. Mayor Beauchamp responded to -the `canthents ' made concerning' the declining • utilization of the pools, - stating he believes the reason for this is that the City does not have 'a parks and recreation •program'to address these =issues. •He feels - a program needs to be developed to facilitate involving youth in the Learn- to-Swim Progratti. Mike Nixon,- - "207 North 27th Avenue,• Chairman of the Parks & 'Recreation Commission, stated 'the Commission submitted a -reconmehdation which they felt a responsible decision on.their part, however, he is grateful that Council has chosen to do otherwise. Re the 'Commissionis in of recreational programs in the'City and has 'worked hard in the past to'keep'the pools open and will'continue to do 'so in the future.` Ray Honore, 514 South 4th Street, stated he is pleased with the' decision to - keep the' pools `open and' to develop ' a - long •'range - plan;' however, would` like to take "'issue ' with the ' figures presented in'the report. He referred to the figure of 8% of revenue fran'Washington Pool last year, commenting the pool did not open until - the'middle of July due to 'repairs' being made. He questioned how soon the money could' be obtained' for' repairs so the • pool ` can open - at the beginn'i'ng of the swim ' season. Mr. Honore further cotented poor weather conditions "contributed to the - 164 attendance 'during last year's'swim 'season. Laura Hopp, P.O. Box 723, Yakima, 98907, speaking for the'League of'Wamen Voters, stated she is delighted-with Council's action today' as all of their concerns and'recoMtendations were addressed.' She submitted copies of the statement by the League' of Women'Voters to' the City Clerk. Joe West Chestnut, stated' he' is pleased with Council's' action today, but commented he' is bothered' by the fact that everytime there is a problem, the' City"• decides on 'a . bond issue.' He stated he feels poor management is rewarded with bond issues and 'this is totally wrong. 'He stated if funds had been . set aside each year - for repairs and maintenance, suffiecerit funds would now be available for repairs. Referring •'to the underiutil:ization of the pools, ' he stated he used the pool' several 'times last year and in the men's section only one shower'out of six 'was'operable. He also questioned what other type of recreation the 'Ci'ty has, 'other than the pools. Mr. Aridreotti stated there are tennis courts at Franklin,'but no ball fields, and the same thing applies to the other City parks. He stated about 60% of the athletics are performed on'school grounds because the City has inadequate park facilities. Larry Mathews, 805 South 17th Avenue, stated he'presehted written testimony but would like to comment on a statement made 'by' Council member Barnett. Mr. - Matthews stated he checked with the school district and learned that 85% of the students 'participate in a subsidized lunch program: Mr. Mathews 'recommended a free swim session be offered 'to see what type of • re there would 'be: Council member Sims stated is B -1/6 • • 29 MARCH 24•,,,,:1987 . currently. a "dime swim night" offered'rat least :once ,a month by the -Parks & Recreation Department. He stated.Mike of the Parks and Recreation Commission, could comment on thelevel of participation. Maud , Scott, resident of southeast Yakima cautioned that. Washington Pool not survive the planned repairs as it is in such poor condition. She stated it. might• be less expensive to pay the-water costs at , • $4,900 rather than make the repairs at the. cost, of $5,000 to $10,000. She stated perhaps the residents of the southeast area • - would be able to swim ,a longer time-this summer if ,repairs are not ,done.. . 10. REPORT -FROM TRANSIT DIVISION REGARDING. OTHER BUSINESS Council member Carmichael stated Council members received an information item regarding the Policy Guidance for Public Transportation Decision Makers Conference to be conducted by the Washington State Department of Transportation.' in Olympia. She stated Council members have attended this in the past and urged Council representation again this year as i t is a very' worthwhile and'economical conference. Council member Buchanan suggested more than one Council member attend`the conference. • Mayor Beauchamp stated the Urban Area Zoning Ordinance meeting scheduled for last week 'with the County Commissioners had to be • cancelled, and suggested April 16th as a possibility for rescheduling. Mayor Beauchamp, Council members Berndt, Sims, Buchanan and Foy indicated they could be present on April 16th, • however, Council member Carmichael will.not be-available. 'Council • member 'Barnett' stated he will have to check` his calendar and advise staff if he will be available. Glenn Rice stated if the majority of the Council is available he will arrange the meeting for that date. Ray Honore, 514 South 4th Street, related to Council that his mother received a $5 parking ticket at a meter prior to the time of their removal. He stated the ticket went' unnoticed' by him and • escalated to $139 because it was turned over to a collection agency. He asked if Council considers this "gouging." In response' to Mayor Beauchamp's inquiry about the justification for this, Mr. Honore stated the reasoning for such justification was the fact that 'the collection agency had gone to `court to obtain a court • • order. He stated when he first received a notice that•the ticket was overdue, the fine had been increased to $59' and he paid $25 on • the bill prior to it being turned over to the collection agency. He came to City Hall and met with Bert Tabayoyan of Customer Services to inquire why it was $59 for a $5 parking ticket and was B -1/8 31- MARCH 24, 1987 informed it was due to the fact that it had been sent to the collection agency. Mr. Honore further explained that, in his presence, Mr. Tabayoyan phoned the collection agency to obtain more information regarding the situation, and by the time he returned home, his mother had been served with a garnishment on her job and the ticket had gone from $59 to $139. He asked if there is a limit the City could place on the amount charged fora parking ticket because he was told by the collection agency's attorney that -the,. ticket could be as much, as $250. Mr. Honore stated this is totally..irresponsible,. especially when ,the City-Only-receives $15 of the $139. He .pointed out that the City is making. money for an outside agency by not handling this particular situation any better than : it. - currently is doing... Mr. Honore,: asked, what City or State - Code - authorizes . a ticket of ;such -a. small ,amountAo . be turned over to a .collection agency. He commented it is more -,than -just money • that is involved when you are dealing „with•a collection agency. He stated his mother is 74 years old, and in ill health, and he does not want.ar collection agency harrassing •her,....as feels they are vultures. - He stated he...hates to' see the City .- associating with -- vultures- and asked Council to. ascertain if there. is a limit that • can be charged.for a ticket rather than have this type of situation reoccur. .0n another matter, Mr .Honors "asked Council when something is going to be,done about the-, condition of 4th Street. He stated he lived. ,on:, 4th; Street for six years and no repairs have been 'fimade during that time period.: He - stated, "I would like to , see • • something done with the street, if nothing else, take it out.” " - Mayor Beauchamp - asked Mr. ` Honore to leave his receipts- - showing payment of the ticket with staff to review. Assistant City Manager • Stouder told Mr. Honore staff will look into the current procedure and get back in touch with him.
