ADJOURNED MEETING
MARCH 10, 1987
• 1. EXECUTIVE SESSION REGARDING PERSONNEL
• The City Council met in session on this date at 11:30 A.M. at the
Towne Plaza, Yakima, Washington, Mayor Henry Beauchamp presiding,
Council members 'Clarence Barnett, Pat Berndt, Lynn Buchanan, Lynn
Carmichael, Jerry Foy and Bernard Sims present on roll call. City
Manager Zais also in attendance.
It was MOVED by Carmichael, seconded by Buchanan, to move into
Executive Session for the purpose of discussing personnel.
Unanimously carried by roll call vote. -
Following the conclusion of the Executive Session, the meeting was
adjourned at the hour of 1:40 P.M.

' BUSINESS MEETING
1. ROLL 'CALL ' .
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers'of City Hall, Yakima, Washington. Mayor Henry
Beauchamp, presiding, Council members Clarence Barnett, Pat Berndt,
Lynn Buchanan, Lynn Carmichael, Jerry Foy and Bernard Sims present
on roll call. City Manager Zais, Acting City Attorney Vanek, City
. Clerk Roberts and Deputy City Clerk Toney also present.
2. INVOCATION ' •
' The Pledge of Allegiance was led by Clarence Barnett.'' -
3. OPEN DISCUSSION FOR THE GOOD'OF THE ORDER

Council member Carmichael reported the Council Committee met and
have two recommendations for appointments to the Parks & Recreation
Commission. -It was MOVED by Carmichael, seconded by Berndt, to
appoint Thomas Hurson, who resides at 3604 West Lincoln Avenue, and
Lura Good, who is Youth Director at the YMCA, and resides at
901 Cornell Avenue, to 'fill the two vacancies that currently exist
on the Yakima Parks & Recreation Commission. The question was
called for a vote on the motion. Unanimously carried . by voice
vote.
Mayor Beauchamp stated there is an opening on the State Centennial
Commission and Ostrander has expressed an interest in this
appointment: Therefore, it was MOVED by Foy, seconded by
Carmichael, to appoint Dick Ostrander as the Yakima representative
to the State' Centennial Commission. Unanimously carried by voice
vote. .-

MARCH 10, 1987
Mayor Beauchamp presented a proclamation declaring the month of
March as "Chamber of Commerce Month" to Bill Elkins, Assistant
Manager of the Chamber of Commerce.
4. CONSENT AGENDA
Mayor Beauchamp referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Council members or citizens present. Items Nos. 10 and 11
were added to the Agenda, as• requested by Council member
Foy. City Manager Zais explained that Item No. 11 has a video
presentation of approximately 9 minutes. It was the consensus of
the Council to view the video presentation following adjournment.
Item No. 16 was removed at the request of Council member Buchanan.
The City Clerk then read the Consent Agenda items, including
resolutions and ordinances by title. It was MOVED by Carmichael,
seconded by Buchanan, that the Consent Agenda, as read, be passed.
Unanimously carried by roll •call vote. (Subsequent paragraphs
preceded by an asterisk ( *.) indicate items on the Consent Agenda
handled under one motion without further discussion.)
*5. APPROVAL OF MINUTES OF THE COUNCIL MEETINGS OF JANUARY 27 AND
FEBRUARY 3, 1987
The Council minutes of January 27 and February 3, 1987 were
approved, having been duly certified accurate by two Council
members and no one present wishing to have said minutes read
publicly.

6. , AUDIENCE PARTICIPATION
-John Klingele, 1312 W. Walnut, addressed Council requesting that
Council and staff give some thought to future needs of the City's
water system at the location of 16th Avenue & Nob Hill Boulevard.
He reviewed the existing domestic water lines and suggested
extension of the 20" domestic water main through the intersection
of Nob Hill Boulevard & 16th Avenue. Mr. Klingele further
commented while the intersection is being reconstructed this
summer, this would be the appropriate time to extend the domestic
water line. Council member Foy stated he would like staff to bring
back a report regarding Mr. Klingele's suggestion.
7. HEARING ON 1986 GRANTEE PERFORMANCE REPORT AND FILING OF COMMUNITY
DEVELOPMENT BLOCK GRANT 1986 YEAR -END REPORT
•
This being the 'time set for the hearing on the 1986 Grantee
Performance Report and filing of the Community Development Block
Grant 1986 Year -End Report, Director of Community & Economic
Development Glenn Rice stated this is an annual report required by
HUD regulations. He stated the report summarizes the programs,
performance and expenditures for 1986. He indicated the year -end
report is also attached for Council's information. Mayor Beauchamp
opened the hearing for public comment at this time. Phil Pleasant,
1202-Fair Avenue, asked what- portion of the Community Development
Block Grant Funds were channeled into the black community;. thereby
. benefiting black contractors and businessmen. Dixie Kracht,
Housing Manager, responded that -part of. the Grantee Performance
Report (GPR)', Form 49.49.5, 'basically outlines the assistance
given' to• minority population. She stated the GPR' does not list
individual contractors or small businesses,' however, this
•information is provided to the Assistant City Manager and the
Personnel Officer for affirmative action reporting. City Manager
Zais responded that Mr. Pleasant has asked this same question of
• several different departments in the City. He stated staff has
responded in a letter to Mr. Pleasant with respect to areas that
can • and cannot be answered. He 'added the. files are open and
available for Mr. Pleasant's inspection and evaluation. Mr.
Pleasant stated the black community is not receiving the funds to
which he feels they are entitled. He stated if statistics are not
being maintained on utilization of blacks, the City is
administratively, systematically discriminating against the black

community. Council. member-Foy commented. there are two. reports
,before.the Council_today, the Grantee,.Performance.Report and the
Year -End .Report for 1986. He stated he would like to see these
documents presented in a more unified. package for Council'-s review.
Mayor Beauchamp echoed the concerns voiced by Mr. Pleasant
regarding the statistics which show the number of black families
assisted through the Community Development Block Grant Program. He
stated the statistics are. minimal and questioned why, abetter job
- is „not being done. to target these resources to all of the affected
groups within the community. Mayor Beauchamp -also voiced concern
with the staffing of the Community Development Office, asking if
there is an ethnic mixture or composition of .staff to ensure
that the .line of communication extends to the minority areas.
Following. further discussion, and the public hearing having been
closed, it was MOVED by Foy, seconded by Buchanan, to accept the
findings .of fact and authorize the City Manager ,to - submit the
• Grantee Performance Report to HUD. Unanimously carried by voice
vote...
8. HEARING ON RESOLUTION QF INTENTION TO CREATE "J” STREET SEWER LOCAL
IMPROVEMENT DISTRICT (SEE ORDINANCE CREATING L.I.D. NO. 1040
Rita Germunson, Office Engineer, recommended..the public hearing for
the , "J" Street Sewer ,L. I. D., be rescheduled to, a later date due to
the statement of objection submitted by James Berg, Vice
President, and Rick Van Horn, Manager of the Yakima Tennis Club. It
is their contention: that the Yakima !Tennis..Club property does
not derive special benefit. She explained the "special benefit is
the difference in the fair market value of the property with the
improvement as compared to the fair markeCvalue of the property
without the improvement, commonly known before and after." Mrs.
Germunson stated. an. L.I.D. assessment cannot exceed the special
. benefit., She_, further explained the. City will have to acquire the
ser_ vices, of an, ,appraiser to .make., this -, determination. It was MOVED
by Foy, seconded by .Carmichael, that this be referred back to the
appropriate department for continuation of gathering of information
and recommendation. Unanimously carried-by voice vote.
9. REPORT FROM CABLE COMMUNICATIONS OFFICE REGARDING PROPOSED FEE
. SCHEDULE FOR COUNTY RESIDENTS
Racial. Fields, Chairman of the Community Programming Advisory
Committee, introduced those members of .the Committee present,
Terri Norman, Chris Park, James Stilwater,.,Randy Marquis and Alan
Taylor. She then reviewed the staff report and recommendations
which were: 1) Institute a• one -time fee of $15.00 be charged to
. all county, residents - wishing,-,to become, licensed. producers. 2)
. "Grandfather ". all county residents who. are currently ,licensed
• producers. 3) Producers ^.who,- are.employees or volunteers,. for non -
profit organizations and producing programs strictly for that
organization are exempt from paying. the fee. 4) Municipal
employees using, YCTV to produce programs for the City are exempt
from paying the fee. 5) No fee charged to county residents
evidencing substantial financial hardships. Council member Foy
suggested this. be. referred. back- to,CPAC ,'stating he agrees that the
one -time -fee of $15.00 be charged to -all county .residents: wishing
. to become ,-licensed.. producers, however, does., not feel
reconmendations..numbers 2 -4 are needed. He .suggested-adding Item
No. 6,,..„a user .fee for equipment and facilities.- Mrs.. , Fields
• ,commented on this suggestion, stating .YCTV does. -not :have a
secretary or. a'.safe in which- to keep-any type of fees collected,
nor do they have a.record keeping system.in place -to-handle such
.transactions: Following further discussion, it was MOVED by Foy,
seconded. by. Barnett, that we refer this back to the Community
Programming. Advisory Committee to review what we- have.,talked about
on :Items Nos. l,. 4, 5,& 6.. Prior to the vote,. City Manager Zais
asked. if Council, desires this back in the form of a report, or
wishes to have.accompanying legislation. It was the consensus of
the Council to refer the issue back to the CPAC, and then
reconsider the.,issue....The _question was called for a ,vote.-,on the •
motion. Carried by 57-2.- roll. call vote. Berndt and Carmichael
voting nay. City Manager Zaiis acknowledged that this is Bruce

Crest's last'Council meeting as he is leaving to take a position in
Beverton, Oregon. Council member Carmichael expressed appreciation
to Mr. Crest for a job well done and wished him the very best in
his new endeavor.
*10. PRESENTATION OF YAKIMA CENTER YEAR -END REPORT FOR 1986
The report from the Department of Community & Economic Development
- dated March 10'; 1987' regarding the Yakima Center Year-End Report
was accepted and approved.
*11. REPORT FROM DEPARTMENT OF ENGINEERING AND UTILITIES REGARDING
PROPOSED PUBLIC RELATIONS PROGRAM FOR 1987 STREET. IMPROVEMENT
PROJECTS
•
The report from the Department of Engineering & 'Utilities dated
March 10', 1987, regarding the Proposed Public Relations Program for
1987 Capital Improvement Projects, was accepted and approved.
*12. CONSIDERATION OF RESOLUTION AUTHORIZING CONSULTANT TO UPDATE THE
CITY'S-FIXED REPORT FOR 1986
RESOLUTION NO. D -5333, A RESOLUTION authorizing City Manager to
' engage Marshall and 'Stevens, Incorporated to perform fixed asset
management services.
*13. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF A SUPPLEMENTAL
AGREEMENT FOR PARTIAL REIMBURSEMENT OF THE NOB HILL BOULEVARD
OVERPASS PROJECT
RESOLUTION' NO. D -5334, A RESOLUTION authorizing and directing the
City Manager of the City of Yakima to execute a supplemental
agreement, Supplement No. 2, with the State of Washington,
Department of Transportation, for partial reimbursement of costs
- for the rehabilitation Nob Hill Boulevard Overpass.
*14. CONSIDERATION OF RESOLUTION AUTHORIZING FIRE DEPARTMENT PURCHASE OF
A FIRE STATION ALERTING SYSTEM WITHOUT CALLING FOR BIDS
RESOLUTION NO. D -5335, A RESOLUTION authorizing the purchase of a
fire station alerting system without calling for bids.
*15. REQUEST FOR'FILING APPLICATION TO STATE DEPARTMENT OF COMMUNITY
DEVELOPMENT FOR THE EMERGENCY SHELTER GRANTS PROGRAM
The staff report regarding an application for an Emergency Shelter
Grants Program and the staff 'recommendation to' authorize the
Director'of Community and Economic Development to write a letter of
intent to participate in the'Emergency Shelter Grants program, was
accepted.
16. REPORT'' PERSONNEL DIVISION REGARDING YEAR -END HEALTH
INSURANCE•PROGRAM . ..
Council member Buchanan referred to statement in the report
which indicates there was a high frequency of claims and asked
• that an explanation of the frequency• be given in the future.
Personnel Officer Bob Weaver explained .that in 1985 there were 10
claims over' $15, 000 whereas in in 1986 there was 'only one claim over
that amount. Dale Fisher of Beard, Bench, & Mendenhall was
introduced as the person responsible for preparing this report.
Mr. Buchanan commented there was a lot of emphasis placed on
"Wellness Programs" at the AWC Board Meeting which he attended in.
Olympia` and expressed concern that the City of Yakima is not
involved in this type of program. Mr. Weaver stated a committee
• will be established in 1987 to study a Wellness Program which will
be developed in conjunction with Beard, Bench,' & Mendenhall. Mr.
Weaver also 'mentioned that cast containment measures are being
considered, however, he is currently unable to give any specifics
on this due to pending contract negotiations. Council member
Carmichael echoed Mr. Buclianan's'concerris and recommended the City
take advantage of AWC's Wellness Program, adding it is not

•,;necessary for the City -to be enrolled in,AWC's insurance program to
,do so. -:,Mr. Weaver. indicated.. -these prograns will cost the City

•
An ordinance appropriating funds into the' Equipment Rental Fund for
a flail head mower and trucks for the Parks, Street, Cemetery (2)
and Sewer Divisions, having been read by title only at this
meeting, was laid on the table for one week, or until March 17, •
1987.
22. OTHER BUSINESS
Council member Carmichael recognized her father, Harold Crawford,
seated in the audience today to observe his first City Council
meeting as he has just moved to Yakima from Wenatchee.
Council member Foy referred to the Civil Service Commission minutes
provided to Council as an information item, questioning when
Council will have an explanation of the paragraph relating to the

• Public Works Administrative Assistant. Mr. Zais stated the
position and pay range 'was by Council- during the 1986
budget hearings and subsequently' went before the Civil' Service.
Cammission for approval; as is the normal procedure. The AFSCME
Union disagrees with the pay range, contending it should be at a
lower level as the job is merely a glorified Department Assistant
IV position with some additional authority. The Civil Service
Commission rendered a decision recommending the pay range be set at
14.5, however, City staff must respond to the Union's arguements
on the position and pay range. The issue will be presented to the
Civil Service Commission once more for further consideration. The
issue 'will' then came before the Council for 'final action'in the
form of an ordinance. Mr. Zais stated in the meantime,' for the
individual involved, the City cannot act officially until the
position and pay range has been established by ordinance. He
stated Council is the final authority on setting the pay range.
