Executive Session regarding pending litigation per RCW 42.30.110 (1)(i)and collective bargaining pursuant to RCW 42.30.140 Present: Mayor Janice Deccio, presiding,Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Patricia Byers, Danny Herrera and Holly Cousens (attending remotely via Zoom) Absent: Councilmember Eliana Macias (excused) MOTION: Lund moved and Byers seconded to adjourn to an executive session for up to one hour to discuss pending litigation per RCW 42.30.110 (1)(i) and collective bargaining pursuant to RCW 42.30.140. The motion carried by unanimous vote, Macias absent. Executive session was held and adjourned at 5:27 p.m. 1. Roll Call Present: Mayor Janice Deccio, presiding,Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Patricia Byers, Danny Herrera, Holly Cousens (attending remotely via Zoom)and Eliana Macias (attending remotely via Zoom) Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Sonya Claar Tee 2. Pledge of Allegiance Mayor Deccio led the Pledge of Allegiance. 3. Interpreter Services Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Open Discussion for the Good of the Order A. Proclamations Telecommunicator Week Proclamation Mayor Deccio proclaimed April 10-16, 2022 as National Telecommunicators Week. Fire Chief Page 1 of 4 472 Markham and Erica McNamara, Public Safety Communications Manager, accepted the proclamation. ii. Arbor Day Proclamation Mayor Deccio proclaimed the third Saturday in April as Arbor Day in the City of Yakima. Executive Director Colleen Adams-Schuppe and Education Director Garrett Brenden, both from the Yakima Area Arboretum, accepted the proclamation and noted they have 400 trees to give away in honor of this event. 5. Council Reports None. 6. Consent Agenda Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Byers moved and Brown seconded to approve the consent agenda. The motion carried by unanimous vote. A. Approval of minutes from the March 15, 2022 City Council regular meeting, March 22, 2022 study session and March 26 and 29, 2022 special meetings B. Set date of May 3, 2022 for an open record public hearing to consider the Yakima Planning Commission's recommendation regarding proposed 2022 text amendments C. Resolution authorizing permit issuance for the installation of an awning located 3 feet over the right of way at 307 E Arlington Street RESOLUTION NO. R-2022-042,A RESOLUTION authorizing the issuance of a right-of-way use permit for the installation of an awning that projects approximately 3 feet over the right-of- way at the front of the building at 307 E Arlington. D. Resolution authorizing permit issuance for the installation of a fence in the right of way at 225 N 2nd Street RESOLUTION NO. R-2022-043,A RESOLUTION authorizing the issuance of a right-of-way use permit for the installation of a fence at 225 N 2nd St. E. Ordinance adding a new Chapter 3.130 Biennial Budget to Title 3 of the Yakima Municipal Code and amending municipal code sections to reflect the biennial budget ORDINANCE NO. 2022-007,AN ORDINANCE adding a new Chapter 3.130 Biennial Budget to Title 3 of the Yakima Municipal Code and amending municipal code sections to reflect the biennial budget. 7. Public Comment Tony Courcy, City resident, spoke about his water rights in Selah. Page 2 of 4 473 PUBLIC HEARINGS 8. Public meeting on the draft redistricting plan City Attorney Sara Watkins introduced the redistricting plan. Mayor Deccio opened the public hearing. David Morales, City resident, spoke in support of the redistricting plan on behalf of the South Central People of Color Redistricting Coalition. Jeanna Hernandez, City resident, stated she does not have an issue with the plan but questioned why the boundary lines were not cleaner. Kenton Gartrell, City resident, noted he has no issues with the plan but believes the new plan dilutes the Hispanic vote in some districts and believes the City should be annexing areas into the City. With no one else coming forward or calling in to speak, the Mayor closed the hearing. MOTION: Macias moved and Cousens seconded to move forward with the draft redistricting plan as published and place on the April 19 business meeting. The motion carried by unanimous vote. DEPARTMENT ITEMS 9. 2022 Housing Action Plan - 1st Quarter Report Planning Manager Joseph Calhoun reported on the 2022 1st quarter Housing Action Plan. 10. Resolution adopting the Americans with Disabilities Act (ADA) Transition Plan and Self- Evaluation Report Planning Manager Joseph Calhoun briefed Council on the report. The City Clerk read the resolution by title only. MOTION: Lund moved and Byers seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION NO. R-2022-044,A RESOLUTION adopting the City of Yakima Americans with Disabilities Act (ADA) Transition Plan and Self-Evaluation Report. 11. Resolution declaring the property located at 115 North 8th Street, Yakima, Washington, to be surplus to the uses and needs of the City of Yakima, and authorizing disposition of such parcel to Yakima Valley Partners Habitat for Humanity upon mutually acceptable terms and conditions Interim Assistant City Manager Selby briefed Council on the report. The City Clerk read the resolution by title only. MOTION: Lund moved and Brown seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION NO. R-2022-045,A RESOLUTION declaring the property located at 115 North 8th Street, Yakima, Washington, to be surplus to the uses and needs of the City of Yakima, and authorizing disposition of such parcel to Yakima Valley Partners Habitat for Humanity upon mutually acceptable terms and conditions. Resolution authorizing an interagency agreement with the Washington State Department of Ecology to access and secure estate insurance monies for the Frank Wear Cleaner's Site City Attorney Sara Watkins briefed Council on the report. The City Clerk read the resolution by title only. MOTION: Lund moved and Byers seconded to adopt the resolution. The motion carried by unanimous vote. RESOLUTION NO. R-2022-046,A RESOLUTION authorizing an interagency agreement with the Washington State Department of Ecology to access and secure estate insurance monies for Frank Wear Cleaners. 13. Ordinance amending the 2022 Budget for the City of Yakima and making appropriations from Unappropriated Fund Balances within various Funds for expenditure during 2022 for various purposes (First Reading) Jennifer Ferrer-Santa Ines, Director of Finance and Budget, briefed Council on the budget amendment, noting a correction on the schedule, and this is a first reading so no action is necessary. The City Clerk read the ordinance by title only. First reading of AN ORDINANCE amending the 2022 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various funds for expenditure during 2022 for various purposes including 2021 encumbrances as described in the attached Schedule. 14. Other Business None. 15. Adjournment MOTION: Lund moved and Herrera seconded to adjourn to a City Council study session on April 12, 2022, at 5 p.m. in the Council Chambers. The motion carried by unanimous vote.
