PRESENTATION /DEMONSTRATION ON BIKE PATROL AND NEIGHBORHOOD
SPEED WATCH PROGRAM
At 1:45 P.M. the Police Department gave a presentation of the
eight mountain bicycles purchased to patrol the Central Business
District and the Greenway area. The purchase of the bicycles was
made possible by donations from some of the downtown merchants,
some of whom were present to receive an award for their
contribution to the City and to view the demonstration by the
Police Department.
Council members were also briefed on the new public awareness
Neighborhood Speed Watch Program being instituted by the police
department in an effort to help curb speeding in residential
areas. This program involves the use of radar equipment which will
be loaned out through the Traffic Engineering Department of •
Public Works.
BUSINESS MEETING
1. ROLL CALL
The City Council met.in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, Council members Clarence Barnett, Jerry Foy and
Bernard Sims present on roll call. Council members Henry
Beauchamp, Lynn Buchanan, and. Lynn Carmichael absent and excused.
City Manager Zais, City Attorney Vanek, City Clerk Roberts and
Deputy City Clerk Toney also present.
2. INVOCATION
The Invocation was given by Council member Foy.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Mayor Berndt gave a brief update on some of the activities of the
Association of Washington Cities (AWC), stating Yakima was well
represented this year. She reported that Dennis Covell, Director
of Engineering and Utilities, moderated and assisted in a
discussion regarding street utilities; Frank Glaspey, Coordinator
of Coalition for the War on Drugs, participated in a panel
. • regarding intergovernmental partnerships and was a very effective
panelist. Mayor Berndt stated she heard some positive feedback
.regarding the manner in which Yakima is handling the drug program.
She stated she and City Manager Zais testified before the House
Local Government Committee and the Senate Government Operations
Committee. She said this gave them an opportunity to speak about
the economic differences between the east and west side of the
state.
Mayor Berndt initiated a brief discussion of the lg Refuse
Utility Tax. She proposed that the Council talk with the County
Commissioners about the possibility of forming a joint Community
Task Force to develop a recycling program similar to the one used
by the City of Spokane in an attempt to avoid the mandatory
curbside program. Council member Barnett stated he would like
staff to investigate the issue in relationship to the legislation
just passed because it is not clear at this point what the new
state office of Waste Reduction is going to propose. He indicated
he is concerned that the tax will benefit the west side of the
state rather than the City of Yakima. City Manager Zais stated Mr.
Barnett's concern is valid because the tax will benefit the west
side of the State for the first few years. Mayor Berndt pointed
out that there will be some grant money available and the City
should be preparing the paper work to apply for .funding when
that money becomes available. Council member Foy suggested the
Mayor proceed with her plan to meet with the County and bring it

back to the Council for consideration. Mayor Berndt stated the
issue needs to be addressed from a County wide aspect, adding she
will continue to work with Mr. Copeland on this. Director of
Finance and Budget Hanson stated there are some points in the law
which need to be clarified prior to implementation of the tax; i.e.
yard service, the definition of commercial and residential, etc.
He indicated this new tax will not require an ordinance change
because this is a pass - through tax which will be added onto the
billing. Mr. Hanson stated Council will be receiving a memorandum
regarding clarification of these issues and an explanatiion of how
the billing. process will work. '
4. CONSENT AGENDA
Mayor. Berndt referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Council members or citizens present. It was the consensus
of the Council that Item No. 17 C (an off - agenda item) be added,
and that Item No. 18 be removed from the Consent Agenda. The City
• Clerk then read the Consent Agenda items, including resolutions and
ordinances by title. It was MOVED by Foy, seconded by Sims, that
the Consent Agenda, as read, be passed. Unanimously carried by
roll call vote. Beauchamp, Buchanan and Carmichael absent.

*5. APPROVAL OF MINUTES OF THE COUNCIL MEETINGS OF NOVEMBER 3,- 1988,
MAY 15 & 23, AND JUNE 6, 1989
The Council minutes of November 3, 1988 and May 15 & 23, and
June 6, 1989 were approved, having been duly certified accurate by
two Council members and no one present wishing to have said minutes
read publicly.

7. PUBLIC HEARING ON FINAL ASSESSMENT ROLL FOR VIEWMONT SEWER L.I.D.
NO. 1045 (CONTINUED FROM APRIL 25, 1989 - SEE ORDINANCE
CONFIRMING ASSESSMENT ROLL)
City Engineer Whitcher stated the public hearing on the final
assessment roll for the Viewmont Sewer L.I.D. was continued from
April 25, 1989, for clarification of the interest rate charged to
the L.I.D. participants and a response to an inquiry by LaRue B.
Takach regarding postponing the assessment until the property
involved is sold or developed. The matter of the interest rate was
resolved by the Finance Department and Engineering staff determined
that the assessment cannot be deferred until the property in
question is sold or developed. Mr. Whitcher stated he has nothing
further to add to the agenda statement. Mayor Berndt re- opened the
public hearing, however, there was no one present to address the
issue and the public hearing was declared closed. Ordinance No.
3181 having been read by title, it was MOVED BY FOY, SECONDED BY
SIMS, THAT ORDINANCE NO. 3181 BE PASSED. Unanimously carried by
roll call vote. Beauchamp, Buchanan and Carmichael absent.

8. CONSIDERATION OF RESOLUTION REGARDING HAZARDOUS VEGETATION AND
DEBRIS ABATEMENT PROGRAM
Code Administration Manager Shampine stated he had nothing further
to add, and he knows of no one present to address the issue.

RESOLUTION NO. D -5588, A RESOLUTION authorizing the Code
Administration Manager to clear certain weedy lots.
9. DRAWING FOR 1989 ELECTION BALLOT POSITIONS
Council members Foy and Sims drew for positions on the 1989
election ballot. Council member Beauchamp was not present and was
assigned the remaining number. Positions on the election ballot
will be as follows: 1. Jerry Foy; 2. Bernard Sims; and 3. Henry
Beauchamp.
*10. REPORT FROM DEPARTMENTS OF PUBLIC WORKS AND POLICE REGARDING TRUCK
ROUTES AND SIGNAGE AND ENFORCEMENT
The report from the Departments of Public Works and Police
regarding truck routes and signage and enforcement, and
recommendation to not establish formal truck routes, but to
institute a neighborhood speed watch program with targeted
enforcement for problem areas, was accepted.
*11. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF CONTRACT WITH
YAKIMA COUNTY AND YAKIMA VALLEY COUNCIL OF CAMP FIRE FOR SUMMER
YOUTH PROGRAM FOR DISABLED CHILDREN
RESOLUTION NO. D -5589, A RESOLUTION authorizing an agreement
between the City, Yakima County, and the Yakima Valley Council of
Camp Fire for a recreational program'for disabled youth. (Contract
No: 89 -38). -

*17. APPROVAL OF OUT -OF -STATE TRAVEL:
A. CORINNE CHOY, INFORMATION SYSTEMS, TO MARINA_DEL REY, CA :.
The Out -of -State travel for Corinne Choy, Information Systems, to
attend a programming class in "Blacksmith" at Stauffer Informations
Systems, in Marina Del Rey, California, June 25 -30, 1989, at a cost
of $1,000, was approved.
B. WENDY WARREN, CABLE TV, TO DALLAS, TEXAS
The Out -of -State travel for Wendy Warren, Cable Communications
Coordinator, to attend the National Federation of Local Cable
Programmers Annual Conference, in Dallas, Texas, July 11 -16, 1989,
at a cost of $1,155, was approved.
C. DETECTIVE RANDY RUEGSEGGER, POLICE DEPARTMENT, TO BEND, OREGON
The Out -of -State travel for Detective Randy Ruegsegger, to attend
the Northwest Polygraph Examiners Seminar, in Bend, Oregon,
June 25 -30, 1989, at a, cost of $400.00, was approved.
18. CONSIDERATION OF AN ORDINANCE ESTABLISHING FEES AND CHARGES FOR
RECORD BUREAU SERVICES
Council member Barnett stated he feels charging the public $5 for
an Annual Police Report is inappropriate.,_Chief .Green ,stated the
Police Department has never charged for a copy of the Annual Report
and the only reason this has been added is to cover the printing
cost should a large number of reports be requested. Council.member
Foy suggested the fee should not be deleted, however, it should be
stated that if more than one report is requested there will be a
fee of $5 per copy. He explained that every citizen has a right
to ask for a report since they pay taxes, but if someone asks for
ten copies, then they should be billed accordingly. Chief Green
suggested changing the wording to stipulate. that. if ; more,_ than one
copy is requested, a charge of $5 "may" be charged. City Attorney
Vanek stated the law allows for the recouping of printing costs.
He said if the word "may" is used it is an impermissible delegation
of authority to the Police Department because the Council is not
saying under what circumstances that authority will be exercised.
It was the consensus of the Council that the Police Department
continue to use discretion in this matter.
John Klingele, 1312 West Walnut, addressed Council stating since
the report is not copyrighted, it can be reproduced at will.
Regarding annual reports, Council member Foy referred to the
Transit Report presented in today's Council packet and expressed
concern that such an expensive grade of paper was used to produce
the report. He suggested that future reports be prepared in a
less expensive manner. t'
Council member Barnett asked that the amendment be restated. It
was MOVED BY FOY, SECONDED BY .SIMS, THAT THE .POLICE DEPARTMENT
ANNUAL .REPORT,..OVER ONE COPY, BE.. BILLED...AT $5 PER COPY.
Unanimously carried by voice vote. Beauchamp, Buchanan and
Carmichael absent. ORDINANCE NO. 3182, having been read by title,
it was MOVED BY FOY, SECONDED .BY_.SIMS,. THAT THE ORDINANCE BE
PASSED. Unanimously carried by roll call vote. Beauchamp,

ORDINANCE. NO..3182, AN ORDINANCE relating to administration;
increasing police department service fees; and amending Section
1.170.010 of the City of Yakima Municipal Code.
19. OTHER BUSINESS
Council member Barnett referenced the June 2, 1989 memorandum
regarding a request for a traffic signal at the intersection of
24th Avenue and Lincoln Avenue, asking if the Neighborhood Speed

Watch Program presented by the Police Department prior to today's
Council meeting might be applicable? Traffic Engineer Donahue
stated he believes that particular intersection is on the list for
the Neighborhood Speed Watch Program.
Council member Foy referred to the list of. vacancies,. on the various
Boards and Commissions, requesting that each Council member be
..,_provided with a copy of the applications to review. He stated he
*thought -some of these vacancies had recent_1 y_been, filled, and asked
City Clerk Roberts to verify the vacancies listed.
Council member Sims reported that for the past two months citizens
have been parking on both sides of the street on South 20th Avenue
and South 24th Avenue bordering Franklin Park. He stated this
obscures the view of traffic onto Chestnut Avenue making this
area a hazard. It was also noted that Chestnut Avenue is a
bicycle route and has a high volume of pedestrian traffic as well.
He asked that staff investigate a remedy to the situation.
Mayor Berndt stated Council member Buchanan has been the appointed
designee to the Yakima County Health District, however, he is no
longer able to attend the meetings. Council member Foy has been
attending as an alternate and was appointed by Mayor Berndt to
serve as the primary designee.
Council member Foy acknowledged the presence of Mr. Archie Hill at
today's Council meeting, stating Mr. Hill has been a real mainstay
• in the community and is Past President of the Association of
. General Contractors.
EXECUTIVE SESSION
City Manager Zais announced the need for a brief. Executive Session
to discuss pending and prospective litigation. It was MOVED BY ;
SIMS,. SECONDED BY FOY. TO MOVE. INTO EXECUTIVE SESSION FOR
APPROXIMATELY FIFTEEN. MINUTES.. FOR,THE..PURPOSE OF.DISCUSSING PENDING
AND PROSPECTIVE LITIGATION.. Unanimously carried by voice vote.
