1. The parties to this Memorandum of Understanding, the City of Yakima, Yakima
Police Patrolman's association, Yakima Firefighters Local 469, the Police
Department, and the Fire Department, enter this agreement regarding the
Assistant Fire Marshal /Fire Investigator position.
2. The Assistant Fire Marshal/ Fire Investigator is a position within the Fire
Department that through this memorandum may be filled by a YFD member or
YPD Police officer as determined by the Fire Chief.
3. The Yakima Fire Chief retains the right to select the best candidate based upon
the job description as well as the announcement for the Assistant Fire Marshal/
Fire Investigator position.
4. The Yakima Police Patrolman's Association retains full representation of the
police officer selected to fill this position. Full representation includes wages,
hours and working conditions defined by the City of Yakima and the Y.P.P.A.
Collective Bargaining Contract.
5. The Fire Department will reimburse the Police Department for the amount of the
compensation package of Police officer up to the amount of pay code 527
(Assistant Fire Marshal). The Police department will be responsible for any
overtime work done beyond regular hours for police duties worked by a police
officer in this position. The Yakima Fire Department will be responsible for any
overtime work done for the Fire Department including fire training.
6. This agreement is for a term of 5 years from the date of signatures. At the end of
5 years, this Memorandum of Understanding will be renegotiated or terminated by
agreement of all parties involved. The Yakima Police Department may recall the
Detective that presently holds this position at any time with reasonable notice.
7. This agreement may be nullified at any time by agreement between the Fire
Department and Police Department.
8. When this position is filled by a member of the Yakima Fire Department,
compensation shall revert to pay code 527. (Assistant Fire Marshal) as agreed
upon in the Labor Agreement.
9. In the event this MOU is nullified by either party prior to the expiration date, the
position of Assistant Fire Marshal shall be filled by the following process.
Eligibility Requirements: Applicants for Assistant Fire Marshal shall
possess five (5) years of service with the Yakima Fie Department as a
career Firefighter and meet class specifications as outlined in the City of
Yakima Class specification for code 6344 (ASSISTANT FIRE
MARSHAL)
In the event less than three Yakima Fire Department employees apply for
Assistant Fire Marshal, or less than two employees agree to accept the position,
the Chief may elect to advertise the vacancy to the general public, those
applicants also shall possess five (5) years of paid service as a career Firefighter

MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF YAILMA AND THE
YAKIMiA POLICE PATROLMANS ASSOCIATION
The parties to this Memorandum of Understanding (MOU), the City of Yakima (City) and the Yakima Police
Patrolmans Association (YPPA), enter this agreement regarding the special assignment of a Yakima Police
Officer to the Yakima Fire Department as part of a pilot program.
WHEREAS, The Yakima Fire Department and the International Association of Firefighters Local 469 agreed
to a two -year pilot program consisting of a Commissioned Yakima Police Officer with a minimum of 5 years
experience transferred on special assignment to fill the Fire Department's Assistant Fire Marshal position;
and
WHEREAS, The City and the YPPA desire to facilitate this pilot program; NOW, THEREFORE, the parties
agree as follows:
I. The City retains the right to select the best candidate for the pilot program.
?. The YPP A w ill continue t b the bar representative of the police officer selected for th pil
program and that officer's employment will continue to be subject to the YPPA's collective
bargaining agreement with the City.
3. The police officer selected for the pilot program will be treated as a Detective for purposes of wages,
including all premiums and clothing allowance(s) due.
4. In the event the pilot program terminates, the parties agree that the police officer assigned to the
Assistant Fire Marshal position will revert back to the Police Department.
5. In the event the pilot program becomes a permanent appointment, the parties agree to negotiate any
mandatory subjects of bargaining regarding that permanent position.
6. This MOU is a unique one -time arrangement, does not create a past practice.
7.- This MOU cannot be introduced in any subsequent proceeding except CBA negotiations.
8. This agreement shall be effective upon signing.

RE: Updated MOU between FD & YPD (Fire Marshal)
DATE: September 22, 2008
Enclosed is the signed copy of the new MOU concerning an YPD officer
working in the position of Assistant Fire Marshal at the Fire Department. This
document is ready for your review and signature.
There is really no change in the actual agreement conditions from the last
MOU, other than making sure all parties' rights were protected. This document
should take us through September of 2013, unless a personnel change takes
place. I would like to assure you that this program between the two departments
has been successful beyond our expectations. We have been getting inquires
from other cities that have been made aware of the success.
