ROLL CALL The City., Council met in session on this date at 2:00 P.M. in the Council 'Chambers of City- Hall, Yakima, .,Washington. .Mayor, Pat Berndt, pres iding,. Council members Henry Beauchamp, Lynn Buchanan, Lynn Carmichael, Jerry Foy and Bernard Sims present on roll call. Council member Clarence. Barnett absent and. excused. City Manager Zais, City Attorney Vanek, City Clerk Roberts and Acting Deputy City Clerk Watkins also present. 2. INVOCATION The Pledge of Allegiance was led by Police Officer, .Brenda Gorge: 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Brenda. George made a presentation on behalf of the. Yakima Police Department and. the On. Guard .Program to acknowledge work over the last year by On Guard volunteers.. They received a.State award - for the best crime prevention_ program of the year.,. the High Crime Area Targeting Program. It . was started in December, ''1987 and has continued .through 1989. The program consists of volunteers and officers canvassing a four square block residential area that had a significant amount of crime. The goals of the program include distributing crime prevention .information, promoting the block watch program, . and surveying residents to find out how often they have been victimized. Statistics show .crime was reduced through 1988 by 50 % -85% in the involved areas. Mayor Berndt personally, and on behalf of Council, congratulated and thanked the On. Guard volunteers for all the work they are doing in the community. Council member Carmichael notified. Bob Shampine, Code. Manager, that itinerant vendors on street.- corners, and vacant lots are now setting up on Thursday and Friday as well as on the weekend. They,have been seen at 5th Avenue and Lincoln, Nob Hill Blvd. west of 16th, and South lst. Street and Nob Hill. Mr. Shampine informed Council he would look into it. Pleas Green, Police Chief, also stated he would put out a memo to all officers to monitor these vendors on weekends. 4. CONSENT AGENDA Mayor Berndt referred to the items placed on the. Consent Agenda, questioning whether there were any additions or deletions from either, Council members,..or.,.citizens .present... It was the consensus of the Council that Iten'. No .. 12` be removed from the Consent ; Agenda . The City Clerk then read* ' the 'Consent Agenda items, including resolutions and ordinances by title. It was ::' MOVED BY . APPROVAL OF MINUTES OF THE COUNCIL MEETING OF. APRIL 18, 1989 The Council minutes of April .18, 1989 were approved, having been duly certified accurate by Council members and no one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION Mayor Berndt presented a Proclamation to Rusty Mulcahy, of the American Cancer Society, proclaiming the :week of April 27 - May 6, 1989, as "The Week of Eating Smart in Yakima" and urging all citizens to practice the cancer risk reduction recommendations of the American Cancer Society as they relate to diet. Mr. Mulcahy AAD /1 145 APRIL 25,'1989 thanked the Mayor•and "Council for `the proclamation 'and their cooperation with the American Cancer Society in volunteering their services and °funds.. Mayor Berndt also pointed out that Mr. Mulcahy is an honorary life board member of the American Cancer Society. 7. PUBLIC HEARING ON FINAL ASSESSMENT ROLL FOR VIEWMONT SEWER L.I.D. NO. 1045 (SEE ORDINANCE CONFIRMING ASSESSMENT ROLL) This. being the time set, for the hearing on the final assessment roll Viewmont.Sewer L.I.D. No. 1045, Mayor Berndt read the procedures for- conducting this hearing and asked if any Council member knew of any or potential conflict that would cause that member to avoid participation in this. hearing. It was also asked if there were any property owner or representative who objected to either the Mayor or any Council member's.._participation in this hearing. Receiving no objections, the hearing proceeded. It was stated that all protests must be in writing. ,Rita, Germunson, Office Engineer, began the hearing by explaining`"t:I:D:Nq. 1`045 is a sewer project consisting of the construction of approximately 8,672 lineal feet of 8 inch sewer pipe Viewmont Park Addition located in the West Valley area south of Englewood Avenue • and west of 74th Avenue. The total L.I.D. project cost is $472,908.69. Of this total cost the City will contribute ' $35,157.07 ‘leaving a final assessment roll of $437,751.62.. The final assessment roll is prorated to.70 parcels withinthe"Vewmont Sewer L.I.D.; The method' of cost distribution 'is based, a combination "square foot and - a $5;500 . flat rate.. The' difference between the preliminary assessment roll of $621,179 and the final • assessment roll of $437,751.62` is an average L.I.D.' assessment "savings of $2,496 to the property owners. In 1984 and 1985 the City financed over.$400,000 for the construction of,trunk .sewer lines t� Viewmont" to serve Viewmont Park'Additl:on. This sizeable ihvestment provided•an,'affordable means'for property owners•to form the Viewmont` Park Sewer L:I.D. Project. This project was necessary to resolve a number of high septic system failures in the area. In a Yakima .Herald Republic article dated July 20, 1987, Exhibit C, a property owner in Viewmont Park Addition 'stated the seriousness of the septic system failures in the area. The completion of the Viewmont Park Sewer L.I.D. relieves the Potential health hazard concerns of the - Yakima Health.District and the Washington State Department of Ecology. Construction costs and • design modifications were closely monitored by the City Engineer which resulted in a lower assessment to the property owners:. Mayor Berndt asked, if there were,any written protests..' The City Clerk read a wr. itten protest ` from La _Rue Takach, 506 N. 80th . Ave, regarding s , parcel No:, 1181320 = 2 2412;: The, property owner the lot for' the purpose of protecting `her view' and' has no plans to develop it. On this basis, Mrs. Takach, requested that she not be required to pay the full amount until the property is sold and hook up to the sewer system is required. John Vanek, ,City Attorney, responded that 1) even if the property is not built upon it is ,still benefitted by having access" to the new sewer.. system and thereby , should - be assessed; and the ordinancei as presented, • allows either a lump sum payment 30 days after r notice; or - ; payment by ' ten equal` installments oven a`4"-ten year period at a rate of • interest. Mr. Vanek' .stated that the ordinance is not drafted that . - Way 'and he" would look into State law - to.•see' if that :option is 'available. 'Council member Foy requested Mr. Vanek also research the` possibility" of delaying the levying of the assessment until the - property Is sold or developed. Mr. Vanek noted that if the payment is delayed it will take longer for the bond to be paid and interest would be incurred in...the meantime making the payment much more expensive. Ken Powers, 7902 Englewood Avenue, came forward to express his appreciation to Rita Germunson and the Department of Engineering for a job well done. GOSPEL MISSION Council member Carmichael asked for clarification of the request by Union Gospel Mission to drill a well.. Bob Shampine, .. Code Manager, explained the well is for a water -to-air heat exchange inside the building and. :not for potable .water. Council member. Foy expressed concern about the car rifling and the attitude of people who linger around this area. Mr. Shampine said he would talk with Roger Phillips. about ;the .: issue.. Foy asked about the potential of modifying this Ordinance to maintain. installment billing on CCRC and hook up to the box meter.. for commercial /industrial .customers stating it assists in the . pranotion of industrial development and could be set up at an interest rate of prime plus 1/2 %. To determine the significance of the :issue, Council member Beauchamp inquired about the. amount of .a large commercial connection. • Mr. Covell was requested to research this issue determining the amount of connection charges involved, as well as other potential problems with modifying this ordinance' t� exclude commercial /industrial customers. CONSIDERATION .0F, AN ORDINANCE .AMENDING THE COMPENSATION AND CLASSIFICATION PLAN RELATING TO THE FIRE MECHANIC POSITION ORDINANCE 3168; AN ..ORDINANCE 'relating, to City.: personnel; adopting a 'classification, and compensation :plan for City employees to be effective May 21, 1989; amending. OTHER BUSINESS Council member, Carmichael inquired about a newspaper report stating' the' City'was - handling the bids for seating in, the SunDome. Dick Zais, City Manager, clarified that the County is handling the seating bids. Council member Foy gave a status report on the SunDome project, noting the quantity and type of 'seats' that are ...being considered. Council member Foy asked whether an answer had been received from Union Gap regarding the citizen asking to be served with water. City Manager Zais noted there has been no response on .that request nor on the request for a schedule of the time frame to make" public improvements extending utilities in that area. General consensus was a response should be received prior to moving the master meter. City Manager Zais brought up a meeting to be held later this week between the Yakima County Commissioners and the ,Council on the surcharge issue. He referenced erroneous information that had been relayed in an earlier article, particularly in regard to Union Gap's charges per month and the need to insure this information is corrected. Mr. Zais also referenced a letter that was sent to Terrace Heights and Union Gap, advising them of their proportionate share of costs which relate to the improvements scheduled over the next decade and have not yet been factored into their rate schedule. Mayor Berndt requested Council's sentiments regarding a neighborhood beautification program. There have been a great number of calls recently regarding litter, garbage, and the desire to clean up the City. Mayor Berndt acknowledged the initiation of a, program such as this would require additional staff personnel. After discussion of the limitations of legal pursuits to clean up problem areas and vacant buildings under the existing ordinances, there was consensus by Council for staff to bring back an outline of cost and staffing requirements to proceed with a beautification program. Glenn Rice, Director of Community and Economic Development, introduced John Elsden, the City's new Associate Planner.` Mayor Berndt welcomed Mr. Elsden to the City.
