APRIL 18, 1989 •
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, ' Council members Clarence Barnett, 'Henry
. Beauchamp, Lynn Buchanan, Lynn Carmichael, Jerry Foy and Bernard
Sims present on roll call. City Manager Zais, City Attorney Vanek,
City Clerk Roberts and Acting Deputy City Clerk Watkins
present.
2. I o ATION _
•
The Pledge of Allegiance was led by Council member.Buchanan.:._..
3. OPEN DISCUSSION FOR THE, GOD OF THE ORDER. .
Mayor Berndt congratulated Council member Foy on his appointment to
the Fair Board.
Mayor Berndt noted that she, Council member Buchanan,. and Assistant
City Manager Stouder, went to Olympia on Sunday evening and. met
with Eastern Washington city representatives. On Monday - morning
they met with Eastern Washington Legislators regarding some of the
issues that affect Eastern Washington cities. In particular, they
discussed the Senate bill regarding property taxes, what has
happened to the City with the current way they have done the gas
tax, and the gambling tax. Mayor Berndt said they came.away with
mixed feelings but did sense,. on the part of some of the Spokane
•.Legislators. in .•particular,`. a .real willingness. to•form a bigger
coalition of City.; County arid. i$tate representatives;.from, Eastern
Washington. They hope 'to meet. in •June.:
Council member Foy asked if within two weeks Council could be
supplied with information on how many police officers and support
staff the budget could handle to get the hiring process. started.
He expressed concern about getting close to mid -year and the five
to seven .month_ backlog ,in _the Personnel. Department to fill
requests.- City Manager Zais said his staff is preparing a
report giving information.: needed, to amend. the budget and
incorporating the plans for staging the phased in- implementation.
He said supplying .the_ information could,be done in one of two ways;
either giving Council..an: informal_: report within two weeks and
coming back later with the formal documentation, or waiting and
submitting the formal material. He expressed the desire to get the
formal material to Council as soon as possible in order to pursue
the budget amendment and planning for testing and recruitment
efforts before July 1st. Police Chief, Pleas Green, commented that
the Police Department is geared up for both police officers and
department. assistants.. The registers are in place and there is
another test for police officer scheduled the first part of June.
He stated ' "the major timing concern is. is. for police officers to get
into the academy, they can't get.two slots until the first part of
August. Council member Foy asked if there were any police officers
from other areas wanting to come to Yakima, thereby alleviating the
need of attending the academy. Chief Green _responded that
information is not available, the upcoming entry. level test will
determine which candidates will be hired.
4. CONSENT AGENDA _
. Mayor Berndt referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either - Council members or citizens:. present._ The City Clerk then
read the Consent Agenda•:items, including resolutions_ and ordinances

*5. APPROVAL OF MINUTES. OF THE COUNCIL MEETING OF APRIL 11, 1989
The Council minutes . of April: 11., 1989. were approved., having :.been
duly certified accurate by two Council members and no one present
wishing to 'have said minutes read. publicly. .

7. REPORT FROM PARKS AND RECREATION DIVISION REQUESTING. ADDITIONAL
FUNDING FOR CHESTERLEY PARK DEVELOPMENT

David Flaherty, Parks and Recreation Manager, submitted the report
for Chesterley Park. and asked if Council..had .any questions.
Council member Barnett asked for clarification. that it was the
$19,847 figure that was required.and not. a $14,000 figure for the
ash. Mr. Flaherty explained it was the $19,847 figure which
covered the .cost of transporting and distributing .the..ash as well
as items A:through E in the report. Council member Foy..asked• the
consideration of Council to take some :money from the interest
earned .portion of the bond issue-to augment Chesterley Park and
increase it. by:$7,000 to. have an adequate tree surgeon review and a
design plan prepared.to take care of the old and sick trees in the
Naches Avenue. corridor. Public Works Director, Jerry Copeland,
advised there is . $40.,,000 in the . "other projects" .portion .,of the
bond issue .for ;Naches Avenue .parkway tree; •renovation.... He' said
what staff, .would like. is to get.. the. entire Naches.:_Avenue design
ready. In that way.it would be available in the.event we receive
donations from . „a . service .organization as, well ,as. when the-. bond

8. REPORT FROM PERSONNEL,. DIVISION.:.. REGARDING AFFIRMATIVE ACTION
• PROGRAM
Archie Sutton, Personnel _Officer, submitted the Affirmative Action
report for the year 1988 and asked for questions.. Council member
Beauchamp asked if the 43.3% figure for .females in. the_ aggregate
Metropolitan Area (MSA) included. all females or only
white females. Mr. Sutton .clarified that it includes all females
and the 21% minority.figure is primarily males, but there could be
a cross over with females. .Council member Carmichael asked for
verification that .Yakima Metropolitan...Area actually :_refers to
. Yakima County. After discussion and reference. an.area map it
was determined the County is the MSA...Phil .Pleasant, 1101 E. '"A"
St., brought up his concerns with the .report, the -goals_for Black
minorities, and the method of. depicting the statistics.. He stated
by including women.as.minorities it lowers the Black. opportunities
for minority positions..Be expressed concern with .the. method of
establishing and interpreting_ minority goals._ He , ,also.. stated his
concern that. all.. the. minorities are lumped. together :in the Garbage
Department.. when they,..need , to. be. utilized _throughout ,.the .entire
organization.. ,Mayor. Berndt advised Mr. Pleasant to be aware that
minority does ..not just mean Black but also ,includes Hispanic,
Asians,- etc. Mr. Pleasant .responded. that the first :definition
under minority is "Black ".. He continued that, • in his,. opinion, it
is Council's obligation to enforce the law to see that contractors
really do have minorities on their payroll as they say they do when
submitting. bids. Council member Foy emphasized that it is every
department head's responsibility to ensure .bids .meet Affir ative
Action requirements.' City' Manager Zais responded to Mr. Pleasant
that the report is representative:of the City's.Affirmative Action
in terms of hiring .and contract compliance. He :continued that the
City 'is not... practicing 'anything:: that.. would. be .considered
exclusionary either for jobs.within the•:City,or,:for,,the hiring of

contractors. The hiring of minority contractors is based upon who
is available in this area /region and they must meet the criteria to
be eligible for City employment. After further discussion Mr. Zais
summarized, stating he felt it was a good report representative of
a good faith effort on the part of City employment and contracting.
Mr. Pleasant summed up his concerns, stating that statistics can
tell you anthing you want to hear and emphasized the unemployment
rate' among blacks in Yakima is terrible: IT :WAS BY

ACCIDENTS HISTORY
The report from the Public Works Department regarding 1988 Vehicle
Accidents History, was accepted.
* 10. FIRST QUARTER 1989 MOTOR VEHICLE ACCIDENT REPORT
The First.Quarter 1989 Motor Vehicle Accident Report was accepted.
* 11. CONSIDERATION OF AN ORDINANCE AMENDING TAXICAB DRIVER'S LICENSE
REQUIREMENTS

ORDINANCE_ :NO 3167 ::. AN'ORDINANCE relating to licenses and business
regulations, specifically taxicab • regulation; changing
qualifications for taxi driver's licenses; and amending section
5.78.190 of the.City of Yakima Municipal Code.
