1. ROLL CALL
The City . Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, Council members Clarence Barnett', 'Henry
Beauchamp, Buchanan, Lynn Carmichael, Jerry Foy and Bernard
Sims present on roll call. City Manager Zais, City Attorney Vanek,
and City Clerk Roberts also present.
2. INVOCATION
The Invocation was given by Council member Beauchamp.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER'''
Council member Carmichael reported while she was at the National
League of Cities Conference, she attended a separate 'session
regarding cable tv. She stated there are a lot of changes in that
field and she has a list of questions for staff.

4. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Council members.'or'citizens present. City Attorney Vanek
noted a correction in Item No. 17, Section 3 in the ordinance
should read "dangerous" instead of danger; City Manager Zais stated
in Item No. 10 the year 1986 in the contract should be corrected to

1989. The City Clerk then read the Consent Agenda items, including

Unanimously 'carried by roll -call .vote. (Subsequent .paragraphs

*5. APPROVAL OF MINUTES OF THE COUNCIL MEETINGS OF FEBRUARY 14 and
21, 1989 '
The Council minutes of February 14 and 21, 1989 were approved,
having been duly certified accurate' by two Council members and no
one present wishing to have said minutes read publicly.
6. .AUDIENCE PARTICIPATION
Mayor Berndt'declared the week of March 19 -25, 1989 as Drug and
Alcohol Awareness Week in Yakima and presented Lon Wyrick,
Executive Director of Conference of Governments, with the
proclamation. She stated the event will be promoted by the display
of green ribbons on vehicle antennas, etc.
Mayor Berndt also declared the week of March 24 -31, 1989 as
National - ''Community' Development Week. She presented the
proclamation to Joan Davenport, Associate Planner, who presented
Council with special lapel buttons to wear during this week.
7. REPORT FROM TRAFFIC ENGINEERING DIVISION REGARDING RECONSIDERATION
OF TRAFFIC REPORT ON 32ND AVENUE,'NOB HILL BLVD. TO MEAD AVENUE
('CONTINUED-FROM 1/17/89)
Council member Buchanan expressed concern about Council authorizing
the installation of 4 -way stop signs without warrants having been
met. He commented Council needs to give staff guidance on whether
these signs should be installed based solely upon warrants. If we
are'going to refuse this based on warrants, then other unwarranted
stop signs should be removed. A discussion ensued about the
neighborhood's perceived need for these stop signs and staff's
recommendation that the 4 -way stop signs not be installed at this

time, but review the warrants after completion of the neighborhood
retail center on West Nob'Hill Boulevard and South 24th Avenue. It

* 13. SET DATE OF PUBLIC MEETING FOR APRIL 11, 1989.. ON REZONE AT 5407
SUMMITVIEW, FROM.R -2 TO SCC, AS REQUESTED BY MYRON ABRAMS
April 11, 1989 was set as the date for a public meeting to consider
the recommendation of the Hearing Examiner on.the request of Myron
Abrams to rezone. property. in the vicinity of .Summitview and North
56th Avenue from R -2 to SCC.
* 14. SET DATE OF PUBLIC HEARING FOR APRIL .25, 1989 ON FINAL ASSESSMENT
ROLL FOR VIEWMONT SEWER L.I.D. NO. 1045
April 25, 1989 was set as the date of public'hearing on the final
assessment roll for Viewmont Sewer L.I.D. No. 1045.
* 15. APPROVE OUT -OF -STATE TRAVEL .FOR. DAVE.BROWN, WATER. DIVISION, TO
EDMONTON,' ALBERTA, CANADA
The Out -of -State travel for Dave' Brown, Water Treatment Plant
Supervisor, to attend the American Waterworks Association Research
Foundation Conference in Edmonton, Alberta, Canada, April 5 -8,
1989, at a cost of $737.00, was approved.
16. CONSIDERATION. OF AN ORDINANCE. AMENDING THE .YAKIMA, MUNICIPAL
CODE TO REMOVE. THE EXEMPTION ON "LONG DISTANCE' INTRASTATE TOLL
CHARGES AND INCREASING 'THE MAXIMUM'TAX LIMIT TO $3,000 ON GROSS
INCOME
John Hanson., Finance Director, .stated he has some updated
information on Cascade. Natural Gas and asked Council to change the
estimated. impact of increase from.$95,000 down to .$45;000. City
Manager Zais said we still don't have a report :fran AT &T, which is
the biggest industry in the group of long distance carriers, nor do
we have information from Sprint or American Share Cam. He
hopes those revenues will enable us to 'accomplish Phase I of the

Police Department's project. Larry Mathews, 805 So. 17th Avenue,
commented the 1988 Year -End Budget Report shows a $95,000 savings
in the Police Department budget and asked why this additional tax
.is.. .needed. City Manager . Zais . responded,. saying ;.there . are :,.always
going to be expenditure savings in the Police Department'budget due
to unexpected vacancies throughout the year, however, each position
:needs toy_ be. budgeted for _the full year... He' said. this ordinance
..focuses on: enhanced =staffing and does not :.become effective; until
July: 1st.: - Mr.. : Mathews! also asked:. Council.: why ..they had. changed
their minds and this issue won't Abe going. on, the.:ballot' to.:ba voted
on by the citizens. Mayor Berndt stated the utility tax option
required a vote of the people; this does not. Council, member
Barnett commented the utility tax would have had a significant •
impact on the poor and the elderly in the winter heating season and
this tax won't impose such a burden on them. Ordinance No. 3163,

*17. CONSIDERATION OF AN ORDINANCE AMENDING THE DANGEROUS DOG
ORDINANCE ; a . _ .
ORDINANCE...NO.J3164,: AN..ORDINANCE relating to public safety' and
morals and animal control; regulating dangerous dogs; declaring
certain conduct in relation to dangerous - dogs to be a crime;
regulating howling and barking dogs; and enacting 6.20.170 as a new
section, amending Section 6.20.040,•and Subsection A of Section
°6.20.160 and repealing Section 6.20.030, all of the City of Yakima
Municipal Code. • • .
*18. 'CONSIDERATION OF AN ORDINANCE• AMENDING. THE 1989 BUDGET AND
APPROPRIATING FUNDS FOR A YAKIMA CENTER STUDY (SECOND READING)
An Ordinance appropriating funds for a Yakima Center Study, having
been read by title only on February 28, 1989, was brought before
the Council for a second reading.
ORDINANCE.:: NOo: "3165';": AN` ORDINANCE amending . the 1989 budget for the
City of Yakima; and making an appropriation of $3,750 in the
Tourist Promotion Fund for expenditure during 1989 for a Yakima
Convention Center Feasibility Study.
19. OTHER BUSINESS
Council member Barnett stated we have a letter from Judge Gavin
asking us to appoint an ex- officio member to the Yakima County
Community Corrections Board and Council member Carmichael had
requested she be. nominated to serve on that Board. It was-MOVED-BY
