BUSINESS MEETING
• 1. ROLL CALL.
The City Council met in session on this date at 2:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, Council members Clarence Barnett, Henry
Beauchamp, Jerry Foy and Bernard Sims present on roll call.
Council members Lynn Buchanan and Lynn .Carmichael absent and
"' excused: City ..Manager Zais, City Attorney Vanek, City Clerk
Roberts, and Deputy City Clerk Toney also present.
2. INVOCATION
The Pledge of Allegiance was led by Mayor Berndt. •
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Mayor. Berndt announced the Council has been requested to submit a
member's name for the Yakima County Community Corrections Board.
She stated Council member Carmichael has expressed an. interest on
being on this board. City Manager Zais briefly explained the
purpose of this nine member board is to develop. a Community
Corrections Plan for the County. Mayor Berndt commented. it was
also suggested that Pleas Green, Police Chief, serve: on. the Board.
It was the general consensus of the Council to discuss this at the
next meeting after Council has had an opportunity to review the
letter requesting this appointment.
4. CONSENT AGENDA
Mayor Berndt referred •to _the items . placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Council members or citizens present. Items Nos:. 9, 11, 13
and 15 .were removed from the Consent Agenda, as requested by
Council members and citizens. The City Clerk then read the Consent
Agenda items, including resolutions and ordinances by title. It

*5. APPROVAL OF MINUTES OF THE COUNCIL MEETING ,OF. FEBRUARY 7, 1989
The .Council minutes of February 7, 1989 were approved, having been
duly certified accurate by two Council.members and. no one present
wishing to have said.minutes read publicly.
6. AUDIENCE PARTICIPATION
None.
7. REPORT FROM DEPARTMENT OF ENGINEERING AND UTILITIES• REGARDING
REQUEST FROM GARY .MEADOWS FOR UTILITY. SERVICE FOR PROPERTY IN
VICINITY OF WASHINGTON AVENUE
Dennis Covell,. Director of Engineering and Utilities, reminded
Council that several. months ago, Gary Meadows appeared before
Council and requested water service to his property in.the vicinity
of Whatcom and.. Washington Avenues. Gary Meadows, 1116 McKinley,
was present to respond to Council's questions relating to his
request to Union Gap for service and when Union Gap could serve his
needs, lack of submission of .site plan to locate a well,
and acquisition. of proper easements. Mr. Meadows indicated he has
a letter from Mrs. Smith that says.it's' her intention to grant him
a 16 foot easement after all the particulars: are handled.
Responding to Council . member .Barnett's question. .regarding
staff's suggestion that this line be installed, maintained and

operated at Mr. Meadow's expense, Mr. °Meadows indicated that was
his understanding. He questioned the need for an eight inch main.
Mr. Covell said when an individual requests water service to
multiple lots, the City requirement is to put in an adequate line
to serve them and potential others;• 6" line without fire service
and 8" line with fire service. As the contractor, Mr. Meadows can
put a latecomers agreement on it or turn it over to the City and
collect over and above the costs that he would have spent' on a
line to serve his needs. Another option 'is to go with side
service, a minimum one inch line; assuming all maintenance and
operations for that service. He further stated, if the line serves
more than one house, Mr. Meadows must have a meter per house.
Referring to Paul Burlingame's (Union Gap'City Supervisor) , letter
• indicating an unwillingness to accept the' responsibility of
servicing that area, Council member Barnett questioned if this
letter represents the position of the Union Gap City Council.
Council member Foy said he, too, would like Mr. Meadows to inquire
from Union Gap what their time schedule would be to serve that

4409 Arlington, 'commented that water is a. precious. commodity and
Council should use a. great deal of caution and know, where the water
is going and who,we are supposed to serve. She said Union Gap's
idea is to get whatever they can from our City. and they will keep
their tax base.

8. REPORTS FROM .PUBLIC WORKS DEPARTMENT, TRANSIT. AND TRAFFIC
ENGINEERING. DIVISIONS REGARDING ..BUS, LOADING AND _ UNLOADING IN
VICINITY OF DAVIS HIGH SCHOOL
Council member Barnett explained an alternate proposal for the
location of the bus loading and unloading_ of"studentsi.attDavis High
' School, which may require staff- review. Drawing an illustration
on the blackboard, he suggested the bus could swing in a little on
6th Avenue, still heading east and yet loading and unloading the
students on school property. He stated although he could make the
turn in his vehicle, it is possible there is not enough room for
the bus toy make a complete right turn.. It was MOVED BY.FOY.,

9. CONSIDERATION OF "RESOLUTION AUTHORIZING EXECUTION OF:;000PERATIVE
PURCHASING AGREEMENT WITH CITY OF PUYALLUP
Phil. Pleasant, 1101 "E.: "A" Street, asked how this cooperative
purchase would. impact' him as a small minority businessman. Jean
Reid, Purchasing Agent, stated this would allow the City to
purchase police units with the City of Puyallup. She said
previously this purchase was going to be made jointly with Oregon,
however, General Motors would not permit that. Council member Foy
suggested Mr. Pleasant put together a directory of goods he has
available and Purchasing 'could then notify him when we are going to
bid on any of those products. Resolution No. D -5555 having been

11. CONSIDERATION OF RESOLUTION ENDORSING AFFORDABLE HOUSING PROGRAM
Ines Rice, 4409 Arlington, expressed concern that the housing
committee is not totally representative of the area it is serving.
She suggested that Council look to a committee that really
represents that area :and is willing, to work and 'clean it up. She
noted that: crimes and .drugs are not usually found in areas where
private homeowners are living. Dixie Kracht, Block Grant Manager,
stated she believes Mrs. Rice is referencing the Community
Development Advisory Cormnittee and stated there are _representatives
on the committee from every area of town.. She further explained
the purpose of this resolution is to put the City in a - position to
apply for any program that may become available in the future to
. address housing. Barbara Harris; P. O. Box 812, agreed with.
Mrs. Rice's comments that it's' better to have a stable single
family, .owner- occupied neighborhood.'" She said it's her .belief a
moratorium is needed' on the ' zoning -of ' 'commercial property in
residential ,neighborhood's:_` She said '.she: would "like to,Thave -•more
members on the Community Development ;Advisory : Committee from the
people directly affected. Glenn Rice, Director of Community and
Economic Development, stated the Community Development Advisory
Committee was :established by :ordinance; the composition consisting
of representatives: from four districts, a senior citizen
representative, and a" handicapped 'representative. He .stated the
composition of the committee could be expanded, however, he would
not want to exclude those interests either. Council member Barnett
asked if that could be reviewed. Resolution No. D-5557 having been

B. REVISION OF PARKING ORDINANCE ON 28TH AVENUE BETWEEN TIETON
DRIVE AND WALNUT
The staff recommendation to refer this issue to the Legal
Department for preparation of an ordinance prohibiting parking on
28th Avenue, between Tieton Drive and Walnut, was accepted.
13. APPROVAL OF FOURTH QUARTER. 1988 VEHICLE ACCIDENT REVIEW COMMITTEE
REPORT
Council members expressed concern about the number of accidents
which were deemed to be preventable. Council member Foy asked what
kind of program for driving instruction is being. followed? He
Suggested the'? supervisors, `.talk•,'about, accident prevention before the
employees .go out on the streets. Jerry,. Copeland,. Public Works
Director, commented the stats .in' this report don't address the
overall yearly accident rate, just the winter season. Council
member .Sims 'suggested this 'should be reviewed! ory - vehicle mile or
a division basis. He said Transit is on - the road almost every day.
Council member. Beauchamp asked if this winter season was compared
against statistics from 1987 or .1988? Mr. Copeland. responded those.
comparison were not made, however, he would like to .:do that for his
department. Council member Foy stated he would like to know how
quickly he could get a •report on the accidents occurring in the
first three months of this year and then requested monthly

*14. APPROVAL FEBRUARY'1989 BUDGET REPORT
The February 1989 Budget Report was accepted for filing purposes.
15. • CONSIDERATION OF AN ORDINANCE AMENDING THE 1989 BUDGET AND
APPROPRIATING FUNDS FOR PARTICIPATION IN FEASIBILITY STUDY FOR
CWU /AIRPORT FLIGHT TRAINING PROGRAM (SECOND READING

An' Ordinance appropriating funds
for participation in a feasibility
study for a CWU /Airport Flight Training Program, having been read
by title only a the' February 28, 1989 meeting, was, brought before
the Council for, a second reading.
Council member Foy asked that the check not be'released until we
know if all the participants are releasing their checks. City
Manager Zais - stated this is based on all party's contributing its
share and if that does not happen somebody has to makeup - the
difference or we don't have a .program. He further commented a
contract will have to come to Council for authorization prior to
release of any funds. Ordinance No. 3162 having been read by title

. feasibility' study re: 'Central " Washington. University'' Av ation
Science Program.
16. OTHER`BUSINESS
•
Pat 411`South 48th Avenue, requested to address the
Council - concerning' a` petition signed by a large amount of people
opposing the location of Jack -Sons Tavern in the Glenwood Center.
City Attorney Vanek advised Council there will be a Class 3 Review,
which may come to Council for a .public hearing. Mayor Berndt
•
advised Ms. Zimmerman that, if this should come to the Council for a
hearing, and - Council hears her comments today, Council would be
compromised because Council would hear her, but not` the'others.
She suggested Ms. Zimmerman take this petition to the Hearing
Examiner.
Council member Barnett stated he may be proposing three rate
increases and two rate decreases for the irrigation maintenance
roll assessment, at.the public hearing scheduled for March 28th.
He said the rate increases would be for Districts 857, 996 and 618,
and the rate decreases would be 279 and 395. He explained his
reasons for these changes, but said he would like, additional staff
information regarding the number of main repairs and service calls
for those two districts for which he would propose decreases.
Mayor Berndt reminded Council about the Thursday evening Air Fair
reception. Council member Barnett reminded Council about the
Conference. of Government General Membership meeting tomorrow night
at Wapato- Legion Club. Council member Foy said the Dinosaurs will
be in Yakima April 1st -May 15th.
City Attorney Vanek said Council had asked him to look at the
possibility of recouping. City prisoner medical expenses we have
paid over the past several _years under the City /County jail
contract. He stated he'. looked at the City's litigation
aspect; however, SB 5854 is still alive in the Senate Ways and
Means Committee. He said Senators Matson'and Newhouse sit on that
Committee and Council may want to express support by phone call
since the life of the Bill could be short.
City Manager Zais informed Council that Union Gap requested
reconsideration of transit service to Valley They have

asked for costs and route information, which ,will be - .prov.ided,,
bring" that information `to the Council Transit Committee.' It was
the general consensus of the Council to present this request to the
Council Transit Committee before staff time . is - spent, on . any
research.
