STUDY SESSION '
1. ROLL. CALL
The-.City :Council met ,in ses.siom on this ,date• at: 2:00,,P.M. in

Mayor Pat Berndt, presiding, Council members. Clarence
Barnett, Lynn Buchanan, Lynn Carmichael, Jerry 'Foy and
Bernard Sims present on roll call. Council member Henry
Beauchamp absent and. excused. _City Manager..Zais, City
Attorney Vanek, City Clerk - Roberts and Deputy City Clerk
Toney also present.
2. INVOCATION
The Invocation was given by Council member Foy.
3. OPEN. DISCUSSION FOR. THE GOOD OF THE ORDER
Mayor Berndt announced there will be a Washington State
Citizen Rally this Friday at noon in support of the omnibus
drug legislation, at which Frank Glaspey will represent
her.

4. AUDIENCE PARTICIPATION
Jerry Henderson, 309 No. 35th Avenue, reported the
Washington State _Centennial Committee will meet this
Thursday at 7:30 p.m. at the Yakima Valley Regional Library
basement meeting room. He asked to whom should he report
the_ activities of the Committee and was advised to make
reports•to the Mayor.
Lloyd.Mullanix, 623 No. 26th Avenue, indicated he thought
Council was going to discuss contracting out refuse service.
He commented that they tried the bin service in his
neighborhood and he found several things wrong, with that
service, particularly garbage littering the area. After
advising him that contracting out is not on the agenda for
• discussion „.Mayor Berndt referred •Mr., ,Mullanix: to Del Kary,
Refuse Superintendent, to voice, any` specific complaints and
concerns. ,f ;
Mayor Berndt'proclaimed the week of March 1989 as Girl
Scout Week.
5. REPORT AND DISCUSSION REGARDING UNLICENSED PRIVATE SECURITY
AGENCIES
City Attorney Vanek reviewed the information contained in
the staff report and reported those agencies which were
previously reported to be operating without a license are
now licensed. He stated he was directed by Council to draft
legislation to require businesses employing security
personnel to obtain a private security license with the
• City.:. While researching this issue, ; h;el -;discovered the

Act., _'.iHB.I.19.87.., which. regulate the ,.:private security
bu•si.nesses ••;on, . a state .lev.e1 , and ;;eliminate cities' and
counties'. ability to regulate...these. businesses. He
reported this Bill is still in Committee and does not
address all of Council's specific concerns, but Bills can be
amended. He stated he provided Council with a copy of the
Bill and an article summarizing the origin of this Bill. He
recommended that Council wait until this matter is finished
before legislating any regulations at a local level.
Council member Carmichael commented that this Bill does not
address Council's concern about a firm that employs an

individual for its own security and contracts out security
services, using that person 'on.. other property. Council
members discussed the possibility of offering an amendment
to this Bill or if the Bill is enacted into law, passing a
local ordinance with stricter regulations. Police Chief
Green reported he has not received any more complaints
regarding non - licensing of these agencies. It was MOVED BY

SEND A LETTER :OF..SUPPORT . ON .HB. 1987 TO "THE. ` Ron
Anderson, Central ,Washington .Investigations,: commented he
believes the ordinance in effect now is sufficient, however,
the enforcement efforts of that ordinance. needs improvement.
He .stated there is still a private security business working
without a license, insurance, or a bond. Responding to
Council's questions, he said he has been working with the
Chief of Police on this problem, however, the City
Attorney's interpretation of the ordinance indicates no
license is necessary,. and he disagrees. City Attorney Vanek
reported-he had a long conversation with Mr. Anderson's
attorney, James Hurley, about the wording of the ordinance
and whether it applies to. a .firm who.. hired a security
officer and shares him with another firm. Phil Pleasant,
1101 East "A" Street, as a) black _man, .:expressed concern
about arming private security officers .with weapons without
rules .and regulations to ensure the individual qualifies to
handle a weapon, thus, giving the individual more authority
than the Police. ..The question' was called for a _vote on the
. motion. 'Unanimously carried by voice vote. Beauchamp
absent.
6. REPORT FROM PUBLIC WORKS DEPARTMENT REGARDING REFUSE BIN
SERVICE
Council member Barnett said because of the revenue shortfall
he raised the question during budget discussions whether the
City should be in the bin service. He stated, after
reviewing•this• report with the, refined calculations, he can
accept the current policy. Staff responded to Council
member Foy's questions regarding the in -lieu tax, Public
Works lAdministrative charges, and City service charge
included in the calculation of the refuse bin rates.
Following further discussion regarding the calculations, it
was MOVED .BY.- BARNETT, SECONDED _BY SIMS.,.. TO. ACCEPT. THE
. REPORT.. .Unanimously carried by voice vote. .Beauchamp
absent.
7. OTHER BUSINESS --
Mayor Berndt reported there was information in the lastest
AWC Digest regarding proposed.legislation to require outside
striping of lanes. Commenting this could have a significant
financial impact, she asked Jerry Copeland, Director of
Public Works, to review this legislation and advise the
legislators about the financial impact to the City. .
8. EXECUTIVE SESSION REGARDING COLLECTIVE BARGAINING AND
PENDING LITIGATION
It was MOVED BY-.BUCHANAN,. SECONDED.. BY.CARMICHAEL.,: TO'MOVE
INTO. EXECUTIVE. SESSION' FOR APPROXIMATELY 15 -20 MINUTES FOR
THE PURPOSE OF .DISCUSSING. COLLECTIVE BARGAINING.;.. PENDING
LITIGATION-AND ACQUISITION • OF :PROPERTY, TO.B.E.'.FOLLOWED BY
.IMMEDIATE...ADJOURNMENT. "Unanimously carried .by. voice vote.
