The City Council met in session on this date at 2:00 P.M. in the Council ',Chambers of City Hall, Yakima, Washington; Mayor Pat Berndt, presiding, Council members Clarence Barnett,: Henry Beauchamp, Lynn Carmichael, and Jerry Foy present on roll call. Council'members Lynn Buchanan and Bernard Sims absent_and excused. - City Manager Zais, City Attorney Vanek,. City Clerk Roberts and Deputy City. Clerk Toney also present. 2. INVOCATION • The Invocation was given by Council member Beauchamp. • 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER • Mary Sundquist, Yakima Valley Museum, addressed Council regarding the expansion of the museum, stating an additional 30% of floor space is being added. He thanked the City Council for the•part the City of Yakima has played in this project and presented Mayor Berndt with a "kaleidoscope of time" plaque as an expression of appreciation. Mayor Berndt read a proclamation designating the month of January as "National Blood Donor Month" in the City of Yakima. The proclamation was accepted by Red Cross representative Judy Kiehl. Council member Beauchamp stated he has been notified that the term of Barbara Harris has expired and that she has indicated she would like to be reappointed to the Yakima Housing Authority Board. Unanimously carried by voice vote. Buchanan and Sims absent. 4. CONSENT AGENDA Mayor .Berndt referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present: It was the consensus of the Council that Item No. 8 be added to the Consent Agenda. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. IT WAS MOVED BY CARMICHAEL, _'SECONDED BY ' FOY, ' THAT - THE - CONSENT AGENDA, AS READ, BE . PASSED. Unanimously carried by roll .call. vote. Buchanan and Sims absent. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF MINUTES OF THE COUNCIL MEETINGS OF NOVEMBER 15 & 22 AND DECEMBER 10, 1988 The Council minutes of November 15 & 22 and December 10, 1988 were . approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION„ - . . . .• • Charles Kriz, 5708 Bitterroot Lane, again appeared before Council to speak about local and national concerns. He stated he believes the money being spent by the Yakima County Coalition for the War on Drugs would be better spent if given to the Police Department. He also extended a "left- handed compliment" to Council member Foy on the passage of the motion supporting the intrastate toll on long distance phone service within the state, stating the senior citizens will also have to pay this tax and they are on fixed AAD /1 . r • 0 8 4 JANUARY 10, 1989 incomes. Council member Foy responded that he believes this is good legislation and more equitable than increasing the utility tax. Gary Meadows, 1116 McKinley, addressed Council regarding property between Washington and Whatcom which he purchased in 1985 with the intent of developing. He stated at the time he purchased the two lots he was told he would be able to connect to the sewer line, but now he is being told he cannot connect to the sewer line due to, an amendment in the agreement with the City of Yakima and Union Gap. Following a brief discussion of the situation, Council asked that Mr. Meadows present his written concerns to the City Council and City attorney to review. Assistant City Manager Stouder suggested that Mr. Meadows also submit his request to the City of Union Gap as Union Gap has the primary responsibility in this matter. 7. SECOND PUBLIC HEARING ON PROPOSED COMPREHENSIVE WATER PLAN This being the time scheduled for the second public hearing on the Proposed Water Plan, Assistant City Manager Stouder made a few brief introductory comments. He stated he received a letter from John Easterbrook which he distributed to the Council. Mr. Stouder stated he will be responding to.that letter. Mr. Stouder stated the City is continuing involvement in the Yakima River Basin Enhancement process by working with Congressmen Sid Morrison, the Bureau of Reclamation, etc. He stated the future of the Rattlesnake Creek Feasibility Study will depend upon what agreements are reached on the additional water storage. He stated John Mayo, of CH2M Hill is present to respond to any questions the Council or the public may have. Mayor Berndt opened the public hearing at this time. John Klingele, 1312 West Walnut, stated he was greatly encouraged when he received this new plan. He stated there are still some technical problems, ie. Table 6.4 does not match Table 2 in appendix G, but .overall, he sees 'a great improvement. in this particular plan. Mr. Klingele .stated the Plan makes it every clear that the future supplier requirements depend on which demands the City chooses to meet. He said there are many options for the future and this document is a good planning tool for the future. Larry Mathews, 805 S. 17th Avenue, stated the report heavily discounts the use of groundwater as a source for meeting the City's needs. He said at the current time the City treats 20 million gallons of water per day, however, projected another 10 million gallons will be needed by 1990, and that the City .currently has three' wells capable of producing 8.5 million gallons presently .. available. He said two .years: ago he talked with. a_ staff member about those wells and was told they have been turned .on twice in the last four years so they have basically been ignored. Mr. Mathews stated the report places a lot of emphasis on the contamination of groundwater by agricultural chemicals and pointed out that our water comes from the mountains to the north and there is not much agricultural land in between that would percolate into the groundwater. He said the entire emphasis of the report seems to be placed on expanding supply, adding that he understands the present budget is diverting 1 million dollars of reserves from the water fund to do more work on the Rattlesnake Creek Project. He stated this concerns him because the Yakima Indian Nation is not supportive of anything in the Rattlesnake Creek area, but they will support participation in the enlargement of Bumping Lake. Mr. Mathews stated the underlying thrust of this .report seems to point toward Yakima developing a metro water system serving Terrace Heights, Union Gap, Selah and Nob Hill Water Association. He stated the City has a low income level and does not think the City should carry the financial burden alone. Mr. Stouder clarified that the City is not diverting 1 million dollars from the water reserve, and further, the City has spent a tremendous amount of time studying the enhancement process and is supportive of the enlargement of Bumping Lake. Mr. Stouder indicated that a work program will be prepared for an environmental assessment to be AAD /2 085 JANUARY :°10;1989 conducted in 1990 or 1991, 'adding that''"the City not anticipate any major feasibility work during 1989 on the Rattlesnake Creek Project. • There. being .no other present to speak; to this issue, the public hearing was closed, and Council members were given the opportunity to address staff regarding the Water Comprehensive Plan. Council member Barnett stated that unless the City transfers irrigation water to the domestic water system and becomes a regional purveyor of water; .he .does not see the need to expand before the year 2025... He referred.to Table. 11 -1,, page 11 -5, and asked'if'Phase III could be asterisked, and also the construction of the low. zone .reservoir, withia footnote that these expenditures are contingent upon those two major actions.. He stated he is not aware of any commitment by Nob Hill Water Association, Union Gap, Selah or Terrace Heights to join the City in becoming a regional supplier. He pointed out that the.Ci:ty will not know the :answer to the irrigation question until the settlement of the Aquavella case. Mr. Stouder stated that is a good suggestion and one which he believes is already covered in the plan, but he will make. that footnote included. Mr. Zais responded to Council member Barnett's inquiry about whether the public comments are included in the material forwarded to the Department of Social and Health Services stating that the minutes of. the public hearing accompany the certified resolution enacting the Water Comprehensive Plan. Mr. Stouder stated the City's Water Comprehensive Plan is unlike any other plan in the state due to the fact that we are simultaneously . looking at a major storage issue at a time when new storage is not being addressed by many...other cities, and unlike any other City, the City of Yakima has 66 irrigation' systems with which to contend. PLAN AT A FUTURE COUNCIL .MEETING. Under discussion, Council member Beauchamp asked what is the difference between surface water and groundwater. Mr. Stouder stated surface water is rivers and streams and open flow water, while groundwater is the well. The question was called for a vote on the motion. Unanimously carried by voice vote. Buchanan and Sims absent. *8. CONSIDERATION OF CITIZEN'S REQUEST'FOR TWO -WAY LEFT TURN•LANE ON 40TH AVENUE JUST NORTH OF ENGLEWOOD The report dated January 10,. 1989 from. the Department of Public Works regarding the request for a two -way left turn lane on 40th Avenue between Englewood and Kern Road was accepted. Staff recommended no left turn lanes on 40th Avenue between Englewood • Avenue and Kern Road. *9. APPROVAL OF FINAL CONTRACT PAYMENTS FOR (STANDARD MOTION V -B, . ACCEPT PROJECT AND APPROVE FINAL PAYMENTS): A. VIEWMONT.PARK SEWER.;LID'NO. 1045 . The report from the City Engineer dated January 4, 1989, with respect to the completion of the work on the Viewmont Sewer LID No. 1045 project, performed by Central Concrete & Utilities, was approved, the work accepted and payment of the final estimates as therein set forth was authorized. .__ • .. B. 40TH AVENUE, FROM NOB BOULEVARD TO LINCOLN AVENUE • The report' from the City` Engineer dated January 3, 1989, with respect to the completion of the work on the 40th Avenue, Nob Hill Blvd: to Lincoln Avenue, performed by Superior Asphalt, was approved, the work accepted and'payment of the final estimates as therein set forth.was authorized. *10. APPROVAL.OF TREASURY REPORT FOR NOVEMBER 1988 (STANDARD MOTION V- B, ACCEPT AND APPROVE REPORT) AAD /3 0 JANUARY 10, 1989 The report from the Director of Finance and Budget dated January 10, 1989, regarding the investments of the City of Yakima for the month of November 1988, was accepted and approved. 11. CONSIDERATION OF AN ORDINANCE PROHIBITING ANIMAL SLAUGHTERING IN- PUBLIC VIEW WITHIN THE :CITY LIMITS • Council member Foy stated he would like to have the word "fish" removed from the ordinance. OTHER BUSINESS : • Council. member Foy stated that a new wood moulding manufacturing industry from Ontario, Canada, will be constructing a plant in Moxee, and employing 75 people immediately, and the capability of hiring 125 in the future.
