BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 3:00 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Mayor Pat
Berndt, presiding, Council members Clarence Barnett, Henry
Beauchamp,. Lynn Buchanan, Lynn Carmichael, Jerry Foy and Bernard
Sims present on roll call. City Manager Zais, City Attorney Vanek,
City Clerk Roberts and Deputy City Clerk Toney also present.
2. INVOCATION
The Invocation was given by Council member Beauchamp.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Mayor Berndt offered congratulations to Dennis Covell, Director of
Engineering & Utilities, who was recently elected President of the
City Engineers Association of Washington.
4. CONSENT AGENDA
Mayor Berndt referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from
either Council members or citizens present. Item No. 11 was
removed from the Consent Agenda, as requested by Council member
Barnett. The City Clerk then read the Consent Agenda items,
including resolutions' and ordinances by title. It was MOVED
by Carmichael, seconded by Buchanan, that the Consent Agenda, as
read, be passed. Unanimously carried by roll call vote.
(Subsequent paragraphs preceded by an asterisk ( *) indicate items
on the Consent Agenda handled under one motion without further
discussion.)
* 5. APPROVAL OF MINUTES OF COUNCIL MEETING OF OCTOBER 11, 1988
The Council minutes of October 11, 1988 were approved, having been
duly certified accurate by two Council members and no one present
wishing to have said minutes read publicly.
6. AUDIENCE PARTICIPATION
•
Skip Semon, 121 East Yakima Avenue, representing a group of
downtown merchants and property owners, adressed Council regarding
concerns of the criminal activities taking place in the downtown
area. Mr. Semon stated he would like to influence Council to use
. their policy setting power to attack this problem and make it a top
priority. Mayor Berndt provided Mr. Semon with a copy of a letter
sent to Governor Booth Gardner this morning indicating the need for
outside assistance in dealing with this issue. Council member Foy
commented this is a letter generated from a meeting held at the
Chamber of Commerce in which Bob Schultz expressed the same
concerns about this issue. Council member Carmichael stated there
will be a public hearing on the budget later in the month and
citizens are encouraged to comment on the budget at that time.
Bob Whitney, whose office is located in the Larson Building,
shared with Council that he has received a great deal of positive
feedback regarding the recently established police foot patrol in
the downtown area.
7. PUBLIC HEARING ON ALLEY VACATION REQUESTED BY WILLIAM ASH FOR
PROPERTY IN VICINITY OF 913 -915 NORTH 6TH AVENUE (CANCELLED; TO BE
RESCHEDULED)
The public hearing on the alley vacation requested by William Ash
was cancelled and will be rescheduled at a later date.

*8. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF CONTRACT WITH
AREA AGENCY ON AGING FOR SENIOR EMPLOYMENT PROGRAM
RESOLUTION NO. D -5520, A RESOLUTION authorizing and directing the
City Manager and City Clerk of the City of Yakima to execute an
agreement with the County of Yakima, Area Agency on Aging, for a
Senior Employment Program.
* 9. DISCLOSURE OF APPLICANT FOR HOMESTEADING AND SINGLE FAMILY HOUSING
REHABILITATION LOAN
The staff report disclosing application of person associated with
the Urban Homesteading and Single - Family - Program and recommendation
to authorize the processing of the application by Laine Durand for
assistance under these programs, was accepted.
*10. SET DATE OF PUBLIC MEETING FOR NOVEMBER 15, 1988 ON THE REZONE OF
PROPERTY AT 810 -820 WEST WALNUT AS REQUESTED BY JACK SPARLING
November 15, 1988 was set as the date of public meeting on the
rezone of property at 810 -820 West Walnut, as requested by Jack
Sparling.
11. REPORT FROM FINANCE ON THE THIRD QUARTER 1988 INSURANCE STATUS
Council member Barnett asked why some of the claims are paid at a
higher rate than the claim was originally filed. Director of
Finance and Budget, John Hanson, responded there often are
additional expenses in processing the claims. City Attorney Vanek
stated typically what happens is that a claim is filed prior to all
of the expenditures being presented to the City. He explained that
with sewer backups, the claim is usually filed immediately after
the incident, prior to all of the expenses having been received,
and any additional expenses are submitted at a later date. He
stated this accounts for some of the discrepancies contained in the
report .to Council. Council member Carmichael pointed out that
there has been more than one sewer backup filed by some of the
claimants and asked what is being done to resolve these recurring
situations. Mr. Vanek stated staff is preparing an ordinance to
require citizens with sewer backup valves to repair and maintain
these valves. Failure to do so will result in denial of the
claim. It was MOVED by Barnett, seconded by Carmichael, to accept
the report. Unanimously carried by voice vote.
*12. APPROVAL OF FINAL CONTRACT PAYMENT FOR YAKIMA CENTER RE -ROOF
PROJECT (STANDARD MOTION V -B — ACCEPT CONTRACT AND APPROVE FINAL
PAYMENT)
The report from the City Engineer dated November 3, 1988, with
respect to the completion of the work on the Convention Center
Reroof project, performed by M. G. Wagner Company, was approved,
the work accepted and payment of the final estimates as therein set
forth was authorized.
13. OTHER BUSINESS
City Manager Zais stated the public hearing on the Water Sewer
Comprehensive Plan will be held on December 22, 1988.

There being no further business to come before the Council, it was
MOVED by Foy, seconded by Beauchamp, to adjourn to November 15th,

1988 at 9:00 A.M. to 12:00 noon for Budget Review. Unanimously
carried by voice vote.
