SUMMARY EXPLANATION:
Mr. Gilbert E. Knotts purchased a parcel of land, Parent Parcel No. 181319 - 14001, located at
321 North 84 Avenue, Yakima, that is included in Final Assessment Roll for L.I.D. 1057, and
that he has subsequently subdivided into eight (8) new parcels. He has requested, pursuant
0 to Chapter 35.44 RCW, and more specifically RCW 35.44.410, "Segregation of Assessments ",
that the City prepare a segregation of assessments for the new parcels created by his
property subdivision. RCW 35.44.410 sets forth the conditions for such an action. A copy of
RCW 35.44.410 is included with the Resolution for reference.

STAFF RECOMMENDATION: Staff recommends that the City Council adopt the attached
Resolution and grant Mr. Knotts' request pursuant to the conditions specified in the
Resolution: specifically, payment by Gilbert E. Knotts to the City of Yakima in the total amount
of $251.00 pursuant to RCW 35.44.410 (which consists of $80.00, an administrative fee of
$100.00, and the Auditor's Office recording fee of $71.00), and delivery of a certified copy of
the Resolution to the City Finance Director.

A RESOLUTION ordering a segregation of the special assessments in Local
Improvement District No. 1057 pursuant to RCW 35.44.410 against a
parcel of land that was designated as Parcel No. 181319 -14001 and is
included in Local Improvement District (L.I.D.) No. 1057.
WHEREAS, the City passed by Ordinance No. 2006 -12, the Final Assessment Roll for
Local Improvement District No. 1057 (L.I.D.), and established the Special Assessments for each
of the parcels included within said L.I.D., which document was recorded under Auditor File
No. 7577187, on August 17, 2007, and
WHEREAS, Mr. Gilbert E. Knotts purchased Parcel No. 181319 -14001 from James C.
Noel, who was the owner of record for the Special Assessments on said Parcel, which parcel
has a street address of 321 North 84t Avenue, Yakima, Washington, 98908, and
WHEREAS, Mr. Knotts has since subdivided the parcel into eight (8) parcels by Short
Plat recorded under Auditor's File No. 7566953, Records of Yakima County, Washington, and
further re- divided a portion of said Short Plat by Short Plat Exemption Numbers 15 -07 and 46-
07, and
II) WHEREAS, Mr. Knolls has paid the outstanding delinquent Special Assessment
associated with the parcel he purchased current to the present date; and
WHEREAS, Mr. Knotts has requested that the remaining balance of the Special
Assessment against said Parcel No. 181319 -14001 be divided proportionately among the newly
created parcels to wit:
181319- 14461, 181319- 14463, 181319- 14464, 181319- 14465, 181319- 14469,
181319- 14471, 181319 - 14472, 181319- 14473, the legal descriptions for which are
contained in Exhibits "A" and "B" attached hereto; and
WHEREAS, the City may, by authority granted under Chapter 35.44 RCW, entitled
"Local Improvements— Assessments and Reassessments ", and more specifically
RCW 35.44.410, "Segregation of Assessments", upon request from a landowner whose
property is included in the Final Assessment Roll, order a Segregation of Assessment for a
subdivided parcel; and
WHEREAS, insofar as the annual L.I.D. assessment for Parcel No. 181319 -14001 is
fully current in the annual assessment payments due as of July 16, 2009, and the City Engineer
has determined that it is in the best interest of the City to grant the requested Segregation of
Assessments, and has prepared an Amended Final Assessment Roll for L.I.D. No. 1057 to
include the revised assessed amounts for the original Parent Parcel . No. 181319 -14001
segregated proportionately among the eight aforementioned new Parcels, and said Amended
Final Assessment Roll is attached hereto as Exhibit °A "; and
• WHEREAS, Mr. Knotts is hereby notified and has agreed that as each of the new
parcels within the "Segregation of Assessment" is sold the assessment balance assigned to the
0 transferred parcel, as set forth in the Segregation of Assessment", shall a be p aid in full at t he
time of property closing; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Pursuant to RCW 35.44.410, and in accord with the specific conditions set forth in this
resolution after the City Finance Director has received a certified copy of this Resolution along
with payment by Gilbert E. Knolls in the total amount of $251.00 (which consists of $80.00, an
administrative fee of $100.00, and the Auditor's Office recording fee of $71.00), then the City
Finance Director or her designee in the Finance Department is ordered to make segregation on
the original assessment roll as directed in this Resolution and as set forth in the Amended
Assessment Roll attached as Exhibit "A ", attached hereto and incorporated herein by this
reference; following which the City shall grant the requested Segregation of Assessments for
Parent Parcel No. 181319 -14001 as set forth herein, and the Amended Assessment Roll as set
forth in Exhibit "A" shall be hereby adopted for Local Improvement District No. 1057 and shall be
recorded immediately thereafter with the Yakima County Auditor.
