The City and Air Park Plaza, LLC have a common interest in insuring that the property is properly cleared and beautified and the wastes removed in accord with legal requirements. Each party is responsible for up to $5,000.00 with any costs above paid by the City. R -2015- A RESOLUTION authorizing and direct the City Manager to execute an Agreement for Building Demolition and Lot Clearing with Air Park Plaza, LLC. WHEREAS, the City of Yakima owns the property located at 1816 S. 24th Avenue, Yakima, Washington; and WHEREAS, to restore the property, the building structure, a decommissioned fuel oil tank, vegetation and asphalt needs to be demolished and removed; and WHEREAS, both the City of Yakima and the Air Park Plaza, LLC have a common interest in insuring that the property is properly cleared and beautified and the wastes removed in accord with legal requirements; and WHEREAS, Air Park Plaza, LLC is willing to commit funding toward the clearing of the property and to installing irrigation and landscaping to make the property attractive, as indicated in the Agreement for Building Demolition and Lot Clearing, attached hereto and incorporated herein by this reference; and WHEREAS, the City Council has determined that it is in the best interest of the City to accept the participation of Air Park Plaza, LLC, to assist with the cost to demolish the structures and improve the City's property pending any further construction development that may occur on the property in the future; Now, Therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager of the City of Yakima is hereby authorized and directed to execute the attached and incorporated Agreement for Building Demolition and Lot Clearing with Air Park Plaza, LLC to provide demolition and removal of the building structure and lot clearing for the City -owned property located at 1816 S. 24th Avenue, Yakima, Washington. Micah Cawley, Mayor ATTEST: Sonya Claar Tee, City Clerk BUILDING DEMOLITION AND LOT CLEARING AGREEMENT BETWEEN THE CITY OF YAKIMA AND AIR PARK PLAZA, LLC This Building Demolition And Lot Clearing Agreement, entered this _ _ day of between the City of Yakima, a Washington Municipal Corporation (hereinafter "City") and the Air Park Plaza, LLC, a Washington Limited Liability Corporation (hereinafter "Plaza") describes the terms and conditions of building, tree, asphalt and decommissioned heating fuel tank removal from the property that is the subject of this Agreement. The parties agree that they shall share in the cost of the demolition and removal of the building structure including any necessary asbestos abatement, the building foundation, the removal of all vegetation and asphalt and the extraction of the decommissioned fuel oil tank from the property identified as 1816 S. 24th Ave, Yakima, Washington. The parties agree that the total cost of the site clearing efforts described herein, including the leveling of the site after the clearing process is completed, shall be shared equally by each party, up to the maximum amount of $5,000. paid by each party individually. Any cost above and beyond the $5,000. equal shares payable by City and Plaza for this work shall be paid by City, so that in no cue shall Plaza be required to participate in the cost of site clearing described herein in an amount in excess of $5,000. The parties agree that the City shall 1) arrange for and contract with the contractors necessary to complete the demolition, site clearing and hauling work, 2) shall obtain the asbestos inspection and abatement services as deemed necessary following an initial asbestos assessment and 3) shall invoice Plaza for Plaza's equal cost share 'up to but not to exceed the maximum participation amount of $5,000. Plaza agrees to provide payment in full for its share of the cost as stated herein within 30 days of receipt of the City's invoice. The parties agree to the terms and conditions set forth herein, as evidenced by the signatures of the authorized representatives of each party, below.
