RESOLUTION NO. R-2015-011
authorizing the City Manager to prepare and execute purchase,
sale and exchange documents and deeds with Cascade Parkway,
LLC for exchange of two parcels and purchase of one parcel of
property, for purposes of acquiring right-of-way for development of
public street known as Cascade Mill Parkway (first phase) and
associated roundabout.
, WHEREAS, the City Council of the City of Yakima (City) previously adopted
Resolution No. 2013-138 reserving City -owned property known as Yakima County
Assessor's Parcel No. 191318-43003 for development of the first phase of Cascade Mill
Parkway, designed to be a four -lane, landscaped divided roadway which begins at a
planned roundabout at the intersection of Fair Avenue, East Lincoln Avenue and Martin
Luther King, Jr. Boulevard, which street and roundabout project is listed in the City's Six -
Year Transportation Improvement Plan; and
WHEREAS, when Resolution No 2013-138 was considered and approved, the
reservation of City -owned property as right-of-way for such project was described as the
first step in a four -step process to accomplish the acquisition of necessary rights -of way
for the construction of the subject portion of Cascade Mill Parkway. The four -step process
was described as:
(a) Reserve City -owned parcel (Yakima County Assessor's Parcel No.
191318-43003) by Resolution as future City right-of-way for the project;
(b) Indentify property adjacent to the City -owned parcel that will be necessary
to purchase to acquire sufficient right-of-way for the extension of Cascade Mill
Parkway;
(c) Utilize Yakima County Right -of -Way staff for acquisition of such properties
to be purchased;
(d) Purchase right-of-way for Cascade Mill Parkway;
and
WHEREAS, the City, in conjunction with the Yakima County Right -of -Way staff,
has accomplished the first three steps of the acquisition process and is ready to proceed
with purchase and acquisition of the necessary property; and
WHEREAS, acquisition of the necessary property is shown and summarized on
the map attached hereto as Exhibit "A," and includes an exchange of parcels with
Cascade Parkway, LLC, and purchase of a parcel from Cascade Parkway, LLC; and
WHEREAS, the Yakima County Right -of -Way staff has received a written Letter of
Opinion of Value dated December 5, 2014 from Carson T. Olafson, a qualified appraiser,
stating that the parcels of property to be exchanged are generally equivalent in size and
value, and thus subject to disposition by exchange; and
WHEREAS, the Yakima County Right -of -Way staff has received an appraisal from
a qualified appraiser establishing the appraised value of the parcel to be purchased by the
City from Cascade Parkway, LLC, to be $74,800.00; and
WHEREAS, the Yakima County Right -of -Way staff have recommended approval
of the proposed property exchange and purchase; and
WHEREAS, the City Council finds and determines that the City Manager should
be authorized to prepare and execute any and all necessary and appropriate documents
and deeds to accomplish the exchange and purchase of the parcels described above, and
that such authorization and action is in the best interests of residents of the City of Yakima
and will promote the general health, safety and welfare; therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
1. The exchange of parcels by and between the City of Yakima and Cascade
Parkway, LLC, together with the purchase of the parcel described above and as further
described in the map attached as Exhibit "A" and incorporated herein by this reference,
being portions of Yakima County Assessor's Parcel Nos. 191318-43003 and 191318-
44022, is hereby approved.
2. The City Manager is hereby authorized to prepare and execute any and all
necessary documents and deeds to accomplish such exchange and purchase, and is
authorized to expend up to $74,800.00 for the purchase of the designated parcel within
Yakima County Assessor's Parcel No. 191318-44022, together with such additional and
incidental funds necessary to accomplish such purchase and exchange in escrow and
closing.

SUMMARY EXPLANATION:
Construction of the Fair Avenue Roundabout will develop the first leg of the Cascade Mill
Parkway. An exchange of land for street right-of-way between the City of Yakima and Cascade
Parkway LLC is required to begin the project. The subject parcels are approximately the same
size and land value, as determined by a private appraiser. The land swap is voluntary for both
parties and will result in more logical land use for interests.
