AT TAC HM E NT S : Description Upload Date Type 3-1 3/8/2022 Cover Memo 3-8 3/10/2022 Cover Memo 1 MINUTES YAKIMA CITY COUNCIL March 1, 2022 City Hall -- Council Chambers 4:15 p.m. Executive Session; 5:30 p.m. Regular meeting -- conducted in person and virtually via Zoom EXECUTIVE SESSION 1.Executive Session regarding pending litigation and to consider the selection of a site or the acquisition of real estate by lease or purchase per RCW 42.30.110 (1)(i) and (b) Present: Mayor Janice Deccio, presiding, Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Holly Cousens and Eliana Macias Absent: Councilmembers Patricia Byers and Danny Herrera MOTION: Cousens moved and Lund seconded to adjourn to Executive Session for up to 1 1/4 hours to discuss pending litigation and to consider the selection of a site or the acquisition of real estate by lease or purchase per RCW 42.30.110 (1)(i) and (b). The motion carried by unanimous vote, Byers and Herrera absent. Executive Session was held and adjourned at 5:20 p.m. 1.Roll Call Present: Mayor Janice Deccio, presiding, Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Holly Cousens, Patricia Byers (attending remotely via Zoom and present until 6:26 p.m.), Danny Herrera (attending remotely via Zoom) and Eliana Macias (attending remotely via Zoom) Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Sonya Claar Tee 2.Pledge of Allegiance Mayor Deccio led the Pledge of Allegiance. 3.Interpreter Services Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4.Open Discussion for the Good of the Order Councilmembers observed a minute of silence for the people of Ukraine. A.Proclamations Page 1 of 4 DRAFT 2 i.WIAA month proclamation Councilmember Herrera proclaimed the month of March 2022 as Washington Interscholastic Activities Association (WIAA) month and WIAA Executive Director Mick Hoffman, WIAA staff, board members and other affiliated members, accepted the proclamation. B.Presentations / Recognitions / Introductions i.Yakima Valley Tourism 2021 Annual Report presentation John Cooper, Yakima Valley Tourism President and CEO, presented a video of the 2021 Yakima Valley Tourism Annual Report. ii.Yakima School District Briefing Yakima School District Superintendent Trevor Greene and District Athletic Director Sarah Cordova, provided a report on activities occurring with the Yakima School District. C.Appointments to Boards, Commissions and Council Committees i.Appointment to the Planning Commission Councilmember Cousens reported on the February 17, 2022 Council Nominating Committee meeting. MOTION: Brown moved and Byers seconded to appoint Kenton Gartrell to the Planning Commission. After discussion, the motion failed by a 5-2 vote, with Cousens, Deccio, Herrera, Lund and Macias voting no. MOTION: Cousens moved and Lund seconded to reopen the application process for the Planning Commission with a closing date the end of March. The motion carried by unanimous vote. MOTION: Cousens moved and Lund seconded to have a study session on a future date on boards and committees. The motion carried by unanimous vote. 5.Council Reports A.Council Code of Ethics and Principles of Conduct MOTION: Cousens moved and Lund seconded to approve the Council Code of Ethics and Principles of Conduct. The motion carried by unanimous vote. 6.Consent Agenda Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Cousens moved and Brown seconded to approve the consent agenda. The motion carried by unanimous vote. R-2022-032, A RESOLUTION fixing time for a public hearing before the Hearing Examiner on April 14, 2022, on a petition (Petition No. 22-01) to vacate a portion of platted right-of-way along Pacific Ave. D.Resolution accepting and approving 4th Quarter 2021 Claim Report RESOLUTION NO. R-2022-033, A RESOLUTION accepting and approving the 4th Quarter 2021 Claim Report for the City of Yakima E.Resolution authorizing a permit for continued use of right-of-way for lights projecting over the street frontage at 506 Fruitvale Blvd RESOLUTION NO. R-2022-034, A RESOLUTION authorizing the issuance of a right-of-way use permit to continue the use of the installation of six (6) street lights along the turn-about frontage at Fruitvale Blvd and N 5th Ave F.Resolution authorizing an Agreement to lease 30 shares of Yakima Tieton Irrigation District irrigation water to the City of Tieton RESOLUTION NO. R-2022-035, A RESOLUTION authorizing a Lease Agreement with the City of Tieton and Yakima-Tieton Irrigation District to lease 30 shares of the City of Yakima’s Yakima Tieton Irrigation District water to the City of Tieton for the water year 2022. G.Resolution authorizing award of Bid 12201 to Grating Pacific LLC., for Aluminum Bar Grating for Catwalk RESOLUTION NO. R-2022-036, A RESOLUTION authorizing award of Bid 12201, to Grating Pacific LLC., for Aluminum Bar Grating for Catwalk H.Resolution authorizing a Grant Agreement for a Summer Experiences & Enrichment for Kids (SEEK) program RESOLUTION NO. R-2022-037, A RESOLUTION accepting and authorizing a Grant Agreement for a Summer Experiences & Enrichment for Kids (SEEK) program to be administered by the City of Yakima Parks and Recreation in the amount of $135,125. I.Resolution adopting amended Rules of Procedure of the Yakima City Council RESOLUTION NO. R-2022-038, A RESOLUTION adopting amended Rules of Procedure of the Yakima City Council. J.Ordinance Creating Street Overlay and Reconstruction Fund 346 (First Reading) First reading of an ordinance establishing the Street Overlay and Reconstruction Fund 346. K.Ordinance Creating Transportation Benefit District Fund 344 (First Reading) First reading of an ordinance establishing the Transportation Benefit District Fund 344. 7.Public Comment Page 3 of 4 DRAFT 4 Kenton Gartrell, City resident, thanked Council for considering his application to the Planning Commission and reported this was his second time applying so he will not apply again. Izamar Garay Lages, City resident, spoke in support of her husband Kenton Gartrell. DEPARTMENT ITEMS 8.2021 3rd & 4th Quarter Capital Improvement Projects Report City Engineer Bill Preston reported on the 3rd and 4th Quarter 2021 Capital Improvement Projects. 9.2022 State Legislature Session Briefing Randy Beehler, Communications & Public Affairs Director, provided a briefing about the 2022 session of the Washington State Legislature. 10.Letter of Intent with the Greater Yakima Chamber of Commerce with regards to delay of Chamber improvements and conducting a parking feasibility study City Attorney Sara Watkins reported on a letter of intent with the Greater Yakima Chamber of Commerce with regards to delay of Chamber improvements and conducting a parking feasibility study. 11.Other Business MOTION: Brown moved and Lund seconded to have a future study session on municipal WIFI. The motion carried by unanimous vote, Byers absent. 12.Adjournment MOTION: Lund moved and Cousens seconded to adjourn to a City Council study session on March 8, 2022, at 5 p.m. in the Council Chambers. The motion carried by unanimous vote, Byers absent. City staff have evaluated the existing City Council boundaries with the new population data, and recommends that the City Council consider some adjustments to the boundaries, because of the imbalance of population between the existing districts. Attorney Watkins presented three options, noting a correction on option 2 is now to be considered, instead of option 2 in the agenda packet. Option 1: District boundaries are similar to current boundaries, but altered to create population equality. Corrected Version of Option 2: 16th Avenue is used as a general boundary for Districts 3 and 4 rather than Nob Hill Blvd. This creates a possible future third Latino Citizens of Voting Age Population (LCVAP) majority district. Option 3: 16th Avenue used as boundary for Districts 3 and 4 rather than Nob Hill Blvd. Page 1 of 2 DRAFT 6 MOTION: Macias moved and Herrera seconded to direct staff to start the process to adopt the corrected version of Option 2. The motion carried by a 4-3 vote with Brown, Byers and Cousens voting no. 5.Biennial Budgeting for Cities Jennifer Ferrer-Santa Ines, Director of Finance and Budget, reviewed the process of adopting an annual budget and reported a biennial budget would provide an opportunity for better long-range and strategic financial planning and consolidation of efforts invested in the budget development and approval process, thereby improving services to the citizens of Yakima. Councilmember Byers spoke in support of a biennial budget. 6.Adjournment MOTION: Lund moved and Brown seconded to adjourn to the next City Council regular meeting on March 15, 2022, at 5:30 p.m. in the Council Chambers. The motion carried by unanimous vote.
