ITEM TITLE: Set September 15, 2009 as the date for an "Open Record" public hearing to
consider the Development Agreement for a 66 -lot Master Planned Development by Toscanna
LLC (developer).

SUMMARY EXPLANATION: Set Date of an "Open Record" public hearing on a proposed
Development Agreement. The proposal is for a Master Planned Development to allow a
private /gated subdivision, which requires that the City enter into a Development Agreement with
the applicant.
An "Open Record" public hearing was held on July 9, 2009, and the Hearing Examiner issued
his written recommendation for approval of this application, subject to conditions, on July 22,
2009. City Council approved the Preliminary Plat of Toscanna, Phase 1, on August 18, 2009.
