R- 2014 -153 A RESOLUTION amending Capital Facilities Element of the Yakima Urban Area Comprehensive Plan 2025 to add downtown plaza as a planned capital facility of the City of Yakima. WHEREAS, the City of Yakima (City) is required to adopt a comprehensive plan under the Washington State Growth Management Act, and has adopted the Yakima Urban Area Comprehensive Plan 2025 ( "Comprehensive Plan "); and WHEREAS, pursuant to RCW 36.70A.130 and YMC 16.10.035(2)(c), the City may amend its Comprehensive Plan concurrently with the adoption or amendment of the City's budget; and WHEREAS, the City's 2015 Budget contains an appropriation of $800,000 from Real Estate Excise Tax (REET 2) revenues, authorized pursuant to RCW 82.46.035, to be used for preliminary studies and design for the planning, construction, reconstruction, repair, rehabilitation, or improvement of a public plaza park and abutting public streets and rights -of -way, known as the "Yakima Central Plaza," located within and upon City - owned property commonly described as Yakima County Assessor's Parcel No. 191319- 24507. Such property is bounded on the west by South 2 Street, on the south by East Chestnut Avenue, on the east by South 3 Street, and on the north by a designated alleyway; and WHEREAS, a public hearing on the proposed amendment to the Comprehensive Plan has been held on December 9, 2014 pursuant to the public notice requirements of YMC 16.10.070, and in conjunction with the adoption of the City's 2015 Budget; and WHEREAS, after consideration of all testimony and evidence presented at such public hearing, the record herein, and the 2015 Budget, the City Council finds and determines that: (a) The City Council has jurisdiction to consider and decide all issues in this matter; (b) All public notice requirements of YMC 16.10.070 have been met and satisfied, (c) The amendment of the Comprehensive Plan to add the Yakima Central Plaza to the Capital Facilities Element is in the best interests of residents of the City of Yakima and will promote the general health, safety and welfare; (d) The amendment of the Comprehensive Plan to include the Yakima Central Plaza within the Capital Facilities Element of such Comprehensive Plan is considered and accomplished concurrently with the adoption of the City's 2015 Budget, all in compliance with RCW 36.70A.130 and YMC 16.10.035(2)(c); and 1 WHEREAS, the City Council finds and determines that Chapter VII (Capital Facilities Element) of the Yakima Urban Area Comprehensive Plan 2025 should be amended to add the Yakima Central Plaza capital facility project; now, therefore; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: 1. Chapter VII (Capital Facilities Element) of the Yakima Urban Area Comprehensive Plan 2025 is hereby amended to add the Yakima Central Plaza capital facility project as described and set forth above; and 2. The City Manager is hereby authorized and directed amend the Yakima Urban Area Comprehensive Plan 2025 to include such Yakima Central Plaza, and to delineate revenue amounts and sources projected for the development and construction of such capital facility, including but not limited to funds appropriated in the 2015 Budget from REET 2 and any other appropriate funding source; now, therefore, ADOPTED BY THE CITY COUNCIL this 9th day of December, 2014. For Meeting of: December 09, 2014 ITEM TITLE: Public Hearing to consider a Resolution amending the City of Yakima's Comprehensive Plan adding the Yakima Central Plaza to the Capital Facilities Plan as a public improvement SUBMITTED BY: Cindy Epperson, Director of Finance & Budget SUMMARY EXPLANATION: Real Estate Excise Taxes are required by State law (RCW 82.46.035) to be used on projects that are "specified in a capital facilities plan element of a comprehensive plan ". State law also allows the comprehensive plan to be amended annually concurrently with budget adoption to add budgeted projects to the capital facilities plan. Council has approved "next steps" for Yakima Central Plaza. To accomplish the next phase of the project, an additional $800,000 is being added to the final budget for preliminary engineering /design. Currently, the best source of funds to accomplish this is the second quarter percent Real Estate Excise Tax (REET 2). Even though it is likely that we will reimburse these costs with bond proceeds when we do issue bonds for the entire project, we feel this is a necessary step to be able to spend REET 2 funds in 2015. The attached legislation amends to Capital Facilities Plan element of the Comprehensive Plan to add the Yakima Central Plaza.
