WHEREAS, pursuant to YMC 6.88, the SEPA Administrative Official issued a Determination of Nonsignificance for the rezone request inaccordance, with WAC 197- 11-355, as required under the State Environmental Policy Act; and WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on October 22, 2014, (the "recommendation"), recommending that the City approve the rezoning of one certain parcel of property as more fully described herein; and WHEREAS, the City Council finds that the findings of the Hearing Examiner set forth in the recommendation in response to the requirements of Yakima Municipal Code ("YMC") § 15.23.030(D) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein; and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. The introductory findings relative to the open record public hearing process for this application are as follows: (1) The He. ng Examiner conducted an open record public hearing for this application on October 9, 2014. (2) The staff report which was presented by Assistant P1. er Robbie Aaron recommended approval of this request to rezone a parcel from the Multi -F. ily Residential (R-3) zoning district to the Professional Business (B -I) zoning district. (3) The applicant's representative for this application, Thomas R. Durant of Durant Development Services, Inc., testified in favor of the requested rezone and specifically with regard to the need for additional property with B-1 zoning in this area. (4) A written comment was submitted by Clark Pe ann who has a professional office building across the street from the site and who expressed concern about the fact that employees of businesses on 50th Avenue park along both sides of the street, about the Bernice Monahan Rezone from R-3 to B-1 118 North 50th Avenue RZ #004-14; SEPA #022-14 1 * fact that traffic backs up at Summitview Avenue and about the fact that trees on the site should be removed to avoid further damaging the sidewalk and asphalt. A written comment was also submitted by Roger Kline whose residence abuts the site on the west and who expressed the hope that there would be a landscape buffer either left in place or created on the rezoned commercial property to protect the residential property on the west and south borders. (5) No other testimony or written public comments were submitted at the hearing. (6) This recommendation has been issued within ten business days of the hearing. B. Summary of Recommendation. The Hearing Examiner recommends that the Yakima City Council approve this request for a rezone from the Multi -Family Residential (R-3) zoning district to the Professional Business (B-1) zoning district. C. Basis for Recommendation. Based upon a view of the site and surrounding property without anyone else present on October 8, 2014; the information contained in the staff report, exhibits, testimony and other evidence presented at an open record public hearing on October 9, 2014; and a review of the Yakima Urban Area Comprehensive Plan and the Yakima Urban Area Zoning Ordinance; the Examiner makes the following: FINDINGS 1. Applicant/Property Owner. The applicant and property owner is Bernice Monahan, 304 South 49th Avenue, Yakima, Washington. The representative of the applicant and property owner for this application is Thomas R. Durant of Durant Development Services, Inc., 513 North Front Street, Yakima, Washington. The location of the requested rezone is on the west side of North 50th Avenue at 118 North 50`' Avenue. It is Assessor's tax parcel number 181321-41425. III. Application. This application for a non -project rezone of approximately 2.98 acres was submitted on July 10, 2014. The applicant does not have any development plans for the subject property. This rezone is being requested in order to improve the marketability of the site since the applicant believes that the property is better suited for B-1 zoning which would allow for expansion of commercial uses that already exist north of the site. IV. Notices. Notices of the open record public hearing of October 9, 2014, were provided by the following methods: Mailing of hearing notice to owners within 300 feet: August 8, 2014 Publishing of hearing notice in the Yakima Herald -Republic: August 8, 2014 Posting of hearing notice on the property: August 28, 2014 V. State Environmental Policy Act. A final Determination of Nonsignificance (DNS) was issued by the City of Yakima for this application on September 8, 2014, after a 20 -day comment period. The appeal period expired on September 22, 2014, without any appeals being filed. VI. Current Zoning, Comprehensive Plan Designations and Land Uses. The subject parcel is currently zoned as Multi -Family Residential (R-3) and is currently designated as High Density Residential in the Comprehensive Plan. Rezone Review Criteria. Recommendations regarding rezone applications within the Yakima Urban Area must be based upon the following criteria specified in Subsection 15.23.030(E) of the Urban Area Zoning Ordinance: (1) The testimony at the public hearing: Assistant Planner Robbie Aaron and the applicant's representative Thomas Durant testified in favor of the requested rezone. There was no testimony offered at the hearing in opposition to the requested rezone. The written public comment relative to sitescreening will be addressed by the sitescreening requirements in the City zoning ordinance when the property is developed. The written public comment relative to restricting parking to one side of the street is best addressed to the City's traffic engineer. There is no evidence in the record to indicate that develop- ment pursuant to the requested B-1 zoning would create any more traffic than development pursuant to the existing R-3 zoning. There were no comments from the Development Services Team which met on September 23, 2014. (2) The suitability of the parcel for uses permitted under the proposed zoning: The fact that the subject property is suitable for uses permitted within the Professional Business zoning district is shown by the following factors: (a) The subject parcel is relatively flat and is served with all necessary public utilities. It has access to and frontage on a public street. It is a short distance from an arterial street (Summitview Avenue) with access to that street entirely through a Bernice Monahan Rezone from R-3 to 13-1 118 North 50th Avenue RZ #004-14; SEPA #022-14 4 DOC. INDEX � -t commercial area that has the same B-1 zoning that is being proposed here. Allowed commercial land uses would be similar to existing land uses to the north, northeast and east. (b) The subject parcel would be of sufficient size to accommodate many of the uses listed in the table of permitted land uses for the Professional Business zoning district. The Class (1) uses which are permitted outright and which could potentially be utilized on the subject parcel without Type (2) or Type (3) review in the B-1 zoning district include exercise facilities; daycare centers; libraries; museums, art galleries; group homes (six or fewer), adult family homes; stockpiling of earthen materials; mixed use buildings; financial institutions; massage therapy/spas; offices and clinics; and offices -- contractor, building and trade (plumbing, heating, electrical and painting). The subject property would generally be suitable for permitted 13-1 uses since any permitted B-1 uses would be developed in accordance with City zoning ordinance and City code requirements and would likely be similar to some of the uses already existing in the area. (3) Recommendations from interested agencies and departments: The Planning Division recommended approval of the requested rezone. No other agencies or departments submitted comments favoring or opposing this rezone application. (4) The extent to which the proposed rezone is in compliance with and/or deviates from the goals and policies as adopted in the Yakima Urban Area Comprehensive Plan and the intent of the Zoning Ordinance: The fact that the proposed rezone complies with the goals and policies of the Comprehensive Plan and the intent of the zoning ordinance is shown by the following factors: (a) The Comprehensive Plan: This rezone request complies with the City's 2025 Comprehensive Plan Future Land Use Map (Map I1I-3). Table 111-11 entitled Future Land Use and Current Zoning Comparison supports the proposed rezone from the R-3 to the 13-1 zoning district. The High Density Residential designation is intended for some mixed land uses such as professional offices and community services. The requested rezone is also in compliance with the following Compre- hensive Plan provisions: Bernice Monahan Rezone from R-3 to B-1 118 North 50th Avenue RZ #004-14; SEPA #022-14 5 DOC. INDEX Goal 3.6: Provide opportunities for office development to promote economic growth and to meet the need for office space in the Yakima Urban Area. Policy 3.6.1: Encourage clustering of office development in concentrated areas. Policy 3.6.2: Use offices as transitional uses between commercial and resi- dential areas. Policy 3.6.3: Promote small-scale office development that will not have significant adverse impacts on adjacent neighborhoods. Policy 3.6.4: Encourage placing parking lots behind buildings, or along the side of buildings. (b) The Zoning Ordinance: Subsection 15.03.020(D) of the City's Urban Area Zoning Ordinance states that the purpose of the existing Multi -Family Residential (R-3) zoning district is to establish and preserve high-density residential districts by excluding activities not compatible with residential uses; to locate high-density residential development of more than twelve dwelling units per net residential acre in areas receiving the full range of urban services; to locate high-density residential development near neighborhood shopping facilities; and to locate high-density residential development so that traffic generated by the development does not pass through lower density residential areas. Subsection 15.03.020(E) of the City's zoning ordinance states that the purpose of the requested Professional Business (B-1) zoning district is to establish and preserve areas for professional offices; provide a buffer between commercial clusters and residential neighborhoods; and locate professional offices in areas presently receiving a full range of urban services. There is already commercial zoning and development to the north, east and northeast of the subject parcel along North 50th Avenue and Summitview Avenue. Any new development on the subject parcel will have to comply with the development standards in the B-1 zoning district. Those include structure setback standards in Table 5-1 of Chapter 15.05, off-street parking standards in Table 6-1 of Chapter 15.06, sitescreening standards in Chapter 15.07, signage standards in Chapter 15.08 and other applicable development standards in the Urban Area Zoning Ordinance and in other ordinances. (5) The adequacy of public facilities such as roads, sewer, water and other re - Bernice Monahan Rezone from R-3 to B-1 118 North 501 Avenue RZ #004-14; SEPA #022-14 6 DOC. INDEX fill, IP quired public services: The public facilities are adequate for B-1 uses on the subject parcel for the following reasons: (a) The parcel has access by way of North 50th Avenue from Summitview Avenue which is an arterial street through an existing developed commercial area. (b) There are Nob Hill Water water lines and City of Yakima sewer lines along North 50th Avenue and along Summitview Avenue. There is a stormwater manhole in North 50th Avenue indicating that there are drainage facilities in the vicinity even though drainage is often retained on the development site. (c) Schools and fire and police services are available in the general area. The proposed B-1 zoning is likely to have less need for public schools and for other public services than development under the current R-3 zoning. (6) The compatibility of the proposed zone change and associated uses with neighboring land uses: The requested rezone and associated B-1 uses would be compatible with neighboring land uses for the following reasons: (a) This proposal would not represent any substantial change in the type of potential use of this site because of the similarity between R-3 and B-1 zoning and the existence of overlapping land uses in those zoning districts. (b) This site is particularly compatible with neighboring land uses, when compared to other locations, because it already has utilities and improved frontage and access that would direct most traffic to the arterial street system without passing through residential areas. (c) There are existing commercial properties to the north, the east and the northeast which are zoned B-1 and which are developed with uses similar to the type or types of uses likely to be developed on the subject property. (d) The residential areas to the south and to the west adjoin the site on their rear lot lines and do not generally share access with the subject property. Residential and commercial traffic would therefore be mostly separated on the local access streets. Sitescreening and other buffering measures required by the zoning ordinance would also help facilitate compatibility with neighboring land uses. INDEX # (7) The public need for the proposed change: The testimony, application information and staff report all agree that there is a public need for additional B-1 zoning in this area for the following reasons: (a) Mr. Durant testified that his review of aerial photographs disclosed the existence of more vacant property zoned B-1 in 2004 than at the present time. (b) The application information and staff report agree that B-1 zoning outside of areas in and around the downtown core is found in relatively small areas located along arterial streets and at major intersections. Most of these areas west of downtown are built out with businesses that serve the surrounding residential community, with one or two vacant lots in a few areas. The largest vacant B-1 zoned area in the vicinity of the site is at the corner of 48th Avenue and Nob Hill Boulevard. (c) Enlarging the already existing B-1 zoned area at and near the inter- section of North 50th Avenue and Summitview Avenue would provide more opportunities for compatible businesses and employment centers of the types that already exist and for possibly other mixed-use development in this neighborhood. VIII. Consistency of the Rezone with Development Regulations and with the Comprehensive Plan under the Criteria Required by Subsection 16.06.020(3) of the YMC is to be determined by consideration of the following factors: (1) The types of land uses permitted at the site if the site were rezoned to the City's Professional Business (B-1) zoning district would be consistent with the Compre- hensive Plan's current High Density Residential designation for the site. (2) The density of residential development or the level of development such as units per acre or other measures of density is not a factor weighing against this rezone request. The requested rezone would not increase the density of residential development beyond what is allowed under the existing R-3 zoning for the subject parcel. Any future development would have to comply with applicable B-1 zoning ordinance setback, sitescreening and other standards which would promote the compatibility of the development with neighboring uses. The subject property is located in an area where all urban services and facilities are present. No extension of utilities is required, and adequate public facilities exist to accommodate future expansion. CONCLUSIONS Based on the foregoing Findings, the Hearing Examiner reaches the following Conclusions: (1) The Hearing Examiner has jurisdiction under Subsections 15.23.030(C) and 15.23.030(E) of the Urban Area Zoning Ordinance to make a recommendation to the Yakima City Council regarding this rezone application. (2) The public notice requirements of Chapters 15 and 16 of the Yakima Municipal Code have been satisfied. (3) SEPA review resulted in issuance of a final Determination of Nonsignificance (DNS) on September 8, 2014, which became final without any appeals being filed during the appeal period. COMPREHENSIVE PLAN COMPLIANCE The proposed rezone is fully supported by the City of Yakima's 2025 Comprehensive Plan Future Land Use Map (Map III -3) as the subject properties High Density designation and Table III -11 Future Land Use and Current Zoning Comparison supports the proposed rezone from R-3 to B-1 zoning district. The City of Yakima's Comprehensive Plan 2025 further defines the High Density Future Land Use designation as "Multi -Family residential development which may include apartments, condominiums and townhouses containing 12 or more dwelling units per acre. A limited range of other mixed land uses may be permitted, such as some professional offices and community services." The Goals and Policies of the 2025 Comprehensive Plan which support this rezone and use include: Goal 3.6: Provide opportunities for office development to promote economic growth and to meet the need for office space in the Yakima Urban Area. Policies: 3.6.1: Encourage clustering of office development in concentrated areas. 3.6.2: Use offices as transitional uses between commercial and residential areas. 3.6.3: Promote small-scale office development that will not have significant adverse impacts on adjacent neighborhoods. 3.6.4: Encourage placing parking lots behind buildings, or along the side of buildings. URBAN AREA ZONING ORDINANCE The City of Yakima Urban Area Zoning Ordinance and map indicates that the subject property is currently zoned R-3, Multi -Family Residential which is intended to: 1. Establish and preserve high-density residential districts by excluding activities not compatible with residential uses; 2. Locate high-density residential development more than twelve dwelling units per net residential acre in areas receiving the full range of urban services; 3. Locate high-density residential development near neighborhood shopping facilities; and 2 4. Locate high-density residential development so that traffic generated by the development does not pass through lower -density residential areas. If the proposed rezone is approved the subject property would be changed to the B-1, Professional Business District zoning district which is intended to: 1. Establish and preserve areas for professional offices; 2. Provide a buffer between commercial clusters and residential neighborhoods; and 3. Locate professional offices in areas presently receiving a full range of urban services. REZONE CRITERIA Recommendations for approval of rezone applications are governed by seven criteria specified in YMC § 15.23.030. 1. Testimony at public hearing. Neighboring property owners within 300 feet of the subject property have been mailed a Notice of Application, Environmental Review, and Public Hearing, and have been invited to submit written and oral comments on the proposed application up to and through the public hearing. Two comments were received prior to the public hearing. The first comment addresses traffic and parking concerns due to the already existing commercial development to the north and east of the subject property (Permann e-mail dated August 13, 2014). The other comment is in regards to future sitescreening in order to create a buffer between potential commercial development and the existing residential districts (Kline e-mail dated August 28, 2014). Based upon the public comments submitted prior to the public hearing, City staffs recommendation for approval is still warranted. However, after consideration of both the written and oral public comments at the public hearing it may be appropriate for the City of Yakima's Hearing Examiner to modify the staff's recommendation. 2. Suitability of property for proposed use. The property is relatively flat (not steep), has access and frontage to a public street, short distance from an arterial street (Summitview Avenue) with access to that street entirely through a commercial area with identical zoning to that being proposed and available utilities. Allowed commercial land uses would tend to be similar to, and compatible with, the land uses adjoining the site to the north and northeast. 3. Recommendations from interested agencies. No agencies are opposed to this rezone. 4. Compliance with the Comprehensive Plan. B-1 zoning is allowed in areas designated High Density Residential under the comprehensive plan, and the land uses allowed in the B-1 zoning district are generally compatible with land uses in the R-3 zone. Therefore, a Comprehensive Plan Amendment is not required. Adjoining property to the north and northeast is designated Professional Office by the comprehensive plan. This proposed rezone would effectively permit the enlargement of the existing office commercial area. 5. Adequacy of public utilities. Access to the site is via North 50th Avenue to Summitview Avenue, an arterial street through an existing developed commercial area. There are Nob Hill Water and City of Yakima sewer lines in 3 DOC. INDEX #A-1- 50th and Summitview Avenues. There is a stormwater manhole in 501h Avenue indicating drainage facilities in the vicinity, although drainage is often retained on the development site. Schools, fire and police service is available in the general area. The proposed B-1 zoning is likely to have less need for public schools and other public services than development under the current R-3 zoning. 6. Compatibility of proposed use. The existing commercial uses to the north, east and northeast are similar to the type of land use likely to occur in this location. Those areas already have identical B-1 zoning. The residential areas to the south and the west adjoin the site on their rear lot lines and generally do not share access with the rezone site. This lack of access from the rear of the property would keep residential and commercial traffic mostly separated on the local access streets, and the site screening and other buffering measures required by the zoning ordinance would also help facilitate compatibility. 7. Public NeedlChange in Circumstance Other than the areas in and around the downtown core, the B-1 zoning district is a relatively small zoning district, located along arterial streets and at major intersections with businesses located to serve the surrounding residential community. Most of these areas west of downtown are built out, with one or two vacant lots. The largest vacant B-1 zoned area in the vicinity of the site is at the corner of 48'h Avenue and Nob Hill Boulevard. Enlarging the already existing B-1 zoned area at the intersection of 501h and Summitview Avenues would provide more opportunities for compatible businesses and employment centers of this type and possibly mixed-use development in this neighborhood. Other factors that support this application are the close similarity between R-3 and B-1 zoning due to their inherent compatibility with each other and overlapping types of land use. Consequently, this proposal would not represent and substantial change in the type of potential use of this site. Also, the suitability of this site, when compared to other locations, having utilities, improved frontage and access that would direct most traffic to the arterial street system without passing through residential areas. ZONING ORDINANCE DEVELOPMENT STANDARDS The zoning ordinance sets forth specific standards for lot size, maximum lot coverage, minimum building setbacks, parking, building height, sight screening, etc. All standards of the zoning ordinance must be met at the time of development. DEVELOPMENT SERVICES TEAM (DST) REVIEW The DST meeting for this proposal was held on September 23, 2014, at which time no comments were submitted by the members of the Development Services Team. STATE ENVIRONMENTAL POLICY ACT On September 8, 2014, the City of Yakima issued a Determination of Non -Significance (DNS) for Environmental Checklist SEPA#022-14. The 20 -day comment period, which precedes the issuance of this DNS, ended August 28, 2014, with no comments received during the 20 -day comment period. The 14 -day appeal period for this DNS ended on September 22, 2014, with no appeals filed. 4 PUBLIC NOTICE Notice for the hearing was provided in accordance with the UAZO requirements in the following manner: Mailing of notice Posting of property Legal Ad published Two comments were received during the comment period. The subject property has a designation of High -Density Residential, however the properties to the north and east of the subject property are designated Professional Office. This property is also located near all the infrastructure that would be necessary to support future development. CONCLUSIONS 1. The hearing examiner has jurisdiction to issue a recommendation on this application to the City Council. 2. The proposed use does not conflict with the goals and objectives of The Yakima Urban Area Comprehensive Plan. 3. SEPA review resulted in the issuance of a DNS on September 8, 2014. The applicant has no development plans at this time. The purpose of the rezone is to improve the value and marketability of the site and because the applicant believes that it is better suited as an expansion of the already existing commercial center at the intersection of 50`h and Summitview Avenues. A. How is the subject property suitable for uses permitted under the proposed zoning? The property is relatively flat (not steep), has access and frontage to a public street, available utilities and short distance from an arterial street (Summitview Avenue) with access to that street entirely through a commercial area with identical zoning to that being proposed. Allowed commercial land uses would tend to be similar to, and compatible with, the land uses adjoining the site to the north and northeast. What is the status of existing land use? The site is vacant, land uses to the west are detached single family residential, to the south, two and multiple family residential (condominiums), to the north a daycare center and to the northeast and east, commercial including offices, medical offices, financial and insurance establishments. B. How is the rezone request in compliance with and/or how does the request deviate from the Yakima Urban Area Comprehensive Plan? B-1 zoning is allowed in areas designated High Density Residential under the plan, and the land uses allowed in the 13-1 zone are generally compatible with land uses in the R-3 zone. Therefore, a plan amendment is not required. Adjoining property to the north and northeast is designated Professional Office by the plan, a designation normally zoned B-1. The proposed rezone would effectively just enlarge the existing office commercial area. C. Are there adequate public facilities, such as traffic capacity, sewer services, potable water, stormwater drainage, schools, fire and police services, and other public services and infrastructure existing on and around the subject property? Access to the site is via North 50th Avenue to Summitview Avenue, an arterial street through an existing developed commercial area. There are Nob Hill Water and City of Yakima sewer lines in 50th and Summitview Avenues. There is a stormwater manhole in 50th Avenue indicating drainage facilities in the vicinity, although drainage is often retained on the development site. Schools, fire and police service is available in the general area. The proposed B-1 zoning is likely to have less need for public schools and other public services than development under the current R-3 zoning. Are the existing public facilities capable of supporting the most intensive use the new (requested) zone? If not, what mitigating measures are going to be implemented to address any short falls in public services that may exist? Based on Title 15, Table 4-1, the most intensive allowable land use in the B-1 zone is probably an institutional land use such as a school or a hospital. Neither are likely in this location, primarily because the site is not large enough. The ability of existing public facilities to support such a land use has not been determined, but the potential short falls would be addressed through their review as Type 3 land uses under Table 4-1, and also subject to further environmental review. The City has sufficient authority under these procedures to ensure that such a land use would have adequate facilities and services available to it or to deny its development at this location. It is important to note that these same land uses are also allowed by Type 3 Review at this site under its current R-3 zoning. The most intensive Type 1 land use in the proposed B-1 zoning is probably a mixed use building, or a complex of commercial or mixed commercial and residential land uses. While it appears that the public facilities and utilities are sufficient to support such development, a larger project would be subject to further environmental review, and very likely a preliminary plat or binding site plan process that would provide for further evaluation of demands and determination of necessary improvements. The most intensive Type 1 land use in the currently existing R-3 zone would probably be an apartment complex and it would be expected to have similar if not higher demand for public facilities and services. Availability of facilities and services should be assumed by the already existing R-3 zoning, existing utilities and the level of development that has occurred (much of it recently) in the surrounding area. The requirements of a specific project would be evaluated more specifically at the time that it is proposed when its needs and characteristics are better quantified. D. How is the proposed zone change compatible with the existing neighborhood uses? The existing commercial uses to the north, east and northeast are similar to the type of land use likely to occur in this location. Those areas already have identical B-1 zoning. The residential areas to the south and the west adjoin the site on their rear lot lines and generally do not share access with the rezone site. This would keep residential and commercial traffic mostly separated on the local access streets and facilitates the sitescreening and other buffering measures required by the zoning ordinance. What mitigating measures are planned to address incompatibility, such as sitescreening, buffering, building design, open space traffic flow alteration, etc? Sitescreening and other development standards of the zoning ordinance are expected to generally address any conflicts. (This statement is not intended to prevent a future property owner from requesting adjustment of or variance from standards, based on justifiable circumstances or project design that is not known at this time). Other measures may also be taken or required based on specific project designs to further address any concerns. E. What is the public need for the proposed change's Other than the areas in and around the downtown core, B-1 zoning is typically relatively small areas along arterial streets and at major intersections with businesses located to serve the surrounding residential community. Most of these areas west of downtown are built out, with one or two vacant lots in a few areas. The largest vacant B-1 zoned area in the vicinity of the site is at the corner of 48th Avenue and Nob Hill Boulevard. Enlarging the already existing B-1 zoned area at the intersection of 50th and Surnmitview Avenues would provide more opportunities for compatible businesses and employment centers of this type and possibly mixed use development in this neighborhood. Other factors that support this application are the close similarity between R-3 and B-1 zoning due to their inherent compatibility with each other and overlapping types of land use. Consequently, this proposal would not represent a substantial change in the type of potential use of this site. WHEREAS, pursuant to YMC 6.88, the SEPA Administrative Official issued a Determination of Nonsignificance for the rezone request in accordance with WAC 197- 11-355, as required under the State Environmental Policy Act; and WHEREAS, the Hearing Examiner for the City of Yakima issued a recommendation on October 22, 2014 (the 'recommendation"), recommending that the City approve the rezoning of one certain parcel of property as more fully described herein; and WHEREAS, the City Council finds that the findings of the Hearing Examiner set forth in the recommendation in response to the requirements of Yakima Municipal Code ("YMCJ) § 15.23.030(D) are correct and appropriate, and that the same should be adopted by the City Council as its findings herein; and WHEREAS, the City Council finds that it is in the best interest of the City to enact the following; now therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF YAKIMA, WASHINGTON: Section 1. The following parcels of property located in the vicinity of Summitview Avenue and North 50th Avenue shall be, and the same hereby are, rezoned from Multi -Family Residential (R-3) to Professional Business (B-1): Tax parcel number 181321-41425. Attached hereto and incorporated herein as Exhibit "A" are legal descriptions of said property. Section 2. The findings of the Hearing Examiner's recommendation in this matter dated October 22, 2014, are hereby adopted by the City Council as its findings in Page 1 of 3 DOC. INDEX # —2 support hereof pursuant to YMC § 15.23.030(E), and are incorporated herein by this reference as if fully set forth herein. Section 3. Any and all zoning, land use, and other similar maps maintained by the City of Yakima shall be amended or modified to reflect this rezone. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the Yakima County Auditor. Section 4. Severability: If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional for arty reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 5. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter.
