R- 2014 -134 A RESOLUTION ratifying the declaration of an emergency and authorizing the City Manager to execute all applicable contracts for the repair /refurbishment of the damage to East Yakima Avenue as a result of the water main break on October 25, 2014. WHEREAS, Article VI, section 6 of the City of Yakima Charter and the Yakima Municipal Code Chapter 1.80 provide that the City Council may declare an emergency dispensing with the necessity for bidding for services, material, and equipment and supplies costing more than $25,000; and WHEREAS, on October 25, 2014, a City of Yakima water main broke under a portion of East Yakima Avenue generally located between North 1 Street and North 2 Street, and the roadway, ballast and lateral support of the affected roadway was damaged by water leaking from the broken water main; and WHEREAS, City of Yakima staff have inspected the damaged section and determined that the condition of the damaged roadway constitutes an immediate hazard to vehicular traffic, and that the need to make immediate repair constitutes an emergency under Article VI, Section 6 of the Yakima City Charter and state law; and WHEREAS, Yakima Avenue is a main arterial in the downtown core; and WHEREAS, traffic is severely disrupted due to the damage; and WHEREAS, the water main will be replaced between North 1 Street and North 2nd Street, this will reduce future risk and it is cost effective to make the main replacement during the road repair; and WHEREAS, city staff has reviewed the extent of damage and necessary repairs and necessary replacement of water main in the affected area, and estimates that the cost of such repair will be approximately $125,000, and WHEREAS, the City Council finds that it is in the best interest of the City to declare an emergency and authorize, and specifically ratify, the execution of all necessary documents to repair /refurbish, and to repair, Yakima Ave between North 1 Street and North 2 Street, now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. The City Council hereby declares that the water main break within Yakima Avenue generally located between North 1 Street and North 2 Street, constitutes an emergency as and from the initial break on October 25, 2014, all in accordance with Article VI, Section 6 of the Yakima City Charter and applicable law; and Section 2. The City Manager is authorized to undertake immediate repairs and /or replacement of water main, to secure necessary and appropriate contractors to make such repairs within the scope of the emergency declared in Section 1 above, and to do all things authorized to accomplish such repairs, including without limitation, execution of contracts and hiring of persons to perform such work, all without calling for competitive bids or quotes, and 1 Section 3. The actions of the City Manager and his designee(s) to repair the above - described damage undertaken as and from the time of occurrence of such emergent water main break on October 25, 2014, are hereby specifically ratified and approved, and further declared by the City Council to be necessary work and action performed to repair such emergent damage. For Meeting of: November 04, 2014 ITEM TITLE: Resolution ratifying the declaration of an emergency and authorizing the City Manager to execute all applicable contracts for the repair /refurbishment of the damage to East Yakima Avenue as a result of the water main break on October 25, 2014 SUBMITTED BY: Debbie Cook, Utilities and Engineering Director David Brown, Water /Irrigation Manager SUMMARY EXPLANATION: The 12 -inch water main on the north side of Yakima Avenue between North 1 Street and North 2 Street broke the morning of October 25, 2014. Before the main could be shut down the leaking water caused extensive damage to Yakima Avenue. The water main was patched and service quickly restored, however, Yakima Avenue remains closed to traffic until the road can be repaired. In addition to replacing the damaged subbase and pavement, a new water main will be installed between 1st and 2nd Street. This is a resolution declaring an emergency authorizing the City Manager to execute contract for the repair without asking for bids.
