RE: Betty Rae Way/Peach Ten Lane renaming history
At the July 1, 2014 Public Hearing on renaming Betty Rae Way to Peach Ten Lane, Mr.
Elvin Welch expressed concern and confusion on the status of the road itself and whether
it is a private or public road. The original road, Ramona Road, was platted as right-of-
way, and the `private' designation refers to the fact that it is privately maintained and not
a road the City maintains. In listening to Mr. Welch's testimony, it appears his belief is
that a private road is owned by someone. In this case, it is not, it is public right-of-way,
which is privately maintained.
The formal process for naming or renaming a street within the city of Yakima was not
established until 2005, which can make it difficult to locate these records. Fortunately, a
memorandum dated March 3, 2003 was located, which requested the street be renamed
from Ramona Road to Betty Rae Way.
The memorandum was from Doug Maples, Code Administration Manager, to Dick Zais,
City Manager, and outlined Robert Lynch's request to rename Ramona Road to Betty
Rae Way. Mr. Lynch was residing at 5408 Ramona Road at the time and the request was
in order to honor the memory of Mr. Lynch's recently deceased wife. In this memo, Mr.
Lynch, as well as Shelley Willson, Street Division Manager, both acknowledged that
neither the County nor the City maintained the road. The request was approved by
Assistant City Manager Glenn Rice.

Courts Rule on Disclosure of Police Dashboard Cameras,
Searches of Personal Computers
Last month, the Washington Supreme Court ruled that police dashboard camera video may only be
withheld from public disclosure in limited circumstances.
The case stems from a reporter seeking videos arid video logs from the Seattle Police Department
(SPD). SPD argued it was barred frorn releasing, the videos under the State's privacy act.
A divided Supreme Court instead overturned a lower court's ruling that all dashboard camera
videos could be withheld for three years, and held that the Public Records Act's general. rule that
exemptions be interpreted narrowly means that videos can only be withheld when they relate to
actual, pending litigation.
In addition, a Kitsap County Superior Court issued a ruling in a case citir s should watch closely,
Paulson v, the City of Bainbridge island. The court ruled that documents on councilrnembers'
personal computers were subject to the Public Records Act, that the city should have searched
their personal email accounts and computers for documents responsive to a public records act
request:, and that the councilrnembers must turn over their personal computers for a search. The
city has appealed this ruling.
