Patterson and Curtiss Gilbert requesting Council approval to change the name of private street "Betty Rae Way" to "Peach Ten Lane" SUBMITTED BY: Steve Osguthorpe, AICP, Community Development Director Royale Schneider, Code Inspection Office Supervisor, (509) 576-6669 SUMMARY EXPLANATION: Betty Rae Way is a private street extending westerly off North 53rd Avenue, about midway between Scenic Drive and Englewood Avenue. On April 8, 2014, Alan E. Patterson and Curtiss Gilbert (applicant's), submitted an application to change the name of Betty Rae Way to Peach Ten Lane. On May 20, 2014, the City Council reviewed the application, deemed it appropriate for further processing, and set a public hearing to consider the change of name for July 1, 2014. There are currently two residences that have access from Betty Rae Way. Both owners have signed the application for change of street name. Betty Rae Lynch, whom the road was named after, was the wife of Robert Lynch. They previously resided in the home now occupied by Alan E. Patterson. In their narrative, the applicants state that the property was initially purchased by Curtiss Gilbert in 1916 and it became known to that family as the "Peach Ten Block". Currently, the original owner's grandson and family (applicant Curtiss Gilbert) reside in the home at 5402 Betty Rae Way. Both applicant's came to the collective opinion that "Peach Ten Lane" would be appropriate. The street name change procedures are set forth in Chapter 8.70 YMC. The renaming of a street requires that the City Council conduct a public hearing. If, following the public hearing, the City Council determines that the proposed change of name is appropriate, it may adopt an ordinance accomplishing such change. WHEREAS, pursuant to Yakima Municipal Code Chapter 8.70 and YMC 8.70.050, an application was received on April 8, 2014 by the City of Yakima to rename private street "Betty Rae Way" to "Peach Ten Lane;" and WHEREAS, the City Council on May 20, 2014 determined that the application was complete and scheduled a public hearing to be held on July 1, 2014 to consider such application; and WHEREAS, the City Council has conducted a public hearing on July 1, 2014 pursuant to notice duly published, and considered the application, the record herein and all evidence and testimony presented at such hearing, and hereby makes the following findings and conclusions: A. The City Council is authorized pursuant to Chapter 8.70 YMC to receive, consider and approve, modify or disapprove of petitions for change of street names, subject to the provisions of such code; B. The public hearing was scheduled and conducted on July 1, 2014 in accordance with law and applicable procedure; C. The application for change of street name from Betty Rae Way to Peach Ten Lane is complete; D. The City has considered the application, the record herein and all testimony and evidence presented at the public hearing; E. No other petition for change of street name concerning Betty Rae Way is pending or applicable, and the City Council may proceed to consider and act upon the current petition to change the name of Betty Rae Way to Peach Ten Lane; F. The requested name change to Peach Ten Lane is consistent with the street naming policy of Chapter 8.70 YMC, and the changed name consists of twelve characters; G. Approval of such name change is in the best interests of residents of the City of Yakima, and should be granted; and WHEREAS, the City Council, having made the above findings and conclusions, hereby ordains as follows; now, therefore, 1 BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Renaming of Betty Rae Way to Peach Ten Lane. Upon the effective date of this Ordinance, the name of Betty Rae Way, a private street, as shown and delineated on the maps attached hereto and incorporated collectively herein as Exhibit "A," is renamed Peach Ten Lane, a private street. Section 2. Description of Betty Rae Way, renamed to Peach Ten Lane. Betty Rae Way described below, renamed to Peach Ten Lane as enacted above, is described as follows: Betty Rae Way, renamed herein to "Peach Ten Lane:" Beginning at the easterly terminus of Betty Rae Way at its intersection with North 53rd Avenue; thence westerly upon the right-of-way of Betty Rae Way to the westerly terminus of Betty Rae Way at the easterly lot lines of Yakima County Assessor's Parcel Numbers 181316-43463 and 181316-43468. All situated within the City of Yakima, Yakima County, State of Washington. Section 3. Directive. The City Manager is hereby authorized to undertake all measures to accomplish the street renaming approved herein, including but not limited to, making necessary and appropriate change of street signs and maps of the City of Yakima, and advising all agencies with interest of such change of name for the purposes of facilitating governmental service and emergency service response. Section 4. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 5. Effective Date of Ordinance. This ordinance shall be in full force and effective 30 days after its passage, approval, and publication as provided by law and by the City Charter.
