Councilman Bill Lover requested that a report be made to City Council after the Parks facilities rentals had ended for the year. To date, the additional charge was not needed for any Park facility rentals. The Parks and Recreation Division, with assistance from Planning and Storm Water, completed a report on the property located in Chestnut Hollows, Phase 3. According to the Plat of Chestnut Hollow, Phase 3, "the grading and drainage area shown hereon and noted cannot be altered from the configuration. The easement is herein dedicated to Yakima County." According to Yakima County, the owners of lot 10 are Blaise M 86 Nicole Sullivan. The Commissioners unanimously approved a motion to recommend that Parks not take on responsibility for maintenance of this property. S ms I I /04/2009 90th 89th supplemental information 2009 budget 2 III YAKIMA PARKS AND RECREATION COMMISSION August 12, 2009 Commissioners Present: Bob Busse, Rod Bryant, Paul Williams, Tom Hinman and Alex Deccio City Council: Sonia Rodriguez Staff Present: Ken Wilkinson and Lynn Quesenbury Call to Order. Chairman Bob Busse called the meeting to order at 5:30 p.m. in the Council Chambers at City Hall. The minutes of the July 8, 2009, meeting were approved as written. Informational Item: Non-Park Properties Maintained by Park Maintenance. Responding to Alex Deccio's request at the July meeting, Ken Wilkinson drew the group's attention to a list of non-park properties and very small park properties that Parks and Recreation maintains. He reviewed brief descriptions and maintenance cost estimates for each. He said, however, this information did not indicate how much time these properties take away 411 from the City's other parks. Alex asked how the City came to be responsible for the Fairbrook Addition Islands and the Wine Country Information Center and if there might not be someone more appropriate to be responsible for these properties. Ken said he would look further into the history of the listed locations and Alex suggested distinguishing between those of long standing and those that have been assigned to parks more recently. Information Item: South 89th and 90th Avenues Property Feasibility Study Discussion. Following the previous meeting's discussion of this item, Ken Wilkinson reported he checked with both the City's Legal and Planning Departments. Rod Bryant agreed with that idea but said there is a need to develop a process to address delegation of properties to Parks. Lynn Quesenbury said City Planning's land use applications 40 and processes normally present proposals to all interested parties who are then invited to comment. She cited a recent example where a developer had proposed to include one vacant • parcel for green space which would be donated to the City which would then provide for its care and maintenance. In that case, Parks was able to register its disagreement with the proposal. Alex Deccio suggested asking the City Council to establish an ordinance relating to this issue and volunteered to speak to that group. Ken Wilkinson said he would research existing procedures and possible future ones. The Commissioners unanimously approved a motion to recommend that Parks not take on responsibility for maintenance of this property. Information Item: Upper Kiwanis Redevelopment Update. Ken Wilkinson called attention to two handouts relating to the proposed filling in of Kiwanis Pond - one from Huibregtse Louman Associates and the other from Ken Leingang Excavating. The first was a proposal for professional engineering and surveying services for the project and the second was for furnishing and placing the fill. Ken also indicated the City continues to work with the Department of Ecology. Rod Bryant asked about the deadlines for requesting reimbursement for the Recreation and Conservation grant. Ken said the deadline is September 30, 2010, but there are procedures for requesting extensions if need be. Information Item: 2010 Budget Discussion. Ken Wilkinson reported on his meeting with the Assistant City Manager and Finance Department staff regarding next year's budget. He said they are making progress and moving toward the final draft. Cuts made for 2009 will carry over for 2010. None of the current vacancies will be filled but only one job has been eliminated, that being one of Fisher Park Golf Course's two golf starters. Alex Deccio suggested the Commission make recommendations to the Council. Responding to a question from Bob Busse, Sonia Rodriguez said that she was not speaking for the Council but she thinks recommendations from citizens are very important. Sonia went on to say the City Budget Committee is talking about using prisoners from the City jail to take up some of the slack. Most of these individuals have been convicted for minor crimes and it is difficult to see them sitting in the prison when there is a need that they can fill. Rod Bryant and Sonia suggested the possibility of partnering with Juvenile Justice and putting kids to work. Ken Wilkinson said supervision is an issue and that most of the work needing to be done is somewhat skilled in nature. 40 Information Item: 2010 Policy Issues Discussion. The first of Parks' 2010 policy issues is a feasibility study for water cost reduction. Ken reported. they have already learned that the Washington State Revised Code specifically says one municipal fund cannot subsidize another so staff will look for efficiencies for the coming year. Upon receipt of a proposed final plat, the city council shall at its next • public meeting set a date for consideration of the final plat. Notice of the date, time, and location of the public meeting shall be given to the subdivision applicant, surveyor, city engineer, office of environmental planning, and the Yakima County health officer at least four days prior to the date of the public meeting. B. The city council shall review the final plat during the public meeting and shall approve the final plat if the council determines that the final plat conforms to the conditions of preliminary plat approval and applicable state laws and meets the requirements of this title as they existed when the preliminary plat was approved. C. Upon approving any final plat, the city council shall authorize the mayor to sign the final plat as evidence of city council approval. (Ord. 98-65 § 2 (part), 1998). 14.20.210 Final plat—Recording. All final plats approved by the city council shall be filed for record immediately, or as soon as possible, by the subdivision applicant in the Yakima County auditor's office. The subdivision applicant shall be responsible for all filing fees. Any final plat filed for record containing a dedication shall be accompanied by a current title report. (Ord. 98-65 § 2 (part), 1998). 14.20.220 Final plat—Alterations, vacations. A. The alteration or vacation of final plats filed for record in the office of the Yakima County auditor shall comply with the provisions of Chapter 58.12 Revised Code of Washington. B. All petitions for plat alterations or vacations shall be submitted on forms provided by the office of environmental planning and shall be reviewed by the hearing examiner at an open record public hearing. Yakima Municipal Code Section 1.43.060(D), delegates to the hearing examiner final authority on plat alterations. The final amended plat will be prepared in accordance with the hearing examiner's decision and submitted to the hearing examiner or his/her designee (director of community and economic development) for signature. (Ord. 98-65 § 2 (part), 1998). 14.20.230 Final plat—Street vacations. A. The vacation of any street within a final plat filed for record in the office of the Yakima County auditor shall comply with the provisions of Chapter 35.79 Revised Code of Washington. B. All petitions for street vacations or resolutions of the city council initiating the same shall be reviewed by the hearing examiner and a recommendation made thereon to the city council prior to council action. C. The abutting property owners of any street, alley, or other public way proposed to be vacated shall compensate the city of Yakima for vacated public 1111 0 right-of-way in accordance with the current city council policy on said compensation. (Ord. 98-65 § 2 (part), 1998). 14.20.240 Plat vacation—Requirements for complete application. An applicant for a plat vacation shall submit the following items and information: A. The reasons for the proposed vacation; B. Signatures of all parties having an ownership interest in that portion of the subdivision proposed to be vacated; C. If the subdivision is subject to any covenants which were filed when the subdivision was approved, and whether the proposed vacation would result in the violation or failure of any such covenant, the application shall include an • agreement signed by all parties subject to the covenants providing that the parties agree to terminate or alter the relevant covenants to accomplish the purpose of the proposed vacation of the subdivision or portion thereof. D. A copy of the approved plat proposed to be vacated, together with all plat amendments recorded since the date of the original approval. (Ord. 98-65 § 2 ,(part), 1998).
