For Meeting of: December 7, 2021 ITEM TITLE: Ordinance amending the City of Yakima Municipal Codes Section 3.125.010, Clean City Fund (second reading) SUBMITTED BY: Scott Schafer, Public Works Director- (509)576-6411 SUMMARY EXPLANATION: On November 1, 2021, City Council approved an increase in the refuse in-lieu tax under Yakima Munich Code 7.64.030 from 15%to 20%. The intention behind this increase is to allocate the additional incom raised from the tax towards the Clean City Program. This ordinance amends the Clean City Fund ordinance to reflect the additional funding source. Attached is a redline and a clean copy of Ordinance 3.125.010 for City Council review. WHEREAS, Chapter 3.125 of the Yakima Municipal Code establishes the Clean City Fund for the City of Yakima, which fund pays for a variety of services associated with the Clean City program; and WHEREAS, on November 1, 2021, the City Council approved an increase in the refuse in-tax under YMC 7.64.030 from 15%to 20%; and WHEREAS, the increase in refuse in-lieu tax is intended to provide additional funding for the Clean City program; and WHEREAS, the City Council of the City of Yakima finds and determines that YMC 3.125.010 should be amended to reflect the additional funding resource for the Clean City program, is in the public interest and best interest of the City and its residents; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 3.125.010 of the City of Yakima Municipal Code is hereby amended to read as follows: 3.125.010 Clean City Fund A. There is created the Clean City Fund. B. The Clean City Fund shall consist of monies collected in utility tax imposed on waste systems' commercial refuse collection and monies collected in garbage tax imposed under YMC 7.64.030 to meet program objectives of the Clean City program. Section 2. This ordinance is one making appropriation and shall take effect immediately upon its passage, approval, and publication as provided by law and by the City Charter. PASSED BY THE CITY COUNCIL, signed and approved this 7'h day of December 2021.
