HomeMy WebLinkAboutYakima Firefighters Association Local 469 - Memorandum of UnderstandingMEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF YAKIMA, AND YAKIMA FIREFIGHTERS ASSOCIATION ]LOCAL 469 The parties, City ofYakirna and International Association of Firefighters Local 469 (Local 469 or Union), hereby enter into this tnernorandum OfUnderstanding to resolve certain disputes described below, Recitals Local 469 represents Fire Departinent CITIP10yeCS, employed by the City, in the Public Employees Retirement Systems (PERS) classifications, including 9-1-1 calitakers, public safety dispatchers, and public safety cornmunications supervisors, 1 On or about May 13, 2021, SunComm--thc City's dispatch center —issued Special Directive 2t.001, which announced that beginning May 5, 2021, SunComm personnel should no longer transfer EMS or low-level law, enforcement incidents to the Yakima County Sheriff's Office (YSO). 3. On or about June 7, 2021, Local 469 filed an unfair labor practice complaint with the Public Employment Relations Commission (PERC) challenging the issuance of Special Directive 21.001 as a unilateral change to a mandatory subject of bargaining, implemented without bargaining. 4. PERC docketed that case as 134253-U-21, It is currently pending. 5. Recently, SunComm has assigned significant mandatory overtime, which has impacted the City's budget and affected PERS employees' quality of life. 6. The parties wish to resolve these disputes amicablysand hereby settle them as follows. Terms 1. Effective December 1, 2021, through December 31, 2021 (Adjustment Period), Jenyne Wells shall work a swing -shift position consisting of four 10-hour shifts per week, Wednesday through Saturday. This schedule shall not apply to Ms. Wells' s work in 2022. 2. Ms. Well shall accrue 12 hours of sick leave per month during the Adjustment Period. The change in Ms. Wells's shift shall not affect the credit of hours, under Art. 20.1 to Ms. Wells's holiday bank account accruals for 2021 3. The City shall rescind Special Directive 21.001 by no later than November 12, 2021„ and shall provide the Union notice of that rescission by November 12, 202 1. 4. Within three business days of notice of the City's rescission of Special Directive 21.001, the Union shall withdraw the ULP docketed as 134253-U-2 1. I 5.
