A RESOLUTION ratifying an amendment to a lease agreement between the City of Yakima
and the County of Yakima allowing the County to remain in the City's
former Probation Division office space through February 28, 2009.
WHEREAS, on January 1, 2006, the City and County entered into a Lease Agreement
Between the City of Yakima and the County of Yakima, Washington, City Contract No. 2005-
126 ("Lease"), whereby the County leased office space from the City at no charge for a period
of three years in exchange for the consolidation of City and County probationary services; and
WHEREAS, the County recently informed the City that it is delayed in moving out of the
leased premises until the end of February 2009; and
WHEREAS, the Acting City Manager executed the attached amendment extending the
term of the Lease from December 31, 2008, through February 28, 2009, in consideration for
the County moving out at the end of February 2009 and continuing to provide probation
services; and
WHEREAS, the City Council deems it to be in the best interest of the City of Yakima to
ratify the attached amendment with Yakima County, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The attached and incorporated "Amendment to Lease Agreement Between the City of
Yakima and the County of Yakima, Washington" providing for the County's lease of City
Probation Division office space rent-free through February 28, 2009 is hereby ratified.

AMENDMENT TO LEASE AGREEMENT BETWEEN THE CITY OF YAKIMA AND
THE COUNTY OF YAKIMA, WASHINGTON
THIS AMENDMENT TO THE LEASE AGREEMENT is made and entered into by
and between THE COUNTY OF YAKIMA, a Washington State political subdivision ("County")
and THE CITY OF YAKIMA, a Washington municipal corporation ("City").
WHEREAS, on January 1, 2006, the City and County entered into .a "Lease Agreement
Between the City of Yakima and the County of Yakima, Washington", City Contract No. 2005-
126 ("Lease"), whereby the County leased office space from the City at no charge for a period of
three years in exchange for the consolidation of City and County probationary services; and
WHEREAS, the County is delayed in moving out of the leased premises until the end of
February 2009; and
WHEREAS, the City is willing to extend the term of the Lease from December 31, 2008,
through February 28, 2009, in, consideration of the County's moving out by the end of February
and continuing to provide probation services for the City.
NOW, THEREFORE, in consideration of the mutual covenants, promises, and
agreements set forth herein, it agreed by and between the City and the County as follows:
Section 2 of the attached and; incorporated "Lease Agreement Between the City of Yakima and
the County of Yakima, Washington" is amended to read as follows:
2. TERM: The tenancy created by this Lease shall commence on January 1,
2006, and shall terminate on February 28, 2009, unless otherwise terminated
as provided for herein.
Except as expressly modifiedl herein, all other terms and conditions of the attached Lease shall
remain in full force and effect A copy of this Amendment shall be filed with the Yakima County
Auditor pursuant to RCW 39.34.040.

SUMMARY EXPLANATION:
Ori January 1, 2006, the City and County entered into a Lease Agreement between the City of
Yakima and the County of Yakima. The County leased office space from the City at no charge for
a period of three years in exchange for the consolidation of City and County probationary
*services.
The lease is due to expire December 31, 2008. The County has requested an
extension to the current lease agreement until February 28, 2009. This request is being made
due to construction delays in their new offices.
