For Meeting of: November 1, 2021 ITEM TITLE: Public Hearing and ordinance to amend Yakima Municipal Code 7.64.040 to increase the stormwater tax SUBMITTED BY: Scott Schafer, Public Works Director SUMMARY EXPLANATION: On October 14, 2021, Council directed staff to increase the Clean City Program budget as part of the budget presentation and discussions. On October 19, 2021 , Council directed staff to set a public hearing to discuss amending Yakima Municipal Code 7.64.040 to increase the stormwater tax from 15% to 20%. The increase in the tax will be used to fund the Clean City Program and requires a super majority- (i.e. minimum affirmative vote of 5 votes by City Council). ITEM BUDGETED: No STRATEGIC PRIORITY: Public Trust and Accountability APPROVED FOR SUBMITTAL BY THE CITY MANAGER RECOMMENDATION: Pass ordinance ATTACHMENTS: Description Upload Date Type Ordi na ice-YMC i.64.040-redline 10/21/2021 Ordinance ID Ordinance-YMC 7.64.040-changes accepted 10/21/2021 Ordinance 2 ORDINANCE NO. 2021- AN ORDINANCE amending the City of Yakima Municipal Code Section 7.64.040 Stormwater Tax WHEREAS, the City of Yakima is authorized by Title 35 RCW to acquire, construct, own, operate, and provide financing for storm drainage and surface water management, and to establish rates, fees, and charges therefore; and WHEREAS, in 2019 the City Council authorized the formation of the Clean City Program which provides additional services through the City of Yakima; and WHEREAS, as part of the 2022 budget process, the City Council determined it was appropriate to increase the budget of the Clean City Program to increase additional services associated with the Program in the City; and WHEREAS,the City Council finds that the stormwater tax should be increased from fifteen percent to twenty percent, which will provide additional funding for the Clean City Program; and WHEREAS, the City Council of the City of Yakima finds and determines that adoption of this ordinance amending the stormwater tax rate section of the Yakima Municipal Code, Section 7.64.040, is in the public interest and best interest of the City and its residents; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 7.64.040 of the City of Yakima Municipal Code is hereby amended to read as follows: 7.64.040 Stormwater tax. For the provision of stormwater compliance and stormwater collection services there is levied a tax against the total assessments collected from annual stormwater assessments charges. Commencing January 14, 24149 2022, and effective annually thereafter, the rate of the tax shall be fiftccn perccnt twenty percent. Section 2. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter.
