For Meeting of: November 1, 2021 ITEM TITLE: Public Hearing and ordinance to amend Yakima Municipal Code 7.64.030 to increase the refuse tax SUBMITTED BY: Scott Schafer, Public Works Director SUMMARY EXPLANATION: On October 14, 2021, Council directed staff to increase the Clean City Program budget as part of the budget presentation and discussions. On October 19, 2021 , Council directed staff to set a public hearing to discuss amending Yakima Municipal Code 7.64.030 to increase the refuse tax from 15% to 20%. The increase in the tax will be used to fund the Clean City Program and requires a super majority- (i.e. minimum affirmative vote of 5 votes by City Council). WHEREAS, RCW 35.22.195, RCW 35.21.120 and RCW 35.21.130 give cities primary responsibility to manage solid waste collection and disposal; and WHEREAS, in 2019 the City Council authorized the formation of the Clean City Program which provides additional services through the City of Yakima; and WHEREAS, as part of the 2022 budget process, the City Council determined it was appropriate to increase the budget of the Clean City Program to increase additional services associated with the Program in the City; and WHEREAS, the City Council finds that the refuse tax should be increased from fifteen percent to twenty percent, which will provide additional funding for the Clean City Program; and WHEREAS, the City Council of the City of Yakima finds and determines that adoption of this ordinance amending the refuse tax rate section of the Yakima Municipal Code, Section 7.64.030, is in the public interest and best interest of the City and its residents; now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 7.64.030 of the City of Yakima Municipal Code is hereby amended to read as follows: 7.64.030 Refuse tax. For the provision of refuse services, there is levied a fiftccn perccnt twenty percent tax against the total gross revenue of the refuse fund derived from refuse collection and disposal service charges. Section 2. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter.
