R-2009-31 authorizing and directing the Parks and Recreation Division Manager to implement the addition of a Special Service Charge to the 2008 Parks and Recreation Fee Schedule to provide for unusual and excessive maintenance following certain special events in the City's parks and public spaces. WHEREAS, Yakima City parks and public spaces are available to organizations, associations, clubs and private individuals for special events including sports toumaments, class reunions, festivals, family picnics and so forth; and WHEREAS, upon certain occasions, such events result in the need for increased maintenance and repair to restore the park or public space to its original order, and WHEREAS, the City Council desires that City parks and public spaces be maintained in accordance with accepted standards; and WHEREAS, the City Council desires that fees be collected for the use of City parks and public spaces; and WHEREAS, the City wishes to be compensated for the excessive need for maintenance and repair following certain events; now therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The Parks and Recreation Division Manager of the City of Yakima is hereby authorized and directed to amend the 2008 Parks and Recreation Fee Schedule with the addition and implementation of a new Special Service Charge to be assessed when maintenance and repair of City parks and public spaces exceeds normal standards. ADOPTED BY THE CITY COUNCIL this 24th day of F bruary, 20 ATTEST: David Edler, Mayor 2008 FEE SCHEDULE YAIOMA PARKS & RECREATION DIVISION ELIiECTIVE March 1, 2009 CONTRACTED SERVICES: Organizations, (associations, clubs, groups, etc.) contract with the City of Yakima Parks & Recreation for services such as facilities reservations and scheduling, maintenance, supplies, administration, etc. The organizations pay for these services. PROGRAM FEE FORMULA: In determining fees for services and programs, the following formula will be used: 1) Program personnel wage and benefits *X total program hours plus 2) Facility cost per hour X total program hours plus 3) Depending on the particular program, the following costs will be included as needed: a) Special Equipment d) Insurance b) Material e) Maintenance c) Transportation f) Program Promotion g) Other pjus 4) Administration of program (at least 15% of total costs); equals 5) Total cost of the program dividedby 6) Minimum number of participants. Minimum and maximum number of participants is based on facilities, appropriate student/instructor ratio, safety Limits, and is determined by the supervisor and/or instructor. equals 7) Fee for each participant Wages or salary may be calculated by tfie hour or by the unit (i.e., game, match, etc.). TAXES: Sales or other taxes will be charged when appropriate. In some cases, tax is included in the stated fee. PROGRAM DISCOUNT FOR CITY OF YAKIIVIA RESIDENTS: As a benefit to CITY OF YAKIMA RESIDENTS who participate in the following Parks & Recreation Programs in 2008, a discount of approximately 20% will be offered. Discounts apply to the following areas: a. Special Interest Classes for both Youth and Adults b. Fisher Golf Lessons c. Swimming Lessons d. Youth Sports. However, individuals or organizations wanting to make specific reservations are able to do so at the Parks and Recreation Office using the standardized written application. A non-refundable application fee of $8.00 must accompany each facility use application when it is submitted. Examples of community or special events could include, but are not limited to: community Imeetings, political events, weddings, reunions, public concerts and other similar events open to the general public. 1 Special Events Fees for.2009 will be as follows: 1 -- 50 participants – no special event fee 51 – 99 participants – $ 57.50 101– 200 participants –$ 86.00 201-300 participants –$161.00 Over 301 participants – $195.00 In addition, groups may be required to pay for additional refuse bin service and/or for portable chemical toilets when anticipated attendance exceeds the park's capacity. Special Event Service Charge Events requiring clean-up that exceeds routine litter and trash removal by two hours or more than the standard* known to be normal for that location or where damage to irrigation, restroom and park equipment requires repair and service beyond normal maintenance. The Special Event Service Charge will begin with the second hour and will be charged in increments of one hour at a rate of $50.00 per man hour. * The Park Maintenance Management Plan provides guidelines for standard maintenance for each of the city's parks. The Special Event Fee will be collected before reservations are confirmed. Applicants will be responsible for the condition of the park after the event. Clean-up and/or damage fees will be charged to the applicant as determined by the Parks and Recreation Manager. The Parks & Recreation Manager will have the discretion to limit usage in the Parks based on capacity, parking, neighborhood impact, noise level and availability. CONCESSIONAIRE PERMIT FEE Citizens or Groups wishing to sell concessions in the Parks will be assessed a yearly fee of $215.00. The Parks and Recreation Manager will have the authority to authorize vending in certain parks according to Parks and Recreation Division policy and procedures. The Parks & Recreation Manager will have the authority to ,waive the yearly fee in cases of contracted services or one-time special events. REFUND POLICY If Parks & Recreation needs to cancel an activity, staff will notify registered participants by phone and refund 100% of the registration fee. If you need to cancel a reservation and seek a refund, you should present your receipt with your request up to three (3) days before your activity's registration deadline, unless otherwise stated. If you paid in cash or with a check, a refund for your fee minus a $5 processing fee will be processed by the City's Finance Division and a check will be mailed to you within 15 to 30 days. If you charged your fee on your VISA or Mastercard, the refund will be credited to the original cardholder minus the $5.00 processing fee. There are a few exceptions. Fees of less than $5 will not be refunded. There are no refunds on team sports. Bradford YAKIMA PARKS AND RECREATION COMMISSION January 14, 2009 Commissioners. Present: Bob Busse, Rod Bryant, Tom Hinman, Sam Karr, Mike Nixon and Paul Williams Commissioners Absent: Maureen Adkison Staff Present: Ken Wilkinson, Lynn Quesenbury, Traci Bennett and Ron Anderson Guests: Attached Call to Order. Chairman Bob Busse welcomed visitors and Y -PAC TV viewers and called the meeting to order at 5:35 p.m. in the City Council Chambers at City Hall. He noted the presence of a quorum. The minutes of the December 10, 2008, meeting were approved as mailed. Election of Officers. The Commissioners unanimously approved the election of Bob Busse as chairman and Mike Nixon as vice chairman for 2009. Informational Item: Harman Center Senior Trips Presentation. Ken Wilkinson introduced Traci Bennett, recreation supervisor, and Ron Anderson, recreation program supervisor, both of whom work at the Harman Center and with its trips and tours program. They distributed copies of the 2009 Trips and Tours catalog which describes 39 day, overnight and extended excursions. Traci and Ron described several of the trips including the popular Northwest Flower Show, several plays, the Mariners' spring training and games,mystery day trips and extended travels to Reno and New England. The trips, they said, must be prepaid and information is also included in the monthly newsletter. Ron Anderson said this program is one way to appeal to the Baby Boomers but the trips are geared toward seniors so departures do not usually occur extremely early in the morning and retums are not usually late at night. Planning the annual list includes checking out trips offered by other senior centers, networking and information sharing and travel fairs. Trip evaluations help provide insight, he said, into what works and what doesn't. Responding to a question from Bob Busse, Traci Bennett explained the Harman Center usually provides the tour escort for day trips while the vendors furnish escorts for extended tours. Ken Wilkinson said he had participated in the Leavenworth Christmas Tree. Lighting bus trip in December and noted there is an amazing number and variety of outings planned for 2009. Generally this program is limited to people 55 years old and older but, if a trip is not sold out, it is .opened to those under 55 two weeks prior to departure and participants are signed up on a first -come -first-served basis. Yakima Parks. and Recreation Commission • January 14, 2009, • Page 1 Information. Item: Upper Kiwanis Park Update. Ken Wilkinson reported meeting with City Engineering and with the special interest advisory group to talk about the development design for'Upper Kiwanis. He also reported both the Army Corps of Engineers and the Environmental Protection Agency passed on jurisdiction over the application proposing alterations to the pond and have been forwarded it to the local Department of Ecology Office. At this point in time, discussions continue to explore what can andcannot be done. Ken stated he is not sure the Kiwanis Redevelopment will accommodate four fields as some people have favored, Ken said the design would certainly be able to include three fields. He hopes to have a site drawing within the next several weeks. Information Item: Regional Aquatic Center Update. The aquatic center citizen advisory committee will meet with February 12 with the Mayor and members of the Council aquatic committee. Then the whole Council will hold a study session in April. The council committee is still in the process of talking with the cities of Selah and Union Gap regarding their willingness to participate in a public facilities district election. Ken has contacted consultant USKH to ask for an updated construction estimate relevant to the year 2012. Meanwhile, staff is working on a request for proposals for operation of an aquatic center. Information Item: Youth Commissioner Proposal. Ken Wilkinson passed out copies of a. draft proposal for increasing the Commission's membership to nine with the addition of two new positions designated specifically for youth representatives. He said specifically designating both positions for youth as well as the other proposed minimum requirements — two-year terms, high school upper class standing, city residency, etc. — were open for discussion. Mike Nixon said his impression was that the positions would be open for individuals between the ages of 16 and 22 and that preferred that both slots be filled with youth. Paul Williams generally agreed. Bob Busse suggestedseeking representatives from each of the two city high schools' leadership groups. He also proposed a meeting between the Commission and the Council Committee making the selections to establish what might work the best. Ken Wilkinson encouraged the panel to make a recommendation to the Council and suggested making the guidelines less rather than more restrictive. Paul suggested making the information public by spring break to reach as many people as possible in time for a June appointment. Ken said staff would assemble a formal proposal and bring the issue back at the February meeting. Information Item: Service Charge for Special Events Proposal. Reminding the panel of its December discussion, Ken Wilkinson said dealing with the residual effects of past large events has led staff to seek assistance from event sponsors and the proposal of a Special Events Yakima Parks and Recreation Commission • January 14, 2009, • Page 2 Service Charge. Pending a recommendation from the Commission and subsequent Council action, the proposal seeks to charge sponsors $50 per man hour for exceptional clean-up that exceeds onehour more than the standard maintenance for the particular site. The intent is not to create an additional source of revenue but rather to encourage event sponsors to provide volunteers to help police litter and to restock restroom supplies. Some organizations, the Yakima Youth Soccer Association for example, have already stepped up to provide this type of assistancefor its tournaments. The Commission unanimously approved a motion, made by Paul Williams and seconded by Sam Karr, to recommend that Council adopt of the service charge as written. Information Item: Elks Park Improvement Requests from Yakima National Little League. Referring to Little League's presentation at the December Commission meeting, Ken Wilkinson reported visiting Elks Park with staff members Bill Wells, Tami Andringa, John Thomas and Randy Murphy to assess the situation and determine what repair and request could be reasonably accommodated. The results of that assessment were contained in a report to Little League, copies of which were distributed to the Commissioners. (See January handouts.) For the Good of the Order. Ken Wilkinson reported water condensation problems at Lions .Pool. Consultations indicate the need for a new chiller costing in the neighborhood of $15-20,000. Responding to a question from Tom Hinman, Ken said this particular item had not been included in Lions' 2007 rehabilitation project. He is currently getting quotes for new equipment. Ken has been working with West Valley School District regarding maintenance of West Valley Community Park. Originally the school district agreed with Yakima County for the mowing of the large areas while the county did the trim mowing. The district is willing to continue a similar agreement with the City and a contract to make the arrangement official is being prepared for Council action. Bob Busse invited TV viewers to alert Parks and Recreation when they see things that need attention. Audience member Zach Edmondson said he was former City Mayor Betty Edmondson's grandson, and. asked what are the plans for Fisher Golf Course. Ken Wilkinson said staff is in the process of preparing.a request for operation proposals to explore the possibility of an outside organization operating the golf course beginning in 2010. The intent is to deliver the same level of service without expending the same level of funding. Zach said he suspected the proposed youth commissioners would notsupport closing the course as youth, in particular, enjoy golfing there. If Fisher does not continue as a golf course, he suggested removing the fence and letting it continue as a park. Suggest they appoint someone to police their assigned area or sideline and remind team- mates and fans to pick up their litter. ❑ Confirm their participation in writing by e-mail or snail mail. ❑ One week prior to the event, contact Parks and Recreation to have someone meet you at the park to show you where supplies and waste containers will be located. ❑ Two or three days prior to the event, meet with your volunteers at the site to review the location and to re -confirm assignments. ▪ On the day of the event, have a check-in site with the day's schedule and assignments posted. Touch base regularly with your vol- unteers to make sure everything is on track. LI As your event nears its conclusion, make sure your volunteers are ready for the final sweep through the park. ❑ Before leaving the site, inspect the park and restrooms to make sure all litter has been picked up. Return unused supplies to stor- age and lock up securely. (Name of Event/ s) has been successful for many years and has grown into a community institution! Parks and Recreation is proud to provide the venue and support for your program and looks forward to it each year. I am sad to say, however, that budget and staff revisions over the past decade have take a toll on Parks and Recreation and we have had to reevaluate some of our operational standards. Unhappily, we find ourselves facing a new reality, one where we can no longer continue to provide the same level of service that we have in the past. Beginning this spring, our park "rovers" will visit each park only once a day. This means they will not be making extra stops to empty trash cans, pick up litter and check restroom supplies during your event and this is where we hope we can count on assistance from you. What we are asking is that you provide the manpower to periodically pull and replace trash can liners during your event, place the full liners is a designated location for our staff to remove, police the site for litter and make sure that restrooms are stocked with toilet paper and paper towels. Our crews will make sure supplies are on site and will be responsible removal of refuse from the location. They will also be available to meet with you prior to the event to show you where supplies are stored and how they need to be used. We have also put together a simple checklist that identifies the steps that need to be taken and that may be helpful in organizing a volunteer force. A copy is endosed. This month Parks and Recreation will ask the City Council to consider a rate of $50 per man hour for this extra maintenance service to be assessed when extra service exceeds more than one hour. The proposed Special Service Charge is one that would be billed following events, activities, or programs requiring extra park maintenance exceeding more than one hour beyond the standard day-to-day clean-up and repair. The proposed fee would apply to the City's public spaces as well as its parks. The standard for each park is defined in Parks and Recreation's Park Management Plan. The proposed fee is $50 per man hour and billing would start with the second hour. The intent of the proposed fee is to provide an incentive for groups and individuals planning events to assist with litter patrol and the stocking of restroom supplies, assistance already being provided by some groups including the Yakima Youth Soccer Association for summer tournaments. BOARD/COMMISSION RECOMMENDATION: The Parks and Recreation unanimously approved a motion to recommend that the City Council adopt the Special Service charge as written as its January 14, 2009 meeting. Parks Maintenance staff would assist the users by providing instructions and supplies prior to the event and visiting the park once during the day of the event. Reduction and adjustments in staffing levels over the past has decreased Park Maintenance's ability to provide special services for larger events. In the past Parks staff has been able to visit parks with such events several times throughout the day to empty refuse containers and restock restrooms. In 2009 staff will be scheduled to visit each park to perform day-to-day maintenance only once a day. The proposed fee will hopefully encourage user groups to perform some of these duties or, if such assistance is not forthcoming, provide a small amount of revenue to cover over time services that may be required. •
