R 2009-85 A RESOLUTION related to Historic Preservation, initiating the designation of the Barge - Chestnut Neighborhood Area Historic District, Phase One under the provisions of Yakima Municipal Code 11.62.045 Yakima Register of Historic Places WHEREAS, the City of Yakima desires to establish the "Barge -Chestnut Neighborhood Area Historic District, Phase One" under the provisions of Yakima Municipal Code 11.62.045; and WHEREAS, the "Barge -Chestnut Neighborhood Area Historic District, Phase One" is generally described as the properties that are located within the following boundary: north of West Chestnut Avenue between 31st Avenue and 32nd Avenue, then' east of 32nd Avenue between West Chestnut Avenue and Barge Avenue, then south of Barge Avenue between 24"' and 32hd Avenue, then west of 24"' Avenue between Barge Avenue and West Chestnut Avenue, then north of Chestnut Avenue between 24"' Avenue and 26"' Avenue, then west of 26"' Avenue between Chestnut Avenue and Walnut Street ; then north of Walnut Street between 26"' Avenue and 28"' Avenue, then properties along both sides of North 28"' Avenue between Walnut Street and West Chestnut, and the properties located along the south frontage of West Chestnut Avenue between 28th Avenue and 31st Avenue; and WHEREAS, residents of the proposed Historic District submitted a petition signed by a majority of the properties within the limits of the district; and WHEREAS, the Yakima Historic Preservation Commission reviewed the resident petition and determined that the area contains a significant resource of buildings with architectural qualities which exemplify Yakima's cultural, economic and distinctive history; and conducted a public hearing on May 28, 2009 to receive testimony regarding the formation of the Historic District and, WHEREAS, the Yakima Historic Preservation Commission at the conclusion of the public hearing on May 28, 2009 voted to approve the formation of the Historic District and adopted Findings of Fact to support the recommendation that the district be established in consideration of the requirements of YMC 11.62.045, now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City of Yakima hereby designates the "Barge -Chestnut Neighborhood Area Historic District, Phase One" as a Local Historic District in the Yakima Register of Historic Places under the provisions of the Yakima Municipal Code 11.62.045 ADOPTED BY THE CITY COUNCIL this 16th day ne, 2009. The purpose of this chapter is to provide for the identification, evaluation, designation, and protection of designated historic and prehistoric resources within the boundaries of the city of Yakima and preserve and rehabilitate eligible historic properties within the city of Yakima for future generations through special valuation, a property tax incentive, as provided in Chapter 84.26 RCW in order to: A. Safeguard the heritage of Yakima as represented by those buildings, districts, objects, sites and structures which reflect significant elements of Yakima history; B. Foster civic and neighborhood pride in the beauty and accomplishments of the past, and a sense of identity based on Yakima history; C. Stabilize or improve the aesthetic and economic vitality and values of such sites, improvements and objects; D. Encourage capital investment in the rehabilitation of real property and assist in strategic economic development through the creation of jobs, construction spending and physical improvement within Yakima; E. Promote fundamental growth management principles and the development of sound tools for land use planning, urban design and environmental protections; F. Conserve valuable material and energy resources by ongoing use and maintenance of the existing built environment; and G. Assist, encourage and provide incentives to private owners for preservation, rehabilitation, restoration, redevelopment, and use of historic buildings, districts, objects, sites and structures. (Ord. 2005-02 § 2 (part), 2005). 11.62.020 Short tiMie. The following sections shall be known and may be cited as the "historic preservation ordinance of Yakima." (Ord. 2005-02 § 2 (part), 2005). 11.62.025 Applicability. This chapter applies to any property which fall into the following categories: A. Property listed or eligible to be listed on the Yakima historic inventory; B. Property listed or eligible to be listed on the Yakima register of historic places, National Register of Historic Places, or Washington Heritage Register. (Ord. 2005-02 § 2 (part), 2005). 11.62.030 Definitions. The following words and terms when used in this chapter shall mean as follows, unless a different meaning clearly appears from the context: A. "Actual cost of rehabilitation" means costs incurred within twenty-four months prior to the date of application and directly resulting from one or more of the following: 1. Improvements to an existing building located on or within the perimeters of the original structure; or 2. Improvements outside of but directly attached to the original structure which are necessary to make the building fully usable but shall not include rentable/habitable floor space attributable to new construction; or 3. Architectural and engineering services attributable to the design of the improvements; or 4. All costs defined as qualified rehabilitation expenditures for purposes of the federal historic preservation investment tax credit. B. A "building" is a structure constructed by human beings. This includes both residential and nonresidential buildings, main and accessory buildings. C. "Certificate of appropriateness" means the document indicating that the commission has reviewed the proposed changes to a local register property or within a local register historic district and certified the changes as not adversely affecting the historic characteristics of the property which contribute to its designation. D. "Certified local government' or "CLG" means the designation reflecting that the local government has been jointly certified by the State Historic Preservation. Officer and the National Park Service as having established its own historic preservation commission and a program meeting federal and state standards. E. "Class of properties eligible to apply for special valuation in Yakima" means all properties in Yakima listed on the National Register of Historic Places or certified as contributing to a National Register Historic District which have been substantially rehabilitated at a cost and within a time period which meets the requirements set forth in Chapter 84.26 RCW, until the city of Yakima becomes a certified local government (CLG). Once the city of Yakima becomes a CLG, the lass of properties eligible to apply for special valuation in the city of Yakima means only all properties listed on the Yakima and National Registers of Historic Places or properties certified as contributing to a Yakima or National Register Historic District which have been substantially rehabilitated at a cost and within a time period which meets the requirements set forth in Chapter 84.26 RCW. F. "Cost" means the actual cost of rehabilitation, which cost shall be at least twenty- five percent of the assessed valuation of the historic property, exclusive of the assessed value attributable to the land, prior to rehabilitation. G. A "district" is a geographically definable area—urban or rural, small or Targe, possessing a significant concentration, linkage, or continuity of sites, buildings, structures, and/or objects united by past events or aesthetically by plan or physical development. H. "Emergency repair" means work necessary to prevent destruction or dilapidation of real property or structural appurtenances thereto immediately threatened or damaged by fire, flood, earthquake or other disaster. I. "Historic property" means real property together with improvements thereon, except property listed in a register primarily for objects buried below ground, which is listed in the Yakima register of historic places or on the National Register of Historic Places. J. "Incentives" are such rights or privileges or combination thereof which the Yakima city council, or other local, state, or federal public body or agency, by virtue of applicable present or future legislation, may be authorized to grant or obtain for the owner(s) of register properties. Examples of economic incentives indude but are not limited to tax relief, conditional use permits, rezoning, street vacation, planned unit development, • • • • • • transfer of development rights, facade easements, gifts, preferential leasing policies, beneficial placement of public improvements or amenities, or the like. K. "Local review board" or "board" used in Chapter 84.26 RCW and Chapter 254-20 WAC for the special valuation of historic properties means the commission created in YMC 11.62.040. L. "National Register of Historic Places" means the national listing of properties significant to our cultural history because of their documented importance to our history, architectural history, engineering, or cultural heritage. M. An "object" is a thing of functional, aes etic, cultural, historical, or scientific value that may be, by nature or design, movable yet related to a specific setting or environment. N. "Ordinary repair and maintenance" means work for which a permit issued by the city of Yakima is not required by law, and where the purpose and effect of such work is to correct any deterioration or decay of or damage to the real property or structure appurtenance therein and to restore the same, as nearly as may be practicable, to the condition prior to the occurrence of such deterioration, decay, or damage. O. "Owner" of property is the fee simple owner of record as exists on the Yakima County assessor's records. P. "Significance" or "significant" used in the context of historic significance means the following: a property with local, state, or national significance is one which helps in the understanding of the history or prehistory of the local area, state, or nation (whichever is applicable) by illuminating the local, statewide, or nationwide impact of the events or persons associated with the property, or its architectural type or style in information potential. The local area can include the city of Yakima, Yakima County, or south central Washington, or a modest geographic or cultural area, such as a neighborhood. Local significance may apply to a property that illustrates a theme that is important to one or more localities, state significance to a theme important to the history of the state, and national significance to property of exceptional value in representing or illustrating an important theme in the history of the nation. Q. A "site" is a place where a significant event or pattern of events occurred. It may be the location of prehistoric or historic occupation or activities that may be marked by physical remains, or it may be the symbolic focus of a significant event or pattern of events that may not have been actively occupied. A site may be the location of ruined or now nonextant building or structure if the location itself possesses historic cultural or archaeological significance. R. "Special valuation for historic properties" or "special valuation" means the local option program which when implemented makes available to property owners a special tax valuation for rehabilitation of historic properties under which the assessed value of an eligible historic property is determined at a rate that excludes, for up to ten years, the actual cost of the rehabilitation. S. A "structure" is a work made up of interdependent and interrelated parts in a definite pattern of organization. Generally constructed by human beings, it is often an engineering project. T. "Waiver of a certificate of appropriateness" or "waiver' means the document indicating that the commission has reviewed the proposed whole or partial demolition of a local register property or in a local register historic district and failing to find altematives to demolition has issued a waiver of a certificate of appropriateness which allows the building or zoning official to issue a permit for demolition. U. "Washington Heritage Register' means the state listing of properties_significant to the community, state, or nation but which may or may not meet the criteria of the National Register. V. "Washington State Advisory Council's Standards for the Rehabilitation and Maintenance of Historic Properties" or "State Advisory Council's Standards" means the rehabilitation and maintenance standards used by the Yakima historic preservation commission as minimum requirements for determining whether or not an historic property is eligible for special valuation and whether or not the property continues to be eligible for special valuation once it has been so classified. W. "Yakima historic inventory" or "inventory" means the comprehensive inventory of historic and prehistoric resources within the boundaries of Yakima. X. "Yakima historic preservation commission" or commission" means the commission created by YMC 11.62.040. Y. "Yakima register of historic places," "local register," or register" means the listing of locally designated properties provided for in YMC 11.62.045. (Ord. 2005-02 § 2 (part), 2005). 11.62.040 Yakima historic preservation commission. A. Creation and Size. There is hereby established a Yakima historic preservation commission consisting of seven members, as provided in subsection B of this section. Members of the Yakima historic preservation commission shall be appointed by the mayor with the approval of the Yakima city council and shall be residents of the city of Yakima. B. Composition of the Commission. (1) All members of the commission must have a demonstrated interest and competence in historic. preservation, history, urban planning, or architecture and possess qualities of impartiality and broad judgment. (2) The commission shall always include at least three professionals who have experience in identifying, evaluating, and protecting historic resources and are selected from among the disciplines of history, architecture, architectural history, landscape architecture, historic preservation, planning, folklore, cultural anthropology, prehistoric and historic archaeology, American studies, curation, traditional building crafts, the practice of historic rehabilitation or restoration, finance and banking, law, and real estate, or related disciplines. The commission action that would otherwise be valid shall not be rendered invalid by the temporary vacancy of one or all of the professional positions, unless the commission action is related to meeting certified local government (CLG) responsibilities cited in the certification agreement between the mayor of Yakima and the State Historic Preservation Officer on behalf of the state. Furthermore, exception to the residency requirement of commission members may be granted by the mayor of Yakima with the approval of the Yakima city council in order to obtain representatives from these disciplines. (3) In making appointments, the mayor may consider names submitted from any source, but the mayor shall notify Yakima history, heritage, preservation, and development related organizations of vacancies so that names of interested and qualified individuals may be submitted by such organizations for consideration along with names from any other source. C. Terms. The initial appointments to the commission shall be staggered. Two members shall be appointed for one year, three members shall be appointed for two years, and two members shall be appointed for three years. Thereafter, the terms shall be made for three years. Membership on the commission shall be limited to two full consecutive three-year terms. Reappointment after two full consecutive terms may be made after at least a one-year absence. Vacancies shall be filled by the mayor with the approval of the council for a new or unexpired term in the same manner as the original appointment. • • • • • D. (13) Offic ally recognize excellence in the rehabilitation of historic buildings, structures, sites and districts, and new construction in historic areas and encourage appropriate measures for such recognition. (14) Be informed about and provide information to the public and city of Yakima departments on incentives for preservation of historic resources including legislation, regulations and codes which encourage the use and adaptive reuse of historic properties. (15) Review nominations to the State and National Registers of Historic Places. (16) Investigate and report to the Yakima city council on the use of various federal, state, local or private funding sources available to promote historic resource preservation in the city of Yakima. (17) Serve as the local review board for special valuation and: a. Make determination concerning the eligibility of historic properties for special valuation; b. Verify that the improvements are consistent with the Washington State Advisory Council's standards for rehabilitation and maintenance; c. Enter into agreements with property owners for the duration of the special valuation period as required under WAC 254-20-070(2); d. Approve or deny applications for special valuation;. e. Monitor the property for continued compliance with the agreement and statutory eligibility requirements during the ten-year special valuation period; and f. Adopt bylaws and/or administrative rules and comply with all other board responsibilities identified in Chapter 8426 RCW. E. Compensation. At members shall serve without compensation. F. Rules and Officers. The commission shall establish and adopt its own rules of procedure, and shall select from among its membership a chairperson and such other officers as may be necessary to conduct the commission's business. G. Commission Staff. Commission and professional staff assistance shall be provided by the department of community and economic development with additional assistance and information to be provided by other city departments as may be necessary to aid the commission in carrying out its duties and responsibilities under this chapter. (Ord. 2005-02 § 2 (part), 2005). 11.62.045 Yakima register off historic places. A. Criteria for Determining Designation in the Register. Any building, structure, site, object, or district may be designated for inclusion in the Yakima register of historic places if it is significantly associated with the history, architecture, archaeology, engineering, or cultural heritage of the community; if it has integrity; is at least forty years old, or is of lesser age and has exceptional importance; and if it falls in at least one of the following categories: (1) Is associated with events that have made a significant contribution to the broad patterns of national, state, or local history. (2) Embodies the distinctive architectural characteristics of a type, period, style, or method of design or construction, or represents a significant and distinguishable entity whose components may lack individual distinction. (3) Is an outstanding work of a designer, builder, or architect who has made a substantial contribution to the art. (4) Exemplifies or reflects special elements of Yakima's cultural, special, economic, political, aesthetic, engineering, or architectural history. (5) Is associated with the lives of persons significant in national, state, or local history. (6) Has yielded or may be likely to yield important archaeological information related to history or prehistory. • • • • (7) Is a building or structure removed from its original location but which is significant primarily for architectural value, or which is the only surviving structure significantly associated with an historic person or event. (8) Is a birthplace or grave of a historical figure of outstanding importance and is the only surviving structure or site associated with that person. (9) Is a cemetery which derives its primary significance from age, from distinctive design features, or from association with historic events, or cultural patterns. (10) Is a 'creative and unique example of folk or vernacular architecture and design created by persons not formally trained in the architectural or design professions, and which does not fit into formal architectural or historical categories. B. Process for Designating Properties or Districts to the Yakima Register of Historic Places. (1) Any person may nominate a budding, structure, site, object, or district for inclusion in the Yakima register of historic places. Members of the historic preservation commission or the commission as a whole may generate nominations. In its designation decision, the commission shall consider the Yakima historic inventory and the Yakima comprehensive plan. (2) Applications for nominations must bear the signature of the property owner(s) of record of the subject property as indicated by the records of the Yakima County auditor, or in the case of districts, signatures must be obtained from the owners of a majority of the properties within the proposed district. Applications shall be on forms and indude information and documentation supporting the historic significance of the building, structure, site, object, or district. (3) In the case of individual properties, the designation shall include the legal description and all features—interior and exterior—and outbuildings that contribute to its designation. (4) In the case of districts, the designation shall include description of the boundaries of the district, the characteristics of the district which justify its designation, and a listof all properties including features, structures, sites, and objects ,hick contribute to the designation of the district. (5) The commission shall consider the merits of the nomination, according to the criteria in subsection A of this section and according to the nomination review standards established in rules, at an open record public hearing. At least ten days prior to the hearing, written notice by first-class mail of the time, date, place, and subject of the hearing will be given to all owners of record of the subject property as indicated by the records of the Yakima County auditor, the authors of the nomination, if different, and lessees, if any, of the subject. property. Public notice of the hearing shall also be provided and sham include, at least tel days prior to the hearing, publication in a newspaper of general circulation in Yakima and posting of the property. The commission shall, by a majority vote of its members, make a written recommendation to the city council that the nomination of the subject property be approved or rejected for listing on the Yakima register of historic places. The recommendation shall set forth findings of fact which constitute the basis for the recommendation. (6) Upon receipt of the commission's recommendation, the city council shall hold an open record public hearing to consider the recommendation. Notice of the hearing shall be provided in accordance with subsection (B)(5) of this section. The city council shall approve, reject or refer the recommendation back to the commission for further consideration, as the council deems appropriate. Approval of a recommendation to designate a property for listing on the register shall be done by city council adoption of a resolution designating the building, structure, site, object, or district for listing on the Yakima register of historic places. (7) Properties listed on the Yakima register of historic places shall be recorded on official zoning records with an "HR" (for historic register) designation. This designation shall not change or modify the underlying zone classification. C. Removal of Properties from the Register. (1) In the event that any property is no longer deemed appropriate for designation or no longer meets the eligibility requirements for the Yakima register of historic places, the commission may initiate removal from such designation by the same procedure as provided for in establishing the designation in subsection B of this section. (2) Additionally, and except to the extent that a property is subject to a historic preservation special valuation agreement entered into under the authority of YMC 11.62.060 and applicable state law, the property owner(s) of record (as indicated by the records of the Yakima County auditor) of a property listed on the Yakima register of historic places may make a written request to have said property removed from the register. The written request must be signed by said property owner(s) and notarized. Upon receipt of such a properly notarized written request, the commission shall immediately remove the property from the register. D. Effects of Listing on the Register. (1) Listing on the Yakima register of historic places is an honorary designation denoting significant association with the historic, archaeological, engineering, or cultural heritage of the community. Properties are listed individually or as contributing properties to an historic district. (2) Prior to the commencement of any work on a register property, excluding ordinary-repair and maintenance and emergency measures defined in YMC 11.62.030,. the owner must request and receive a certificate of appropriateness from the commission for the proposed work. Violation of this rule shall be grounds for the commission to review the property for removal from the register. (3) Prior to whole or partial demolition of a register property, the owner must request and receive a waiver of a certificate of appropriateness. (4) Once the city of Yakima is certified as a certified local government (CLG), all properties listed on the Yakima register of historic places may be eligible for special tax valuation on their rehabilitation under YMC 11.62.060. (Ord. 2005-02 § 2 (part), 2005). 11.62.050 Review of changes to Yakima register of historic places properties. To achieve the comprehensive plan and historic preservation goals and to safeguard the heritage of Yakima, a two-part evaluation system shall be followed: (1) The identification of those materials, features and combinations of features that give significance to property(ies) or districts on the Yakima register of historic places. (2) Assessing the potential impact or effect of rehabilitation work necessary for efficient contemporary utilization of the property. The historic character of a property or district is defined by many features: materials, style, method of construction, composition and decorative features; the presence of architectural metals; window number, arrangements and styles (fenestration); entrances and porches, storefronts on commercial buildings, internal arrangement and detailing; and the historic relationship between buildings, landscape features and open space, as well as many other materials and features can all contribute to a property's character. After identifying the distinguishing historic characteristics of a property subject to the design review process, retention and preservation of those features and materials are the primary goals of the design review effort. 0 0 • • • This is accomplished through the review process individual to each property. Preferred approaches to the treatment of properties, specified by the Secretary of the Interior, are common to each property. These are, in descending order of preference: (1) protecting and maintaining, (2) repairing, (3) replacing in-kind, (4) design for missing features, and (5) alterations and additions to historic buildings. The guidelines for the above are listed in the "rules and procedure? adopted herewith. A. Review Required. No person shall construct any new building or structure, or reconstruct, alter, restore, remodel, repair, move, demolish or make any material change affecting significant historic features as listed in the designation form(s) to any existing property on the Yakima register of historic places or within a historic district on the Yakima register without review by the commission and without receipt of a certificate of appropriateness, or in the case of demolition, a waiver of certificate of appropriateness, as a result of the review. The review shall apply to all features of the property, interior and exterior, that contribute to its designation and are listed on the designation. This requirement shall apply whether or not the proposed alteration also requires a building or other permit, except as noted under subsection B of this section. Material, documents and other information required by the commission to review the proposed changes shall be established in its rules and procedures. A preapplication conference is recommended but is at the request of the applicant. B. Exemptions. The following activ- es do not require a certificate of appropriateness or review by the commission: (1) Ordinary repairs and maintenance which do not affect significant historic features, including painting, or emergency measures as defined in YMC 11.62.030.. (2) Ordinary repairs and maintenance which do not alter the appearance of a significant feature and do not, utilize substitute materials. (3) If there are not interior features of significance, repairs to or replacement of utility systems. C. Review Process. (1) Requests for Review and Issuance of a Certificate of Appropriateness or Waiver. The code administration and planning manager or his/her designee shall report to the commission any application for a permit to work on a designated Yakima register of historic places property or in a Yakima register historic district. If the activity is not exempt from review, the commission or staff shall notify the applicant of the review requirements. The code administration and planning manager or his/her designee shall not issue any such permit until a certificate of appropriateness or a waiver is received from the commission but shall work with the commission in considering building and fire code requirements. (2) There shall be two types of reviews for issuance of a certificate of appropriateness: a. Type I. An administrative review by commission staff for repairs and replacements -in-kind as listed below, but not limited to, the following: i. Repairs (other than ordinary repair and maintenance) using the same materials and design as the original; ii. Re -roofing using the same type and color of material; iii. Replacement of sidewalks and driveways using the same type and color of materials; iv. Replacement of foundations or major portions thereof, using the same type and color of materials; v. Replacement of utility systems if contributing interior features of significance are present; vi. Structural or seismic upgrades which do not alter or affect significant features. b. Type II. A public meeting review by the commission is required for any alteration in the appearance of a significant contributing feature, the replacement of historic material (other than in-kind) in a significant feature, and/or additions to a Yakima register property; new construction on a Yakima register property or in a historic district; demolition or removal of a Yakima register property; or any excavation on an archaeological site. When a certificate of appropriateness is required, the following procedures shall govern according to the type of review required. (3) Type I Commission Staff Review. A Type I application for review for certificates of appropriateness shall be reviewed by the commission staff. a. The property owner or his/her agent shall file an application with the commission staff on a form provided by the commission. At a minimum, applications shall be accompanied by the following documents, materials and information: a dear photograph orphotographs of the building, object, site or structure; a brief description of the proposed work; scaled drawings depicting the proposed work; and samples of replacement material for comparison with the existing or the original building or structure must be fumished with the application. b. A Type I commission staff review decision shall be made within thirty days from the date on which the commission staff receives a fully complete application. c. The commission staff may, on his or her own motion, refer the application to the commission for a decision in accordance with the procedures set forth for a Type II commission review. The time for a decision of the commission on the application shall run from the date that the application is referred to the commission by the staff. d. A Type I commission staff review decision shall be final and binding unless it is appealed to the commission by the aggrieved person, public agency or other legal entity. The appeal must be in writing on forms provided by the commission, and filed with the commission within fourteen calendar days of the date of the decision. The written appeal must specify all grounds for the appeal, request a hearing before the commission and be accompanied by an appeal fee of one hundred dollars. The commission shall set a date, time and place for the appeal hearing. After the hearing, the commission shall make the final and conclusive written determination regarding the appeal. (4) Type II Commission Review. A Type II application for review for certificates of appropriateness or waiver thereof shall be reviewed by the commission in accordance with the following process. a. The property owner or his/her agent shall file an application with the commission on a form provided by the commission. Each application shall be accompanied by such documents, materials and information as required by the commission and which is reasonably necessary for the review of the proposed project. b. When an applicant is requesting a waiver of the certificate of appropriateness requirement in order to demolish a designated Yakima register of historic places property in whole or in part, the applicant shall also demonstrate in writing with the application that demolition altematives have been or are being pursued (alternatives include but are not limited to economic analysis; offers to lease, sell or dedicate site to a private, public or nonprofit entity, and outcome of the offer; relocation of building, etc.). The commission shall consider these and other altematives to demolition as part of its Type II review process. The commission may extend the review process as necessary to allow sufficient time to fully explore and consider altematives to demolition. The commission may also condition the issuance of a waiver upon the satisfaction of certain mitigation steps and measures (including, but not limited to, photographic documentation of the resource, an identification plaque, use of an architectural element in new construction, and/or buffering of the historic or cultural resource). 0 0 • • • • c. The commission shall hold a public meeting to review the proposed work according to the design review criteria established in its rules. Notice of the time, date and place of the design review meeting shall be sent by first-class mail to the property owner(s) of record of the subject property as indicated by the records of the Yakima County auditor, applicant (if different), lessees and any other interested parties. The commission shall issue a written decision which shall set forth findings of fact and conclusions which constitute the basis for the decision. The commission's decision shall be forwarded to the code administration and planning manager or his/her designee. d. A Type II commission review decision shall be final and binding unless it is appealed to the city of Yakima hearing examiner by the aggrieved person, public agency or other legal entity. The appeal must be in writing on forms provided by the commission, and filed with the hearing examiner within fourteen calendar days of the date of the decision. The written appeal must specify all grounds for the appeal, request a hearing before the hearing examiner and be accompanied by an appeal fee of one hundred dollars. The hearing examiner shall set a date, time and place for the appeal hearing. The record on appeal shall be limited to that record developed before the commission at its public meeting to review the application. The hearing examiner shall apply the design review criteria established by the commission in considering the appropriateness of the commission decision. After the hearing, the hearing examiner shall make the final and conclusive written determination regarding the appeal. (Ord. 2005-02 § 2 (part), 2005). 11.62.060 Review and monitoring of properties for special property tax valuation. A. Time Lines. (1) Special property tax valuations applications shall be forwarded to the commission by the assessor within ten calendar days of filing. (2) Applications shall be reviewed by the commission before December 31st of the calendar year in which the application is made. (3) Commission decisions regarding the applications shall be certified in writing and filed with the assessor within ten calendar days of issuance. B. Procedure. (1) The assessor forwards the applications to the commission. (2) The commission reviews the application(s), consistent with its rules of procedure, and determines if the application(s) are complete and if the properties meet the criteria set forth in WAC 254-20-070(1) (and as may be amended) and listed in subsection C of this section. a. If the commission finds the properties meet all the criteria, then, on behalf of the city of Yakima, it shall enter into a historic preservation special valuation agreement with the owner in a form set forth in WAC 25420-120 (and as may be amended) and listed in subsection D of this section. Upon execution of the agreement between the owner and commission, the commission shall approve the application. b. If the commission determines the properties do not meet all the criteria, then it shall deny the application. (3) The commission shall certify its decision in writing and state the facts upon which the approval or denial is based and file copies of the certification with the Yakima County assessor. (4) For approved applications, the commission shall: a. Forward a copy of the agreement, application, and supporting documentation as required by WAC 254-20-070(4) (and as may be amended) and identified in subsection (C)(2) of this section to the assessor; b. Notify the state review board that the properties have been approved for special valuation; and c. Monitor the properties for continued compliance with the agreements throughout the ten-year special valuation period, including but not limited to any special valuation agreements that were entered into under the authority of YMC Chapter 11.60 and that are still in effect. (5) The commission determines, in a manner consistent with its rules of procedure, whether or not a property is disqualified from special valuation either because of: a. The owner's failure to comply with the terms of the agreement; or b. A loss of historic value resulting from physical changes to the building or site. (6) In the event that the commission concludes that a property is no longer qualified for special valuation, the commission shall notify the owner, assessor, and state review board in writing and state the facts supporting its findings. C. Criteria for Special Valuation. (1) Historic Property Criteria. The class of historic property eligible to apply for special valuation in the city of Yakima means all properties listed on the National Register of Historic Places or certified as contributing to a National Register Historic District which have been substantially rehabilitated at a cost and within a time period which meets the requirements set forth in Chapter 84.26 RCW (and as may be amended), until the city of Yakima becomes a certified local govemment (CLG). Once Yakima becomes a CLG, the class of property eligible to apply for special valuation in Yakima means all properties listed on the Yakima and National Registers of Historic Places or properties certified as contributing to a Yakima or National Register Historic District which have been substantially rehabilitated at a cost and within a time period which meets the requirements set forth in Chapter 84.26 RCW (and as may be amended). (2) Application Criteria. Complete applications shall consist of the following documentation: a. A legal description of the historic property; b. Comprehensive exterior and interior photographs of the historic property before and after rehabilitation; c. Architectural plans or other legible drawings depicting the completed rehabilitation work; d. A notarized affidavit attesting to the actual cost of the rehabilitation work completed prior to the date of application and the period of time during which the work was performed and documentation of both to be made available to the commission upon request; and e. For properties located within historic districts, in addition to the standard application documentation, a statement from the Secretary of the Interior or code administration and planning manager or his/her designee indicating the property is a certified historic structure. (3) Property Review Criteria. In its review the commission shall determine if the properties meet all the following criteria: a. The property is historic property; b. The property is included within a class of historic property determined eligible for special valuation by the city of Yakima under subsection (C)(1) of this section; c. The property has been rehabilitated at a cost which meets the definition set forth in RCW 84.26.020(2) (and as may be amended), and identified in subsection C of this section within twenty-four months prior to the date of application; and d. The property has not been altered in any way which adversely affects those elements which qualify it as historically significant as determined by applying the Washington State Advisory Council's standards for the rehabilitation and maintenance of historic properties (VVAC 254-20-100(1)). • • • • (4) Rehabilitation and Maintenance Criteria. The Washington State Advisory Council's standards for the rehabilitation and maintenance of historic properties in WAC 254-20-100 (and as may be amended) shall be used by the commission as minimum requirements for determining whether or not an historic property is eligible for special valuation and whether or not the property continues to be eligible for.special valuation once it has been so dassified. D. Agreement. The historic preservation special valuation agreement in WAC 254- 20-120 (and as may be amended) shall be used by the commission as the minimum agreement necessary to comply with the requirements of RCW 84.26.050(2). E. Appeals. Any decision of the commission acting on any application for classification as historic property, eligible for special valuation, may be appealed to superior court under RCW 34.05.570 in addition to any other remedy of law. Any decision on the disqualification of historic property eligible for special valuation, or any other dispute, may be appealed to the county board of equalization. Summary of Decision The Historic Preservation Commission approves of the nomination application to place the Barge -Chestnut Neighborhood - Phase I designation on the Yakima Register of Historic Places as a Historic District. Basis for Decision Based upon a review of the complete application, site visit, discussions with the applicant/agent, staff Report of Findings, exhibits, testimony and other evidence presented at the open record public hearing on April 22, 2009; and a review of Yakima Historic Preservation Ordinance and Yakima Register of Historic Places Criteria; the Historic Preservation Commission recommends approval of this petition, based on the following findings of fact: FINDINGS OF FACT 1. The petition to nominate the Barge -Chestnut Neighborhood Association (BCNA) Historic District - Phase One was filed April 13, 2009. A total of 216 properties are included in Phase One of the district nomination. All of the homes in Phase One meet the 40 -year age criteria for listing on the Yakima Register of Historic Places. The eleven blocks surveyed in Phase One were platted as early as 1907 and as late as 1939. Construction dates of homes on each block typically span between the 1910s and 1 960s, with the great majority of the 216 properties surveyed having been built in the 1920s and 1930s, followed by the 1940s. 2. The Barge -Chestnut neighborhood contains the array of twentieth century residential architecture found throughout Washington State. The present day urban form and land use pattern of the Barge -Chestnut neighborhood directly resulted from early uses and ownership of the land. Originally, the dominant use of the land was for orchard farming in the late 19th century and first couple decades of the 20th century gave way to more intense suburban residential development in the 1930s and 1940s. INDEX # A- to the fruit industry. The Barge -Chestnut neighborhood has developed into a cohesive residential district with a mix of early to mid -twentieth century residential architecture. Its resources, dating from the late 1 890s to mid-1960s, represent the birth, growth and development of Nob Hill, a once rural area transformed into one of Yakima's most desirable suburban neighborhoods. The combination of larger -scale, older houses such as Rosedell or the Irish House, along with the period revival style houses of the 1920s, and the popular Minimal Traditional style of the 1930s to 1950s, gives the Barge -Chestnut neighborhood its character. It is the consistency in craftsmanship and diversity of architectural styles mixed with mature landscaping that give the Barge -Chestnut neighborhood its potential historic district quality. The neighborhood is almost exclusively made up of single family homes with the occasional duplex; and with the exception of a couple blocks, there no sidewalks. Front yards with lawns terminate in concrete curbs adjacent to the street. A variety of mature trees are found throughout the neighborhood including Elm, Maple, Cedar, Spruce, Weeping Birch, Japanese maple, Sycamore, Blue Spruce and Arborvitae. 3. At least one work session is recommended for the Commission to discuss Design Review processes and other details, i.e. Certificate of Appropriateness process and criteria; 4. The Barge -Chestnut Neighborhood Historic District - Phase I, as proposed, is eligible for listing in the Yakima Register of Historic Places as a historic district in under YMC 11.62.045(A) as it meets Criteria One, Two, Three, Four and Five. Is associated with events that have made a significant contribution to the broad patterns of national, state, or local history. The Barge -Chestnut neighborhood is anchored on the east by Rosedell, the original home of A. E. Larson, one of Yakima's most prominent citizens and businessmen. The H.M. Gilbert House and William Irish House are other examples of fine residences built by some of Yakima's pioneers. More typical however, are the scores of Craftsman bungalows, Colonial Revival style houses, Tudor cottages, Spanish Eclectic homes, and the modest Minimal Traditional residences that make up this neighborhood. The Barge -Chestnut neighborhood has scores of Craftsman bungalows, Colonial Revival style houses, Tudor cottages, Spanish Eclectic homes, and the modest Minimal Traditional residences that make up this neighborhood. It is the consistency in craftsmanship and diversity of architectural styles mixed with mature landscaping that give the Barge -Chestnut neighborhood its potential historic district quality. 3. Is an outstanding work of a designer, builder, or architect who has made a substantial contribution to the art. The majority of the houses built in the Barge -Chestnut neighborhood were either not designed by architects or the architects are unknown. William W. deVeaux and john W. Maloney were two prominent architects who designet houses in the neighborhood. In Phase One, only one house was identified with an architect and six were identified with a builder (building contractor Louis C. Rainey is associated with five houses in Phase One). Some houses were built using plans from plan books that were popular at the time. 4. Exemplifies or reflects special elements of Yakima's cultural, special, economic, political, aesthetic, engineering, or architectural history. The dominant original use of the land was for orchard farming in the late 19th century and first couple decades of the 20th century gave way to more intense suburban residential development in the 1930s and 1940s. Many of the houses in the neighborhood were occupied by people who had direct ties to the fruit industry. The present day urban form and land use pattern of the Barge -Chestnut neighborhood directly resulted from early uses and ownership of the land. Architectural styles in Phase One and in the study area in general reflect the periods of construction and trends of the day. The oldest houses were designed in the Queen Arine style and date from 1 898 and 1906. INDEX R -i style found more often in the older residential districts located north and southeast of downtown Yakima. The Queen Anne style residences in Nob Hill are usually associated wit h a property that was once part of a larger orchard. The Arts & Crafts style houses is one of the predominant styles in the neighborhood popular from about 1905 to the late 1920s to early 1930s. Fifty-nine (59) Arts & Crafts style houses are included in the Phase One nomination. Typical features of these homes include a low-pitched gabled roof (Occassionally hipped) with wide, unenclosed eave overhangs, exposed roof rafters, decorative beams or braces under gables, and porches supported by tapered square columns. Styles from the Eclectic movement such as Tudor, Colonial Revival, Spanish Eclectic and French Eclectic were popular in the 1 920s and 1930s. The predominant style in Phase One is the Minimal Traditional style - 66 houses built in the mid -1930s to 1950s reflect this style. Especially popular in the post -WWII years, these houses reflect the form of the more traditional Eclectic or Revival styles but lack the decorative detailing. 5. Is associated with the lives of persons significant in national, state, or local history. William W. deVeaux designed the H.M. Gilbert House at 2109 W. Yakima Avenue. He was born in 1866 in Charleston, South Carolina, yet chose to live most of his days in Yakima until his death in 1962 at the age of 96. De Veaux and his wife, Edith, were very active in the local Congregational Christian Church. He not only participated earnestly as a deacon, but also provided his architectural skills to the church by designing its present structure on N. 2nd Street. De Veaux's contributions to the city of Yakima can be observed in many other buildings throughout the downtown area. One of the best examples of his work is the Masonic Temple, on which de Veaux collaborated with his associate, Frederick Heath, of Tacoma. The Washington National Guard Armory Building (no longer extent), which was designed along with well-known Yakima architect William H. Weatherwax, was another fine example of de Veaux's work. The Winslow -McCafferty Building and the W. P. Sawyer House are also structures accredited to de Veaux. DeVeaux also designed the State Fair's first permanent exhibition hall, the Horticultural Building, built in 1895. INDEX city building inspector. Starting out as an assistant city building inspector in 1938, de Veaux retired holding the title of Yakima Deputy City Building John W. Maloney The house located at 8 N. 24th Avenue was designed by architect John W. Maloney. Born in 1895 in Sacramento, California, John W. Maloney was educated in the Catholic schools of Grass Valley, California. Maloney's work included a sizeable number of Yakima Valley institutional buildings, including the Young Women's Christian Association Building with Mary Remy (Yakima, 1935), Grandview High School (Grandview, 1937), and Yakima Indian Agency Building (Toppenish, 1931). He also designed the 4-H Building (1937) at the Central Washington State Fairgrounds. Louis C. Rainey Building contractor Louis C. Rainey is associated with five houses in Phase One. Rainey lived in the neighborhood and developed all five houses in the mid -1930s (2704 W. Yakima Avenue, 2792 W. Yakima Avenue, 2610 W. Yakima Avenue, 2703 W. Chestnut Street, and 2709 W. Chestnut Street). I-1( purchased vacant lots and built the houses and sold them one year later with the exception of 2709 W. Chestnut Street which served as his residence from 1935 to 1958. Similarly, builder Louis Jarvis built a house at 3002 Barge Street in 1927 and sold the property in 1929. RECOMMENDATION The Barge -Chestnut Neighborhood Historic District - Phase I nomination meets YMC 11.62.045(A), Criteria 1 through 5 for designation to the Yakima Register of Historic Places. The Yakima Historic Preservation Commission recommends approval of nomination of the Barge -Chestnut Neighborhood Historic District - Phase I to the Yakima Register of Historic Places. 1) The Commission, by a majority vote of its members, recommends the Yakima City Council approve of the nomination to establish the district. Last week 1 was forwarded a copy of the City of Yakima's Notice of Public Hearing for the Barge -Chestnut Neighborhood Historic District Phase -1 nomination announcing a public hearing to be held Thursday, May 28, 2009 at 5:30 p.m., with a map attached to the Notice identifying the "subject site" as a rectangle of property bounded on the east by 24th Avenue, the north by Barge Street, the west by N. 32nd Avenue, and on the south by W. Walnut Street. The Notice indicated that the nominated historic district would be "in this vicinity," not necessarily inclusive of every parcel within it. A copy of the Notice and map received by the Hospital are appended hereto as Attachment "A." As the Hospital has been working closely on its campus development planning with the Barge - Chestnut Neighborhood Association, I contacted Mr. Gary Forrest, Co -Chair of the Barge - Chestnut Neighborhood Association Historic Preservation Committee today and asked him for a copy of the "actual" boundaries intended for the Barge -Chestnut Neighborhood Historic District. I also spoke with Vaughn McBride, Historic Preservation Liaison for the City of Yakima and was provided with more precise maps, copies of which are appended hereto as Attachment "B," showing that there are several parcels between S. 28th Avenue and S. 32nd Avenue, north of W. Walnut Street, that are not intended for inclusion in the Historic District. Out of an abundance of caution, nevertheless, Yakima Valley Memorial Hospital wants to make sure that the boundaries are drawn as depicted on Attachment "B," not as shown on the mailing to the public, Attachrnent "A." The reason being, there are 35 parcels owned by Yakima Valley Memorial Hospital located north of W. Walnut Street, south of W. Dear Members, Next month will mark the two year anniversary of our associations quest to form a historic district honoring the City of Yakima and the 1200+ homes within the Barge - Chestnut Area where almost 90% of the homes are 50 years of age or older and 44 of them are nearing the century mark (16 or more have already celebrated). During the last two years, our committee spent over 1000 volunteer hours researching the 216 homes in Phase One and documenting them to Washington State Historic Property Guideline Standards ( We discovered early on that 1200 homes was much too big of a bite at one time and had to settle on seven separate phases). We completed our work on Phase One this past April with the initial gathering of 168 signatures from properly owners supporting the creation of a historic district. A mailing was done to cover the absentee owners and those not home when we made the physical canvass. 14 more signatures have been gained and the final count in favor is 182 signatures. This represents 84% of the property owners in favor of forming a historic district and listing their homes in the Yakima Registry of Historic Places and/or Districts should those properties qualify. At last estimate over 80% of the homes in their present condition within the proposed district would qualify as contributing to a historic district. We are ready for an official designation and respectfully request and are forever hopeful that this commission will make a favorable recommendation to the Yakima Historic Commission and to the City Councii. My home, located at 102 N. 26th Ave, is technically just outside of the proposed Phase One zone, and I have owned my home for about 15 years. However I'm assuming a Phase Two naturally would follow Phase One, and would expect my home to be included in Phase Two. Thus why I'm voicing my opposition early in the process. The proposed zone is certainly an older neighborhood, however it does not constitute a "historical" neighborhood in my opinion. The style and age of homes is widely varied, with many of the newer ones obviously having been modified/remodeled over the years. I have added on to my own home as well, which was built in the 30's, and enlisted the aid of an architectto ensure the addition was integrated into the original design of the home. Likely many of my neighbors would've done the same with such a project* I didn't need some committee (likely consisting of non -architects) approving my design. The addition was certainly built according to City code, and actually had to go through a public hearing process. I've since received many compliments on how the addition looks like its part of the original structure. There ianVunderlying theme orcharacter hothe neighborhood, such as a predominantly Victorian style, colonial style, etc. There are also very few homes of which | would consider historically significant. Many of the homes are fairly well nnaintained, but of 7,ethiacondibonhaooxintedandourvivedovertheyeorovvithoutanadded/oymrofrogu|aUnn. The homeowners have done a /ob maintaining their homes of their own free will. That is one of the attractions of the neighborhood and why | moved into it. simply a well maintained, older neighborhoodbut not one of historical significance and not one in need of additional regulation to "preserve history." Not many, if any, details have been announced about the proposed district as it's early in the process. l'm sure the advocates will reassure the homeowners that unreasonable restrictions will not be imposed, and we'll all be told we can still paint our homes the color we want. Perhaps a significant remodel would need approval, but how will some sort of committee determine what should be connidenodappropriahe.asMheroistru|ynocommoncharecterofhVmasinthoneighborhood? And if the advocates continue to claim that |itt|e, if any, restrictions will be imposed, then why create the historic district in the first place? My opinion on the answer to that question is two -fold. It's my gut feel that the homeowners behind this proposal are concerned about the growth of Memorial Hospital, and feel a historic district designation will give the neighborhood more clout when opposing the hospital's growth projects, to have more influence on what Memorial canlcannot do. I happen to be a supporter of Memorial, feel they are an instrumental member of the community, and have demonstrated responsible growth and genuine concern for the surrounding neighborhood. Others likely don't view Memorial this way. The other opinion is the advocates simply are interested in tax benefits for home improvement projects. 1 am not at all informed on the details of possible tax benefibs, so my opinion on this is purely speculative. I'm always interested in reducing my taxes as the next guy is. But again, given the apparent lack of historical significance in the neighborhood, I don't feel its right for this particular older" neighborbood to get tax breaks wher the next one doesn't. And we alt know how budgets work. You take revenue away from one area, you try to get it back through some other means. | won't be able to attend tomorrow night's meeting, thus wanted to get my comments to you via email. |wiU be very interested in how this proposal progresses, but hopefully it will be short-lived. Certainly this is the only area in Yakima with a concentration of older buildings. When we moved into town from the country 4 years ago, this was the only area in the city of Yakima that I wanted to live in, due to the beautiful old homes and historic feel of the neighborhood. Many of my neighbors feel the same way, and were drawn to this area because of their love of histonc areas and homes. Their pnde of ownership is evident in the care of the homes and yards in this area. Most cities have a historic distnct, with well preserved older homes which add to the value to the city. 1 believe it is time for Yakima to take a stand and show that they want to preserve their history and honor their past.
