A RESOLUTION authorizing the purchase of eight solar flashing yellow beacon/lighting
assemblies (School Zone Solar Safety Flashers) from RTC Manufacturing
Incorporated to be used for school zone safety, as a Sole Source purchase
without calling for bids.
WHEREAS, Article VI, Section 6 of the City of Yakima Charter and the Yakima Municipal
Code Chapter 1.80 generally require that purchase of equipment, materials, or services in
excess of $25,000 be done by competitive bid, subject to certain exceptions; and
WHEREAS, the law recognizes a "Sole Source Purchase" exception from these
competitive bidding requirements when, due to the uniqueness of the product to be purchased
and the fact that there is only one source, it would be futile to utilize competitive bidding for such
product; and
WHEREAS, the Yakima Traffic Division requires the purchase of eight School Zone
Solar Safety Flasher assemblies which enhance our public safety in school zones; and
WHEREAS, the solar flashers manufactured by RTC Manufacturing Inc. are compatible
with the existing programmable pager time switch program and fifteen existing locations already
in use. While other vendors produce solar flashes they are not compatible with the City of
Yakima's existing program and system; and
WHEREAS, RTC Manufacturing Inc. is the -only vendor that manufactures the program
and School Zone Solar Safety Flashers already used, which meet the specialized needs of the
City; and
WHEREAS, the City Council finds that it is in the best interest of the City to authorize
purchase of School Zone Solar Safety Flashers from RTC Manufacturing Inc. as a Sole Source
purchase without calling for bids, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City of Yakima Traffic Engineering Division is authorized to purchase the required
School Zone Solar Safety Flashers.
2. The purchase of the School Zone Solar Safety Flashers shall not exceed the approved
Washington Traffic Safety Commission grant of $29,975.00.

1. Describe the product, service or system. Attach all information:
The School Zone Safety Flashers are used to notify the motorist that a
reduced speed limit is in effect during school start and release times when
children are present. The system uses a solar panel for power and
communicates the on and off times of the flashers using a programmable
pager system. This system is operated on a computer in the Traffic
Engineering Division of the Public Works Department. This equipment is used
for 15 school crossings currently, both in the Yakima School District and the
West Valley School District. The system has been funded through safety
grants.

manufactured solely by RTC manufacturing Inc.

STATEMENT OF NEED:
My division's recommendation for sole source is based upon an
objective review of the good/service being required and appears to be
in the best interest of the City. I know of no conflict of interest on my
part or personal involvement in any way with this request. No
gratuities, favor, or compromising action have taken place. Neither
has my personal familiarity with particular brands, types of
equipment, materials or firms been a deciding influence on my request
to sole source this purchase when there are other known suppliers to
exist.

Description of Activity
(1) Problem Identification
The City of Yakima works closely. with the area school districts to establish, upgrade and maintain
student -patrolled school crossing locations, most of which are at city intersections (along "Safe
School .Routes") which have moderate to high vehicle traffic volumes and lack the minimum safe
gaps for children to cross on their own. The goal is to establish new, or improve existing, school
crossing locations to promote student safety, as well as consistency and uniformity among the
numerous crossing locations. This often requires the installation of a "20 -MPH School Zone", (as
per the RCW 46.62A00 and applicable sections of the MUTCD). The practice of student patrols
flagging the beginning and end points of the school zone is not consistent, or highly visible to
motorist on a four -lane arterial street where the posted speed limits are 30 to 35 MPI -L The solar
flashers activate automatically using a central program operated by the City of Yakima. Plus, they
provide greater advance warning and a significant increase in visibility for approaching motorists.
This flasher system greatly reduces the student patrols' exposure to traffic by eliminating their
need to "flag" the advance warning signs along the vehicle traffic corridors. Replacing the flagged
crossings with school zone flashers is a priority for the City of Yakima.
The City of Yakima and the Yakima School District are requesting the approval of this grant to
upgrade the existing "20 -MPH When Flagged" sign assemblies with new solar -powered school zone
warning flashers, which include "20 MPH When Flashing" signs at the four student -patrolled school
crossings listed below,
• S. 3rd Avenue and Viola Avenue (Hoover Elementary School);
• W. Washington Avenue and Cornell Avenue (Ridgeview Elementary'School)
• W. Nob Hill Blvd. and W. 44th Avenue (Existing mid -block crossing west of 44th
Avenue- Whitney Elementary School)
• S. le Street and Pierce Street (Martin Luther King Jr. Elementary School).
S. 3rd Avenue and W. Viola Avenue
S. 3rd Avenue is a four -lane minor arterial urban street with approximately
15,100 average daily vehicle trips (ADT). The posted speed limit is 30 MPH,
however, the recorded 85th percentile speed is 39 MPH. Viola Ave is a two-
lane residential street used for driver access to the signal at S. 3rd Ave.
Hoover Elementary School is located one block west of S. 3rd Avenue and
Viola Avenue, and is a school with a high percentage of "walk -to -school"
students. S. 3rd Avenue and W. Viola Avenue is a signalized intersection
with a high percentage of vehicle right turns. Between 2002 and 2007 there were eighteen.
reported collisions at this intersection, including one involving a pedestrian, eight with property
damage only, and nine with " injuries". This proposal installs two school zone flashers on S. 3rd
Avenue: one to be located 300 feet north of, and one to be located 300 feet south of W. Viola
Avenue.

W. Washington Avenue and Cornell Avenue
W. Washington Avenue is a four -lane minorarterial street with an ADT of
16,400. The posted speed limit is 30 MPH, however, the recorded 85th
percentile speed is 41 MPH. Cornell Avenue is a two-lane residential
street with a high volume of cut -through traffic to the signal at
Washington from a minor arterial. Ridgeview Elementary school is located
Northeast of and adjacent to the intersection of Washington Avenue and
Cornell Avenue. Between 2002 and 2007, there were twelve reported
collisions at this intersection, six with property damage only, and six with "injuries". This proposal
installs two_ school zone flashers on W. Washington Avenue: one to be located 300 feet north of,
and one to be located 300 feet south of Cornell Avenue.
W. Nob Hill Blvd and S. 44th Avenue
W. Nob Hill Blvd is a four -lane principal arterial street with an ADT of
14,800. The posted speed limit is 30 MPH, however, the recorded 85th
percentile speed is 40 MPH. 44th Avenue has a high volume of high
school traffic. It is a two lane residential street that is adjacent to three
schools, one of which is a high school. Whitney Elementary School is
located adjacent to the intersection of W. Nob Hill Blvd and 44th Avenue.
Between 2002 and 2007, there were eleven reported collisions within the
300 feet of the school crossing, 44th . to 46th Ave, including one involving a pedestrian, eight with
property damage only, and two with "injuries". This proposal installs two school zone flashers on
W. Nob Hill Blvd: one to be located 300 feet north of, and one to be located 300 feet south of 44th
Avenue.
S. 18th Street
S. le St is a three -lane collector arterial street with an ADT of 10,270.
The posted speed limit is 30 MPH, however, the 85th percentile speed
has been observed at 36 MPH. Martin Luther King Elementary School is
located in the City of Union Gap, at 2000 South 18th Street, south of
Pierce Street. No collision data is available for this intersection. This
proposal installs two school zone flashers on 18th St: one to be located
300 feet north of, and one to be .located 300 feet south of Pierce St. The school has requested to
be added to the City of Yakima solar flashing system because it is adjacent to a City of Yakima
arterial.
(2) Agency Qualifications -
In the year 2000, when the first school safety grant funds were made available, the City of
Yakima, Traffic Engineering Division installed four solar powered safety flashers at student -
patrolled school crossings. With subsequent safety grant assistance, the city has continued to
upgrade and currently has in operation fifteen flasher -regulated school crossing locations. Since
then, the city has effectively operated a centrally controlled software pager/program for school
zone flashers.

The City of Yakima continues to collaborate with the area school districts, police departments and
other affected organizations. The system has received strong positive support from police patrols,
parents, and the schools. The city continues to collect and evaluate school zone traffic volume and
speed data, before and after the activation of the flashers.
(3) Project Goal(s)
Increasing safety for our youngest pedestrians on these mandatory walk -to school routes remains
one of our highest safety priorities. Since the Yakima School District does not bus students within
a half -mile radius of the school, students must walk or rely on parents to transport them. The
primary purpose of upgrading the existing school zone signs with a new school zone flashing light
system is to maximize safety and convenience for children on walk -to -school routes, eliminating
the need to "flag the advance warning signs along the vehicle traffic corridors. It also increases
visual clarity and consistency for approaching motorists. Since the year 2000, the City of Yakima
has installed school zone safety flashers at fifteen student -patrolled school crossings on arterial
streets.
The installation of these additional school flashers will continue the program goal of replacing
"flagged" crossings with automated school zone safety flashers.
This application, submitted by the City of Yakima, is in joint cooperation with the City of Union Gap
and the Yakima School District. Union Gap has pledged to contribute a fair share local match of
costs not covered by the grant. (See the attached letter of support from Union Gap.)
(4) Project Activities
This project includes the installation of eight flashing yellow beacon/lighting assemblies. The
assemblies include a dual 12" LED flashing yellow signal (with 8" indicator light), a battery
powered solar panel, a control cabinet with a central processing unit and receiver, and an MUTCD-
approved 20 MPH school speed limit sign assembly. The equipment listed above will be mounted
on an approved pole, which will be set on a concrete foundation installed as per WSDOT
specifications. This project will take approximately 30 days to complete and will meet the
requirements of the applicable sections of the RCW 46.61.400 and WAC 392-151-030 and WAC
392-151- 035.
The project also includes the addition of these eight locations to the existing master controller
program.
(5) Project Evaluation.
As previously noted, a 2000 grant launched four demonstration locations in the City of Yakima for
the solar powered school flashers. The majority of feedback from the schools, police department
and drivers has been very positive. One modification made since the original installation of the first

four locations (at the request of the Yakima Police Department) was the addition of an indicator
Tight on the back of the solar powered assembly. This LED light remains on when the flasher is
active, and gives the police patrols visual conformation from all approaches, aiding in their
enforcement of the 20 MPH school zone. This indicator light is now standard in the school zone
flasher equipment that we purchase.
After the new flashers are installed, the Traffic Engineering staff will continue to monitor and
evaluate motorist speeds during the periods when the school zones/flashers are active.
The Yakima Police department provides vital enforcement and education services to ensure a
successful school safety zone program. Please refer to the letter of support from the Yakima Police
Department.

Budget Summary

This grant seeks to purchase the necessary equipment to install school zone flashers for both
approaches to 4 different school patrol locations which include: 8 Solar Powered School Zone
Flasher Assemblies with Battery and Cabinet; 40 -watt solar panel with pole mounting, 15' pole,
two 12" amber LED, one amber 8" LED, school zone signs, antenna & harness. Additionally, the
City of Yakima will contract the installation and Labor & Industry Permit at a cost of $2,200 per
pole.
If awarded, this grant would add four more locations to our list of existing school -patrolled
crossings. Greatly adding to student safety and visibility, as well as the significant increase of
advance warning for the motorist.

Invoicing Requirements
Invoices should be submitted to the Traffic Safety Commission on a monthly basis.
Due to state fiscal year closing on June 30 of each year, all invoices, whether state or federal funds, for
goods received or services performed on or prior to June 30 need to be received by WTSC no later
than August 15. The Federal fiscal year and project agreements end on September 30 of each year.
Invoices for goods received or services performed on or before September 30, for federal funded projects,
need to be received by WTSC no later than November 15.
Invoices received after the above cutoff dates are subject to non-payment.

As your partner in traffic safety, the Yakima Police Department is pleased to have
learned that you are attempting to improve signaling options in some of the area school
zones. We believe that such improvements are necessary and anything that can make
drivers better aware of school zones; the more likely they may slow down, reducing the
potential for serious injuries.
In 2008, the Yakima Police Department issued 792 infractions for speeding in posted
school zones. That is an average of nearly 4 1/2 citations per school day. We will
continue to be diligent with our enforcement duties and welcome zones marked with
flashing Tight systems.

Dear Mr. Rosenlund,
On behalf of the Washington Traffic Safety Commission (WTSC), I am pleased to inform
you that funding for School Zone Flashing Lights in the amount of $7,500.00 is
approved for Ridgeview Elementary School.
Your project(s) must begin within 60 days after July 1., 2009 (date of grant approval and
availability of funds) and must be completed within 120 days.
PLEASE NOTE: You may not obligate or spend any funds for this project until
after July 1, 2009.
Reporting Requirements
Your agency is responsible to fulfill the reporting requirements as outlined in the signed
agreement, including submitting requests for reimbursement and final reports, in a
timely manner.
Final reimbursement requests must be received by the WTSC no later than 30 days
after the completion of your project(s) or you will not receive reimbursement.
> Verification that the lighting systems are installed is required prior to our
processing of any request for reimbursement. (Please provide a digital picture or
similar documentation of the system in place with your request for
reimbursement.)
A final report shall be submitted within one year of installation detailing the impact of this
project within the school zone, and should include if the goals outlined in your original
proposal were achieved. The speed data collected for the final report should be
consistent with the conditions existing during baseline data collection. One year of post
installation collision data should be included as well.
Failure to submit reimbursement requests or to file the required final report could lead to
termination of the project agreement, and forfeiture of reimbursement.
The response to this RFP was overwhelming, as we received proposals from over 150

SUMMARY EXPLANATION:
Staff respectfully requests City Council consideration .of a resolution authorizing Sole Source
procurement from RTC Manufacturing Incorporated. This would be a Sole Source purchase and
formal bid requirements would be waived. RTC Incorporated isthe only vendor that produces
School Zone Solar Safety Flashers that are compatible with the existing programmable pager
system and which meet the specialized needs of the City. Therefore, competitive bidding for
comparable products would be futile. The money ($29,975) for this purchase was appropriated
through a grant from the Washington Traffic Safety Commission.
