RESOLUTION NO. R-2009-125
authorizing the purchase of biodegradable leaf bags from BioBagUSA to be
used for the 2009 Fall Leaf Program, as a Sole Source purchase without
calling for bids.
WHEREAS, Article VI, Section 6 of the City of Yakima Charter and the Yakima Municipal
Code Chapter 1.80 generally require that purchase of equipment, materials, or services in
excess of $25,000 be done by competitive bid, subject to certain exceptions; and
WHEREAS, the law recognizes a "Sole Source Purchase" exception from these
competitive bidding requirements when, due to the uniqueness of the product to be purchased
and the fact that there is only one source, it would be futile to utilize competitive bidding for such
product; and
WHEREAS, the Yakima Refuse Division requires the purchase of biodegradable leaf
bags for use in the Fall Leaf Program; and
WHEREAS, the biodegradable bags manufactured by BioBagUSA are compatible with
the requirements of Yakima County Solid Waste. While other vendors produce biodegradable
bags, they are not compatible with.the Yakima County requirements; and
WHEREAS, BioBagUSA is the only vendor that manufactures the biodegradable bags
accepted for composting by Yakima County; and
WHEREAS, the City Council finds that it is in the best interest of the City to authorize
purchase of biodegradable leaf bags from BioBagUSA as a Sole Source purchase without
calling for bids, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
1. The City of Yakima Refuse Division is authorized to purchase the required
biodegradable leaf bags.
2. The purchase of the biodegradable leaf bags shall not exceed the approved Department
of Ecology Alternatives to Burning grant of $25,000 and the Yakima Refuse Division
matching funds of $6,250.

ITEM TITLE: Consideration of a resolution authorizing Sole Source procurement between the
City of Yakima and BioBagUSA for the purchase of Biodegradable Leaf Bags

SUMMARY EXPLANATION:
Staff respectfully requests City Council consideration of a resolution authorizing Sole Source
procurement from BioBagUSA. This would be a Sole Source purchase and formal bid
requirements would be waived. BioBagUSA is the only vendor that produces the
biodegradable leaf bags accepted by Yakima County Solid Waste for composting leaves.
Therefore, competitive bidding for comparable products would be futile. The money ($25,000
grant funding plus $6,250 city matching) for this purchase was appropriated through an
Altemative to Buming grant from the Department of Ecology issued to Yakima County.
The Fall Leaf Program will be performed in a similar manner as it was last year, using only
biodegradable bags. No plastic bags will be collected. The program will begin October 20
and run through January 8th. Approximately 42,000 bags will be purchased through grant
funding and the 25% matching funds from the Refuse Division. The proposed bags are
significantly larger and sturdier than those used last year. Senior Volunteers will assist in the
distribution of the bags at the Harman Center, beginning October 5th. The collected bags will
be taken to the compost site, at the Terrace Heights Landfill, which will prevent the leaves from
being buried in the landfill and will significantly reduce disposal costs.
