R-2009-165 A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute an Amendment to the Professional Services Contract with Opportunities Industrialization Center of Washington (hereafter "OIC"), which Professional Services Contract assists in implementing and performing services pursuant to the Yakima Police Department's federally funded Byme Grant regarding the Second Chance Initiative. WHEREAS, on September 8, 2008, the City received a grant through the Edward Byme Memorial Discretionary Grants Program (Byrne Discretionary Program), a program that helps local communities improve the capacity of local justice systems and provides for national support efforts; and WHEREAS, on June 16, 2009, the City Council adopted Resolution No. 2009-90, and the City and OIC entered into a °Professional Services Contract Between the City of Yakima and Opportunities Industrialization Center of Washington Regarding Yakima Police Department's Second Chance Initiative", City Contract No. 2009-71 (referred to here as the "Professional Services Contract"); and WHEREAS, pursuant to Resolution No. R-2009-90, the City executed the Professional Services Contract on June 17, 2009, and OIC executed the Professional Services Contract on July 5, 2009, and the Professional Services Contract provided in Section 2, 'Period of Performance°, for a period of performance of two (2) years, commencing on July 1, 2009; and WHEREAS, the City and OIC believe it is advantageous and appropriate to amend the Professional Services Contract, and further agree that the amendments are to be retroactive to July 1, 2009, which is the beginning of the period of performance of the Professional Services Contract and WHEREAS, the City Council finds it to be in the best interest of the City to authorize the City Manager to execute an Amendment to the Professional Services Contract with OIC, which amendments are retroactive to July 1, 2009; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Council authorizes and directs the City Manager to execute the attached Amendment to the Professional Services Contract with the Opportunities Industrialization Center of Washington COIC"). ADOPTED BY THE CITY COUNCIL this 1 of Decem.1 20 ATTEST: City C David Ed e ayor AMENDMENT TO PROFESSIONAL SERVICES CONTRACT BETWEEN THE CITY OF YAKIMA and Opportunities Industrialization Center of Washington Regarding Yakima Police Department's Second Chance Initiative THIS AMENDMENT TO THE PROFESSIONAL SERVICES CONTRACT is made and entered into by and between the City of Yakima, a Washington municipal corporation (hereafter referred to as the "City"), and the Opportunities Industrialization Center of Washington, a Washington non-profit corporation (hereafter referred to as the "OIC"). WHEREAS, on September 8, 2008, the City received a grant through the Edward Byrne Memorial Discretionary Grants Program (Byrne Discretionary Program), a program that helps local communities improve the capacity of local justice systems and provides for national support efforts; and WHEREAS, on June 16, 2009, the City Council adopted Resolution No. 2009-90, and the City and OIC entered into a "Professional Services Contract Between the City of Yakima and Opportunities Industrialization Center of Washington Regarding Yakima Police Department's Second Chance Initiative", City Contract No. 2009-71 (referred to here as the "Professional Services Contract"); and WHEREAS, pursuant to Resolution No. R-2009-90, the City executed the Professional Services Contract on June 17, 2009, and OIC executed the Professional Services Contract on July 5, 2009, and the Professional Services Contract provided in Section 2, "Period of Performance", for a period of performance of two (2) years, commencing on July 1, 2009; WHEREAS, pursuant to the Professional Services Contract between the City and OIC, OIC is to develop, assist with, and implement the Yakima Police Department's federally funded Second Chance Initiative; and WHEREAS, to facilitate the goals of the Second Chance Initiative, which include but are not limited to goals to improve the qualify of life for the residents living in high crime neighborhoods in the City of Yakima, to reduce the crime rate through the establishment of special emphasis patrol sweeps, and to improve the relationship between Yakima Police and the residents living and working in the targeted high crime neighborhoods, the City and OIC believe it is advantageous and appropriate to amend the Professional Services Contract, and further agree that the amendments to Section 1.7, Section 4 and specifically Section 4.6 of the Professional Services Contract are retroactive to the beginning of the period of performance on July 1, 2009, and the amendments to Section 1 on "Scope of Services" will be effective on January 1, 2010. Amendment to Contract Between the City of Yakima and 1 Opportunities lndustnalization Center of Washington NOW, THEREFORE, in consideration of the mutual covenants, promises, and agreements set forth herein, it is agreed by and between the City and OIC as follows: A. Section 1 Section 1 of the attached Professional Services Contract, and specifically Section 1, Scope of Services are amended to read as follows: Section 1. Definitions and Scope of Work Scope of Services: Opportunities Industrialization Center (hereafter "OIC") agrees to perform the following minimum services, OIC shall maintain a professional staff and shall provide professional services to the City and shall dedicate its best efforts for the express purpose of fostering community development, contributing to the operation of City government, enhancing the quality of life in Yakima and building a safe community for its citizens. OIC's efforts under this Agreement shall conform to all applicable federal, state, and local laws, and to all standards of professional skill, competence and care in the community economic development profession. OIC shall use its best efforts and devote all necessary personnel, and recruit and utilize volunteers, to work on the projects undertaken on behalf of the City. OIC shall hire a Project Coordinator. The Project Coordinator must be Spanish/English bilingual. OIC will administer an examination for the Project Coordinator position to test both oral bilingual and bi-literate written skills (Spanish/English) which will be graded on a pass/fail basis. As a condition of employment with OIC, the Project Coordinator will have a reference check and a criminal background check prior to employment commencing., located at the Miller Park Activities Center, 604 North Fourth Street, Yakima, Washifigtethe The Project Coordinator will serve as a conduit between service providers, residents, educational agencies and organizations, community organizations, and law enforcement to assist with the Yakima Police Department's Second Chance initiative, which project and work includes, but is not limited to the services referred to in Section 1.1 through 1.8 below: B. Section 1.7 Section 1.7 entitled "Grant Funding Mechanism" and Sections 1.7a and 1.7b, of the attached Professional Services Contract are deleted. Section 1.7 and Sections 1.7a and 1.7b are removed from the services to be performed by OIC under the Professional Services Contract as follows: 1.7 Grant Funding Mechanism a. The Project Coordinator will seek funding each year through grants, Amendment to Contract Between the City of Yakima and 2 Opportunities Industrialization Center of Washington C. Section 4.6 Section 4 of the attached Professional Services Contract, and specifically Section 4.6 of the Professional Services Contract are amended to read as follows (Sections 4.1, 4.2, 4.3, 4.4 and 4.5 of the Professional Services Contract remain the same): Section 4. Performance by OIC and Location of Offices 4.6 Offices to be Located at the Miller Park Activities Center and the Southeast Yakima Community Center The office for the Project Coordinator and for the services and activities pursuant to this Contract will be located at the Miller Park Activities Center, 604 North Fourth Street, Yakima, Washington. The City will provide the office space at the Miller Park Activities Center for the Project Coordinator and for the services and activities under this Contract without charge to OIC, either through the City providing the space itself or through a lease between the City and the Yakima Police Athletic League ("YPAL") or between the City and whatever entity has a current Site Use Contract with the City of Yakima for the Miller Park Activities Center. The Project Coordinator also will have another office for the services and activities pursuant to this Contract at the Southeast Yakima Community Center, 1211 South 7th Street, Yakima, Washington 98901. The amendments to Section 1.7, Section 4 and specifically Section 4.6 of the Professional Services Contract are retroactive to the beginning of the period of performance on July 1, 2009. The amendments to Section 1 on "Scope of Services" will be effective on January 1, 2010. Except as expressly modified herein, all other terms and conditions of the Professional Services Contract shall remain in full force and effect. The City of Yakima has been identified as the lead agency in administering this grant to the disparate agencies also included in the award. A Memorandum of Understanding has been completed between the agencies to formalize the City of Yakima as the lead/administering agency. Funds from this grant will be used to support youth crime/graffiti suppression and technology updates. The total amount of this award is $534,191 to be allocated to all participating agencies, as follows: City of Yakima $331,066 Yakima County $82,880 City of Grandview $10,417 City of Sunnyside $26,721 City of Toppenish $38,949 City of Union Gap $18,569 City of Wapato $25,589 The attached appropriation includes the entire grant amount, as some agencies may choose to expend their entire grant allocation in 2009.
