Resolution authorizing execution of Amendment No. 1 of the
Interlocal Agency Agreement with Yakima County, to have
the County perform Right -of -Way acquisition services for the
City on Capital Improvement Projects.

Attached is a copy of Amendment No. 1 that will extend the Interlocal Agency Agreement
between the City and Yakima County for an additional five years, to have the County perform
Right -Of -Way acquisition services for the City. The City administers many capital improvement
projects each year, some of which require the acquisition of property for right-of-way purposes.
Many of the projects that require the acquisition of right-of-way contain federal or state funds.
The use of these funds requires that a certain protocol be followed. The County has individuals
within its right-of-way division that are qualified to perform these tasks and know the steps that
are required. In the past, the City has used consultants and/or staff to perform this work. At the
present time, the City does not have staff dedicated for performing this work, since it is
somewhat specialized and there is not enough work to keep a person busy full time. The
County has acknowledged that they are willing to perform this work for the City.

execute this Interlocal Agency Agreement with the County.

RESOLUTION NO. R -2014 -
RESOLUTION authorizing execution of Amendment No. 1 of the Interlocal Agency
Agreement with Yakima County, to have the County perform Right -of -
Way acquisition services for the City on Capital Improvement Projects.
WHEREAS, the City, at times, needs to purchase property for right of way on capital
improvement projects; and,
WHEREAS, the City often receives State and Federal funds for capital improvement
projects that require acquisition of right of way; and,
WHEREAS, the City desires to utilize said funds in addition to City funds to
undertake capital improvement projects; and,
WHEREAS, the expenditure of said funds can require that the projects be designed
and administered in accordance with the Washington State Department of Transportation
("WSDOT") Local Agency Guidelines, including acquisition of right-of-way by a WSDOT
authorized agency; and,
WHEREAS, the City is not sufficiently staffed to have designated employees for
acquisition of right-of-way; and,
WHEREAS, the County is presently staffed and authorized by WSDOT to acquire
right-of-way on federal aid projects; and,
WHEREAS, the construction of capital improvement projects is a benefit to the
general public; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
The City Manager is hereby authorized to execute Amendment No. 1 of the Interlocal
Agency Agreement with Yakima County to have the County perform Right -of -Way
acquisition services for the City on Capital Improvement Projects.

AMENDMENT #1
INTERLOCAL AGENCY AGREEMENT
Right of Way Acquisition Services
THIS AMENDMENT is made to the Interlocal Agency Agreement dated April 14, 2009
between the County of Yakima, Washington (hereinafter called the "County") whose
address is Yakima County Courthouse, 128 North Second Street, Fourth floor, Yakima,
Washington 98901 and the City of Yakima, Washington (hereinafter called the "City")
whose address is 129 North Second Street, Yakima, Washington 98901.
It is mutually agreed that the above -referenced Interlocal Agency Agreement shall be
revised to extend this Interlocal Agency Agreement for another five (5) years. All other
provisions remain unchanged.
IN WITNESS WHEREOF, the County and the City have executed this amendment as of
the date and year last written below.
