Invocation /Pledge of Allegiance Council Member Cawley gave an invocation and led the Pledge of Allegiance. 3. Open Discussion for the Good of the Order A. Proclamations • The Big Read Month Council Member Johnson read a proclamation declaring October as The Big Read month. Monica Weyhe and Linda McCracken of the Yakima Regional Library accepted the proclamation and explained The Big Read program. • Harvest Marching Band Festival Day — deferred • Fire Prevention Week Susan Whitman read the proclamation. Ron Melcher, Deputy Fire Marshall, accepted the proclamation and spoke briefly about fire safety and events occurring during Fire Prevention week. 3 �'3 OCTO 2, 2 00 7 • Primary Immunodeficiency Awareness Month Council Member Lover read a pro clam a tion declaring October as Primary Immunodeficiency Awareness month. Leroy Rothamel and his son Jordan accepted the proclamation and spoke about the Immune Deficiency Foundation (IDF) fund raiser he was coordinating called "Jeans for healthy genes ". B. Special Presentations / Recognitions • Presentation by HUD officials of regional and state activity on fighting homelessness John Meyers and Paula Carr from HUD spoke about the "Housing First" concept, and what is being accomplished at the state and regional levels to fight homelessness. Tim Sullivan from the Homeless Network of Yakima County, also spoke about local accomplishments from the ten -year plan that was endorsed by the Council in 2005. Steve Gaulke said there are several landlords in Yakima who have established a program that provides services for the homeless. C. Status report on prior meeting's citizen service request -- None D. Appointments to Council Boards and Commissions • Parks and Recreation Commission CAWLEY MOVED AND BONLENDER SECONDED TO APPOINT PAUL WILLIAMS TO THE PARKS AND RECREATION COMMISSION. Council Member McClure spoke in support of Mary Place as an applicant for this position. The motion carried by a 5 -2 roll call vote; McClure and Whitman voting nay. 4. Consent agenda Mayor Edler referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. Items No. 11 and 25 were removed from the Consent Agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances by title. CAWLEY MOVED AND McCLURE SECONDED TO ADOPT THE CONSENT AGENDA AS READ. The motion carried by unanimous roll call vote. Council Minutes • Adjourned Meeting — June 12, 2007 The minutes of the June 12, 2007 Adjourned meeting were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. *B. Council Committee Meeting Reports: • Public Safety Committee — September 5, 2007 • Budget Committee — September 6, 2007 • Neighborhood Development — September 12 and 13, 2007 The reports were approved as submitted. • 2 34 OCTOBER 2, 2007 5. Audience Participation Doug Carey, 2801 W. Chestnut, raised concerns about the possibility of a Walgreen's store replacing the Sullivan Cleaners building. He commented that the Sullivan's building is an example of buildings from the 1940's and if we lose it, it "shoots the idea of historic preservation in the foot ". He knows that a lot of what happens is at the discretion of the owners, but questioned if the Historic Preservation Committee can be effective with regard to something like this. Is there any recourse? Mayor Edler assured him that City staff would report back at a future meeting as to rights citizens have when a private owner is moving in this direction. Mr. Carey suggested that if a Walgreen store does go in at that location, at the very least, they should try to integrate the existing building into their structure. 7: 00 P.M. -- PUBLIC HEARINGS / MEETINGS 6. Public Hearing and Consideration of an Ordinance annexing the West Powerhouse II annexation area Bill Cook, Community and Economic Development Director, explained that the annexation is based on outside utility agreements and petitions representing 100% of the total assessed value of the proposed annexation area. The annexation consists of fifteen tax parcels with an assessed valuation of $1,085,050. It is approximately 61 acres with an estimated population of eleven. Staff recommends acceptance of Petition No. 07 -05 for the West Powerhouse II Annexation and adoption of the ordinance. • Mayor Edler opened the Public Hearing No one came forward to speak. • Mayor Edler closed the Public Hearing The City Clerk read the ordinance by title; McCLURE MOVED AND BONLENDER SECONDED TO PASS THE ORDINANCE. The motion carried by unanimous roll call vote. ORDINANCE NO. 2007 -46, AN ORDINANCE concerning annexation; annexing the West Powerhouse II Annexation area to the City of Yakima; maintaining the current zoning of the area; providing for notice to the WUTC of the City's intent to provide residential refuse collection and disposal service; providing for assumption of the City's current indebtedness by properties in the West Powerhouse II Annexation area; and providing for an effective date of November 4, 2007. 7. Closed Record Public Hearing to consider the long plat of Sierra Vista Doug Maples, Code Administration and Planning Manager, advised that on May 2, 2007 SBJ Joint Venture submitted an application to subdivide approximately 9.55 acres of R -1 single family zoned property into 30 single family lots. Public notice and environmental review for the proposed plat was issued on June 27, 2007, and the comment period ended July 17 with multiple comments received. A Determination of Non Significance was issued on July 18 for the proposed plat stating no adverse environmental impacts were identified. Staff review of this plat disclosed all standards of the subdivision and 3 35 OCTOBER 2, 2007 zoning ordinance and comprehensive plan were met and the transportation concurrency review indicates there is sufficient capacity within the surrounding streets to absorb the traffic from the proposed development. On August 9, 2007 the Hearing Examiner conducted an open record public hearing where testimony was presented by parties both for and against the development. On August 23 the Hearing Examiner issued his written recommendations affirming that the proposed plat met all applicable standards and laws subject to the conditions contained within the staff report. Therefore, staff is recommending acceptance of the Hearing Examiner's recommendation. Council Member Whitman asked questions about traffic flow expressing concern that there is only one entrance /exit. It was noted that two were not required until a development is for more than 30 lots; this one is not. In answer to a question as to why the easement going out onto Chestnut was not going to be used as an exit, Mr. Maples said it was not part of this plat; therefore a right -of -way dedication for an extension of that road could not be required. Assistant City Attorney Jeff Cutter reminded Council and the audience that this is a closed record hearing; therefore, Council should not be hearing new testimony or new evidence but must restrict consideration to the record that was reviewed by the Hearing Examiner. Council can approve the recommendation, deny it, or send it back to the Hearing Examiner with a request for additional information. Council Members had no Ex Parte contact to report. • Mayor Edler opened the Closed Record Public Hearing Linda Kusske, 224 St. Andrews Place, spoke on behalf of the residents of Sierra Vista. She raised points regarding safety, specifically noting the location of the closest fire department. She also expressed concern for the children in the neighborhood due to the anticipated increase in traffic. She suggested redesigning the development to include two access points. Other residents who came forward to speak regarding concerns with the limited access were Howard Prentice, Jeff Schlect, Marion Jones, as well as two unidentified citizens. Dennis Whitcher, Huibregtse Louman project engineer, said he has reviewed the Hearing Examiner's report and feels it is correct. He stated that access is limited because of non -owned property. All of the issues being raised were addressed comprehensively by the Hearing Examiner. He concurs with the Hearing Examiner's recommendations and findings in the report and believes it to be thorough and accurate. Eric Herzog, also an engineer with Huibregtse Louman, repeated that the developer does not own the property the citizens are suggesting be used for access. They physically do not have the power to grant a right -of -way through there. Council Member Bonlender asked if there had been any negotiations with the actual owners about a right - of -way. Mr. Herzog did not know. • Mayor Edler closed the Public Hearing 4 36 OCTOBER 2, 2007 Council continued discussion asking specific questions about various roads. Council Member Whitman commented that, although it is legal on paper, she doesn't like the safety issue. WHITMAN MOVED AND McCLURE SECONDED TO REMAND IT BACK TO THE HEARING EXAMINER TO RE- EVALUATE THE POSSIBILITY OF EASEMENTS IN EITHER THE NORTH OR SOUTH FOR ADDITIONAL EGRESS INTO THE SUBDIVISION. Council Member Bonlender suggested that, if negotiations fail, the Torrey Pines Lane should be considered as an option. Following further discussion, City Attorney Paolella suggested that if Council feels the Hearing Examiner did not adequately address public safety issues relating to access, they could remand it back to him with specific instruction to reopen the record on the narrow issue of public safety with regard to access and options that may be available to address that narrow issue. The question was called for a vote on the motion. The motion carried by a 6 -1 vote; Edler voting nay. 8. Public meeting to consider final plat approval for Phase 6 and 7 of the plat of Cottonwood Grove Doug Maples, described the Final Plat as part of a seven -phase subdivision located south of Tieton Drive. Phases 6 and 7 have a total of 72 lots. The City Engineer's office and the Planning Division have reviewed the final plat and affirmed conformance with all terms and conditions of the preliminary approval. The motion carried by unanimous roll call vote. RESOLUTION NO. R- 2007 -131, A RESOLUTION approving the final plat of Phases 6 & 7 of Cottonwood Grove, a 228 -lot subdivision in seven phases, and authorizing the Mayor to sign the final plat. CITY MANAGER'S REPORTS 9. Consideration of Resolution authorizing execution of a contract with People for People in the amount of $15,000 to assist the 2 -1 -1 Information and Referral System due to an unexpected budget shortfall Bill Cobabe, Office of Neighborhood Development Services Manager, referred to a recent presentation by People for People after which the Council directed them to the Council Committee and, if it was approved by them, to bring it back to the full Council. In response to Council Member Cawley's questions regarding why there was a shortfall, Amy Peters, Program Manager for 2 -1 -1, said there was an oversight at the state level through a miscommunication about whether the funding was to continue at the current level or for service expansion. As a result, the statewide funding was cut by 60 %. Other cities are also being asked to help cover the shortfall. The City Clerk read the resolution 5 37 OCTOBER 2, 2007 by title; McCLURE MOVED AND BONLENDER SECONDED TO ADOPT THE RESOLUTION. Council Member Bonlender suggested this be included as part of Council's legislative priorities. Council Member Lover, purporting to be the only conservative on Council, described how at a recent committee meeting they voted down a $10,000 roof for another non - profit organization. If we were to add that to this $15,000, there would be $25,000 of non - federal funds that could be used to clean alleys and assist with sewer hook -ups. The motion carried by a 6 -1 roll call vote; Lover voting nay. RESOLUTION NO. R- 2007 -132, A RESOLUTION authorizing the City Manager to • execute a contract with People for People in the amount of $15,000 to assist the 2 -1 -1 Information and Referral System due to an unexpected budget shortfall. 10. Consideration of a Resolution authorizing execution of a consultant agreement with Artifacts Consulting, Inc. to provide professional services related to a Washington State Department of Archeology and Historic Preservation funded architectural survey in the Barge Chestnut neighborhood Jenifer Wilde- McMurtrie, Chair of the Historic Preservation Committee, clarified that this is $12,000 the City successfully secured from the state to begin phase 1 of research and the logging of inventory of the Barge Chestnut Neighborhood Association. The City Clerk read the resolution by title; JOHNSON MOVED AND CAWLEY SECONDED TO ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote. RESOLUTION NO. R- 2007 -133, A RESOLUTION authorizing the City Manager to execute a Consultant Agreement with Artifacts Consulting, Inc., to provide professional services related to a Washington State Department of Archeology and Historic Preservation funded architectural survey in the Barge Chestnut area. 11. Consideration of Resolution authorizing execution of an amendment to the Automatic Technical Rescue Response Agreement between the City of Yakima and other fire protection agencies Fire Chief, Charlie Hines, clarified that this resolution would allow streamlining the process of adding districts to the agreement by not requiring it come before the Council each time a new district wants to join. The City Clerk read the resolution by title; CAWLEY MOVED AND WHITMAN SECONDED TO ADOPT THE RESOLUTION. Council Member Lover questioned the way the agreement is written and suggested a change. LOVER MOVED AND CAWLEY SECONDED TO AMEND THE RESOLUTION TO EXCLUDE ITEM E UNDER SECTION 20. The motion failed by 6 -1, roll call vote; Bonlender, Cawley, Edler, Johnson, and Whitman voting nay. LOVER MOVED AND JOHNSON SECONDED TO CHANGE "CEO" TO "CITY COUNCIL'S REPRESENTATIVE" (AN ELECTED). Chief Hines explained that if a city does not have a Fire Chief or a decision maker, then the responsibility falls onto an elected official. The motion failed by a 4 -3 roll call vote; Bonlender, Edler, McClure and Whitman voting nay. The question was called for a vote on the original motion. The motion carried by unanimous roll call vote. RESOLUTION NO. R- 2007 -134, A RESOLUTION authorizing the Mayor of the City of Yakima to execute an amendment to the Automatic Technical Rescue Response Agreement between the City of Yakima and other fire protection agencies. 6 38 OCTOBER 2, 2007 *12. Consideration of a Resolution authorizing execution of a professional services agreement with PLSA Engineering and Surveying for surveying services for the Simpson Lane Area Sewer Local Improvement District Project RESOLUTION NO. R- 2007 -135, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a professional services agreement in an amount not to exceed $ 62,500.00 for surveying services on the Simpson Lane Area Sewer Local Improvement District. *13. Consideration of a Resolution authorizing execution of an extension agreement with the Hispanic Chamber of Commerce of Yakima County RESOLUTION NO. R- 2007 -136, A RESOLUTION authorizing the City Manager to execute an extension to the Hispanic Chamber of Commerce of Yakima County for the purpose of extending said underlying agreement to continue the Chamber's actions to foster community economic development, citizen participation in City government, and improvement in the quality of life in Yakima. *14. Consideration of a Resolution authorizing execution of an extension agreement with the Yakima Morelia Sister City Association RESOLUTION NO. R- 2001 -137, A RESOLUTION authorizing the City Manager of the City of Yakima to execute an extension to the agreement between the City of Yakima and the Yakima Morelia Sister City Association to provide financial support up to $2,000 for delegation of cultural and economic exchange activities between the City of Morelia, Michoacan, Mexico and the City of Yakima. *15. Consideration of a Resolution setting a date of Public Hearing before the City of Yakima Hearing Examiner for November 8, 2007 for right -of -way vacation in the vicinity of East R Street RESOLUTION NO. R- 2007 -138, A RESOLUTION fixing November 8, 2007 as the date for a public hearing before the Hearing Examiner. This hearing concerns a petition to vacate: That portion of the 13 -foot alley lying northerly of the southerly boundary of Lot 6, Block 2 of Beckers Subdivision as recorded in volume "B" of plats, page 3, records of Yakima County; and lying southerly of the northerly boundary of Lot 6, Block 6 of Hines Subdivision, as recorded in volume "B" of plats, page 32, records of Yakima County. AND; That portion of the 20 -foot alley lying north of Lots 5 and 6, Block 2 of Beckers Subdivision as recorded in volume "B" of plats, page 3, records of Yakima County; and south of Lots 5 and 6, Block 6 of Hines Subdivision as recorded in volume "B" of plats, page 32, records of Yakima County. *16. Consideration of a Resolution authorizing execution of a contract with the Yakima Regional Clean Air Authority to inspect and replace wood stoves that do not meet clean air requirements RESOLUTION NO. Consideration of a Resolution authorizing execution of a state operating grant agreement with WSDOT for a special needs transportation project RESOLUTION NO. R- 2007 -140, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute a State Operating Consolidated Grant Agreement and all other necessary documentation with the Washington State Department of Transportation to accept a Special Needs Transportation Grant. *18. Consideration of a Resolution authorizing execution of a temporary staffing services agreement with Creative Employment Options (formerly known as A -1 Temps) for customer support services at the Transit Center RESOLUTION NO. R- 2007 -141, A RESOLUTION authorizing and directing the City Manager of the City of Yakima to execute a Temporary Staffing Services Agreement with Creative Employment Options for customer support services at the Transit Center. *19. Approval of final contract payment for 40 Avenue, Lincoln Avenue and 6 Street Sidewalk Improvements / Project No. 2046 (Adopt Standard Motion V -B — accept project; and approve final payment) The report from the City Engineer, dated September 25, 2007, with respect to the completion of the work on the 40 Avenue, Lincoln Avenue and 6 Street Sidewalk Improvements / Project No. 2046, performed by Columbia Asphalt and Gravel , was approved, the work accepted and payment of the final estimates as therein set forth was authorized. *20. Consideration of approval of second quarter budget report from Finance The second quarter 2007 budget report from Finance was approved. *21. Set date of Final Public Hearing for October 16, 2007 at 7:00 p.m. to consider the 2008 CDBG and HOME Annual Action Plan October 16, 2007 at 7:00 p.m. was set as the date of final public hearing to consider the 2008 CDBG and HOME Annual Action Plan. *22. Set date of Public Hearing for November 6, 2007 at 7:00 p.m. to consider the sale of Transit property at 32" Avenue and Nob Hill Boulevard November 6, 2007 at 7:00 p.m. was set as the date of public hearing to consider the sale of Transit property at 32 Avenue and Nob Hill Boulevard. 8 4. OCTOBER 2, 2007 ORDINANCES 23. Consideration of Ordinances authorizing Code officers a limited commission from the Chief of Police: A. Ordinance granting Building Code Inspectors, their manager, and supervisor the power to issue infractions and criminal citations for the purpose of enforcing the City of Yakima Building Code; and adding a new section 11.01.030 to Chapter 11.01 of the City of Yakima Municipal Code Bill Cook, Community and Economic Development Director, explained that they are not • changing the current process, but this would be a tool that could be used if they are unsuccessful with all other efforts. They will continue to work with people who have financial or timing issues. This would be for the 5% of the people who don't make any effort to correct the problems. Tickets will be issued through the mail. Council Member Lover raised concerns about it being a criminal violation and the potential of targeting the poor. He also asked whether this would increase costs. Ken Harper, counsel for the City, estimates he currently files about one case a year, but because it has to go through Superior Court it is time consuming. For every one he files, he starts eight or nine and that is also very time consuming. They believe they could resolve most of those through this method, thereby making it more efficient. Council Member Bonlender commented that neighborhood organizations have asked for this for many years and he sees it as an efficient use of staff. • Citizen Comments Robert Owen, 614 N. 3rd Street, said he is opposed to this because it will result in "Code Cops" and the last thing he wants to see is more cops on the street. Lynne Kittelson, 305 N. 9 Street, talked about problems experienced in her neighborhood with the lack of compliance with codes. Ken Peterson 402 S. 9 Avenue, said he has a lot of issues with providing police authority. He suggested allowing the Code Enforcement Officers to draft the citations and then have a police officer sign it. Many of the correspondences he has received already stated there was a $250 fine hanging over his head so he questioned why citations were necessary. Cynthia Martinez, Assistant City Attorney, described different methods that had been considered. She pointed out that the powers given to the City are authorized by statute and since there is no specific statute addressing this, there is a risk. However, other jurisdictions have conferred police power for this type of violation. She said these points had been discussed in the Public Safety Committee meetings. C. The motion carried by a 4 -2 roll call vote; Cawley and Lover voting nay, Whitman absent; ORDINANCE NO. 2007 -49, AN ORDINANCE relating to the Fire Code; granting Fire Code Inspectors, their manager, and supervisor, upon receiving a limited commission from the Chief of Police, the power to issue infractions and criminal citations for the purpose of enforcing the City of Yakima Fire Code; and adding a new section 10.01.030 to Chapter 10.01 of the City of Yakima Municipal Code. *24. Consideration of Legislation regarding the South Airport- Ahtanum Sewer Extension Project: A. Resolution authorizing and ratifying a grant and SIED loan application with Yakima County for infrastructure improvements RESOLUTION NO. R- 2007 -142, A RESOLUTION authorizing the City Manager to execute and submit a grant loan application with Yakima County for funding from the Yakima County "Supporting Investments in Economic Development (SIED) Fund for infrastructure improvements necessary for the South Airport - Ahtanum Industrial Area Sewer Extension Project. B. First Reading -of an Ordinance amending the 2007 budget and appropriating funds in the Sewer Capital budget (Second Reading on 10/16/07) An Ordinance amending the 476 — Sewer Construction Fund during 2007 and appropriating funds for a Sewer Extension Project in the South Airport - Ahtanum Industrial Area, was read by title only, and laid on the table until October 16, 2007 for a second reading. 10 .4 2 OCTOBER 2, 2007 25. First Reading of an Ordinance amending the 2007 budget and appropriating funds in the Office of Neighborhood Development Services budget for Marvin Gardens (Second Reading on 10/16107) In response to Council Member Lover's questions, Mr. Cobabe gave an estimate on the cost to fund the infrastructure for this development and provided a description of the Affordable Housing Program. He also agreed to supply information on available CHODO funds. An Ordinance amending the 124 — Neighborhood Development Fund during 2007 and appropriating funds for infrastructure for an affordable housing subdivision, was read by title only, and laid on the table until October 16, 2007 for a second reading. 26. Other Business Council Member Cawley requested a staff report on the intersection of 40 and Fruitvale. He would like to see the flashing arrow deactivated. It was determined the subject needed to be discussed at the Transportation Committee level.
