Chair Lover called the meeting to order at 2:00 p.m.
Steve informed the Committee of Bruce Benson's retirement.
Moratorium Update — Communication Towers and Billboards
The communication tower and billboard moratoriums expire on October 1, 2013. Steve briefly
updated the committee on the status of the communication tower moratorium. Following a meeting
with interested parties, a public hearing will be held with the Yakima Planning Commission (YPC)
on August 7th to review the proposed draft ordinance for communication towers and receive
feedback from the public and commission members. City Council will then hold its public hearing
on the second meeting in August for adoption of the ordinance. The proposed effective date of the
ordinance is September 22, 2013. However, due to the short turnaround for Council to hold the
public hearing, staff will consider the option of extending the moratorium depending on the
outcome of the Planning Commission's public hearing. Steve expressed concern in meeting the
deadline for the billboard moratorium He is currently working on a report for Tony to detail his
concerns as they relate to policy, aesthetics, and safety factors.
Update on the Shoreline Master Program (SMP) Process
The main highlights accomplished include: certain issues regarding permitted uses have been
resolved by the YPC; Cowiche Creek was removed from the shoreline jurisdiction; YPC accepted
staff's revisions to the draft SMP; the State Environmental Policy Act review process has begun.
Currently, the SMP is going through the SEPA review process and is in the comment period stage.
A date has been set for August 28, 2013 to hold the public hearing with the Yakima Planning
Commission and staff is looking at a tentative date for Council's public hearing in October with an
effective date in November.
Update on the Mobile Home Park on North 1st Street Status
A Notice of Non -Compliance was issued for several of the structures followed up with a site
inspection in which 26 violations were found. The site inspection was performed in conjunction
with City staff, Police, and L&I Electrical Division. Glenn Denman described the violations and
explained what actions need to be made to bring them into compliance. Many of the mobile homes
are in deplorable conditions and are too close to each other that they may need to be removed.
Code Enforcement / Signage Status Report
Progress has been made in eliminating the portable temporary signs in the right of way. The next
step is to crack down on the abandoned signs for which enforcement notices have been issued.
Another focus has been towards complaints about people living in RV's and boarding up vacant
houses. Staff is actively enforcing and identifying these issues.
Mill Site Update
Following the study session on the Mill Site, the city will proceed with hiring an urban economist to
come up with recommendations on what the best use of the property is based on a needs
assessment. Joan will work with Steve Lewis of Lochner Associates to do an amendment to their
contract to hire the consultant as a subcontractor and present it to City Council as soon as
September. This service will cost approximately $40,000 and she noted that it is an eligible expense
under the LIFT funding. Joan provided an update on the progress of the soil testing being performed
by Landau Associates. Currently they are testing the site where the plywood plant used to be and
she noted that they did not find any surprises however; monitoring wells may need to be installed.
North 1st Street Improvement Project Update
As a follow-up to the discussion at the last committee meeting regarding the construction funds for
phase one the North 1st Street Improvement project, Joan informed the Committee that the YVCOG
has assured her the funds have not been lost and will be obligated in 2014. A landscape architect
firm will be hired to develop a concept landscape design incorporating the ideas envisioned from
the previous design process.
Proposed Harden Annexation
Two property owners, Christopher Harden and Joe and Carol Yeates, have submitted intent to
commence annexation. The properties are located in the vicinity of 612 North 80th Avenue. Council
will be considering this petition at a later council meeting.
Other Business
Kathy Coffey requested an update regarding her concern of having the city council preside over the
hearing examiner cases that are appealed. Tony informed her that legal staff was working on an
ordinance.

Chair Lover called the meeting to order at 3:30 p.m.
Swimming Pool Improvement Report
Ken Wilkinson reviewed a memo with the Committee regarding the cost for pool improvements at
Franklin Park. Staff researched and estimated the costs for other improvement options such as an air
supported dome structure is about $340,000; new water slide is $250,000; new 6,000 sq ft pool bath
house & filter is about $1,110,000; and a new aquatic center, depending on size, is estimated
between $7 million and $25 million. Further discussion continued on the feasibility on transforming
Franklin Pool into an all season facility. It was suggested that the least expensive and best practical
approach would be to install an air supported dome structure. This method would also allow staff to
analyze the community's interest and support for future enhancements to Franklin Pool. Ken added
that he is awaiting a response from a local architecture firm regarding estimated costs for upgrading
the building at Franklin Park. Kathy noted that the estimate does not include operational costs and
requested a detailed budget analysis before further consideration is given to any of the options
listed. Two main issues for Rick are what it will take to get the pools back into really good
operation and what would it cost to make Franklin a year round pool. Staff noted the operational
costs at Lions Pool are approximately $400,000 a year. Additional information will be provided at
the next meeting along with the possibility of inviting a dome manufacturer to speak to the
committee.
Mode Code Update
A draft subdivision chapter has been provided from the consultant Carol Morris. Steve briefly
described the following substantive changes:
1. Transfer and development of lots not divided according to City standards.
2. New section on right-of-way acquisition and condemnation.
3. Notice requirements when located in an irrigation district.
4. Format of Preliminary and Final plats.
5. Phased subdivisions and developers agreements.
6. Requirements for grading plans.
7. Revisions to approved plats.
8. Extension of improvements.
9. Bindings site plans.
10. Short plat process.
He indicated Staff will review the code text amendments with the Planning Commission as other
big items are concluded such as the Shoreline Master Program update, and text amendments
regarding billboards and communication towers. Bill asked whether the 30 -day money back
guarantee was still in effect. Steve was not aware of an active guarantee.
McDonald's Update
The building permit for the construction of McDonald's was issued today. Steve recapped the
administrative process and how some of the conditions are being addressed by the developer.
Report on Request for Interpretation — Mini -Storage Units at 908 South 72nd Avenue
Due to a text amendment to the zoning ordinance in 2008, mini -storages were discontinued as
permitted uses in the single-family residential (R-1) zone. Prior to this text amendment, a developer
was proposing to construct a mini -storage facility at 908 South 72nd Avenue and obtained land use
approval to do so. The applicant then submitted their building permits; however, their building
permits expired and they did not complete the project. The question is whether or not their approval
is vested or not. A formal request for interpretation was submitted to the Hearing Examiner to
decide this issue. It is staff's position that the permits have expired and the project is not vested
under the previous code therefore, the city is not authorized to issue permits on this development
because it is does not meet current code.
