Council Member Bonlender gave an invocation and led the Pledge of Allegiance.

• Appreciation to the Yakima Arts Giving Circle
Council Member McClure read and presented a proclamation of appreciation
to Chad and Michael Gray representing the Yakima Arts Giving Circle for
their commitment to placing public art in downtown Yakima.
C. Special Presentations:
• Commendation of Police Officer Ryan Wisner
Police Chief Granato described how Officer Ryan Wisner saved the life of an
elderly man by removing him from his burning home. He presented Officer
Wisner with the Police Department's Medal of Valor and a certificate. Fire
Chief Mayo also acknowledged Officer Wisner's heroic efforts and presented
him with a certificate.
• Introduction of New Assistant Fire Marshall Jim Fuehrer
Police Detective Fuehrer was introduced as the new Assistant Fire Marshall.
He will provide a link between the Police and Fire Departments in arson
investigations.

D. Status report on prior meeting's citizen service request:
• Response to Sandy Massong - Lloyd's concerns
Doug Maples provided a response to the concerns Ms. Lloyd expressed at
an earlier council meeting regarding fencing and weeds on the Congdon
property. The weeds were not in such a condition that would cause the City
to initiate abatement procedures, and the City does not have any codes
regulating fencing materials.

RICHARD OSTRANDER TO THE PUBLIC FACILITIES DISTRICT BOARD
FOR A FOUR -YEAR TERM. The motion carried by unanimous roll call vote.

This item was removed from the agenda.
4. Consent agenda
Mayor Edler referred to the items placed on the Consent Agenda, questioning
whether there were any additions or deletions from either Council members or
citizens present. Item No. 9 was added to the Consent Agenda and Items Nos.
15, 16 and 19 were removed. The City Clerk read the Consent Agenda items,
including resolutions and ordinances by title. McCLURE MOVED AND
BONLENDER SECONDED TO ADOPT THE CONSENT AGENDA AS READ.
The motion carried by unanimous roll call vote. (Subsequent paragraphs

Hearings were approved, having been duly certified accurate by two Council members
and no one present wishing to have said minutes read publicly.

5. Audience Participation
Josh Jeffries, Apple Valley Kiwanis, introduced David Severson and Gailon Gentry,
who spoke about their Club's fund - raising efforts, and presented the City with a
$10,000 contribution for the construction of a skateboard park at Kiwanis Park.
Gisella Rigby told Council about a problem with a drainpipe located in front of her
residence, which floods her property when there is a rain or snowfall. The Mayor
said that staff would have a response to her concern at the next meeting.
Mary McDaniels spoke about vandalism and attempted break -ins that occurred
in the vicinity of Track 29. She urged Council to develop a plan to curb the crime
in downtown (and all over Yakima). She also complimented the new Downtown
Ambassadors.
(Council will proceed to the agenda items under City Manager Report; however, at 7 :00 p.m.,
Council will consider intergovernmental items, if requested, conduct the public hearings and
then resume discussion of any agenda item not considered prior to the hearings.)
PUBLIC HEARINGS
6. Closed Record public hearing to consider the Hearing Examiner's
recommendation on a rezone request by United Builders of Washington, Inc.
for property located at 101 North Naches Avenue
Doug Maples, Code Administration and Planning Manager, reviewed the purpose of
the closed record public hearing concerning the rezone of property at 101 North
Naches Avenue from B -1 to CBD. The applicant wishes to use the property for a
performing arts center in conjunction with a wine center /bistro. The Hearing
Examiner approved the application with three conditions, primarily about the
permitting process.

JOHNSON MOVED AND WHITMAN SECONDED TO UPHOLD THE HEARING
EXAMINER'S RECOMMENDATION AND DIRECTED STAFF TO PREPARE THE
APPROPRIATE LEGISLATION. The motion carried by unanimous roll call vote.

7. Second Public hearing to consider:
A. Adoption of the Six -year Transportation Improvement Program (STIP) for
years 2007 to 2012, and to amend the Metropolitan Transportation Plan
(see resolution)
B. Amendment of the Yakima Urban Area Comprehensive Plan Capital
Facilities Element to incorporate the adopted Six -year Transportation
Improvement Program (STIP) (see resolution)
Brett Sheffield, Acting City Engineer, stated this is the second of two public hearings to
review the Six Year Transportation Plan. Several projects were added following the
June 6, 2006 hearing, and it is not too late to add projects or make changes or
corrections. Council Member Bonlender referenced #64, citywide alleys and asked if
there is a goal for completing a certain number of alleys per year. City Manager Zais
responded that staff would make it a priority and look at REET money in the 2007
budget to fund it. A discussion ensued regarding the notification from the State
Department of Transportation regarding a proposed toll on the east/west connection
project on 1 -90, which Council Member Johnson did not support. City Manager Zais
stated that staff would look at representation for that issue.

Lynne Kittelson, 305 N. 9 Street, inquired about her request at the last hearing to
include an eastside canal pathway project. She was assured it was added and
provided a copy of the project list.

The City Clerk read the resolution for Item A by title; JOHNSON MOVED AND LOVER
SECONDED TO ADOPT THE RESOLUTION. The motion carried by unanimous roll
call vote.
• RESOLUTION NO. R- 2006 -93, A RESOLUTION adopting a Six -Year Transportation
Improvement Program for the period of 2007 through 2012 for the construction of
streets and arterials streets in the City of Yakima and amending the Metropolitan
Transportation Plan.
The City Clerk read the resolution for Item B by title; McCLURE MOVED AND
BONLENDER SECONDED TO ADOPT THE RESOLUTION. The motion carried by
unanimous roll call vote.
RESOLUTION NO. R- 2006 -94, A RESOLUTION to amend the Yakima Urban

CITY MANAGER'S REPORTS
8. Report on proposed Downtown Housing Area Designation
Bill Cook, Director of Community and Economic Development, described the
Downtown Housing Area Designation program offered by the State that would
encourage permanent downtown housing by providing a property tax incentive to the
•owner. Permanent housing in the downtown would promote safety, stability and
vitality within the designated area. The City Council would have to define a boundary
and then hold a public hearing on this concept. The Council Economic Development
Committee has reviewed this program and recommended bringing it forward to
Council. He introduced Gary Bodenstab, a housing developer from Tacoma.
Gary Bodenstab said that this program was offered to buyers of condos in Tacoma
in their downtown area. As an incentive to get them in the downtown environment
they offered a property tax abatement for ten years. He wants to do this in Yakima.
Jon Christoffersen, Director of Communications, Committee for Downtown Yakima,
spoke about his experience living in downtown Cheyenne, Wyoming. People living
downtown will create better support of businesses in the downtown area.
John Finke, National Development Council, stated his firm works equal parts in
housing and in economic development. He said similar programs have worked well
in Tacoma and Vancouver. Those two cities were in similar situations as Yakima is
now; wanting to revitalize their downtown by creating jobs in small businesses as
well as in housing.
JOHNSON MOVED AND McCLURE SECONDED TO DIRECT STAFF TO
PREPARE A RESOLUTION OF INTENTION FOR THE NEXT MEETING AND
SCHEDULE A DATE OF PUBLIC HEARING. After a brief discussion regarding the
proposed boundary, which could be changed, and on the timeline for Mr..
Bodenstab's proposal for converting the former Bon Marche building into
condominiums, the question was called for a vote on the motion. The motion
carried by unanimous roll call vote.
*9. Consideration of a Resolution authorizing execution of professional services
contract with GR Dohrn for environmental planning services
RESOLUTION NO. R- 2006 -95, A RESOLUTION authorizing the City Manager of
the City of Yakima to execute a Consultant Agreement for Professional Services
with GR Dohrn & Associates, to provide professional assistance to the City of
Yakima Planning Division.

*10. Consideration of a Resolution ratifying approval of permit issued to Eagle
Fireworks for public display of fireworks held at the Yakima County Stadium
on June 24, 2006
RESOLUTION NO. R- 2006 -96, A RESOLUTION granting a public fireworks display
permit to Eagle Fireworks on behalf of the Yakima County Stadium, Yakima Bears
baseball.
*11. Consideration of Resolutions granting a permit for public display of fireworks
to:
A. Eagle Fireworks for July 1 and 8, 2006 events at Yakima County
Stadium
RESOLUTION NO. R- 2006 -97, A RESOLUTION granting a public fireworks display
permit to Eagle Fireworks on behalf of the Yakima County Stadium, Yakima Bears
baseball.
B. Western Display Fireworks for July 4, 2006 event at the State Fair Park
RESOLUTION NO. R- 2006 -98, A RESOLUTION granting a public fireworks display
permit to Western Display Fireworks on behalf of the Yakima 4 of July Committee.
*12. Consideration of a Resolution declaring two 1987 Gillig Phantom 29-
passenger buses surplus and authorizing the sale of these buses to Asotin
County Public Transportation Benefit Area
RESOLUTION NO. R- 2006 -99, A RESOLUTION declaring two 1987 Gillig Phantom
29- passenger buses surplus to the needs of the City of Yakima Transit Division and
authorizing the sale of these vehicles to Asotin County Public Transportation Benefit
Area (PTBA).
*13. Consideration of a Resolution authorizing execution of an agreement with
Yakima Valley Community College for Retired and Senior Volunteer Program
support services
RESOLUTION NO. R- 2006 -100, A RESOLUTION authorizing the City Manager and
the City Clerk of the City of Yakima to execute an agreement with Yakima Valley
Community College (YVCC), for the purpose of providing, through its Retired and
Senior Volunteer Program, volunteer support to senior citizens within the City of
Yakima.
*14. Consideration of a Resolution authorizing execution and submittal of a
grant/loan application to Yakima County Supporting Investments in Economic
Diversification fund for the Nob Hill -Fair Avenue (Fiesta Foods) improvement
project
RESOLUTION NO. R- 2006 -101, A RESOLUTION authorizing the City Manager to
execute and submit a grant and loan application with Yakima County for funding
from the Yakima County Supporting Investments in Economic Development (SIED)

Fund for infrastructure improvements necessary for the Nob Hill -Fair Avenue (Fiesta
Foods) Improvement Project.
15. Consideration of a Resolution approving the sale of land to Washington State
Department of Transportation for improvements to SR -24 and authorizing
execution of necessary documents
Council Member Lover asked in which fund would the $86,000 revenue be placed,
and could it be used for the Safe Communities program? City Manager Zais said_it
would have to go back to the City utility that owns the property. The City Clerk read
the resolution by title; McCLURE MOVED AND BONLENDER SECONDED TO
ADOPT THE RESOLUTION. The motion carried by unanimous roll call vote.
RESOLUTION NO. R- 2006 -102, A RESOLUTION approving the sale of portions of
Yakima County Assessor's Parcel No. 191329 - 41400, 191329 -41404 and 191329-
41406, which parcels are located southeast of the State Route 82 and State Route
24 interchange, Yakima, Washington, the legal descriptions of which are attached
hereto and incorporated by reference herein as Exhibit "A ", for use by the State of
Washington for road construction and improvements, and directing and authorizing
Russell H. Gilbert of Lyon, Weigand & Gustafson PS, counsel for the City of
Yakima, to execute a Stipulated Judgment and Decree of Appropriation for the
appropriation of said property by the State of Washington substantially in the form
as attached hereto as Exhibits "B ", and to take any additional actions and execute
any additional documents that may be necessary or appropriate relating to the sale
of said property.
16. Consideration of Resolution authorizing execution of a grant agreement with
the State of Washington Employment Security Department for a team -based
AmeriCorps community project for youth
Council Member Lover sought clarification on the partnership with the Southeast
Community Center as it relates to this agreement. Chris Waarvick, Director of Public
Works, and Denise Nichols, Parks and Recreation Division Manager, provided
additional information on this agreement. Both OIC and the City submitted an
application to Americorps and they asked that we partner together on one grant for
after school programs. Council Member Johnson asked if he needed to recuse
himself from this discussion because he is a member of the OIC Board. City
Manager Zais stated that would not be necessary because the contract is not with
01C, but with the Washington State Employment Security Department, and Mr.
Johnson would not directly benefit from the agreement. The City Clerk read the
resolution by title; BONLENDER MOVED AND WHITMAN SECONDED TO ADOPT
THE RESOLUTION. The motion carried by unanimous roll call vote.
RESOLUTION NO. R- 2006 -103, A RESOLUTION authorizing the City Manager of
the City of Yakima to execute a Grant Agreement Between the City of Yakima and
the State of Washington Employment Security Department for a team -based
AmeriCorps Project.
*17. Set date of public meeting for July 11, 2006 to consider final plat approval for
Phase 5 of the Plat of Cottonwood Grove

July 11, 2006 was set as the date of public meeting to consider the final plat
approval for Phase 5 of the Plat of Cottonwood Grove.
ORDINANCES
*18. Consideration of an Ordinance adopting the Hearing Examiner's
recommendation to approve the rezone of property at 1708 South 16 Avenue,
requested by DH Construction and Development, Inc.
ORDINANCE NO. 2006 -25, AN ORDINANCE relating to land use regulation and
zoning; rezoning, with conditions, one parcel of property located in the vicinity of
1708 South 16 Avenue from Two - Family Residential (R -2) to Professional Business
(B -1) as more fully described herein; and approving, with conditions, the
recommendation of the Hearing Examiner for the City of Yakima regarding the
same, DH Construction & Development, Inc., being identified as the applicant
herein.
19. First reading of an Ordinance amending the 2006 Budget in the Capitol Theatre
Construction Fund to provide for roof replacement (Read ordinance only at this
meeting; second reading scheduled 7- 11 -06)
Council Member Lover asked if the contract could be rebid since the original
$80,000 bid is now estimated to be $200,000. Steve Caffery, Executive Director of
the Capitol Theatre, explained that when they put in a new HVAC system, they
noticed a leak and discovered the roof needed to be replaced. The project has not
been let for bid yet; this is to fund the architectural agreement to develop the
specifications and manage the project.
An Ordinance amending the 2006 budget and appropriating funds to provide for roof
replacement at the Capitol Theatre, was read by title only, and laid on the table until
July 11, 2006 for a second reading.
*20. First reading of an Ordinance amending the 2006 budget in the Arterial Street
Fund to provide for reimbursable costs related to two (2) federal enhancement
grants for the William O. Douglas Heritage Trail Program including bridge
restoration and trailheads (Read ordinance only at this meeting; second reading
scheduled 7- 11 -06)
An Ordinance amending the 2006 budget and appropriating funds to provide for

*21. Second reading of an Ordinance amending the 2006 budget and appropriating
funds for the Healthy Families Initiative
An Ordinance amending the 2006 budget and appropriating funds for the Healthy
Families Initiative, previously having been read by title only, was brought before the
Council for a second reading.
ORDINANCE NO. 2006 -26, AN ORDINANCE amending the 2006 budget for the
City of Yakima; and making an appropriation within the 127 — Community Services
Fund and other various funds for expenditure during 2006 to provide for the "Greater
Yakima Valley Healthy Marriage and Responsible Fatherhood Community
Demonstration Initiative" child support enforcement demonstration project.
*22. Second reading of an Ordinance amending the 2006 budget and appropriating
funds for payment to Yakima County for 96 Avenue annexation
An Ordinance amending the 2006 budget and appropriating funds for costs related
to street improvements within the 96 Avenue Annexation area, previously having
been read by title only, was brought before the Council for a second reading.
ORDINANCE NO. 2006 -27 AN ORDINANCE amending the 2006 budget for the City
of Yakima; and making an appropriation of $39,095 within the 000 — General Fund
for expenditure during 2006 to provide for costs related to an interlocal agreement
with Yakima County for street improvement made within the 96 Avenue Annexation
area.
*23. Second reading of an Ordinance amending the 2006 budget and appropriating •
funds to purchase grant- funded fire safety puppetry program "Safety Troupe"
equipment and supplies
An Ordinance amending the 2006 budget and appropriating funds to purchase
grant- funded fire prevention puppetry education equipment, known as "Safety
Troupe ", previously having been read by title only, was brought before the Council
for a second reading.
ORDINANCE NO. 2006 -28, AN ORDINANCE amending the 2006 budget for the
City of Yakima; and making appropriations of $3,000 within the 000 — General Fund,
Fire Department, for expenditure during 2006 to purchase grant- funded fire
prevention education equipment.
24. Other Business
Council Member McClure reported on a presentation on the development of
communities (specifically, code development of communities) he attended at AWC
and asked staff to contact that presenter and bring back information on development
standards for aesthetics.
Council Member Cawley asked about the delay in installing the water play equipment
at Miller Park. Chris Waarvick explained the delay, which started with a five -to -six
week delay from the manufacturer.

Mayor Edler asked for information about a letter forwarded from the airport board
regarding the WaI -Mart issue. City Manager Zais responded that the issue is still
under review by the Hearing Examiner. After the Hearing Examiner makes his
recommendation, Council will set a date of public hearing to reconsider this issue;
most likely the hearing date will be set to be heard by Council sometime in early-to-
mid September.
Council Member Lover requested an updated estimate for the railroad grade
separation project.
Lynne Kittelson provided additional information to Council Member Cawley about the
woman who approached him concerning the delay of the water play toys at Miller
Park.

Assignments as of June 27, 2006.
25. Approximately 9:00 p.m. -- Adjournment to July 8, 2006 at 8:30 a.m. at the
Convention Center for Council workshop; then to July 11, 2006 at 8:30 a.m. for a
Study Session regarding the Yakima Safe Community Action Plan .

MEETING TO JULY 8, 2006 AT 8:30 A.M. AT THE CONVENTION CENTER FOR
COUNCIL WORKSHOP; THEN TO JULY 11, 2006 AT 8:30 A.M. FOR A STUDY
SESSION REGARDING THE YAKIMA SAFE COMMUNITY ACTION PLAN. The
motion carried by unanimous voice vote.
