A RESOLUTION setting date for public hearing on January 21, 2014 to receive
recommendation of Planning Commission and to consider proposed
ordinance to amend YMC 15.01.035 regarding production,
processing and retailing of marijuana within the City of Yakima.
WHEREAS, the City of Yakima (City) has previously adopted regulations
governing and regulating land uses within the City, as codified in Title 15 of the Yakima
Municipal Code (YMC); and
WHEREAS, the City Planning Commission has scheduled a public hearing to
receive public comment and testimony regarding a proposed amendment to YMC
15.01.035 regarding the production, processing and retailing of marijuana within the City;
and
WHEREAS, pursuant to the procedures of Title 15 YMC, an amendment to such
title requires a public hearing before the Planning Commission, which thereupon adopts
findings and a recommendation to the City Council regarding such proposed amendment,
and which is presented to the City Council for consideration following its own public
hearing; and
WHEREAS, the City Council finds and determines that a public hearing should be
set for 6:30 p.m. on January 21, 2014 to receive the recommendation of the Planning
Commission and a proposed ordinance regarding the production, processing and retailing
of marijuana within the City of Yakima; and
WHEREAS, the City Council finds and determines that scheduling of such public
hearing is in the best interests of residents of the City of Yakima and will promote the
general health, safety and welfare; therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
A public hearing is hereby set at 6:30 p.m. on Tuesday, January 21, 2014 to
receive the recommendation of the City of Yakima Planning Commission and to consider
an ordinance amending YMC 15.01.035 regarding the production, processing and retailing
of marijuana within the City of Yakima. The City Manager is hereby authorized to take all
action necessary and appropriate to schedule such public hearing; now, therefore,
ADOPTED BY THE CITY COUNCIL this 7 day of January, 2014.

SUMMARY EXPLANATION:
The Planning Commission is scheduling a public hearing to consider an amendment to YMC
15.01.035 regarding production, processing and retailing of marijuana in the City of Yakima. It
is planned to present the recommendation of the Planning Commission and a proposed
ordinance for City Council consideration on January 21, 2014. Because the proposed
Ordinance amends a provision in Title 15 YMC, public hearings must be scheduled and held
before the Planning Commission and the City Council. The attached Resolution sets the date
for public hearing before the City Council on January 21, 2014.
