COUNCIL CHAMBERS - CITY HALL RoII Call Present: Council: Mayor Pro Tem Neil McClure, presiding, Council Members Ron Bonlender, Micah Cawley, Norm Johnson and Bill Lover Staff: City Manager Zais, City Attorney Paolella and City Clerk in Training Moore Absent: Mayor Dave Edler and Council Member Susan Whitman (both excused) 2. Public Hearing to consider the 96 Avenue Annexation Mayor Pro Tem Neil McClure introduced Bruce Benson, Supervising Planner, who described the 96 Avenue Annexation area: 296 acres; population 1,000; assessed valuation of $73,026,000 and 79.5% in support. City Manager Zais gave background on recent actions that took place with Yakima County concerning this annexation. The County requested to invoke the Boundary Review Board, which was to hold a hearing earlier in the month. City staff and new council members requested a meeting with the County Commissioners to review the issues of concern pertaining to the development standards in the area, specifically the issue of the debt service for street improvements on a loan the County has with the Public Works Trust Fund (PWTF). The City and County reached a negotiated settlement providing for the City to pay approximately half of the debt service on the loan -- $39,000 in annual installments for a total of $586,000 over the remaining fourteen years of the outstanding indebtedness. The City will begin making payments in mid year when they receive the property tax levy payment from the County. In exchange for this agreement, the County agreed to withdraw its request to the Boundary Review Board. This agreement will enable us to discuss urban area uniform development standards in the future. The City Clerk in Training read the ordinance by title only. JOHNSON MOVED AND BONLENDER SECONDED TO PASS THE ORDINANCE • Mayor Pro Tem McClure opened the public hearing. Jean Reed, 312 North 93` Avenue, asked questions about taxes, snow removal and utilities. City Manager Zais described services that would commence upon annexation and offered to share the City's snow removal plan with Mrs. Reed. He clarified utility 436: ADJOURNED BUSINESS MEETING — JANUARY 27, 2006 services and fees associated with those services for city residents. He also reiterated the status of the library annexation issue and the fees that would apply if the voters approve the ballot measure in the upcoming election. Darrell Turner questioned the timing on the annexation and was advised it would become effective 30 days after publication of the annexation ordinance. • Mayor Pro Tem McClure closed the public hearing. The question was called for a vote on the motion. The motion carried by unanimous voice vote. ORDINANCE NO. 2006 -04, AN ORDINANCE concerning annexation; annexing the 96 Avenue Annexation area to the City of Yakima; maintaining the current zoning of the area; providing for notice to the WUTC of the City's intent to provide residential refuse collection and disposal service; assumption of the City's current indebtedness by properties in the 96 Avenue Annexation area; and an effective date of February 27, 2006. Council Member Lover asked whether the City would need to redistrict the boundaries due to recent annexations. City Manager Zais advised that the City has an obligation under the Charter to review boundaries when the population size of any district is greater than a 10% variance. Bruce Benson will evaluate the census and determine if redistricting is necessary. Council Member Bonlender stated he would like to change the Charter and create six districts. Doug Maples advised that the City is obligated to redistrict about six months before an election. Currently, he believes Mayor Pro Tem McClure's district is over the 10 %, but it is not necessary to redistrict now as the next election is in two years.
