SUBMITTED BY: Jeff Cutter, City Attorney SUMMARY EXPLANATION: The City of Yakima has allowed the Yakima County Commissioners to use their Council Chambers to hold public meetings and hearings for the past four years. Yakima County has not been charged for the use of the Council Chambers during these past four years and the entities believe it to be in the best interest of the citizens of Yakima and Yakima County to continue to allow the County to use the City Council Chambers for County meeting and hearing purposes. The Council Chambers are in need of improvements and the Board of Yakima County Commissioners are willing to provide $12,000 toward the needed improvements in consideration for the use of the Council Chambers. The City Council deems it to be in the best interest of the City of Yakima to authorize execution of the attached Interlocal Agreement between the City of Yakima and Yakima County, authorizing the County to use the City Council Chambers to hold Yakima County public meetings and hearings. Yakima County agrees to provide $12,000 to the City of Yakima for the agreed upon improvement for the City Council Chambers. R -2014 - authorizing and directing the City Manager of the City of Yakima to execute an Interlocal Agreement between the City of Yakima and Yakima County, authorizing the County to continue to use the City Council Chambers to hold its public meetings and hearings and accepts the receipt of County funds to be used for Council Chamber improvements. WHEREAS, the City of Yakima has allowed the Yakima County Commissioners to use their Council Chambers to hold public meetings and hearings for the past four years due to the County Commissioners repurposing their meeting space for the County Law Library; and WHEREAS, Yakima County has not been charged for the use of the Council Chambers during these past four years and the entities believe it to be in the best interest of the citizens of Yakima and Yakima County to continue to allow the County to use the City Council Chambers for County meeting and hearing purposes; and WHEREAS, the Council Chambers are in need of improvements to furnishings and the Board of Yakima County Commissioners are willing to provide $12,000 toward the needed improvements in consideration for the use of the Council Chambers; and WHEREAS, the City Council deems it to be in the best interest of the City of Yakima to authorize execution of the attached and incorporated City/County Council Chambers Interlocal Agreement between the City of Yakima and Yakima County, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized and directed to execute the City/County Council Chambers Interlocal Agreement, attached hereto and incorporated herein by this reference between the City of Yakima and Yakima County, authorizing the County to use the City Council Chambers to hold Yakima County public meetings and hearings. Yakima County agrees to provide $12,000 to the City of Yakima for the agreed upon improvement to furnishings for the City Council Chambers. ADOPTED BY THE CITY COUNCIL this _ day of January, 2014. Micah Cawley, Mayor ATTEST: City Clerk CITYICOUNTY COUNCIL CHAMBERS INTERLOCAL AGREEMENT THIS COUNCIL CHAMBERS AGREEMENT is entered into by and between the City of Yakima ("City"), a municipal corporation, and the County of Yakima ("County"), a Washington State political subdivision, under the authority and in conformance with RCW 39.34, the Interlocal Cooperation Act. WHEREAS, the City of Yakima has graciously allowed the Yakima County Commissioners to use their Council Chambers to hold public meetings and hearings for the past four years due to the County Commissioners repurposing their meeting space for the County Law Library; and, WHEREAS, Yakima County has not been charged for the use of the Council Chambers during these past four years and the entities believe it to be in the best interest of the citizens of Yakima to continue to allow the County to use the City Council Chambers; and, WHEREAS, the council chambers are in need of improvements to furnishings and the Board of Yakima County Commissioners are willing to provide $12,000 in consideration for use of the Council Chambers; NOW, THEREFORE, Yakima County agrees to provide $12,000 to the City of Yakima for the agreed upon improvements to furnishings for the city council chambers. APPROVAL The attested signatures of the City Manager and the Yakima County Commissioners below shall constitute a presumption that such approval was properly obtained.
